If your home remains unsold, you usually still owe the listing-preparation or bridge loan under the repayment schedule you signed. The failed sale does not automatically erase the balance, extend the maturity date, or transfer the house to the lender. Your note and any separate preparation, listing, extension, or purchase-offer agreement determine what happens next.
Some providers publish a specific fallback. For example, Knock says a customer whose home has not sold on the market within six months may choose its upfront Knock Purchase Offer. That is a company-specific contractual option, not a general feature of bridge loans. Read the executed documents and obtain written payoff and extension terms before the due date.

What a failed listing means for the loan
A listing-preparation loan advances money for work intended to help sell an existing home, often alongside a short-term bridge loan that covers carrying costs. The loan is still a credit obligation after the listing expires, is withdrawn, or fails to attract an acceptable offer. The legally important dates and remedies are in the signed note and related agreements, not in the fact that the property was listed.

- When is the money due? Find the maturity date, required monthly payments, interest-only period, and any final balloon payment.
- What does the balance include? Check interest, origination charges, preparation advances, inspection or administration fees, late charges, and any amounts added to principal.
- What secures the debt? The collateral may be the old home, the new home, both properties, or another pledged asset. The agreement should explain how a sale, refinance, or payoff releases liens.
- What happens after a missed deadline? Default provisions can trigger late fees, acceleration of the full balance, collection activity, foreclosure or other lien remedies, and possible liability for a remaining deficiency, subject to the contract and applicable state law.
A lender is not required to postpone repayment merely because the market is slow. Any grace period, maturity extension, workout, or conversion to another product must be offered under the agreement or approved in writing by the lender or servicer.

How provider-specific purchase offers fit in
Knock’s published fallback
Knock’s FAQ describes a Bridge Loan intended to help a customer buy a new home while selling the old one. It says that, if the old home does not sell on the market within six months, the customer has the option to exercise an upfront Knock Purchase Offer. The same FAQ says Bridge Loan proceeds can pay the old mortgage for up to six months. It also states that up to $35,000 of the total Bridge Loan may be used for preparation such as cosmetic upgrades or landscaping.
Those statements describe Knock’s published program, not every listing-preparation loan. The actual offer, state availability, eligibility rules, valuation method, deadlines, net-price calculation, and treatment of existing liens must be confirmed in the documents supplied to the borrower. An “option” may require an affirmative election by a particular date; it should not be assumed to happen automatically.

Questions to ask before relying on a purchase offer
- Is the offer optional or mandatory once the marketing period ends?
- What event starts the six-month or other deadline: the loan closing, the listing date, or another date?
- How is the purchase price calculated, and which repairs, commissions, taxes, liens, loan payoffs, or service charges are deducted?
- Does accepting the offer pay the entire bridge balance, or could a remaining amount still be due?
- What inspections, listing activity, preparation work, price changes, or cooperation requirements must be documented?
- What happens if the home is under contract, has an offer below the required price, or cannot close by the deadline?
Knock separately describes an “Upside Guarantee” that depends on conditions such as listing and preparation requirements. A resale-proceeds guarantee is different from the terms that determine when and how the bridge loan itself is repaid.

Temporary bridge-loan ability-to-repay exemption
Under Regulation Z, a temporary or bridge loan with a term of 12 months or less can be exempt from specified ability-to-repay requirements in 12 CFR 1026.43(c) through (f). The Consumer Financial Protection Bureau gives an example involving financing a new dwelling while the borrower plans to sell the current dwelling within 12 months.

This is a qualification rule about a creditor’s underwriting obligations. It is not a promise that the debt disappears when the old property does not sell, and it does not set the maturity date, interest rate, collateral, or default remedy for an individual contract. Whether the exemption applies depends on the transaction’s structure and governing law.
Ability-to-repay rules for covered transactions
For transactions covered by the general rule, the creditor must make a reasonable, good-faith determination at or before consummation that the consumer can repay according to the loan terms. The rule also says the assessment cannot rely on the assumption that the consumer can repay only by refinancing later or selling the property securing the loan. These provisions do not decide whether a particular listing-preparation product is covered or how a specific dispute will be resolved.

Payoff-statement timing
When a consumer credit transaction is secured by a dwelling, the applicable creditor, assignee, or servicer generally must provide an accurate payoff statement within a reasonable time and no more than seven business days after receiving a written request. Send the request early, identify the property and loan number, and ask for the amount good through a stated date. Keep proof of delivery and the response.
Read the documents before the listing deadline
Gather the complete closing package rather than relying on a marketing page or verbal explanation. The note may be separate from a bridge agreement, home-preparation agreement, listing contract, purchase-offer document, or deed of trust. Compare each document for conflicting dates and definitions.

Document-review checklist
- Mark the maturity date, payment dates, daily interest method, and whether interest accrues on undisbursed or preparation funds.
- List every one-time and recurring fee, including extension, draw, inspection, servicing, late-payment, and payoff charges.
- Identify the borrower, lender, servicer, guarantor, and every property or asset pledged as security.
- Find notice requirements for an extension, payoff, sale, or exercise of a purchase option. Note whether notice must be written and how many days in advance it is due.
- Read default and acceleration language, cure periods, attorneys’ fees, collection costs, and provisions governing foreclosure or other enforcement.
- Check how sale proceeds are applied: first to taxes and commissions, then liens, fees, accrued interest, principal, or another order.
- Look for restrictions on renting the home, changing the listing price, pausing marketing, making additional repairs, or accepting an offer without lender consent.
Use the federal disclosure forms as a cross-check
For a mortgage application, the Federal Trade Commission says the consumer receives a Loan Estimate after applying and a Closing Disclosure before closing. The Closing Disclosure shows final terms, projected payments, fees, and other costs. Compare those figures with the note and settlement statement, and question discrepancies before signing. Once the closing documents are signed, the borrower is legally responsible for repaying the loan.

- Calculate the dates. Put the contractual maturity, next payment, listing expiration, purchase-offer deadline, and expected closing date on one calendar. Treat the earliest binding deadline as the urgent one.
- Request a written payoff quote. Ask the creditor or servicer for principal, accrued interest, fees, per-diem interest, lien-release charges, and the quote’s expiration date. Request it in writing so the federal timing rule can apply where the transaction is covered.
- Contact the lender before default. Ask for an extension, revised payment plan, sale-delay accommodation, refinance process, or other workout. Request eligibility criteria, cost, approval authority, and the date by which an application must be submitted.
- Document the marketing effort. Keep listing records, price-change approvals, showing logs, repair invoices, photographs, inspection reports, and written communications. These may be conditions of a provider’s fallback or extension.
- Model several exit paths. Compare a normal sale, an accepted lower offer, a provider purchase option, a refinance, additional cash, and a delayed sale. For each, subtract commissions, taxes, liens, accrued interest, and fees from the expected proceeds.
- Get professional help for a shortfall. A housing counselor, attorney, or qualified tax professional can review state-specific lien, deficiency, foreclosure, bankruptcy, and tax consequences. Ask the lender for written answers rather than relying on a salesperson’s assurances.
Possible outcomes and their trade-offs
| Situation | What may happen | What to verify |
|---|---|---|
| Sale closes before maturity | Closing proceeds are applied according to the payoff statement and lien instructions. | Quote expiration, per-diem interest, release fees, and the exact order of deductions. |
| Sale is pending but maturity arrives first | The lender may require payoff, approve an extension, or place the loan into default if no agreement is reached. | Written extension terms, approval deadline, added interest, fees, and whether the listing contract satisfies conditions. |
| No acceptable offer | The borrower remains responsible under the note; a provider-specific purchase option may be available if its conditions are met. | Election deadline, valuation, net proceeds, liens, and whether the option fully satisfies the debt. |
| Borrower cannot make payments | Late charges, acceleration, collection, or lien-enforcement remedies may follow after any contractual cure period. | Notice method, cure period, collateral, state protections, and the amount needed to reinstate. |
| Refinance or replacement loan | A new lender may pay off the bridge balance, but the borrower takes on new underwriting, fees, rate risk, and collateral terms. | Total interest, closing costs, prepayment charges, maturity, and whether income and equity qualify. |
How to compare an extension, refinance, or purchase offer
Compare alternatives on the same written, after-cost basis. A lower monthly payment can still be more expensive if it extends the term or capitalizes unpaid interest.
| Comparison point | Why it matters |
|---|---|
| Due date and extension rights | Determine whether the option prevents a default and how early approval is required. |
| Total payoff | Include principal, interest through the expected closing date, origination charges, extension fees, and release costs. |
| Collateral and remedies | Understand which property is at risk and what happens after acceleration or a shortfall. |
| Payment obligations during marketing | Some loans require scheduled payments while others accrue interest for a later payoff. |
| Fallback conditions and net proceeds | A headline purchase price is not the cash available after liens, commissions, taxes, and program charges. |
| Eligibility and geography | Provider programs, state rules, property types, and borrower qualifications can vary. |
If considering a refinance or another loan, the Office of the Comptroller of the Currency advises contacting several lenders and comparing offers. Borrowers facing financial difficulty can also consider reputable credit or budget counseling. Do not take a higher-cost loan merely to postpone a decision without a credible repayment plan.
Common mistakes that increase the balance
- Waiting for an automatic extension: Silence rarely changes a contractual maturity date. Start discussions weeks before it.
- Relying on a verbal promise: Ask for a signed amendment or written approval identifying the new due date and all costs.
- Confusing a listing guarantee with debt relief: A promise about resale proceeds may have conditions and may not alter loan repayment.
- Ignoring lien and commission deductions: A sale price can exceed the loan balance while net proceeds remain insufficient.
- Stopping payments without advice: A disputed fee or delayed sale does not necessarily suspend payment duties.
- Using preparation funds without records: Keep invoices and approvals when the agreement limits eligible work or requires proof.
When to escalate for legal or housing advice
Obtain individualized advice if the lender threatens foreclosure, the payoff exceeds expected sale proceeds, multiple properties secure the debt, a deficiency is possible, or the purchase-offer agreement conflicts with the note. State law can affect foreclosure procedure, deficiency liability, lien priority, rescission rights, and consumer protections. A counselor or attorney can also help evaluate whether an extension, short sale, refinance, or negotiated settlement is realistic.
The safest immediate action is written: request the payoff, confirm the maturity date, ask what options are available before default, and preserve every response. That record gives you a factual basis for choosing the least costly exit permitted by your agreements.
