The 2023 proposal would have allowed the New Hampshire Lottery Commission to offer regulated online casino-style games and directed net proceeds to a community college scholarship fund. Senate Finance review advanced it, but the House Ways and Means Committee recommended against it, and the House indefinitely postponed it on May 4, 2023.
What SB 104 proposed
SB 104 was a 2023 proposal to authorize the New Hampshire Lottery Commission to operate online games of chance itself or through agents selected competitively. The Senate-amended bill covered casino-style games including poker, blackjack, roulette, craps and baccarat.

It excluded sports wagering, paid fantasy sports, traditional games of chance, Internet lottery and historic horse racing. The proposal was not an authorization for those products.
Proposed player protections and oversight
The amended text called for safeguards including age and identity verification, geolocation, wager limits, voluntary self-exclusion, information security, system reviews, audit controls, responsible-gaming plans and Lottery Commission oversight. These were requirements in the proposed framework; SB 104’s failure to become law means they did not take effect under this bill.

Where proceeds would have gone
After administrative costs, prizes and payments for problem-gambling services, proceeds received by the Commission would have been directed to a new community college scholarship fund. Proposed eligibility included New Hampshire residency, academic or work qualifications set by the trustees, and household income of no more than $100,000. The amended text specified an intended effective date of January 1, 2024, but the bill did not become law.
What happened in the Finance Committee and afterward
The Finance Committee test was a stage in the bill’s 2023 Senate process, not a current or upcoming hearing. The official SB 104 docket records this sequence:
Rank #2
- On February 22, 2023, the Senate adopted an amendment, voted 13–11 to report the bill ought to pass, and referred it to Finance under Senate Rule 4-5.
- On March 30, the Finance committee amendment’s initial ought-to-pass motion failed 11–12. After reconsideration, the Senate adopted an ought-to-pass motion 12–11 and sent the bill onward.
- The House referred SB 104 to Ways and Means. On April 26, that committee voted 20–0 to recommend “inexpedient to legislate.”
- On May 4, 2023, the House indefinitely postponed the bill.
The New Hampshire General Court’s bill status lists the House disposition as “INDEFINITELY POSTPONED.” SB 104 is therefore a historical proposal, not an active measure awaiting Finance Committee action.
What the fiscal note projected
The New Hampshire Lottery Commission’s 2023 fiscal note gave estimates, not actual collections or spending. Its revenue projections assumed a contracting and rulemaking ramp-up, later market growth, and an expected state share of at least 35% of gross gaming revenue.
Rank #3
| Fiscal year | Estimated state revenue | Estimated expenditures |
|---|---|---|
| FY 2024 | $2,362,500 | $160,000 |
| FY 2025 | $9,450,000 | $633,000 |
| FY 2026 | $14,175,000 | $621,000 |
All figures are projections in the New Hampshire Lottery Commission fiscal note from 2023. Since the House indefinitely postponed the bill, they should not be read as realized revenue or expenditures.
