If a bitcoin custodian is hacked, you may lose access to your bitcoin or suffer a loss; reimbursement depends on the circumstances, your agreement and any applicable insurance. If the custodian goes bankrupt, segregation and contract terms may support your claim to the assets, but they do not guarantee fast or complete recovery. Bitcoin held by a crypto custodian is not covered by FDIC or SIPC protection.
What happens to your bitcoin if a custodian is hacked?
A security breach can compromise wallet keys, interrupt access or prevent customers from selling or withdrawing bitcoin. Whether the custodian reimburses a customer depends on the facts and the agreement; reimbursement is not automatic. Coinbase’s annual report, for example, says a loss of private keys or a wallet compromise could affect customers’ ability to access or sell assets, and that reimbursement may be required depending on the circumstances.

Some custodians or funds describe commercial crime insurance intended to cover specified losses, such as certain thefts, fraudulent transfers or security breaches. That does not mean every hack is covered or every customer will be made whole. One fund filing describes a policy shared among Coinbase customers, not dedicated to that trust, and warns that coverage may be unavailable or insufficient for a particular loss. Policy terms, exclusions, limits and the insured parties matter.
What happens if the custodian goes bankrupt?
The outcome depends on the custody agreement, how the assets are held and the legal process in the relevant jurisdiction. A customer may have a contractual or property-based claim to bitcoin held for them, but proving that claim and getting access can take time. A company disclosure warns that bitcoin can be delayed or unrecoverable if a custodian breaches its agreement, stops operating, becomes insolvent or files for bankruptcy—even when the bitcoin is segregated.

Article 8 protections are not a court-guaranteed outcome
Coinbase’s SEC filing describes using UCC Article 8 in certain custody agreements. Coinbase says it believes custodied assets would not be part of its general creditors’ claims in bankruptcy. The same filing acknowledges that courts have not yet considered this treatment for custodied crypto assets. That is the company’s stated position, not a ruling that settles the outcome for every customer or custodian.
Contract terms differ between custody arrangements
A Bitwise fund filing describes an agreement requiring client assets to be held in segregated wallets, separate from the custodian’s assets and other clients’ assets, and prohibiting a lien or security interest in those assets. It also describes an Article 8 framework intended to create a security entitlement and keep the assets outside the custodian’s insolvency estate. Those protections describe that particular agreement; they are not standard terms that can be assumed for every account.

Does segregation guarantee that you will get bitcoin back?
No. Segregation can help distinguish client assets from the custodian’s own property, and a no-lien term can limit the custodian’s ability to claim or pledge them. But those terms do not guarantee that records will be uncontested, that access will continue during insolvency, or that recovery will be quick. The governing agreement and applicable law still matter.

1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsIn practical terms, “held separately” and “immediately available to you” are different promises. Read the custody agreement to see what it says about ownership, segregation, asset use, insolvency and withdrawals rather than relying on a general description of the service.

Is custodied bitcoin covered by FDIC or SIPC?
Do not assume so. A cited trust filing states that the trust and custodian are not FDIC or SIPC members and that the trust’s bitcoin is not covered by those programs. Bitcoin held by a crypto custodian is not itself a bank deposit or a security protected by those programs.
If an arrangement also involves cash held at a bank, that is a separate arrangement: any applicable deposit coverage depends on the bank account structure and program requirements. It does not turn the bitcoin into an insured bank deposit.

What to check before choosing a custodian
Compare the actual account agreement and the legal entity that will hold your assets. Disclosures from different companies and funds show that custody terms and stated protections vary; an “insured” label alone does not explain what happens in a hack or insolvency.
- Ownership and segregation: Does the agreement say the bitcoin is held for you, and how are client assets separated from the custodian’s assets and other clients’ assets?
- Asset use: Can the custodian lend, pledge or rehypothecate your bitcoin, or grant another party a lien or security interest?
- Insolvency treatment: Does the contract describe an Article 8 or equivalent arrangement, and what does it say about disputes, bankruptcy and access?
- Liability and insurance: Which losses are covered, who is insured, what exclusions or limits apply, and is any policy shared across customers or accounts?
- Records and operations: What account records and reconciliation information are available, and how are withdrawals, termination and service interruptions handled?
- Legal details: Identify the contracting entity and governing jurisdiction; those details affect which agreement and legal process apply.
What should you do after a suspected hack or insolvency?
- Use verified contact channels. Check the custodian’s official website and account notices for instructions. Do not rely on unsolicited messages claiming to help recover bitcoin or asking for private keys or recovery material.
- Preserve your records. Save the custody agreement, account statements, transaction history, withdrawal requests and relevant communications. These may help establish your account and the custodian’s obligations.
- Follow formal case instructions. If the custodian has stopped withdrawals or entered an insolvency process, use its official notices and the applicable court or administrator process. Deadlines and procedures can depend on the case and jurisdiction.
- Get advice for your jurisdiction if funds are at risk. The legal treatment and recovery timeline are case-specific; a qualified adviser can assess the agreement and the live proceedings.
Can a hardware wallet protect bitcoin held by a custodian?
Not after access to the custodied bitcoin has already been lost. A hardware wallet is a self-custody tool for bitcoin you can still withdraw or otherwise control; it cannot retrieve assets that are inaccessible at a custodian.
One company filing describes the possibility of moving bitcoin to cold storage if its custodian stops operating or becomes insolvent while a replacement is arranged. That is a contingency, not a guaranteed option for every customer. Self-custody also means you must protect your private keys and recovery material yourself.
