What Happens to H-1B Workers When Their Employer Cuts Jobs?

If an H-1B job ends, you usually do not have to leave the United States that day. Federal regulations generally allow up to 60 consecutive days after employment cessation, or until the end of your authorized validity period if that comes first. The shorter deadline controls. That period is for finding qualifying employment or pursuing another immigration option; it is not an unrestricted work permit.

What happens immediately after an H-1B layoff?

Your immigration position turns on two dates: the date your H-1B employment actually ended and the date your authorized stay ends. Under 8 C.F.R. § 214.1(l)(2), as reproduced in a March 1, 2023 USCIS Administrative Appeals Office decision, the post-termination period lasts “for up to 60 consecutive days or until the end of the authorized validity period, whichever is shorter.”

That means a worker whose job ends on June 1 may have less than 60 days if the authorized period ends earlier. Conversely, the 60-day period does not automatically extend an approval notice, admission record, or other underlying validity date.

The visa stamp is not the controlling deadline

Do not use the expiration date printed on a visa stamp as a substitute for the authorized-stay date. A visa generally permits travel to a port of entry; the period you may remain in the United States is reflected by your admission and immigration documents, including the I-94 record and the end date on the H-1B approval notice. Check those documents together with the actual last day of employment.

The grace period is not an open work authorization

The grace period gives you time to seek a new qualifying position or consider a change to another status. It does not authorize you to keep working for the former employer after a bona fide termination, to perform services for a prospective employer before the rules permit it, or to take any unrelated job. Work authorization still depends on a valid H-1B petition, portability rules, or another status that authorizes the specific work.

How to calculate your available time

  1. Record the last day you actually worked. Use the employment-cessation date, not merely the date a layoff was announced. If paid notice, garden leave, or severance is involved, ask the employer and an immigration professional how the arrangement is being treated.
  2. Find the authorized end date. Review the I-94 admission record and the end date on the latest Form I-797 approval notice. Keep copies of both.
  3. Count up to 60 consecutive calendar days from cessation. The regulatory wording is “up to 60,” not a guaranteed extra 60 days.
  4. Use the earlier deadline. Your practical last day is the earlier of the 60-day calculation and the authorized validity end date.
  5. Build filing and travel time into the calculation. A petition or change-of-status filing may require documents, employer review, and attorney preparation. Waiting until the final days can leave no workable option.
Fact to compare Why it matters
Employment-cessation date Starts the potential grace-period calculation.
I-94 “admit until” date Shows the authorized period reflected in your admission record.
H-1B approval end date Helps identify the petition’s validity period; it does not replace checking the I-94.
Visa-stamp expiration Relates primarily to travel and visa issuance, not automatically to the time authorized inside the United States.

Can another employer hire you during the 60-day period?

A prospective employer can generally file an H-1B petition for a new position. Department of Labor Fact Sheet #62W, revised November 2016, describes portability for an H-1B worker when the new employer files a nonfrivolous petition before the worker’s authorized stay expires and submits an unexpired, approved Labor Condition Application (LCA) covering the offered work.

When portability can allow an earlier start

For an H-1B worker who remains employed under a valid LCA, the DOL fact sheet says the worker may begin the new employment when the qualifying petition is filed, without waiting for adjudication. That rule is often called H-1B portability.

A recent termination makes the analysis more fact-specific. The fact sheet describes portability in the context of an already employed H-1B worker. A person whose employment has ended should not be told categorically that any filing automatically authorizes immediate work. The filing history, maintenance of status, petition language, LCA, dates, and the employer’s evidence all matter.

What the new employer must coordinate

  • A nonfrivolous H-1B petition describing the offered position and the requested employment period.
  • An approved LCA that is still unexpired and covers the work location, occupation, and required wage obligations.
  • Filing before the worker’s authorized stay expires.
  • Evidence addressing the worker’s prior H-1B employment and the end of that employment when relevant.

Portability is a specific statutory and regulatory mechanism, not a general job-search work permit. Do not begin work merely because an employer has made an offer or because an attorney has started preparing forms; obtain confirmation that the filing and start date are permitted for your facts.

What must the former employer do?

The Department of Labor’s H-1B Advisor and Fact Sheet #62I identify several employer responsibilities when an H-1B worker is terminated. The employer should provide clear notice to the worker, notify U.S. Citizenship and Immigration Services that the employment has ended and the petition should be canceled or withdrawn, and document those actions.

Return transportation

Department of Homeland Security regulations can require the employer to offer transportation home in certain termination circumstances. The obligation is not a promise that immigration status continues, and it does not necessarily cover every departure arrangement or every type of separation. Ask for the employer’s position in writing and preserve the response.

Petition withdrawal and bona fide termination

DOL guidance describes evidence of bona fide termination as notice to USCIS that the employment relationship ended and the petition should be canceled, together with transportation payment when required. These steps matter to wage obligations and the government’s records, but they do not themselves grant a new period of stay.

Do wages continue after a layoff?

DOL Fact Sheet #62I says an employer generally does not have to pay for H-1B nonproductive time after a bona fide termination. The fact sheet links the end of that wage obligation to the employer’s effective termination actions, including notice to USCIS and required transportation arrangements. Official regulations control if the facts differ from the general guidance.

Severance, salary continuation, or payment through a notice period does not automatically extend H-1B status. Immigration validity and wage-law obligations are separate questions. A worker can receive severance while still needing to meet the immigration deadline, and a wage dispute can exist even when status has ended. Keep pay statements, termination letters, severance agreements, and correspondence.

Early-termination penalties

An older DOL termination FAQ states that an employer cannot charge a penalty fee simply because an H-1B worker’s employment ended early. Because that FAQ dates from 2011 and later rules or facts may affect the result, use current DOL fact sheets and the governing regulations when evaluating a specific contract or repayment demand.

What options exist if you cannot find another H-1B job?

USCIS has explained that a worker may seek a change to another nonimmigrant status where eligible. The appropriate category depends on personal facts such as the purpose of the stay, dependents, financial support, prior status, and whether the application is filed on time. Filing requirements are not interchangeable: a change-of-status filing is different from a new employer’s H-1B petition and does not automatically authorize employment.

Examples of issues that can change the answer

  • Dependents: H-4 family members may have their own status and expiration dates. A principal worker’s layoff can affect extension planning for the whole family.
  • Pending petitions: An extension, amendment, transfer, or change-of-status filing may alter the analysis. Do not assume a pending case cures every gap.
  • Travel: Leaving the United States while a change-of-status request is pending can affect that request. Obtain case-specific advice before booking travel.
  • Prior status problems: Unapproved employment, an overstay, or inconsistent dates can make a filing riskier than the ordinary layoff scenario.

A practical action plan for the first week

  1. Collect the immigration file. Save the latest approval notices, I-94 record, passport biographical page, visa page, prior petitions, LCA details, pay records, and any notices from the employer.
  2. Get written separation details. Ask for the last employment date, whether the employer will withdraw the petition, whether it notified USCIS, how severance is characterized, and whether return transportation is being offered.
  3. Calculate both deadlines. Mark the 60-day date and the authorized-stay end date, then use the earlier one.
  4. Tell prospective employers the real deadline. A recruiter needs enough time for the LCA and petition review; hiding the termination date can create avoidable filing problems.
  5. Have the new employer assess portability. Confirm that the petition is nonfrivolous, the LCA is approved and unexpired, and the proposed start date is legally supportable.
  6. Evaluate alternatives before the window closes. If an H-1B offer is uncertain, discuss an eligible change of status or departure plan early rather than waiting for the final days.
  7. Get individualized advice when facts are complicated. Prompt legal review is especially important for travel, dependents, a pending filing, prior status issues, disputed termination dates, or a planned start before approval.

Common mistakes to avoid

  • Assuming everyone receives a full 60 days: the authorized-period cutoff can shorten it.
  • Counting from the announcement date: the relevant date is generally when employment ceased, which may differ from when the layoff was announced.
  • Working for cash or “temporarily”: the grace period itself does not authorize unrelated employment.
  • Relying on the visa stamp: check the I-94 and approval notice instead.
  • Treating a filed petition as automatic approval: portability and change-of-status rules have specific prerequisites.
  • Assuming severance preserves status: payment and immigration authorization are separate.
  • Ignoring the employer’s filings: withdrawal and termination notices can affect the record and wage analysis.
  • Waiting until day 59: document collection and LCA preparation can take time, and a defective filing may not solve the problem.

Three illustrative timelines

Termination with a full available window

An employee’s last day is March 1, and the I-94 remains valid beyond the 60th day. The worker can use up to 60 consecutive days to pursue a qualifying H-1B filing or another eligible option, subject to the applicable filing and work rules.

Termination near the end of authorized stay

An employee’s job ends while only 20 days remain on the authorized period. The worker does not receive a separate 60-day extension; the authorized-period end date is the shorter deadline.

New offer but uncertain portability

A prospective employer files after termination, but the worker’s prior status and filing history are not straightforward. The employer should not assume that filing alone permits an immediate start. Counsel must evaluate whether the portability conditions and maintenance-of-status requirements are met.

Bottom line for laid-off H-1B workers

A job loss usually triggers a limited period—up to 60 consecutive days or the end of authorized validity, whichever is earlier—to secure another qualifying path. Use the time to document the exact dates, obtain the former employer’s termination and USCIS-notice information, and coordinate any new H-1B petition and LCA before working. Employer duties concerning notice, wages, and transportation are distinct from your immigration status. Because a recent termination can make portability and status questions fact-sensitive, act promptly when the dates or filings are not clear.
