When a crypto company enters bankruptcy, withdrawals can stop while the court determines who legally owns the assets. Customers may recover cryptocurrency held in a properly segregated custody arrangement, but recovery can be delayed, reduced, or converted into a claim against the bankruptcy estate. Assets that were lent, pooled, pledged, or treated as the company’s property may leave the customer as a general unsecured creditor.
There is no single “crypto bankruptcy” result. The failed legal entity, your account agreement, the product you used, wallet and ledger records, the jurisdiction, and court orders all control the outcome.

Why two customers at the same platform can have different outcomes
Bankruptcy law starts with the legal entity that filed, not the app or brand name shown on your phone. A platform may operate through several subsidiaries, and the entity named in your account agreement may differ from the company that handled marketing, lending, or custody. The court must identify which debtor owns which wallets, contracts, and obligations.
Your contract and product label matter
“Custody,” “earn,” “staking,” “yield,” “borrow,” and “wallet” are not interchangeable legal categories. A custody contract may say the company holds assets for you. A yield or lending agreement may authorize the company to use, rehypothecate, pledge, or combine them with other assets in exchange for interest. Those rights can determine whether you are asserting ownership of particular coins or merely a debt owed by the company.

Segregation and traceability help, but do not guarantee recovery
Separate wallets, customer ledgers, and records that trace specific assets can support an argument that the assets are customer property rather than estate property. Segregation language alone is not a promise: the court must examine how the company actually held and recorded the assets, whether there was a shortfall, and what the governing law says.
Shortfalls and commingling change the calculation
If the debtor has enough identifiable assets to satisfy customer entitlements, returning those assets may be possible. If assets were commingled, transferred, pledged, or missing, customers may share in a limited pool or receive a monetary claim. A favorable ownership ruling does not create coins that the debtor no longer has.
Deadlines and court orders are part of the claim
Bankruptcy cases set deadlines for filing proofs of claim, choosing settlements, verifying identity, and selecting payment methods. Missing a deadline can reduce or delay recovery even when you have a valid entitlement. Notices from the court, trustee, debtor, or claims agent control; social-media posts and customer-service assurances do not.
What happens after the company files
- Withdrawals and transfers may be paused. The company, a court-appointed trustee, or an examiner may freeze withdrawals, swaps, redemptions, and transfers while assets and liabilities are inventoried.
- The debtor and its records are identified. The case determines which corporate entity filed and gathers account agreements, wallet addresses, transaction histories, and internal ledgers.
- Customer claims are classified. Each program may be treated separately. The court can distinguish property held for customers from claims for repayment under a lending or yield contract.
- Ownership and priority disputes are litigated or settled. Parties may argue whether particular wallets belong to customers, the estate, or a shared pool. A settlement may offer a defined distribution in exchange for releasing further claims.
- Approved distributions are made. Payments can be in cryptocurrency, cash, stock, or a combination, depending on the plan and available assets. Multiple distributions may occur over months or years.
Bankruptcy valuation dates also matter. A plan may value a coin at a specified date rather than at the price when you originally deposited it. The applicable plan and court orders, not a platform’s former account balance display, determine the allowed claim.

Account types and the risks they create
| Arrangement | Typical legal question | Possible bankruptcy treatment |
|---|---|---|
| Segregated custody | Were identifiable assets held for the customer and kept separate? | May be treated as customer property, subject to records, shortages, contract terms, and the court’s ruling. |
| Omnibus or pooled custody | Can the customer’s entitlement be traced in a common wallet or ledger? | Customers may share pro rata in the pool; a shortfall can produce a claim for the missing amount. |
| Earn, yield, or interest account | Did the customer authorize the company to use or lend the assets? | May be treated as a contractual claim against the estate rather than ownership of specific coins. |
| Loan, pledge, or rehypothecation arrangement | Could the company transfer, collateralize, or reuse the assets? | Recovery can depend on counterparty records, collateral, and the priority of competing claims. |
| Withheld or restricted balance | Was the balance held under a distinct program or subject to a settlement? | May receive a program-specific distribution, as occurred with Celsius Withhold claims. |
The table describes questions courts commonly have to answer, not automatic results for every exchange or jurisdiction.
What the Celsius bankruptcy shows
The U.S. Bankruptcy Court for the Southern District of New York’s Celsius proceedings demonstrate why account labels and underlying arrangements matter. Celsius offered interest-bearing Earn Rewards and, in some jurisdictions, Custody and Withhold arrangements. In June 2022, it paused withdrawals, swaps, and transfers.
Segregated Custody wallets
The court recorded that assets in the debtors’ segregated Custody wallets were customer property, not property of the debtors. That holding concerned the wallets and facts before that court; it is not a rule that every exchange’s “custody” account will be treated the same way.
The negotiated Custody settlement
Eligible Custody customers could opt into a settlement that distributed 72.5% of the allowed claim over two distributions. In exchange, a customer forfeited the remaining 27.5% and released related claims. Pure Custody and certain Transferred Custody Assets were addressed separately. These percentages are the terms of the Celsius settlement approved in that case, not a prediction for another bankruptcy.

Withhold accounts
For Withhold accounts, the settlement provided 15% of the allowed claim as an in-kind distribution. The remaining 85% was treated as an Earn claim. The result illustrates how a platform can apply different treatment to programs that customers may have viewed as similar.
What the example does not prove
Celsius does not establish that segregation always produces immediate return, that every custody customer receives the same percentage, or that an Earn customer owns coins in a specific wallet. The proceedings involved pauses, litigation, shortages, elections, and distributions under a court-approved plan.
When customers become general unsecured creditors
A customer is a general unsecured creditor when the company owes a debt but the customer cannot establish a superior property right or collateral claim. Unsecured creditors are paid from what remains after higher-priority expenses and claims, and the available pool may be insufficient to pay the full balance.
Coinbase Global, Inc., in its 2025 annual report filed with the SEC, disclosed this risk for its own business: “Moreover, because custodially held crypto assets may be considered to be the property of a bankruptcy estate, in the event of a bankruptcy, the crypto assets we hold in custody on behalf of our customers could be subject to bankruptcy proceedings and such customers could be treated as our general unsecured creditors.” This is a company risk disclosure, not a judicial conclusion about every crypto custodian.

The practical question is not simply whether an account was called “custody.” Review the agreement’s provisions on title, control, use of assets, security interests, lending, rehypothecation, and the governing law. Then compare those terms with wallet and ledger evidence from the failed company.

Do not assume that bank-deposit or securities-broker protections automatically cover a crypto exchange balance. The protections depend on the institution, asset, account, and proceeding.
SIPC and SIPA liquidations
The Securities Investor Protection Corporation framework applies to qualifying securities broker-dealers in a SIPA liquidation. The United States Courts explains that SIPC can fund trustee advances of up to $500,000 per customer, including a maximum of $250,000 for cash. Customer-related property is distributed through the SIPA process, and a customer can participate as an unsecured creditor when customer property and statutory advances do not satisfy the claim.
SIPC is not a general guarantee for cryptocurrency held at an ordinary crypto exchange. Whether a digital asset is a qualifying security, whether the firm is a covered broker-dealer, and whether the proceeding is under SIPA are separate legal questions.

Commodity-broker customer-property rules
Section 190.09 of Title 17 of the Code of Federal Regulations contains customer-property allocation rules for the covered commodity-broker framework, including allocation of segregated or readily traceable property. Its application depends on the debtor, the account, and the type of proceeding. It should not be generalized into a universal crypto-customer guarantee.
What to do if your platform fails
- Identify the exact debtor. Check your account agreement, bankruptcy notices, and court docket for the legal entity that filed. Record subsidiaries and any separate lending or custody entities named in the documents.
- Preserve evidence. Download statements, transaction histories, wallet addresses, deposit and withdrawal confirmations, tax reports, emails, and screenshots showing balances and program enrollment. Keep originals and note the date each file was obtained.
- Classify each balance. Separate custody, Earn, staking, lending, collateral, and withheld balances. Do not combine them merely because they appeared in one app.
- Read the official claim instructions. Use court-approved notices and the designated claims portal. Check the proof-of-claim deadline, identity-verification requirements, valuation date, and permitted distribution methods.
- Review settlement elections carefully. An opt-in distribution may require releasing additional claims. Compare the offered percentage, timing, asset type, tax consequences, and release language before electing.
- Track every court update. Plans, objections, appeals, and distribution schedules can change. Save filed notices and confirmation numbers rather than relying on informal summaries.
- Get individualized advice when the amount or ownership issue is significant. A lawyer experienced in insolvency or digital-asset disputes can analyze the contract, entity structure, records, and applicable law. No general article can determine an individual claim.
How to assess custody risk before a failure
- Read whether you retain title to the assets or grant the platform a right to use them.
- Look for language covering lending, staking, rehypothecation, pledging, and commingling.
- Determine whether assets are held in segregated wallets or an omnibus structure and how the company records your beneficial interest.
- Identify the contracting entity, governing law, jurisdiction, and dispute forum.
- Check whether the company can suspend withdrawals, convert assets to cash, or change program terms.
- Maintain your own transaction and tax records; an app balance may not be available after a freeze.
Self-custody can change who controls assets going forward, but it does not resolve ownership of assets already held by a failed company and does not erase obligations under an existing contract.
The practical answer
Customer funds can be returned as identifiable property, distributed pro rata from a shared pool, or paid only as an unsecured bankruptcy claim. The decisive evidence is the contract and the company’s actual handling of the assets: segregation, traceability, reuse rights, shortages, and the court’s orders. Treat every percentage or deadline as case-specific, follow official notices, and avoid assuming that a favorable result in Celsius or a protection such as SIPC applies to a different crypto platform.
