What Happens to Stablecoins If an Issuer Fails?

If a stablecoin issuer fails, holders may face delayed or suspended redemptions, uncertainty over reserve assets and a token trading below its intended peg. Whether holders recover—and how quickly—depends on the token’s legal structure, the amount and accessibility of its reserves, the holder’s custody arrangement and the insolvency law that applies. A dollar peg is a target, not a guarantee that every holder can get one dollar on demand.

What does “issuer failure” mean for a stablecoin holder?

An issuer’s insolvency is only one of several events that can disrupt access to stablecoins or their backing. The entity holding a customer’s tokens, the bank holding reserve cash and the issuer itself may all be different organizations, with different assets and legal obligations.

Event What may be disrupted Whose assets or claim are involved?
Issuer insolvency Redemptions may stop or slow while the issuer’s affairs are handled. The token may still transfer on-chain, but uncertainty can affect its market price. The issuer’s required reserves and the holder’s claim under the applicable law and token arrangements.
Failure of a bank holding reserve cash Cash may temporarily be inaccessible, making it harder for the issuer to meet redemptions even if the issuer remains in business. The issuer’s bank deposit and whatever protections or resolution rules apply to that deposit.
Failure or dispute involving a reserve custodian Access to assets may be delayed while control, ownership or transfer rights are resolved. The reserve assets held by the custodian and the legal arrangements governing them.
Failure of an exchange or wallet provider holding tokens The customer may be unable to access or transfer tokens through that service. The customer’s claim against the intermediary, which is distinct from a claim against the stablecoin issuer or its reserves.

The GENIUS Act addresses issuer reserves for covered permitted payment stablecoins and separately addresses certain customer claims when an intermediary holds payment stablecoins. Those are different parts of the law and do not make every exchange or wallet balance equivalent to a direct claim on an issuer.

Will holders get their money back if an issuer goes bankrupt?

There is no universal answer for every stablecoin or country. Recovery depends on whether reserves are sufficient, whether they are legally available to holders, how insolvency law treats the token and its reserves, and whether the holder has a direct claim or must go through an intermediary. Even a strong legal claim can take time to administer.

What the GENIUS Act provides for covered U.S. issuers

Section 11 of the GENIUS Act establishes a specific insolvency treatment for a permitted payment stablecoin issuer. In an applicable federal or state insolvency proceeding, holders of covered permitted payment stablecoins have ratable priority over the issuer and other creditors with respect to required payment stablecoin reserves. If those reserves are insufficient, the Act also gives priority against the issuer’s estate for the remaining claim to the extent the issuer should have maintained additional required reserves.

The law also provides that, after the required motion and attestation, a court is to use best efforts to begin ratable distributions no later than 14 days after the specified hearing. This is a conditional best-efforts standard for beginning distributions—not a guarantee that an individual holder will receive funds within 14 days. The insolvency route also depends on the issuer: a depository institution is handled under the applicable bank-resolution regime, while a nonbank entity or certain subsidiary may be a debtor under the Bankruptcy Code.

This framework applies to the Act’s defined category and required reserves; it should not be assumed to govern every token, issuer or holder. Outside that category, other laws, contracts, trust arrangements and court decisions may determine the result.

Why a claim does not mean immediate cash

Insolvency administration, litigation, account reconciliation and redemption processing can all delay access. A court may need to determine who owns or controls reserve assets before distributions can proceed. Legal priority can improve a holder’s position without ensuring full recovery or setting a personal payment date.

Are stablecoin reserves protected from an issuer’s creditors?

Reserve backing matters only if assets are sufficient, accessible and legally available to holders. A reserve report or assurance may describe assets and liabilities at a particular date, but does not by itself establish who controls the assets in insolvency, how quickly they can be liquidated or transferred, whether every holder may redeem directly, or what a court will decide.

Circle has stated that USDC reserves are segregated for holders and that, in a Circle bankruptcy, the reserve would remain outside the bankruptcy estate. That is Circle’s position, not a universal rule or a final court ruling. Circle’s SEC-filed annual report cautions that courts have not yet decided how stablecoin reserve assets would be treated in an issuer bankruptcy. It also notes that recovery might be delayed by bankruptcy administration, litigation or an automatic stay, even if a court ultimately finds reserves belong to holders.

Keep four questions separate when assessing a reserve claim: whether it is large enough, who legally owns it, whether the issuer can access it when needed, and whether a particular holder is eligible to redeem. A statement that a token is backed does not answer all four.

Can a stablecoin lose its peg when its issuer has not failed?

Yes. A token can continue to move on-chain while its issuer’s redemption channel is unavailable or restricted. If holders doubt that they can redeem promptly, secondary-market buyers may demand a discount. A bank failure or operational disruption can therefore cause peg stress without the issuer itself becoming insolvent.

What the 2023 USDC episode shows

On March 12, 2023, Circle said that $3.3 billion—about 8% of USDC’s total reserve at the time—was deposited at Silicon Valley Bank (SVB). Circle said the funds would become fully available following the U.S. authorities’ depositor-protection announcement. In the same statement, Circle described the then-current reserve composition as 77% ($32.4 billion) in short-dated Treasury bills and 23% ($9.7 billion) in cash. These are historical figures from March 2023, not current reserve data.

A Federal Reserve analysis published December 17, 2025 says the announcement that part of the reserves was inaccessible prompted redemption requests and USDC lost its dollar peg on secondary markets while Circle had shut primary-market operations over the weekend. The authors characterize this as a bank failure affecting reserve access, not an issuer bankruptcy. The peg stress eased after the FDIC, Treasury Department and Federal Reserve announced that SVB depositors would be fully protected.

The episode illustrates how reserve-access uncertainty can affect redemptions and market pricing even when the issuer remains in business and the deposit is ultimately recovered. It does not establish what would happen in an issuer insolvency, a reserve shortfall or another jurisdiction.

How does custody change the route to a claim?

A holder who controls tokens in a self-custody wallet, a customer whose tokens sit with an exchange, and someone with a direct redemption relationship may face different practical steps. With an intermediary, access may depend first on that provider’s records, operations and legal status. A hardware wallet can help a user control private keys, but it does not remove issuer, reserve or redemption risk.

Redemption rules also vary by issuer and jurisdiction. For example, Circle’s EEA white paper describes a redemption-plan notice that would set out claim deadlines and submission instructions. It says requests can require identity details, evidence of token holdings, AML/CFT compliance and bank-account information. Circle SAS says complaints involving third-party purchases, or token loss in self-custody or third-party custody, fall outside its customer-care remit. These are Circle-specific EEA disclosures, not universal procedures for stablecoins.

What should holders check before relying on redemption?

Use the issuer’s current documents and the terms that apply to your own account or token. Check these points before you need to redeem:

  • Eligibility and route: whether you can redeem directly with the issuer, or must sell through a secondary market or use an intermediary.
  • Applicable law: the issuer’s legal status, the jurisdiction named in the redemption terms and whether a statutory priority regime covers that issuer and token.
  • Reserve information: the composition, location and concentration of assets, along with the date and scope of any reserve report or assurance.
  • Legal structure: how the issuer describes segregation and holder rights, while distinguishing its statements from a court’s ruling.
  • Operational terms: redemption limits, processing requirements, identity or compliance checks, and what the issuer says happens during disruptions.
  • Custody chain: whether tokens are held directly or through an exchange, wallet provider or custodian, and which entity you would contact if access failed.

These checks can clarify the path and potential bottlenecks; they cannot guarantee a particular market price, recovery amount or timetable.
