A restriction on Chinese-origin inputs would not automatically stop AI development, but it could make parts of the hardware chain slower, less predictable and more expensive to operate. The immediate effect would be licensing checks and supply-chain uncertainty; the eventual effect on AI training capacity, chip prices or deployment schedules would depend on which items were covered, whether permits were granted, and how quickly substitutes could be qualified.
The rules currently documented are targeted export controls, not a blanket prohibition on every component made in China. They reach specific rare-earth-related goods, certain downstream products and particular end uses. That distinction is essential when estimating the risk to AI hardware.

What the current Chinese rules actually cover
Notice 2025 No. 61 uses a licensing system
China’s Ministry of Commerce (MOFCOM) Notice 2025 No. 61 requires a Chinese dual-use export permit before specified listed goods leave China or are re-exported from another country. The rule covers listed Chinese-origin items, but it can also reach some goods manufactured outside China.
A foreign-made item can fall within the notice when it contains qualifying Chinese-origin listed rare-earth materials worth at least 0.1% of the item’s value. The notice also covers listed goods made abroad with specified Chinese technologies for rare-earth extraction, refining, metal smelting, magnet manufacturing or recycling. These are conditions that must be assessed against the exact product and its production history; they do not mean that every foreign-made server or accelerator is automatically controlled.

Controls on Chinese-origin listed items applied when the notice was published. The categories concerning qualifying foreign-made goods were scheduled to take effect on December 1, 2025. Exporters therefore need to check both the item’s origin and the implementation date that applies to the relevant category.
End use and end user can change the outcome
Applications for goods destined for foreign military users or specified controlled entities are, in principle, not approved. The notice also says that applications for military uses, weapons-of-mass-destruction-related uses or terrorist purposes are generally not approved.
Some technically advanced uses receive individual review rather than an automatic approval. The notice identifies exports for research and development or production of logic chips at 14 nanometers or below, memory chips at 256 layers or above, associated production and testing equipment and materials, and artificial-intelligence research with potential military applications. In the English translation, MOFCOM states: "For exports with the end use of research and development or production of logic chips at 14 nanometers and below or memory chips with 256 layers and above, or for production equipment, testing equipment, and materials used to manufacture semiconductors at the above process nodes, or for research and development of artificial intelligence with potential military applications, case-by-case approval shall be implemented."

Items exported for emergency medical needs, public-health emergencies or disaster relief do not require a permit under the stated exception. The foreign exporter must report to MOFCOM within ten working days and undertake that the items will not be used to harm China’s national security and interests. This exception is tied to the specified emergencies; it is not a general waiver for commercial AI shipments.

Announcement No. 18 lists seven rare-earth elements
A separate MOFCOM and China Customs announcement, No. 18 of 2025, took effect on April 4, 2025. It lists controlled forms of samarium, gadolinium, terbium, dysprosium, lutetium, scandium and yttrium. The listed forms include metals, alloys, targets, oxides, compounds and mixtures. Whether a shipment is controlled depends on the listed substance, form, classification and transaction facts.
Why those controls can reach AI hardware
Rare earths matter to AI infrastructure because they can be transformed into magnets, targets, alloys and other manufacturing inputs used in equipment and electronics. A control applied to an upstream material can therefore affect a downstream product even when the final product is assembled somewhere else.
Notice 2025 No. 61 is significant for this reason: its foreign-made-item provisions test qualifying Chinese-origin content and, separately, the use of specified Chinese rare-earth technologies. A manufacturer may have to trace material value, processing steps, technology provenance, destination, end user and end use before shipping. The compliance burden can appear several tiers away from the mine or refinery.

Classification is product-specific. A component with no listed material, no covered technology and no restricted end use may face a different outcome from an item that satisfies one of the notice’s tests.

How a restriction could affect AI development
More checks before equipment moves
Companies would need to verify the origin of materials, the manufacturing processes used, the item’s export classification, the customer, the destination and the declared end use. Suppliers may request additional documentation or pause a shipment while a permit application is prepared. Even when a license is ultimately granted, the extra review can make delivery dates less certain.
Interruptions where alternatives are scarce
A delay matters most when the controlled input has few qualified substitutes. A manufacturer might need to identify another source, test it in the product, validate reliability and update its regulatory records. If no approved alternative is immediately available, a single missing material or production input can hold up a larger assembly.
Higher carrying costs and longer qualification cycles
Businesses may respond by holding more inventory, qualifying multiple suppliers or redesigning products around different materials. Those actions can increase working-capital requirements, engineering time and lead times. The cited official materials do not provide a measured percentage increase for AI hardware costs, so no universal price effect can be calculated from them.

Potential effects on chip-production schedules
If a restricted item is important to semiconductor manufacturing equipment, testing or materials, a shipment interruption could slow a factory expansion, maintenance cycle or production ramp. The scale would depend on the item’s position in the process and whether another supplier can meet the required specifications. The 14-nanometer and 256-layer thresholds in the notice are regulatory triggers for review, not forecasts that production at those levels will stop.

Deployment can be affected separately from model research
AI development includes model research, training, inference and deployment. A shortage of a specialized manufacturing input could affect the number or timing of new accelerators, but it would not automatically halt software research that uses existing compute. Conversely, a restriction that delays data-center hardware could postpone deployment even if engineers continue improving models on already-installed systems.
Pressure to diversify production
A broad or persistent restriction could encourage buyers to source from multiple countries, redesign products to use different materials and support domestic or allied capacity. Building and qualifying that capacity takes time. The official notices establish the controls and their stated policy objectives; they do not establish how quickly alternative capacity would replace affected Chinese supply.
China’s measures and U.S. controls are different policies
It is easy to combine separate restrictions into one supposed ban. They address different flows of goods and technology.

BIS described high-bandwidth memory (HBM) as critical to AI training and inference at scale. That statement illustrates how controls on production capability and memory can affect the same AI ecosystem from a different direction. It should not be used to infer that China’s rare-earth rules cover all HBM or all accelerator products.

The consequences change dramatically depending on the breadth of a measure. The following comparison is an analytical framework, not a forecast of measured outcomes.

How an AI hardware buyer can assess exposure
- Map the bill of materials. List every material, subassembly and manufacturing input, not just the final branded component. Include magnets, targets, specialty alloys, testing inputs and replacement parts.
- Trace origin and processing. Record where each item was extracted, refined, smelted, converted, assembled and tested. A product made outside China may still require review if it contains qualifying Chinese-origin listed material or uses a specified Chinese technology.
- Classify the exact item. Compare the product’s technical description and tariff or export-control classification with the listed categories. Do not classify an entire server fleet from the name of one component.
- Document customer and destination. Identify the legal purchaser, final user, delivery country and any re-export route. Notice 2025 No. 61 makes end user and end use relevant to approval.
- Describe the end use precisely. Separate ordinary commercial inference, scientific research, semiconductor production and applications with possible military relevance. Vague descriptions make licensing decisions harder.
- Check the applicable date. Determine whether the item is covered by rules that applied on publication or by foreign-made-item provisions scheduled for December 1, 2025. Keep the analysis current because implementation can change.
- Ask suppliers for evidence. Request origin statements, material percentages, process information and license status in writing. Preserve the records used for the classification decision.
- Plan a substitute before a shipment fails. Identify technically compatible sources, estimate qualification testing and decide how much safety stock is justified. A substitute that has not been validated is not an immediate replacement.
Which parts of the AI stack are most sensitive?
Semiconductor manufacturing inputs
Inputs used to make, test or maintain advanced chips can have an outsized effect because a missing process material or piece of equipment can constrain an entire production line. The notice’s references to logic chips at 14 nanometers or below, memory at 256 layers or above and related equipment identify categories for individual review, not a complete list of every vulnerable input.
Memory and interconnect hardware
Large-scale AI systems depend on memory, packaging, power delivery and high-speed interconnects as well as the accelerator itself. A restriction affecting one of those layers could reduce the number of systems delivered even if accelerator designs remain available. The available official materials provide no measured estimate of how many units would be affected.

Rare-earth magnets and related materials can be embedded in cooling, motion, power or manufacturing equipment. Their presence does not by itself prove that an AI product is controlled; the listed material, value threshold, production technology and destination must be checked together.
What determines whether the impact is small or severe?
- Criticality: Is the item essential to a process, or can the system operate without it?
- Licensing policy: Are permits routinely approved, delayed or denied for the relevant end use?
- Substitute availability: Are technically equivalent sources already qualified?
- Qualification time: Can a replacement be certified in days, or does it require months of reliability and safety testing?
- Inventory: How long can existing stock cover production?
- Geographic scope: Does the rule affect one route, a supplier’s entire export market or multiple re-export hubs?
- Duration: A short licensing delay and a multiyear prohibition create different planning problems.
Because these variables are unknown for most products, the available evidence cannot support a single percentage for slower AI progress, a universal accelerator shortage or a fixed delay to new data centers.
What the evidence does—and does not—show
The documented measures show a targeted licensing framework, listed rare-earth forms and case-by-case scrutiny for certain advanced-chip and potential-military-use applications. They also show that U.S. controls separately target semiconductor equipment, software and HBM transfers to China.
They do not quantify changes in model-training capacity, accelerator prices, compute availability, research progress or deployment dates. Any article or forecast assigning a precise loss of AI capacity to these rules would need additional, product-level supply, licensing and substitution data.
