An open criminal case does not automatically end when a district attorney leaves office. Who handles it next depends on the state and county’s succession rules, why the prosecutor left, and whether a successor or temporary prosecutor has been authorized. The departure alone does not establish that charges will be dismissed, proceedings delayed, or a plea offer changed.
Who takes over a pending case?
The answer varies by jurisdiction. Depending on local law and the circumstances, the case may remain with assistant prosecutors in the same office, pass to an elected or appointed successor, or be assigned to a temporary or special prosecutor. A court or another authorized body may have a role in appointing a replacement.

Texas illustrates why the state matters. Its law assigns district attorneys duties in district-court criminal cases and appeals, provides specified representation duties for county attorneys when a district attorney is absent, and allows a judge to appoint an eligible attorney to perform prosecutorial duties in certain circumstances. Those provisions are examples of Texas law, not a rule for every state. See the Texas Code of Criminal Procedure, Articles 2A.102–2A.104. The cited duties provisions were enacted in 2023 and took effect January 1, 2025.

“Leaves office” can describe several different events: an ordinary end of term, resignation, death, suspension, removal, or a prosecutor stepping aside from one case because of a conflict. These events may trigger different procedures, and a case-specific recusal does not necessarily mean the whole office has changed hands.

North Carolina, for example, has a statutory judicial process addressing suspension or removal of a district attorney. That is a state-specific procedure, not a nationwide rule for pending cases. See North Carolina General Statutes, Chapter 7A, Article 9.
What may change in the case—and what does not change automatically
A new prosecutor or office may need to review the file, including discovery, witness preparation, deadlines, plea discussions, and disclosure obligations. DOJ guidance for federal prosecuting offices says a new requesting official should independently assess potential impeachment information rather than simply rely on a former office’s disclosure decision. That guidance concerns federal disclosure review; it does not establish that every transition changes the evidence or outcome, and state rules may differ. See the U.S. Attorneys’ Manual archive.

The change in prosecutor does not, by itself, relocate the case or dismiss the charge. Dismissal is a separate legal action governed by the applicable procedure and court authority. A docket entry, appointment order, continuance, or local statute may determine what happens next in a particular case.
Federal rules are not state DA succession rules
Federal criminal procedure should not be confused with state and county rules for an elected district attorney. Federal Rule of Criminal Procedure 20 allows a limited transfer for plea and sentence when the defendant consents in writing and the United States attorneys in both districts approve in writing. It is not a general mechanism for transferring cases when a local prosecutor leaves.

Federal Rule 18 concerns where a federal offense is prosecuted and where trial may occur; it does not identify who succeeds a departing local prosecutor. See the Federal Rules of Criminal Procedure.

- Identify the jurisdiction and court. State or county rules govern most district-attorney transitions; confirm whether the case is state or federal.
- Check the official court docket. Look for an appearance by a new prosecutor, an appointment or recusal order, a continuance, and the next court date.
- Verify the applicable local law. Determine who has authority to take over and when that authority begins; do not assume a rule from another state applies.
- Ask counsel familiar with the case. The case’s procedural stage, existing orders, and local practice can affect the next step.
For a reliable case-specific answer, the relevant details are the state and county, court and case type, reason and effective date of the departure, identity and authority of any replacement, and current docket status. Do not infer dismissal, delay, or a changed plea offer from the departure alone.
