What Happens to Vacant Government Buildings—and Who Pays to Maintain Them?

A vacant government building does not become cost-free when workers leave. The public entity that owns or controls it usually keeps paying for security, utilities, inspections, routine maintenance, repairs, insurance, staff oversight and any work needed before transfer or sale. In the federal system, a General Services Administration (GSA) building is generally financed through the Federal Buildings Fund, which is fed by rent paid by tenant agencies and limited by congressional appropriations. Other federal agencies may charge disposal preparation to their own operating accounts. State and local rules vary: a transfer, lease or sale can shift maintenance, debt and permitted-use obligations only when the governing law and agreement do so.

What “vacant” means for a public building

Vacancy describes use, not ownership. A courthouse, school, office, depot or other public facility can be empty while its title remains with a federal agency, state, county, city, school district or another public body. Until a legally effective transfer or sale occurs, that owner normally remains responsible for the property.

Keeping an empty building safe and legally compliant can require:

  • Security, access control, fire protection and alarm monitoring.
  • Electricity, heating, cooling, water, sewer and other utility service needed to protect the structure.
  • Inspections, grounds care, pest control, cleaning and weather-related repairs.
  • Major repairs or stabilization to prevent deterioration and liability.
  • Environmental investigation or remediation and historic-preservation compliance before disposition.
  • Real-estate, legal, contracting and project-management staff time.

These expenses continue even when no program occupies the building. The exact bill depends on the building’s condition, location, security needs, environmental issues and the owner’s funding rules. There is no national statistic establishing the annual cost of vacant government buildings alone.

How the federal government handles an unneeded building

Federal agencies generally begin the process when they determine that they no longer need a property. The sequence described by the U.S. Government Accountability Office (GAO) and GSA is designed to test reuse before a sale.

1. The landholding agency identifies excess property

The agency documents that the building is no longer needed for its mission and notifies GSA when the property falls within GSA’s disposal process. “Excess” does not mean abandoned; it means the current federal agency has no continuing need under the applicable property rules.

2. GSA reviews the property and seeks federal reuse

GSA can review the submission, accept the property into its process and offer it to another federal agency. An agency with a funded mission may take the building instead of constructing or leasing another facility. The transfer is an interagency transaction, not a public auction, and the agencies must resolve condition, funding and occupancy questions.

3. Eligible public-purpose uses are screened

If no federal agency takes the property, federal law can provide pathways for eligible public purposes. Examples include educational facilities, historic monuments, public parks and certain homeless-assistance uses. A state, local government or qualifying nonprofit must meet the relevant statutory and program requirements and accept the terms attached to the conveyance. GAO reported that some eligible state, local and nonprofit public-benefit transfers in the process it reviewed could receive discounts of up to 100 percent, but eligibility and the governing statute must be checked for each property. A community cannot simply claim any vacant federal building.

4. The property is sold when other routes do not apply

GSA describes competitive public sales, including auctions, as the usual market route when a property is not transferred for federal or eligible public purposes. Negotiated sales are available in particular circumstances authorized by law. The agency must prepare the property for marketing, address environmental or historic requirements, establish sale terms and complete closing before ownership changes.

Who pays while a federal building is empty?

GSA-managed properties: rent-supported Federal Buildings Fund

GAO’s March 26, 2026 testimony explains that GSA collects rent from tenant agencies and deposits it into the Federal Buildings Fund. That fund supports federal real-property acquisition, operations, maintenance and disposal. Congress sets annual limits on how much GSA may obligate, so the fund does not provide unlimited spending authority.

For a GSA-managed building awaiting reuse or sale, the practical answer is therefore that GSA’s real-property system continues to carry the costs, financed through the fund’s rent and appropriations framework. The rent is paid by federal tenant agencies rather than by a private occupant, and an empty building may still require spending even though it produces no current program benefit.

Other federal properties: the owning agency’s accounts

Not every federal building is managed by GSA. GAO’s September 2026 report says disposal-preparation costs for other landholding agencies may come from the agency’s salaries-and-expenses account or its operations-and-maintenance account. Environmental remediation, historic-preservation work, surveys, security and contracting can therefore compete with the agency’s other funded responsibilities.

GAO summarized the timing problem this way in Federal Real Property: Funding and Other Challenges Have Hindered Progress Under a Temporary Disposal Process (2026): “The process for disposing of unneeded and underutilized federal real property may take years, sometimes decades, with the federal government bearing the cost of the property until the disposal is completed.” The statement applies to the federal disposal process broadly, not to a fixed average for every building.

Federal outcomes compared

Possible outcome Who controls the property afterward What happens to carrying costs Important conditions
Retained pending a decision Original landholding agency or GSA, depending on the property Current public owner continues security, utilities, maintenance and preparation costs Costs can continue for years while reviews, funding or remediation are unresolved
Interagency transfer Another federal agency Responsibility shifts under the transfer arrangement and receiving agency’s funding Mission need, condition, funding and occupancy terms must be resolved
Public-purpose conveyance Eligible state, local or nonprofit recipient Agreement and law determine when maintenance and other obligations shift Use eligibility, discount rules and continuing-use requirements apply
Competitive public sale Private or public buyer after closing Government carries costs through closing; buyer’s obligations begin under the sale documents and local law Marketing, environmental, historic and title work may be required
Negotiated sale Buyer specified under an authorized exception Current owner pays until the negotiated transaction closes Available only in circumstances allowed by law

How long can disposal take, and why?

Vacancy and disposal are separate timelines. A building may sit unused while the owner searches for another agency, waits for a public-purpose applicant, secures relocation funding, completes environmental work or resolves historic-preservation requirements. Market conditions, title questions, contamination, security concerns and congressional or agency priorities can add delay.

GAO’s April 9, 2026 report found that GSA had identified 47 properties for an accelerated-disposal approach as of March 2026. That is a dated program count, not a claim that all 47 had sold or that the number represents every vacant federal property. The same report said GSA had not established performance goals tied to accelerated timelines or avoided costs and had not determined how to evaluate private brokers against other sale methods.

For scale, GAO reported that GSA completed 921 real-property sales generating $1.4 billion from October 2013 through November 2025. The report also described about 70 percent of federal property disposals, in its stated context, as competitive public sales. Neither figure means that 70 percent of all vacant buildings are sold publicly, or that sale proceeds cover the carrying costs of every property.

The size of the federal maintenance burden

GAO’s 2026 analysis, using fiscal year 2024 data, reported more than $17 billion in annual maintenance and operating costs for more than 246,000 federally owned buildings. That is a portfolio-wide total covering occupied and unoccupied properties; it is not a vacant-building-only estimate. It demonstrates why an individual building’s delay matters to agency budgets without providing a universal per-building price.

Sale proceeds also do not automatically return to the local community or to the program that once occupied a facility. The responsible federal authority, applicable statute and appropriations rules determine who may sell, how proceeds are credited and what restrictions apply.

State and local buildings follow different rules

There is no single state or local answer. A school district, city, county or state agency may have authority to lease, transfer, demolish or sell a building under a state statute, local ordinance, bond covenant or board policy. The document that matters is the one governing that specific property.

Maine: a school-property example

Maine’s 20-A M.R.S. §4103 illustrates how a statute can allocate both use and cost. For certain closed public school property, a school board may lease or transfer the building. Lease proceeds may be used for maintenance and other authorized purposes. The statute also permits transfer to a municipality; if the town accepts, it may become liable for outstanding indebtedness under the statutory terms. A transfer therefore can change who pays, but acceptance is tied to the law and the transaction documents.

West Virginia: local vacant-building ordinances

West Virginia’s §8-12 shows a different approach. Municipalities may create vacant-building registration and maintenance programs by ordinance, set standards for owners and, under the statute and local rules, take certain actions or place liens. The framework does not impose a general duty on municipalities to take over maintenance obligations that remain with the owner. An empty privately or publicly owned building can therefore remain the owner’s responsibility even while the municipality enforces local standards.

These examples show why a rule from one state cannot be applied nationwide. They are illustrations, not a survey of all school-property or vacant-building laws.

How to determine who pays for one building

For a particular address, identify the legal owner and then trace the documents that control the property.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Confirm title and control. Check the deed, federal or state asset records, school-district records and any interagency agreement. The agency using a building may not be the agency that owns it.
  2. Identify the current funding account. For a GSA-managed federal facility, determine whether expenses are charged through the Federal Buildings Fund. For another federal agency, look for salaries-and-expenses or operations-and-maintenance appropriations. State and local records may show a general fund, capital account, school-district fund or dedicated lease revenue.
  3. List the costs still being incurred. Request budgets or invoices for security, utilities, inspections, grounds, insurance, repairs, environmental work and professional services. Do not assume an empty building has zero utility or staffing costs.
  4. Find the disposition stage. Ask whether the property is being retained, offered to another public agency, screened for a public-purpose conveyance, listed for auction or under a negotiated sale.
  5. Read the transfer or sale terms. Look for maintenance dates, permitted use, debt assumption, environmental liabilities, historic-preservation duties, demolition obligations and any reversion clause.
  6. Check local constraints. Zoning, building codes, landmark rules, bond covenants and vacant-property ordinances can impose duties after a public transfer or sale.

Common misunderstandings

  • “Vacant” means abandoned. A building can be empty but actively managed, secured and scheduled for reuse or sale.
  • The nearest government automatically pays. Responsibility follows ownership, control and the applicable agreement, not geographic proximity.
  • Any community can obtain a federal building for free. Public-purpose conveyances have eligibility, use and statutory conditions; discounts up to 100 percent reported by GAO applied only to eligible transactions.
  • A sale immediately ends every public cost. The government may pay for preparation, remediation, marketing and security until closing, and a transfer may assign continuing obligations rather than erase them.
  • All states handle closed schools alike. State statutes and local policies differ, including who may approve a transfer and whether debt follows the property.

Bottom line for taxpayers and public managers

The payer is usually the current public owner or landholding agency until a legally effective transfer or sale. In the federal system, GSA-managed costs flow through the rent-supported Federal Buildings Fund within congressional spending limits; other agencies may use their own operating accounts. State and local entities can shift maintenance, debt or use obligations only under the governing law and agreement. To answer the question for one vacant building, start with ownership, identify the funding account, determine the disposal stage and read the transaction terms rather than relying on the word “vacant.”
