What Happens If You Miss a GST Return Deadline in India?

Missing a GST return deadline in India does not remove the obligation to file. You may owe a late fee; if tax remains unpaid, interest may also accrue. Continued non-filing can lead to a return-defaulter notice, a best-judgment assessment, and—in persistent cases—action affecting your GST registration. The exact consequences depend on the form, tax period, filing frequency, state or union territory, unpaid tax, and any applicable notification or waiver.

The first step is to identify the overdue form and period, then check your GST Portal account for outstanding returns, notices, and period-specific liabilities. A nil period is not automatically an exception to filing. File in the required sequence, review the amounts shown, and respond to any notice or order by its stated deadline.

First identify which GST return is overdue

Different GST forms serve different purposes, so the consequences and filing sequence depend on what you missed. Start by checking the return name and tax period on the GST Portal rather than treating “GST return” as one interchangeable filing.

  • GSTR-1 reports outward supplies. The GST Portal lists the general due date as the 11th day of the succeeding month for monthly filers and the 13th day of the month after the quarter for quarterly filers, subject to government extensions. The portal says GSTR-1 is required even for a period with no business activity. GST Portal returns guidance.
  • GSTR-3B reports the period’s tax liability and is used to pay tax. For QRMP quarterly filers, portal guidance lists the 22nd or 24th day of the month after the quarter, depending on the state or UT group. Notifications may change the due date. GST Portal returns guidance.

These are general dates, not a substitute for checking the due date that applies to your period. Filing frequency matters: a monthly filer and a QRMP quarterly filer do not necessarily follow the same calendar. State or UT grouping also matters for the QRMP GSTR-3B date. Government notifications may extend or change deadlines, so check the portal and relevant period-specific updates before concluding that a filing is late.

GSTR-1 and GSTR-3B are not substitutes for each other. Missing one can affect the ability to file a later period, and portal guidance identifies dependencies involving the previous GSTR-1 and GSTR-3B as well as the same period’s GSTR-3B. Check your GST Portal dashboard for the outstanding periods and required filing sequence rather than assuming you can skip directly to the latest return. A missed GSTR-1 does not become resolved simply because a GSTR-3B has been filed, or vice versa.

What can happen when you file late?

Late fee may be payable

The CGST Act sets a statutory framework for late fees on specified delayed statements and returns. The amount payable for a particular form and period can be affected by return category and government notifications or waivers. There is no single per-day figure that should be treated as guaranteed for every late GST return. Check the liability shown on the GST Portal for the specific form and tax period. CGST Act and rules information from CBIC.

Late fee is distinct from interest. It relates to a delayed filing; it is not a calculation of tax left unpaid. The form, return category and period all matter, as do any applicable relief measures. For that reason, avoid estimating a final amount from a figure quoted for a different return or period. The liability displayed for your own return is the practical starting point, and any notification or waiver relevant to that period may affect what is payable.

Interest may accrue if tax is unpaid

Late filing and unpaid tax are separate issues: interest under section 50 concerns tax that remains unpaid. GSTN says the portal auto-calculates interest for delayed GSTR-3B based on the tax liability discharged and the applicable liability breakup. The calculation is carried into Table 5.1 of a subsequent GSTR-3B, and the system-generated GSTR-3B PDF shows calculation details. Review that calculation against your liability before paying. GSTN interest computation guidance.

This means a nil period and a period with tax due can have different consequences. A missed filing may still attract a late fee even if there was no business activity, while interest is relevant where tax due remains unpaid. Do not assume that paying the tax alone settles a late-fee liability, or that a late fee answers whether interest is due. Review the separate amounts for each outstanding period.

If the system-generated interest calculation appears discrepant, GSTN describes an interest-recomputation control. Compare the system calculation with the liability breakup and the details in the generated PDF, and use the portal’s control where appropriate rather than silently substituting an estimate. Keep the calculation and payment records with your filing acknowledgement.

A return-defaulter notice can follow

The GST Portal says a GSTR-1 filer who misses the due date will receive a system-generated return-defaulter notice in FORM 3A. Separately, section 46 of the CGST Act provides for a notice requiring specified non-filers to file within 15 days. Read the notice you actually received: its form, stage, required action, and stated deadline determine what you must do next. GST Portal returns guidance and CGST Act and rules information from CBIC.

A notice is not a reason to wait until the last day or to assume that filing alone is a complete response. Check which return and period it concerns, what it asks you to do, and the deadline stated in that communication. Section 46 refers to a 15-day period for filing in the circumstances it covers; follow the actual notice rather than applying that period indiscriminately to every message or portal alert.

Continued default can lead to assessment

If a registered person does not furnish a specified return even after a section 46 notice, section 62 allows an officer to make a best-judgment assessment. A valid return filed within 30 days after the assessment order causes that order to be deemed withdrawn, but interest and late fee remain payable. Filing late therefore does not automatically cancel every demand or notice; follow the order and verify your account after filing. CGST Act and rules information from CBIC.

The stage of the matter is important. A return that is simply overdue calls for filing and checking the portal liability. A section 46 notice adds a stated response deadline. An assessment order requires attention to the order and the 30-day rule; it should not be treated as though no formal action has occurred. If you file within the period described in section 62, the assessment is deemed withdrawn, but the continuing late fee and interest obligations still need to be addressed.

Persistent filing defaults can put registration at risk

The CGST Rules provide a show-cause process and require pending returns and applicable liabilities to be addressed when seeking revocation after cancellation for failure to furnish returns. If you receive a cancellation notice or order, follow its specific process and deadlines and obtain case-specific professional advice. CGST Act and rules information from CBIC.

Cancellation is not the same stage as a missed due date or a return-defaulter notice. Do not assume registration has been cancelled merely because a return is late; equally, do not ignore a cancellation communication if one has arrived. The route to revocation after a cancellation for non-filing involves addressing the pending returns and applicable liabilities, so several overdue periods can make the issue more involved than a single late filing.

How to catch up safely

  1. Check the GST Portal dashboard. Identify every unfiled return, its tax period, and any notice. Confirm whether each missed return is GSTR-1, GSTR-3B, or another form, and whether your filing frequency is monthly or QRMP quarterly. Note the state or UT grouping where relevant. The applicable due date can vary by form, frequency, state or UT, and later notification. Make a list of all outstanding periods so that an older return is not overlooked while you focus on the latest one.
  2. File overdue returns in the required sequence. Work from the earliest outstanding period and follow portal prompts about dependencies. A nil period may still require a return: GSTR-1 is required even when there is no business activity. Nil GSTR-3B filing has eligibility conditions, including having no outstanding interest or late-fee liability. GST Portal returns guidance and CGST Act and rules information from CBIC. If the portal prevents a later return, check the outstanding sequence and clear the prior required filing rather than treating the blocked return as optional.
  3. Verify the amounts before payment. Review the late fee and interest displayed for each period, reconcile the system-generated GSTR-3B interest calculation, and pay the tax and other liabilities shown as due. GSTN describes an interest-recomputation control for cases where the system calculation appears discrepant. GSTN interest computation guidance. Keep the period-by-period breakdown so you can distinguish filing fees from interest and tax.
  4. Meet any notice or order deadline. Respond as required by the actual notice or assessment order, and retain filing acknowledgements and payment records. Do not assume that a return submitted after a notice automatically answers every requirement in it. If several periods are overdue or the matter involves assessment, cancellation, or a disputed demand, consult a qualified GST practitioner or tax professional.

When a return has just become overdue, the sensible priority is to identify the exact form and period, file it as soon as the portal permits, and settle the applicable amounts. If an assessment or cancellation process is already underway, add the notice or order deadline to that checklist. Filing promptly can address the outstanding return, but it is not a guarantee that every fee, interest amount, demand, or separate procedural requirement disappears.

Can GSTR-1A fix a missed return?

No. GSTR-1A is an optional facility for adding or correcting same-period records before GSTR-3B is filed; it is not a replacement for a missing GSTR-1. If a later filing is blocked, check the outstanding return sequence on the portal and file the required earlier return rather than treating GSTR-1A as a way around it. GST Portal returns guidance.

The key distinction is that GSTR-1A can be used for specified same-period additions or corrections before filing that period’s GSTR-3B. It does not discharge an obligation to submit a missing GSTR-1, and it is not a general tool for bypassing a dependency between returns. Check the portal status for the relevant period before deciding whether this optional facility applies.

Which details determine your exact liability?

The consequence cannot be calculated from the fact that a deadline was missed alone. Before relying on a due date or amount, establish:

  • the missed form and tax period;
  • whether you file monthly or under QRMP quarterly;
  • your state or UT where the relevant due date depends on a state grouping;
  • whether tax was unpaid, or whether the period was nil;
  • whether you have received a notice, assessment order, or cancellation communication; and
  • whether a period-specific notification or waiver applies.

These details help separate the main scenarios. A missed GSTR-1 and a missed GSTR-3B are different filings, and a nil return is not the same as a return where tax remains unpaid. A person who is simply late has a different immediate task from someone who has received a section 46 notice, an assessment order, or a cancellation communication. Frequency and state or UT grouping can change which general due date applies, while notifications can affect a date or payable amount.

This is a general India-wide explanation, not a calculation for a particular GSTIN. Use the portal’s period-specific liability and the deadline in any notice or order as your immediate reference. If your portal account shows several overdue periods, an assessment, cancellation, or a disputed amount, seek advice based on the actual filings and notices rather than relying on a generic late-fee estimate.

Frequently Asked Questions

What happens if I miss my GST return filing date?

The filing obligation remains. A late fee may apply, and interest may accrue if tax remains unpaid. Non-filing can also lead to a return-defaulter notice and, if it continues after notice, a best-judgment assessment. Persistent defaults may put registration at risk. The exact result depends on the form, period, tax position, filing frequency, applicable notifications and the stage of any notice or order.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I file a GST return after the due date?

Yes. File the overdue return as soon as possible and follow the portal’s required sequence. The portal will show applicable liabilities for the relevant period, and a notice or assessment order may require a separate response. Filing late does not necessarily remove interest, late fee, or every demand.

What is the late fee for GSTR-3B?

There is not one universal amount that applies to every GSTR-3B. The payable fee depends on the return and period, and may be affected by notifications or waivers. Check the GST Portal liability for that specific return instead of relying on a generic per-day figure.

Do I have to file a nil GST return?

A nil period can still require filing. GSTR-1 is required even when there is no business activity. Nil GSTR-3B filing has portal eligibility conditions, including no outstanding interest or late-fee liability.

Will I receive a notice if I miss GSTR-1?

The GST Portal says a GSTR-1 filer who misses the due date will receive a system-generated return-defaulter notice in FORM 3A. Separately, section 46 provides for a notice requiring specified non-filers to file within 15 days. Read the notice you receive and follow its stated requirements and deadline.

What happens if I do not file after receiving a notice?

If a registered person fails to furnish a specified return even after a section 46 notice, section 62 allows an officer to make a best-judgment assessment. A valid return filed within 30 days after the assessment order causes that order to be deemed withdrawn, but interest and late fee remain payable.

Can GST registration be cancelled for not filing returns?

Persistent filing defaults can lead to a cancellation process under the CGST Rules. If you receive a cancellation notice or order, follow its stated process and deadlines. Revocation after cancellation for non-filing involves addressing pending returns and applicable liabilities.

Can I use GSTR-1A instead of filing a missing GSTR-1?

No. GSTR-1A is an optional facility for adding or correcting same-period records before GSTR-3B is filed. It is not a replacement for a missing GSTR-1 or a way to bypass a required return sequence.

The Bottom Line

A missed GST deadline does not erase your filing obligation. Identify the form and period, check the portal for the required filing sequence and exact liabilities, then file and pay what is due. Late fee and interest are distinct, and non-filing can escalate from a notice to assessment or registration action. If you have received a formal notice, assessment order, or cancellation communication, follow its deadline and get case-specific advice.
