What Happens If a Business Does Not Reply to a GST Show-Cause Notice?

If a business does not reply to a GST show-cause notice, the tax officer may proceed on the information available and make an adverse decision. Silence is not automatically an admission of every allegation, and the result depends on the type of notice, the provision cited and the procedure that applies. Check the notice promptly: its reply deadline is not interchangeable with the time limit for appealing an order later.

What can happen when a business does not respond?

The consequence depends on what the notice concerns. A tax-demand notice, a registration application notice and a registration cancellation proceeding do not necessarily use the same response form, deadline or outcome. If the business says nothing, it risks leaving the officer to decide using the material already available, without its explanation, documents or objections.

For tax demands, the CBIC-hosted CGST Act text describes proceedings under sections 73 and 74 in which an officer calls on a person to show cause against proposed tax, interest and penalty. The notice should identify the alleged issue, relevant period and proposed demand. Do not assume that an unanswered notice itself establishes every allegation or makes every proposed amount final.

First identify the notice and its deadline

There is no single reply deadline for every GST show-cause notice. The CBIC registration rules, for example, set a seven-working-day reply window for certain registration procedures. That example is not a general deadline for tax-demand notices. Follow the deadline, form and submission instructions in the notice, and check the rule or section it cites.

  • Record the notice number, issuing authority, date and mode of service, and stated last date to respond.
  • Identify whether it concerns a tax demand, registration, cancellation or another proceeding; do not reuse a form or deadline from a different procedure.
  • Note the tax period, allegations, proposed calculations, requested records, portal instructions and any hearing date.
  • Compare the notice with the business’s returns, invoices and other relevant records so that any factual disagreement can be addressed specifically.

Safeguards in a tax-determination proceeding

The cited CGST Act text includes safeguards for tax determinations. Section 75(4) addresses when an opportunity of hearing must be granted: “An opportunity of hearing shall be granted where a request is received in writing from the person chargeable with tax or penalty, or where any adverse decision is contemplated against such person.” A business should not treat silence as a substitute for requesting a hearing where one is needed; check the notice and applicable procedure.

Under section 75(6), the officer’s order must state the relevant facts and the basis of the decision. Section 75(7) limits the order: the tax, interest and penalty demanded must not exceed the amounts specified in the notice, and the order cannot confirm a demand on grounds outside it. These provisions do not make a non-response harmless; the officer may still decide the matter on the available record. Confirm that the statutory text and provisions applicable to the notice’s tax period match the case.

Registration notices can have different consequences

Registration procedures have their own rules and forms. The CBIC registration rules give examples in which a reply is due within seven working days; in a specified amendment procedure, an application is to be rejected if no reply is furnished within the prescribed period. The exact consequence depends on the rule invoked, so a business should read the particular notice rather than assume that a tax-demand process applies.

If the deadline is close or has passed

Promptly check the stated submission route and whether the notice allows a response or hearing request. If time is short, a qualified Indian GST practitioner can help assess the procedural options and organize the records and issues for reply. This is a practical recommendation for a technical, fact-specific process, not a claim that professional representation is required in every case.

If an adverse order has already been issued

Section 107 of the CGST Act provides an appeal to the Appellate Authority within three months after the decision or order is communicated. The authority may admit an appeal within a further month if satisfied that sufficient cause prevented filing within the initial period. This is a post-order appeal period, not extra time to answer the original notice. Check the communication date, current appeal requirements and any amendments promptly.
