At least 30% support is needed to petition for an election; it does not win the election. If an election is held, the union generally must receive a majority of votes cast. The exact route, eligible voters, legal issues and timing depend on the workplace and the case.
What this process covers
This is an overview of the U.S. NLRB representation process for private-sector employees. It is not a universal description of labor law in every country or every U.S. job. Coverage depends on the worker and employer, and construction projects can involve special rules. The NLRB describes rights and procedures; it does not endorse either a union or an employer’s campaign position.

A campaign is not required to follow one script. Some begin with employees talking among themselves; others involve early contact with a union. A campaign can end with voluntary recognition rather than a government-run election, or with employees rejecting representation and leaving the existing arrangement in place.
The two routes to union representation
Employees can reach a bargaining relationship through an NLRB election or through voluntary recognition. The routes differ in who makes the final decision and whether a secret ballot is used.

| Feature | NLRB representation election | Voluntary recognition |
|---|---|---|
| Decision-maker | Eligible employees decide by secret ballot. | The employer recognizes the union after accepting evidence of majority support. |
| Support evidence | A petition normally needs a showing of interest from at least 30% of employees in the proposed bargaining unit. | The employer typically reviews authorization cards or comparable evidence showing that a majority wants representation. |
| Procedure | Petition, NLRB investigation, agreement or rulings on the unit and election details, campaign, then vote. | Recognition occurs outside the NLRB election process, followed by bargaining under the conditions described by the Board. |
| Ballot | Yes. The result generally turns on a majority of votes cast. | No NLRB secret-ballot election is required for recognition itself. |
Signing an authorization card is not the same thing as casting an election ballot. Likewise, the 30% petition threshold is not a 30% winning threshold. The NLRB explains the distinction this way: “If a majority of workers wants to form a union, they can select a union in one of two ways: If at least 30% of workers sign cards or a petition saying they want a union, the NLRB will conduct an election.” See the agency’s Your Right to Form a Union guidance.
1. First conversations and deciding whether to organize
Employees identify shared concerns
Organizing commonly starts when coworkers discuss issues such as pay, benefits, schedules, staffing, safety, job security or inconsistent treatment. The purpose is to find out whether concerns are shared and whether collective representation could improve employees’ ability to address them. These conversations may happen without an outside organizer.
Contacting a union
Workers may contact a union for information, advice or assistance in building support. They can ask about the kind of bargaining unit that might be appropriate, how authorization cards work and what an election would involve. Union activity can also include soliciting support and petition-related work described in the NLRB’s guidance on activities unions may freely do.

Participation is voluntary
Employees may support representation, remain undecided, decline to participate or campaign against the union. The NLRB protects organizing and the right to refrain, subject to the facts of a particular workplace and lawful, nondiscriminatory work rules. A person who does not sign a card is not automatically opposed, and a card signer is not compelled to vote for a union later.
2. Building support and using authorization cards
What cards do
Authorization cards are written or electronic indications that employees support union representation or authorize a union to act for them, depending on the card’s wording. Organizers use them to measure support and, for an election petition, to provide the required showing of interest. Employees should read the language and ask what the particular card authorizes before signing.

The 30% showing-of-interest rule
For an NLRB election petition, the union generally must show support from at least 30% of employees in the proposed bargaining unit. This is a gateway to agency consideration of an election, not a prediction of the final vote and not a requirement that 30% vote “yes.” The proposed unit may later be disputed or defined differently, so the relevant percentage is tied to the unit used in the petition and case.
Majority support for voluntary recognition
An employer may recognize a union when presented with evidence that a majority of employees wants representation, typically authorization cards. Recognition happens by the employer’s decision rather than by an NLRB ballot. If the employer does not voluntarily recognize the union, employees can pursue the petition-and-election route when the legal requirements are met.

A union seeking an election files a representation petition with the appropriate NLRB Regional Office. Agency staff then examine whether the Board has jurisdiction, whether the union is qualified to appear, and whether a contract, a recent election or another legal bar affects the petition. The Board’s current process is described in Conduct Elections.
- Submit the petition and support evidence. The filing identifies the proposed bargaining unit and includes the showing of interest.
- Agency investigation begins. NLRB staff review jurisdiction, the proposed unit, voter eligibility questions, existing agreements and possible election bars.
- Employer notice is posted. The employer must post a Notice of Petition for Election and distribute it electronically where the rules require electronic distribution.
- Parties seek agreement. The union, employer and NLRB agents try to settle the unit description, ballot language, eligible-voter list, and the date, time and place of voting.
- Unresolved disputes go to a hearing when necessary. If the parties cannot agree, the Regional Director may hold a pre-election hearing and decide whether, and under what conditions, an election should be directed.
Current procedural rules
For petitions filed on or after December 26, 2023, the NLRB’s 2023 representation-case rule restored procedural provisions first adopted in 2014 and changed elements such as hearing scheduling, notice timing, election details and treatment of some eligibility issues. The current framework is set out in the agency’s Representation Case Procedures page. Older “quick election” charts should not be treated as a guaranteed modern timetable.
4. Defining the bargaining unit and eligible voters
The bargaining unit
The bargaining unit is the group of employees who would be represented together. Its description affects who can vote and whether the 30% showing is sufficient. Unit scope can be agreed by the parties or determined by the Regional Director after a dispute.

Voter eligibility
The NLRB and the parties address which employees are eligible under the applicable rules. Eligibility questions can be resolved before the election, challenged at the polls or addressed in later proceedings. Do not assume that everyone at a worksite, or everyone who signed a card, will necessarily be an eligible voter in the final unit.

What supporters may do
Union supporters may discuss representation, distribute literature in protected circumstances and ask coworkers to support the union. They may explain workplace concerns, the proposed unit and the bargaining process. The exact protection depends on where, when and how the activity occurs and on applicable workplace rules.
What opponents may do
Employees may express opposition, campaign against representation or simply decline to participate. The right to refrain is part of the NLRB framework, not evidence of misconduct. A neutral explanation of uncertainty or questions about a union is different from coercing coworkers.
What employers may do
Employers may communicate their views about unionization within legal limits. They may not threaten adverse consequences or promise benefits to persuade employees to reject a union. The NLRB’s employer guidance identifies conduct that can unlawfully interfere with free choice; the application is fact-dependent. See What’s the Law? — Employers.
Unfair labor practice charges and election objections
Alleged threats, promises, discrimination, interference or other unlawful conduct can lead to an unfair labor practice charge. Conduct that could affect employees’ free choice may also become an election objection. The Board evaluates the circumstances rather than treating every campaign disagreement as illegal. Employees can review the general rights framework in the NLRB’s What’s the Law? guidance.

6. Scheduling the election
After the Regional Director authorizes or orders an election, the NLRB generally schedules it for the earliest practicable date. “Earliest practicable” is not a fixed number of days. Disputes about the unit, eligibility or other legal issues can affect the schedule, and a party may request postponement when alleged conduct could interfere with a free choice. The case record, not a generic campaign calendar, controls the timing.
7. Voting and counting ballots
The secret-ballot choice
Eligible employees vote on whether they want the union to represent the bargaining unit. The NLRB conducts the representation election under the arrangements established in the case, including the ballot wording and voting location or method.
How the result is measured
If the union receives a majority of votes cast, the NLRB certifies it as the employees’ representative. The denominator is votes actually cast, not every employee in the unit. The earlier 30% showing only allowed the petition to proceed; it does not determine the result.
Challenges and objections
A party can raise challenges to voter eligibility or objections alleging conduct that affected the election. Those issues can require post-election investigation or proceedings before the result is finalized. A delayed certification does not by itself mean that the union won or lost; it means the contested issues still need resolution.
8. What happens after the vote
If the union wins
Once certified, the union is the representative for the bargaining unit, and the employer must bargain over terms and conditions of employment. Certification establishes the bargaining relationship; it does not instantly produce a contract or guarantee a particular wage, benefit or schedule. Negotiations are a separate process.

If the union does not win
If the union fails to receive a majority of votes cast, it is not certified on the basis of that election. The existing employment arrangement remains in place unless another lawful process changes it. Any unresolved objections or eligibility challenges can still affect when the result becomes final.
9. Voluntary recognition and the bargaining period
Voluntary recognition can conclude the organizing effort without an NLRB election when the employer accepts reliable evidence of majority support. It is therefore a different endpoint from a defeated election: there is no secret-ballot tally, but there is an employer decision to recognize the union.
The NLRB states that, after voluntary recognition, the bargaining relationship has a reasonable period for bargaining of at least six months and no more than one year after the first bargaining session, subject to the agency’s notice and petition-bar conditions. This period is not the length of an organizing campaign. The conditions and current requirements should be checked in the NLRB’s Conduct Elections guidance.
How long does a campaign take?
There is no official universal number of days from the first coworker conversation to the vote. Early support-building can vary widely, and the NLRB timetable begins only after a petition is filed and the agency’s requirements are addressed. Unit disputes, eligibility questions, election objections, requests to postpone voting and other case-specific events can add time. The agency’s “earliest practicable date” language describes a scheduling standard, not a promise.
Practical checkpoints for employees
- Confirm that the issue is being handled under the U.S. NLRB process and that your worker and employer fall within its coverage.
- Ask what the proposed bargaining unit includes and which employees may be eligible to vote.
- Read an authorization card’s wording before signing; a card’s purpose and an election ballot are different.
- Track whether a statement is a lawful opinion, a threat, a promise or possible discrimination; context matters.
- Keep copies of notices, campaign communications and election information if a dispute arises.
- Use the Regional Office’s instructions for filing or responding to charges, petitions, challenges or objections rather than relying on an informal deadline.
The essential distinction
A union campaign is a protected employee-choice process with two possible routes. Conversations and cards build or demonstrate support; an NLRB petition requires at least 30% showing of interest; agency staff then investigate, resolve the unit and election arrangements, and schedule a vote when appropriate. A majority of votes cast is needed to win that election. Alternatively, an employer can voluntarily recognize a union supported by a majority. At every stage, employees may support, oppose or refrain, while threats, promises and other coercive conduct can trigger legal consequences.
