In England, a developer generally has three choices after a planning application is refused: change the proposal and submit a revised application, appeal the refusal within the applicable deadline, or stop pursuing the site. None guarantees permission.
The correct next move depends on the refusal reasons, the development-plan policies cited by the local planning authority, the evidence available, and the deadline on the decision notice. The process described here is England’s planning system; Scotland and other jurisdictions use different rules.

What a “permit rejection” means for a data center
This article addresses refusal of planning permission in England. A data center may also require other approvals—for example, infrastructure, environmental or utility consents—but the official material covered here concerns the planning application and its decision notice. Those other approvals can have separate deadlines and appeal routes.
A refusal is a formal planning decision, not a finding that the project can never be built. The local planning authority has decided that the application, as submitted, does not satisfy the relevant planning policies or other material considerations. The decision notice should identify the application, the refusal reasons and the date from which any appeal period runs.

There is no official national statistic establishing how many refused data center schemes are later redesigned, win an appeal, are abandoned or are built. Do not infer project outcomes from the Planning Inspectorate’s administrative performance targets.
The first actions after the refusal
- Obtain and analyse the decision notice. List every refusal reason, the policy or guidance cited, and any conditions or information the authority says was missing. A data center should not be redesigned around assumed objections; the notice is the starting evidence.
- Check the application history. Gather the submitted plans, environmental material, transport and infrastructure statements, consultation responses and correspondence. Mark which issues are factual errors, which could be corrected by design changes, and which involve a fundamental policy conflict.
- Re-engage the local planning authority. England’s planning guidance advises applicants to discuss whether changes could make the proposal acceptable. Ask what scope the authority considers capable of addressing the stated reasons, while recognising that informal discussions do not amount to a grant of permission.
- Calendar the appeal deadline immediately. Most English planning appeals must be received within six months of the decision notice, but shorter periods apply to some application types and a 28-day period can apply in specified enforcement-notice cases. The decision notice and current GOV.UK guidance control; do not rely on the six-month period without checking.
- Preserve the evidence and obtain proportionate advice. A planning professional can test the policy interpretation, technical evidence and procedural route. If an appeal is contemplated, assemble the documents needed before the deadline rather than assuming more time will be available later.
The current starting points are the GOV.UK appeals guidance and the Planning Inspectorate’s procedural guide. The latter applies to applications submitted on or after 1 April 2026; older applications may be governed by the previous guide.
The three possible directions
1. Submit a revised planning application
A revised application is normally the route when the scheme itself must change: for example, its siting, layout, scale, appearance, access arrangements or infrastructure strategy. The applicant can redesign the proposal, add supporting material and ask the authority to assess the new submission on its merits. The authority’s pre-application view is informative, not binding, and the revised application can still be refused.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitches2. Appeal the refusal
An appeal is appropriate when the applicant has defensible grounds that the authority misapplied policy, misunderstood the evidence, acted unlawfully or otherwise reached the wrong planning decision. It is a challenge to the refusal that was made; it is not simply a second opportunity to submit a materially different project.

3. Stop pursuing the proposal
The developer may decide that redesign, delay, cost, grid or water constraints, financing or other commercial factors make the project uneconomic. Abandonment is a business decision, not a planning outcome required by the refusal. A later proposal for the site would need to follow the rules applicable at that time.
When a revised application is the better fit
Use the refusal reasons as a design brief
Translate each reason into a specific change or evidence package. If the authority objects to the relationship between buildings and nearby uses, the response might involve a different site arrangement, height, massing, landscaping or buffer. If the concern is transport, the applicant may need a revised access design and updated traffic evidence. The exact remedy depends on the notice; there is no universal list of data-center objections.
Know when a new application is required
The 2026 procedural guide says that where an applicant believes new evidence or an amendment would overcome the refusal, the applicant should submit a revised planning application. An appeal should not be used to introduce a fundamentally changed scheme under the guise of additional evidence. The authority will determine the new application under the policies and material considerations relevant to it.
Recheck the whole evidence base
Changes to a large facility can affect several disciplines at once. Coordinate drawings, land-use plans, access and traffic material, water and power assumptions, landscaping, visual information and the description of the intended use. Make clear which evidence is new, which has been updated and which remains valid. Follow the authority’s application requirements and any current validation checklist.

How an appeal works in England
Confirm eligibility and the deadline
Read the decision notice and the current guidance before selecting an appeal route. Most appeals must arrive within six months, while specified categories have shorter limits. Enforcement-related cases can have a 28-day period. Missing the applicable deadline can remove the appeal option, so treat the date as a hard project milestone and retain proof of submission.
State grounds directed at the refusal
An appeal should explain why the decision should be changed, addressing each refusal reason and the relevant development-plan policies. It should identify errors in the authority’s interpretation, factual misunderstandings, procedural issues or material considerations that support permission. The appeal decision-maker considers the planning merits; filing an appeal does not suspend the need to comply with other legal requirements.
Expect the Planning Inspectorate to choose the procedure
The Planning Inspectorate may determine an appeal by written representations, a hearing or an inquiry. For eligible applications submitted from 1 April 2026, most appeals use the Part 1 written-representations procedure, although some are transferred to another procedure. A hearing or inquiry involves a more structured opportunity to test issues, but the guide sets different evidence and timetable rules for those procedures.
Understand evidence limits in Part 1
In the expedited Part 1 written procedure, new evidence is generally limited. The guide allows an exception where there has been a material change in circumstances, but that exception is not a general invitation to repair a weak application. Existing representations made at the application stage are forwarded under Part 1, and the guidance says further representations are not accepted at the appeal stage. Other procedures have their own arrangements for statements, documents and participation.

Know who decides and what can happen
Most appeals are decided by a Planning Inspector. A recovered appeal can instead be decided by the Secretary of State. The decision is based on the planning merits, the development plan and other relevant circumstances. The appeal can be allowed, enabling permission or another specified outcome, or dismissed, leaving the refusal in place. The decision-maker is not confined to the local authority’s wording and may refuse permission for different planning reasons.
Interpret the timetable correctly
GOV.UK guidance updated 2 April 2026 states Planning Inspectorate targets of 98% of written-representation appeals within 16–20 weeks and 98% of hearings and inquiries within 24–26 weeks, with work toward those targets by 2027. These are service targets, not guarantees and not statistics showing how many refused data center projects proceed. Complex cases, transfers between procedures and procedural issues can affect timing.
Consider costs exposure
An appeal can require planning, legal and technical work. The official guidance warns that a party pursuing an appeal unreasonably and without sound grounds may face an award of costs. That risk makes a documented assessment of the refusal reasons and prospects important before filing. Cost consequences are case-specific; this article is not individual legal advice.

Revised application or appeal?
| Question | Revised application | Appeal |
|---|---|---|
| Does the scheme need to change? | Yes, this route is designed for amendments, redesign or a materially improved evidence package. | Not normally. The appeal challenges the refusal of the submitted scheme; a substantially different proposal should generally be a new application. |
| What must the applicant show? | That the revised proposal addresses the authority’s reasons and complies with applicable policy and material considerations. | That the refusal should be changed on its planning merits, based on sound grounds directed to the decision. |
| Deadline | The new application follows the authority’s application and validation rules; a new application does not preserve an appeal deadline. | Usually six months from the decision notice in England, with shorter periods for some cases and 28 days in specified enforcement cases; verify the notice and current guidance. |
| Evidence | New plans and supporting evidence can be prepared for the revised submission, subject to validation and consultation requirements. | Evidence depends on the procedure. Part 1 generally limits new evidence, with an exception for exceptional material changes in circumstances. |
| Procedure and timing | Determined by the local planning authority under the application process. | Planning Inspectorate selects written representations, a hearing or an inquiry; published targets are not guarantees. |
| Main uncertainty | The authority may still refuse, and redesign can affect cost, land agreements, infrastructure and programme. | The appeal may be dismissed, or permission may be refused on different grounds; unreasonable pursuit can create costs exposure. |
What planning issues can lead to refusal?
England’s planning-permission overview says an authority may assess a proposal against the development plan and consider the building’s size, layout, siting and appearance; available infrastructure such as roads and water supply; landscaping; intended use; and effects on the surrounding area, including increased traffic. These are assessment factors, not a standard data-center refusal checklist. The actual decision notice controls.

For that reason, a developer should avoid generic claims that a project was rejected because of electricity demand, noise, water use, emissions or traffic unless the notice and evidence say so. A technically strong response to the wrong issue will not cure the refusal. The authority’s policy reasoning should be mapped line by line to the proposed remedy or appeal ground.
The official overview of what happens after an application is decided is available at GOV.UK’s planning-permission guidance.
How jurisdiction changes the answer
Planning law is not uniform across the United Kingdom. The deadlines, decision-makers, evidence rules and appeal procedures described above are for England. Scotland has a separate planning system. A Scottish Government Directorate for Planning and Environmental Appeals record concerns a proposed green data centre, but the accessed record does not establish the case’s outcome; it should not be used as evidence that a Scottish project succeeded or failed. The record is available at the Scottish case page.
For a project outside England, identify the relevant planning authority and national appeal body before applying the English six-month assumption or Part 1 terminology. Wales and Northern Ireland also have their own planning arrangements.
A practical decision framework for the project team
- Classify the refusal. Is the problem a fixable design or evidence issue, a disagreement about policy interpretation, a procedural defect, or a fundamental conflict with the site’s planning framework?
- Test the remedy. Ask whether the proposed change would alter the description of development, plans, environmental effects, access or infrastructure enough to require a fresh application.
- Protect both routes while deciding. Start discussions with the authority, but calculate the appeal deadline independently. Pre-application engagement does not extend an appeal period.
- Build an evidence matrix. For every refusal reason, record the cited policy, the authority’s factual premise, the available counter-evidence, the proposed change and the person responsible for preparing it.
- Choose a procedure-aware strategy. If an appeal is likely to be Part 1 written representations, submit a focused case that fits the evidence rules. Do not assume a hearing will be granted or that new material can be added later.
- Record the commercial decision. Compare redesign cost, delay, land-control expiry, grid and water availability, financing conditions and the probability of securing permission. If those factors make the scheme uneconomic, stopping may be rational even where an appeal is legally available.
Common mistakes after refusal
- Missing the deadline while negotiating. Discussions with the authority do not replace a timely appeal submission.
- Using an appeal to submit a new project. Where amendments or new evidence would overcome the refusal, the 2026 guide directs applicants toward a revised application.
- Repeating the application without addressing the notice. A new title or minor drawing change will not answer a policy conflict that remains unchanged.
- Assuming the inspector only reviews the authority’s wording. The appeal decision-maker can reach a different planning conclusion and rely on different refusal grounds.
- Treating target weeks as guaranteed outcomes. Planning Inspectorate targets describe administration, not the likelihood that a data center will receive permission.
- Applying English rules elsewhere. Confirm the jurisdiction, national guidance and decision body before selecting a route.
Bottom line
After an English planning refusal, the project team should read the decision notice, identify whether the scheme can be made acceptable, and protect the applicable appeal deadline. A revised application is the normal vehicle for a materially changed proposal; an appeal tests whether the refusal was wrong on its planning merits; abandoning the project remains a commercial option. The refusal is therefore a decision point, not an automatic end—and neither route guarantees permission.
