What Happens If You Don’t Pay a GST Demand on Time?

If a demand made under the Central Goods and Services Tax (CGST) Act is not paid by its deadline, the tax authority can begin statutory recovery. The ordinary rule is three months from the date an adjudication order is served. The proper officer can set a shorter period when that is expedient in the interest of revenue, but the reasons must be recorded in writing. After the deadline, recovery can reach money owed to you, goods under official control, third parties holding your money, or other assets through the methods listed in section 79 of the CGST Act.

These are legal powers available to the authorities, not a prediction that every measure will be used in every case. The first task is to read the actual order, confirm the service date and deadline, identify each component of the demand, and check whether the liability is adjudicated or self-assessed.

The three-month rule after a GST order

Section 78 of the CGST Act generally gives a taxpayer three months from the date an order is served to pay the amount payable under that order. The clock is tied to service of the order, so preserve evidence of when and how the document was served. An order may specify a shorter period if the proper officer considers that necessary in the interest of revenue. That shorter period should contain the officer’s reasons in writing.

Do not assume that the date printed on the order, the date you downloaded it, or the date an employee first noticed it is automatically the legally relevant date. Compare the order, service record, portal correspondence and any postal or electronic delivery record. If the order itself gives a shorter deadline, treat that date as urgent while obtaining professional advice on whether the direction is valid.

The demand may contain several components, such as tax, interest, penalty, fees or another amount. The amount you need to arrange is the amount legally shown as payable, not an estimate based only on the tax figure in a notice. Reconcile the order with the electronic records maintained for your GST registration.

What recovery can follow non-payment?

Section 79 authorizes one or more recovery methods when an amount payable under the Act remains unpaid. The law lists alternative routes; it does not say that every route will be used in every case.

Recovery method What it can affect What the law allows
Deduction of money owed by government Sums payable to you by the Government or another specified officer The amount can be deducted and applied toward the outstanding GST amount.
Detention and sale of goods Goods belonging to you that are under official control Those goods may be detained and sold, with proceeds applied to recovery.
Notice to a third party Money a person or entity owes you, or holds for you A written notice can require that third party to pay the Government instead of paying you.
Recovery through the district Collector Your recoverable assets under the applicable land-revenue process A recovery certificate can be sent to the Collector for collection as arrears of land revenue.
Application to a Magistrate The unpaid amount as a court-enforced recovery The Magistrate may recover it as if it were a fine.

For example, a government department that owes you money could receive a direction to divert that payment, or a customer that owes you could be served a notice requiring payment to the Government. Goods already under official control can be exposed to detention and sale. These examples describe the reach of the statutory powers; they do not establish that a particular taxpayer will face any one of them.

The deadline and available relief can differ depending on how the liability arose. Two categories should not be treated as interchangeable.

Amount fixed in an adjudication order

This is the situation covered by the ordinary section 78 rule: an order has been served and states an amount payable. Count the applicable period from service, check whether the order records a shorter period, and review whether the order is subject to an appeal, stay or other case-specific direction. The existence, timing and conditions of an appeal or stay cannot be determined from the general framework alone.

Self-assessed tax or interest left unpaid

CBIC Instruction No. 01/2022-GST says unpaid self-assessed tax and associated interest can be recovered under section 79. The instruction specifically discusses tax shown on outward supplies in GSTR-1 but not paid through GSTR-3B as a qualifying self-assessed liability for this purpose. That means a taxpayer should not wait for a fresh adjudication order before taking an unpaid self-assessed amount seriously.

Because self-assessed liability is treated differently from an adjudicated demand, do not automatically apply an instalment description intended for other dues. Establish which return, statement or order created the liability and whether payment was actually posted to the electronic records.

Can you get more time or pay in instalments?

CBIC’s GST FAQ says the Commissioner or Chief Commissioner may, on request, extend the time for payment or permit monthly instalments, up to 24 instalments, for eligible amounts due under the Act. The FAQ also states that this route excludes liability self-assessed in a return and is subject to interest, limitations and conditions.

This is not an automatic entitlement and it is not a general solution for unpaid return tax. The FAQ is an older explanatory publication, so verify the current rule, competent authority, application process and any forms or security requirements before relying on it. A request should be made promptly, with the order, calculation of the outstanding amount, proposed schedule and evidence supporting the request.

The same FAQ says that if an instalment is missed, the remaining balance can become immediately payable. A schedule therefore needs enough cash-flow headroom for every due date; it should not be based on the assumption that one missed payment merely adds a small delay.

A separate 30-day opportunity at the show-cause stage

A demand may begin with a show-cause notice rather than an adjudication order. CBIC’s GST FAQ describes the section 73 route under which payment of tax with applicable interest within 30 days of the show-cause notice can conclude the proceedings without penalty, when the statutory conditions are satisfied.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

This early-payment window is different from the ordinary three-month period that follows service of an order. A taxpayer who has received only a show-cause notice should read the notice’s legal provision, amount and payment instructions carefully. Someone who already has an adjudication order should not assume that the 30-day show-cause opportunity remains open or replaces the section 78 deadline.

How to check that a payment has been credited

GST payment rules provide for payment of tax, interest, penalty, fees and other amounts through the electronic cash ledger. The electronic tax liability register is updated to reflect payment. An accounting entry, bank debit or payment reference by itself is not enough to prove that the demand has been discharged.

  1. Match the document. Note the order or notice number, service date, tax period and each component demanded.
  2. Check the liability register. Compare the demand with the outstanding entries in the electronic tax liability register.
  3. Check the cash ledger. Confirm that the relevant payment was credited and used against the intended liability rather than left as an unapplied balance.
  4. Reconcile differences. Investigate interest, penalty, fees, amendments, credits or appellate relief that make the portal balance differ from the order.
  5. Keep proof. Retain the order, service evidence, payment challan or reference, ledger extracts and correspondence in one case file.

The rules also describe ledger entries when an appellate authority or court grants relief. If a decision changes the amount, check that the electronic liability and cash ledger reflect the relief instead of assuming that the adjustment happened automatically.

A practical response plan when the deadline is close or missed

1. Secure the complete case record

Download the order or notice and collect every annexure, calculation sheet and communication. Record the date and method of service. If several documents exist, build a simple timeline so that the three-month period, any shorter written deadline and any earlier show-cause opportunity are not confused.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

2. Calculate the amount from the order

Separate tax, interest, penalty, fees and other amounts. Do not substitute a self-created calculation for the figure stated in the operative part of the order. If a payment or credit has already been made, identify the ledger entry and the liability against which it was applied.

3. Classify the liability

Decide whether the amount comes from an adjudication order or from self-assessed return liability. Check specifically whether outward-supply tax was declared in GSTR-1 but not paid through GSTR-3B, because CBIC’s 2022 instruction treats that situation as recoverable under section 79.

4. Check for a live legal remedy

Review the order for appeal instructions and any statement about payment, pre-deposit, stay or recovery. The general CGST framework does not establish the deadline, amount or conditions for your individual appeal. A qualified GST professional should assess those issues against the current law and the facts of the case.

5. Pay, or make a documented request

If the amount is undisputed and funds are available, arrange payment before the applicable deadline and verify the ledger posting. If immediate payment is not possible, ask promptly whether a current instalment or extension mechanism is legally available for that type of due. Do not describe a request as approved until the competent authority has issued a written decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

6. Monitor after the deadline

Continue checking official communications and electronic records. Once the payment period has expired, recovery powers under section 79 may be used. Ignoring notices can leave a third party, government debtor or property under official control responding to the authority before you have resolved the underlying account.

Common mistakes that make a GST demand harder to resolve

  • Counting from the wrong date: using the order date instead of the service date, or overlooking a shorter deadline with written reasons.
  • Treating every demand as the same: applying an instalment option described for eligible dues to self-assessed return liability.
  • Paying without reconciliation: assuming a bank debit automatically closes the electronic tax liability register.
  • Waiting for a reminder: section 79 does not require the authority to limit itself to reminders before using a listed recovery method.
  • Assuming recovery is automatic: the law provides several possible routes, but the documents and facts determine what action, if any, is taken.
  • Relying on old guidance without checking currency: the CBIC FAQ describing 24 instalments and the 30-day show-cause route is older material; current consolidated provisions and later instructions must be verified.

What the law does—and does not—tell you

The CGST framework establishes a clear escalation risk: an unpaid amount can move from a payment obligation to formal recovery. It does not, by itself, tell you which method an officer will choose, whether an appeal will stay recovery, what pre-deposit is required, or whether an instalment request will be accepted. Those outcomes depend on the order, service record, liability type, current statutory text and case-specific decisions.

The materials used for this explanation were checked on 13 October 2026. The CGST Act and CBIC explanatory pages include older publications, and later amendments or commencement dates may affect a consolidated text. Before acting on a live demand, compare the latest official law and instructions with the actual order and obtain qualified GST advice.
