There is no universal “digital inheritance” rule for AI accounts. The official guidance reviewed for ChatGPT, Gemini and consumer Copilot describes retention settings, deletion controls, inactivity tools and provider review—not an automatic transfer of conversations to relatives when the account holder dies. Text chats, transcripts, recordings, uploaded files and live-session data can follow different rules, so your family may not receive everything in one package.
Death does not automatically delete or release every AI conversation
AI providers generally tie data to an account, its settings and the actions of the account holder or an organization administrator. The guidance reviewed does not identify death itself as a universal deletion trigger, nor does it promise that a spouse, child or executor automatically inherits login credentials or chat history.

What happens depends on several separate questions:
Recommended Free Tools
- Was the account personal, family-managed or owned by an employer?
- Was the material a text conversation, a voice transcript, original audio, a video or screen share, or an uploaded file?
- Was history enabled, set to auto-delete, marked temporary or covered by a workplace retention policy?
- Does the provider offer a user-configured inactivity plan?
- After death, does the provider have a reviewed request process, and what can that process actually deliver?
An account can therefore remain open, age out under ordinary retention settings, be deleted after inactivity, or be closed after a request. Those outcomes are different from giving another person full access to the account.

How the major services describe retention
ChatGPT and other OpenAI consumer services
OpenAI’s current consumer guidance says regular and archived chats remain saved to the account until the user deletes them or an applicable workspace retention policy removes them. When a user deletes a chat, it is scheduled for permanent removal within 30 days. OpenAI lists exceptions: a chat may already have been de-identified and disassociated from the account, or it may need to be retained for security or legal reasons. A deleted chat cannot be recovered through ChatGPT or Support.
Voice dictation is not necessarily a separate, permanently preserved recording. OpenAI says dictation is transcribed into text that the user can edit before sending as a message. The associated audio remains for as long as that chat remains in chat history. Deleting the chat schedules the audio for deletion within 30 days, subject to the same types of security and legal exceptions. Audio previously shared for model training and disassociated from the account is another stated exception.
Temporary chats require careful interpretation. OpenAI describes them as being kept out of normal history and potentially retained for up to 30 days for safety. A temporary chat that a user later saves becomes ordinary history. “Temporary” therefore does not mean that no copy exists anywhere or that a relative can obtain a special export after death.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsThe OpenAI consumer materials reviewed explain privacy, memory, model-improvement and deletion controls, but do not describe an executor or heir procedure for a deceased consumer account. That does not prove that no other process could exist; it means the reviewed consumer guidance does not establish one. Families should not assume that Support will transfer a deceased person’s complete history.
Google Gemini and Gemini Apps Activity
Google’s Gemini privacy information treats saved Gemini Apps Activity as a broad collection. Depending on the products used, it can include chats, files and other shared content, audio, Gemini Live video and screen shares, plus product or location data.
When Keep Activity is on, activity auto-deletes after 18 months by default. The user can instead select a three-month or 36-month period, or disable automatic deletion. These settings describe saved Activity behavior; they should not be read as a guarantee that every technical copy, safety record or separately stored file disappears on the same schedule.
When Keep Activity is off, future chats do not appear in Activity. Google says those chats are retained for 72 hours so Gemini can respond, process feedback and protect users and the service. That short window is still retention, and it is different from a permanent chat history.
Rank #2
Google offers the clearest advance-planning feature in the reviewed material: Inactive Account Manager. While the account holder can still manage the account, they can choose up to 10 trusted contacts, select all or specific eligible data to share, and set an inactivity period. Google says it assesses activity using signals such as sign-ins, My Activity, Gmail use and Android check-ins. An inactivity plan is not activated simply because a relative reports a death; it depends on the configured period and Google’s activity signals.
Google also reserves the right to delete an account, its activity and its data after at least two years of inactivity. That is a provider reservation, not a promise that deletion will occur at exactly two years or that every service uses the same clock.
Microsoft consumer Copilot
Microsoft’s consumer Copilot FAQ says conversation activity is stored for 18 months by default. Users can delete individual conversations or all conversation history. The FAQ also discusses personalization and model-training settings, which control other uses of data and are not an inheritance mechanism.
The consumer guidance reviewed does not describe a deceased-user, executor or family-transfer process. Do not infer one from Microsoft 365 administration documentation. Microsoft Learn explains that when an employee leaves an organization and a Microsoft 365 account is deleted, Copilot and other AI-app messages subject to retention can be placed in an inactive mailbox. That is an employer-controlled compliance feature. It does not establish that a relative can open a personal Copilot account or retrieve its history.
Comparison: what each provider actually establishes
| Provider | Data and default behavior described | Advance planning | Post-death access described in reviewed consumer guidance | Important boundary |
|---|---|---|---|---|
| OpenAI consumer services | Chats remain until deletion or an applicable workspace policy; deleted chats are scheduled for removal within 30 days, with stated exceptions. Dictation audio follows the chat’s history. | No deceased-account or heir feature is specified. | No consumer executor pathway is specified in the reviewed material. | Temporary chats may be retained up to 30 days for safety; saved temporary chats become ordinary history. |
| Google Gemini | With Keep Activity on, saved Activity auto-deletes after 18 months by default, with 3- or 36-month alternatives. With it off, future chats are retained for 72 hours. | Inactive Account Manager supports up to 10 trusted contacts, selected eligible data and a chosen inactivity period. | Google may provide content after careful review in certain circumstances, but does not promise access. | Google will not provide passwords or other login details; closing the account prevents a later content-transfer request. |
| Microsoft consumer Copilot | Conversation activity is stored for 18 months by default; users can delete selected or all history. | No consumer death-planning feature is specified. | No deceased-user process is specified in the reviewed consumer FAQ. | Inactive-mailbox guidance applies to Microsoft 365 organizations, not proven consumer inheritance. |
Why voice data needs its own inventory
“My AI chats” can conceal several different records. A spoken prompt may create an original audio clip, a machine-generated transcript, the final text message sent to the model, model responses, diagnostic logs and, in some products, a video or screen share. Deleting one layer does not necessarily establish what happens to every other layer.
OpenAI’s dictation description links the audio to the chat: while the chat remains in history, the associated audio remains; deleting the chat schedules both for deletion within 30 days, subject to exceptions. Gemini’s saved Activity can include audio and Gemini Live video or screen shares, but its controls are described through Keep Activity and auto-delete settings rather than the same chat-audio linkage.

What to do while you can still manage the accounts
1. Inventory every account and its owner
Write down each AI service, the email address used, whether it is a personal or employer-managed account, and whether a family member needs preservation, deletion or only notification. Employer accounts may be governed by a retention schedule that overrides personal preferences.
2. Review retention controls separately
Check chat history, archived conversations, temporary-chat behavior, voice settings, memory or personalization, model-improvement choices and automatic deletion. For Gemini, verify Keep Activity and the selected 3-, 18- or 36-month period. For OpenAI, understand that deleting a chat starts a stated 30-day deletion schedule, not an instant erasure. For Copilot, review the 18-month conversation-activity setting and any deletion controls.
3. Decide what should be preserved
Some people want a record of family stories, medical discussions or creative work; others want sensitive prompts and recordings removed. Export or copy only material you are entitled to keep, and store it in a protected location. A provider’s retention setting cannot replace a deliberate archive of the specific conversations you want your family to have.
4. Configure Google Inactive Account Manager if appropriate
Set the inactivity period, verify the trusted contacts and select only the eligible data that should be shared. Google describes this as the best way to tell it who should have access to information and whether the account should be deleted. Keep contact details current, because the feature depends on the configured account and Google’s activity signals.

State which accounts should be preserved, shared or deleted, and identify the person who should act. Tell that person where the record is stored. Do not put passwords in an unsecured document or send them by ordinary email. Credentials can expose unrelated mail, financial information and private conversations, and they are not a substitute for a provider’s official process.
6. Recheck the plan periodically
Provider names, menus and retention periods change. Review the official account controls and help pages whenever you change devices, email addresses or estate documents, and at regular intervals.

Start with preservation, not immediate closure
Closing an account can be irreversible. Google explicitly says that if a requester chooses account closure, Google cannot process a later request to turn over the account’s contents. Before submitting a closure request, determine whether the family needs a lawful review of selected content or whether deletion is the intended outcome.
Use the provider’s current request path
Google says it may work with immediate family members and representatives to close an account and may provide content in certain circumstances after careful review. The result is discretionary, not guaranteed. Google also says, “We cannot provide passwords or other login details.” A successful request therefore should not be described as receiving the deceased person’s credentials.

A free scan shows the junk files, broken settings and background clutter dragging Windows down - then fixes them in one click.Free scan · Windows 10 & 11For OpenAI and Microsoft consumer accounts, the reviewed guidance does not establish a comparable deceased-user route. Contacting support may be possible, but no particular result should be promised. Keep the request limited to the account and data that are actually relevant, and be prepared to provide whatever evidence the provider’s current process requires.
Common assumptions that lead to bad decisions
- “Death automatically deletes the account.” The reviewed policies do not establish that universal trigger.
- “The next of kin automatically gets the chats.” No reviewed provider promises automatic inheritance of credentials or content.
- “Temporary means nothing was retained.” OpenAI describes possible safety retention for up to 30 days; Google describes 72-hour retention when Keep Activity is off.
- “Deleting text deletes the recording everywhere.” The relationship between audio, transcripts and other records differs by service.
- “An employer’s inactive mailbox proves consumer access.” Microsoft’s inactive-mailbox material concerns organizational compliance.
- “Closing first is harmless.” Google warns that closure prevents a later request to turn over account contents.
- “A password list solves digital inheritance.” It can expose far more data than intended and bypasses neither provider policy nor account-security controls.
A practical decision framework
Choose one treatment for each service and data type:
- Preserve and share: export selected conversations or configure an inactivity feature such as Google’s Inactive Account Manager.
- Preserve privately: keep an encrypted archive accessible to the named representative without giving broad account credentials.
- Allow ordinary expiry: leave auto-delete and retention settings in place, understanding the stated periods and exceptions.
- Request deletion: instruct the representative to use the provider’s current process, but verify whether closure would eliminate any later content-review option.
Apply the choice separately to text, audio, video, files and employer-managed data. A single sentence in an estate plan—“delete my AI accounts”—is too vague to express those differences.
What remains uncertain
Provider policies and feature names can change, and the reviewed material is not a jurisdiction-specific statement of inheritance law. Whether an executor has legal authority to request data depends on local law, the account contract and the provider’s identity-verification process. The official guidance reviewed also does not settle whether OpenAI or Microsoft offer another post-death route outside their consumer pages. Treat the documented controls as practical account guidance, not as a guarantee of legal access or a complete statement of every internal procedure.

The Bottom Line
Plan AI accounts individually. Review retention and voice settings, configure Google’s Inactive Account Manager if you want designated sharing, document preservation or deletion choices securely, and avoid assuming that death, a password or account closure will automatically transfer—or erase—your chats and recordings.
