If a crypto custodian is hacked, fails financially, or stops withdrawals, you may lose access to some or all of your assets—and recovery is not guaranteed. What happens depends on the custodian’s legal entity and jurisdiction, your agreement, how customer assets were held and recorded, and the applicable insolvency rules. This article focuses on U.S. consumer protections; other countries may have different laws.
What the different failures can mean
A custodian is a third party that holds or controls crypto assets or the keys used to access them. A security breach, insolvency, and service outage can all block access, but they are different events and do not have the same cause or legal consequences.

| Situation | What may happen | What is not assured |
|---|---|---|
| Hack or theft | Keys, systems, or assets may be compromised, and customers may lose access or assets. | That the custodian, an insurer, law enforcement, or the government will reimburse you. |
| Insolvency or bankruptcy | Withdrawals may stop while a court, trustee, receiver, or estate determines which assets belong to customers and which belong to the firm or its creditors. | That customer assets will be returned quickly, or that a customer claim will be treated as ownership of specific assets. |
| Outage or withdrawal pause | You may be unable to access or transfer assets while the service is disrupted or restricted. | Why access stopped, when it will resume, or whether assets are missing. |
The Federal Trade Commission warns that when a crypto platform goes out of business or a wallet is stolen or compromised, “you’re likely to find that no one can step in to help you recover your funds.” That is a general consumer warning, not a prediction about the outcome of a particular case.

An incident might involve stolen private keys, compromised internal systems, or other problems; not every incident has the same cause or outcome. An outage, a regulatory freeze, a withdrawal pause, and insolvency should not be treated as interchangeable. Without knowing the company, its notices, and the reason for the interruption, it is not possible to say when withdrawals will resume or whether assets have been lost.

- Contact the custodian through an official channel that you verify independently, such as contact information on its established website or in prior account documents.
- Secure any credentials that remain under your control. Do not share passwords, private keys, or recovery phrases with anyone claiming they can restore access.
- Save account statements, transaction IDs, withdrawal requests, notices, and communications. Keep copies of relevant records in a secure location.
- Check official company and regulator notices for information about the disruption. If you suspect theft, report it to the relevant authorities.
These steps can help you protect accounts and document what happened; they do not guarantee that assets can be recovered.
What insolvency means for customer assets
Whether customers can recover crypto may turn on the custody contract, the firm’s records, how assets were segregated, the customer’s legal property interest, the asset’s legal classification, and the jurisdiction’s insolvency law. Segregation and accurate records can matter, but they do not ensure immediate access: even assets determined to belong to customers may remain inaccessible while proceedings are resolved.
In the United States, the SEC Division of Trading and Markets says in its crypto-asset activities FAQ that SIPC generally protects customer claims for securities entrusted to a SIPC-member broker-dealer, not claims for non-security crypto assets. The staff describes one possible contractual approach: parties may agree to treat non-security crypto as “financial assets” carried in a securities account under Article 8 of the Uniform Commercial Code. Staff says this approach could help keep the assets out of the broker-dealer’s estate, but also cautions that non-security crypto is not protected by the Securities Investor Protection Act (SIPA) and may lack another specific insolvency regime. These are staff responses, not binding legal determinations for every account.

Do not assume an account is a custody arrangement simply because it is described or marketed as one. Lending or earn programs may involve different rights and risks; read the agreement to understand whether the firm may use, lend, pledge, or transfer assets.
What FDIC and SIPC protection do—and do not—cover
FDIC deposit insurance applies to eligible deposits at insured banks when the bank fails. It does not insure crypto assets or protect customers against the insolvency or bankruptcy of a non-bank crypto custodian, exchange, broker, or wallet provider. A company’s banking relationship, or its statement that it uses a bank, does not make crypto an insured deposit. The FDIC also says deposit insurance does not cover losses from theft or fraud.
SIPC is not general insurance against crypto losses. SEC staff says SIPC generally does not cover custodial claims for non-security crypto assets, including when a SIPC-member broker-dealer holds them. Traditional securities and cash at a member broker-dealer may be subject to a different framework; that does not mean every token is a SIPC-protected security.

- What property interest do you retain, and may the firm lend, pledge, transfer, or otherwise use your assets?
- Does the firm use sub-custodians? If so, who holds the assets and what terms apply?

New York State Department of Financial Services guidance dated September 30, 2025 says a covered virtual currency entity should take possession for the limited purpose of custody and safekeeping, without creating a debtor-creditor relationship. It also calls for clear disclosure of segregation and accounting, the customer’s retained property interest, and limits on the use of customer virtual currency. This is NYDFS guidance for entities within its scope, not a nationwide rule.

With self-custody, you control the private keys rather than relying on a third-party custodian. That can reduce dependence on the custodian, but it makes you responsible for protecting the keys and recovery information. Investor.gov’s retail custody guidance explains that wallets may generate a seed phrase, also called a seed recovery phrase or mnemonic phrase; losing access credentials can mean losing the crypto.

A hardware wallet does not guarantee protection against theft, user error, device loss, or loss of the recovery phrase. It also cannot settle an insolvency claim against a custodian or reverse an on-chain transfer. Anyone who obtains a recovery phrase may be able to control the associated assets, so treat it as highly sensitive.
How to read U.S. custody guidance
Regulatory statements have different legal weight and scope. SEC Commissioner Crenshaw’s April 25, 2025 roundtable remarks raised insolvency, hacking, blockchain-specific risks, and investor disclosure as custody policy questions; they are remarks, not binding law. A July 14, 2025 joint statement from the FDIC, Federal Reserve Board, and OCC reminded banks to manage crypto-asset safekeeping safely and follow existing laws, while stating that it created no new supervisory expectations. Neither statement guarantees customer recovery.
