What Happens to a GST Appeal If You Cannot Pay the Pre-Deposit? Rules, Exceptions and Next Steps (2026)

In most first appeals under section 107 of India’s Central Goods and Services Tax Act, not having the money does not remove the pre-deposit condition. The appellant normally must pay all admitted dues and the statutory percentage of disputed tax before the appeal can be entertained. Recent High Court decisions do not recognize financial hardship alone as a general waiver. The result can be different if the case involves a penalty-only order, a transition-date issue, or a payment that was attempted but not properly debited.

The direct answer: an unpaid pre-deposit can block the appeal

Section 107(6) of the CGST Act makes payment a condition for filing a first appeal. The appellant must pay two components:

  • the full amount of tax, interest, fine, fee and penalty that the appellant admits; and
  • the statutory pre-deposit on the remaining disputed tax.

For an ordinary tax-demand appeal, the materials considered by the Delhi High Court and the GST Council report a pre-deposit of 10% of the disputed tax, subject to the ceiling in the applicable statutory text. The Finance (No. 2) Act, 2024 changes to sections 107(6)(b) and 112(8) were recorded as taking effect on 1 November 2024. Because the ceiling and consolidated wording must be checked against the law governing the particular appeal, do not calculate solely from an old order, a tax-software screen or a pre-2024 explanation.

If the required amount is not paid, the appellate authority can treat the statutory condition as unsatisfied and decline to entertain the appeal on its merits. A statement that the demand is wrong, or that the business is waiting for receivables, does not by itself replace the payment required by section 107(6).

What the two payment components mean

Component What is paid How to identify it What happens if it is omitted
Admitted amount All admitted tax, interest, fine, fee and penalty Amounts the appellant accepts in the order or appeal papers The statutory filing condition is not met, even if the disputed-tax percentage was paid
Disputed-tax pre-deposit For ordinary tax-demand appeals, 10% of the disputed tax, subject to the applicable ceiling Tax being challenged, not the entire demand including amounts already admitted The appeal may not be entertained until the required deposit is made

Keep a calculation sheet that separates tax from interest, fine, fee and penalty. The percentage is applied to the disputed tax component under the applicable provision; it is not automatically a percentage of every line in the demand order. The order type and the current version of section 107(6) matter.

Why financial hardship usually does not create a waiver

Impressive Data Services: hardship was not treated as a waiver power

In Impressive Data Services, the taxpayer argued that the demand was incorrect and referred to substantial receivables and securities held by government entities. The Delhi High Court considered whether the statutory deposit could be excused in the appeal petition. It treated section 107(6) as a legislative condition, not as a discretionary amount that the appellate authority could waive whenever payment would be difficult. The court did not decide the underlying tax dispute in that proceeding.

The practical lesson is narrow but important: a strong merits case and serious cash-flow pressure are not the same thing as a legal exception to the pre-deposit requirement.

Jiolat Auto Gas Industries: mandatory deposit and limited liberty

In Jiolat Auto Gas Industries, the petitioner asked the Delhi High Court to waive the mandatory 10% deposit. The court dismissed the waiver request, describing the deposit as mandatory. It left the petitioner free to approach the appellate authority for relief in terms of observations made in Impressive Data Services. That liberty is not a ruling that inability to pay entitles a taxpayer to waiver, instalments or a guaranteed alternative remedy. Any relief still depends on the facts, the statutory power available and the order made by the authority.

Accordingly, an application should identify a specific legal basis rather than simply state that the business has no funds. A general hardship plea, without a distinct statutory or procedural error, has not been accepted in these decisions as a universal exception.

First classify the order before deciding what to do

Case type Key question Rule or issue highlighted by the decisions
Ordinary tax-demand order How much tax is admitted, and how much tax is disputed? Pay admitted dues plus the ordinary disputed-tax pre-deposit, reported as 10% subject to the statutory ceiling
Penalty-only order Does the order impose a penalty without a tax demand, and when did the adjudicatory process begin? A separate penalty-only proviso applies from 1 October 2025; transition can be fact-specific
Attempted payment Were funds deposited but not debited or otherwise linked to the appeal? A procedural defect may require notice and an opportunity to cure; this is not the same as having no funds

Do not choose the applicable percentage from the label used by a portal or a consultant. Read the demand order, the show-cause notice, the order date, the payment challan and the appeal form together.

Penalty-only appeals and the 1 October 2025 change

The ordinary disputed-tax rule must be distinguished from an order imposing a penalty without a tax demand. The GST Council’s 55th-meeting agenda recorded a recommendation to add a 10% deposit for penalty-only orders. The Delhi High Court’s 31 July 2026 judgment in Gaurav Jain described the substituted proviso as effective from 1 October 2025.

The same judgment addressed petitioners whose adjudicatory proceedings began with a show-cause notice dated 25 June 2025. On those facts, the court held that the new penalty-only requirement did not govern their appeals. The holding turned on the transition issue and the procedural history before the court; it is not a blanket exemption for every proceeding that began before 1 October 2025.

The judgment also stated that admitted amounts remained payable. Therefore, a taxpayer cannot treat a penalty-only classification as permission to leave admitted tax, interest, fee or other admitted sums unpaid.

Documents that matter in a transition dispute

  • the date and contents of the show-cause notice;
  • the date on which adjudication commenced and the date of the order;
  • whether the order contains any tax demand or is penalty-only;
  • the version of section 107(6) and its proviso applicable on the relevant dates; and
  • the payment and appeal records showing what was admitted and deposited.

Present these dates in a one-page chronology. A court or appellate authority must be able to see the transition question without inferring it from scattered annexures.

When money was put in the cash ledger but not debited

Ssukrit Forwarding Agency, decided by the Jharkhand High Court, involved a taxpayer that had deposited funds into its electronic cash ledger but had not debited the amount as the appeal pre-deposit. The court considered that the record could show an attempted payment and a procedural glitch rather than complete non-payment. It held that natural justice and fair play required notice of the defect and a reasonable opportunity to cure it before dismissal.

This distinction is critical:

  • Attempted payment: money is traceably credited, but the required debit, mapping or confirmation is missing. Ask the authority to identify the defect and allow correction, attaching challans, ledger entries, transaction IDs and screenshots.
  • Inability to pay: the taxpayer has not funded the required amount. The attempted-payment reasoning does not automatically apply.

Do not assume that a positive cash-ledger balance is itself the statutory pre-deposit. Confirm that the amount was debited in the manner required for the appeal and that the portal generated the relevant acknowledgement.

What normally happens after non-payment

  1. The appeal is checked for compliance. The appellate authority or portal examines whether admitted dues and the prescribed deposit are shown.
  2. A defect may be recorded. Depending on the procedure and record, the authority may issue a deficiency or rejection communication. Preserve the date and exact reason.
  3. The appeal may not be heard on merits. If the statutory condition remains unmet, the authority can refuse to entertain the challenge instead of deciding whether the tax demand is correct.
  4. A later challenge must target the real legal issue. A petition that merely repeats financial hardship is materially weaker than one showing a payment-system defect, an incorrect classification, or a transition error supported by documents.

The current limitation text is not stated here; check the consolidated section 107 and the communication date of the order before taking any step. Do not assume that a defect notice, a writ petition or a request for waiver automatically stops the appeal clock.

When a High Court petition may be relevant

Judicial review can be relevant where the complaint is a distinct legal error: for example, the authority applied a penalty-only proviso to a proceeding governed by an earlier legal regime, or it dismissed a traceable attempted payment without giving a reasonable chance to cure a procedural defect. The decisions considered here do not support using a writ petition as a routine substitute for paying the statutory deposit.

Frame the proposed intervention precisely:

  • identify the statutory provision and version relied upon;
  • state whether the case concerns classification, transition, calculation or payment processing;
  • attach the order, notice, appeal form, challan and ledger evidence in date order; and
  • explain the specific relief sought, such as reconsideration after notice, rather than assuming a court will cancel the deposit.

A court’s willingness to examine a legal error does not guarantee a stay, waiver or decision on the tax merits. Those are separate requests requiring separate grounds.

A practical action plan if you cannot fund the deposit today

1. Recalculate the amount from the order

Mark each line as admitted or disputed. Separate tax, interest, fine, fee and penalty. For an ordinary tax-demand appeal, apply the reported 10% figure only to disputed tax and check the current ceiling and wording before payment.

2. Check whether the order is penalty-only

Read the operative part, not just the department’s description. If no tax demand is imposed, record the show-cause notice date, adjudication date and order date and assess the 1 October 2025 proviso with advice specific to those facts.

3. Audit every payment attempt

Download the electronic liability ledger, cash ledger, challan, debit entry, transaction reference and appeal acknowledgement. A credit without the required debit may support a curing request; it does not prove that the appeal condition was completed.

4. File a focused representation

Ask the appellate authority to record the defect and provide a reasonable opportunity to cure if the issue is procedural. If the issue is hardship alone, state the cash-flow facts honestly but do not present them as an established waiver right.

5. Obtain case-specific advice quickly

A qualified GST practitioner can verify the current consolidated provision, ceiling, portal procedure, limitation position and whether a transition argument is viable. Give that adviser the complete chronology and payment evidence rather than only the demand summary.

Common mistakes that make the position worse

  • Paying a percentage of the total demand without identifying admitted and disputed tax.
  • Assuming an amount sitting in the cash ledger is automatically a completed pre-deposit.
  • Calling every order “tax demand” and overlooking the penalty-only proviso.
  • Relying on a pre-1 November 2024 explanation of the percentage or a pre-1 October 2025 explanation of penalty-only appeals.
  • Filing a hardship affidavit without identifying a statutory, transition or payment-process ground.
  • Waiting for a waiver decision without checking the applicable filing and limitation requirements.
  • Leaving admitted amounts unpaid while disputing only the balance.

How to compare your facts with the reported decisions

Use four columns in your internal case note: order type, dates and procedural history, what was paid and how, and the legal basis for intervention. An ordinary tax-demand case with no payment is materially different from Ssukrit Forwarding Agency, where funds had been deposited but not debited. A penalty-only case around 1 October 2025 must be analysed separately from the hardship requests considered in Impressive Data Services and Jiolat Auto Gas Industries.

The safest conclusion from these authorities is limited: inability to pay, standing alone, has not been established as a general waiver of section 107(6). Your prospects depend on proving that a different rule applies or that the required payment was actually attempted and mishandled.
