What GST Offences Can Lead to Prosecution and Imprisonment in India?

Yes. Certain GST violations in India can become criminal offences punishable by prosecution, fines and imprisonment under section 132 of the Central Goods and Services Tax Act, 2017 (CGST Act). The main examples are deliberate tax evasion, invoices issued without genuine supplies, fraudulent input-tax credit, fraudulent refunds, and keeping GST collected from customers instead of paying it to the Government.

However, a tax discrepancy, demand notice or departmental audit does not automatically mean arrest or jail. The department must identify conduct covered by section 132, collect evidence of the required intent or knowledge where the offence requires it, obtain the required sanction and pursue a criminal complaint. Arrest, prosecution and conviction are separate stages.

Which GST conduct can lead to criminal prosecution?

Section 132 of the CGST Act contains the central prosecution framework. It covers specific acts rather than every mistake made in a GST return. Several listed offences use language such as “with intent to evade tax”, “knowingly”, or knowledge that a transaction contravenes the Act. That means the surrounding evidence and the person’s state of mind can be decisive.

1. Supplying goods or services without an invoice

A taxable supply made without issuing the invoice required by GST law can fall within section 132 when it is done with an intention to evade tax. The issue is not merely that an invoice was late or contained a correctable error; investigators would examine whether the omission was part of a deliberate attempt to keep the transaction outside the tax system.

2. Issuing invoices without an actual supply

Creating an invoice, bill or similar document when no corresponding supply of goods or services took place is a classic GST fraud pattern. Such invoices can be used to create an artificial paper trail, inflate turnover, move money between entities or enable another person to claim input-tax credit.

3. Taking input-tax credit on false or improper documents

Section 132 also covers obtaining or using input-tax credit through an invoice or bill without the underlying supply, or through other conduct that makes the credit wrongful. A recipient who knowingly participates in a fake-invoice arrangement can face criminal exposure even if another entity generated the document.

4. Collecting GST and not paying it to the Government

GST collected from a customer is not the supplier’s unrestricted money. The offence list includes collecting tax and failing to pay it to the Government for the period specified in the Act. Evidence can include tax invoices, customer payments, ledger entries, bank records and the timing of the eventual remittance.

5. Evading tax or obtaining a fraudulent refund

Deliberate tax evasion and fraudulently obtaining a refund are expressly listed. False export or supply records, manipulated books, undisclosed turnover and fabricated supporting documents may be relevant, but the exact offence depends on the facts and the evidence linking the conduct to the statutory wording.

6. Certain failures involving tax deduction or collection

The offence list includes specified failures relating to tax deducted at source (TDS) and tax collected at source (TCS). These are not a blanket criminalisation of every TDS or TCS delay; the conduct must match the particular statutory conditions in force for the relevant period.

7. Wrongly distributing input-tax credit

Distributing input-tax credit in contravention of the CGST Act is another listed category. This can matter where an entity or intermediary allocates credit in a way that the GST system does not permit.

8. Dealing in services known to breach the Act

The section includes receiving, dealing with or otherwise participating in services that a person knows, or reasonably believes, contravene the Act. The “known or reasonably believed” wording makes the person’s knowledge and the circumstances of the transaction important.

9. Tampering with or destroying evidence

Falsifying, tampering with or destroying material evidence or documents can itself be prosecuted. Deleting accounting data, altering invoices after an inquiry begins or concealing records may create a separate problem from the underlying tax dispute.

10. Withholding required information or giving false information

Failure to provide information required under the Act, or knowingly supplying information without a reasonable belief that it is true, is also included. A response that is incomplete because records are genuinely unavailable is different from a deliberate false statement; investigators will assess the circumstances and intent.

11. Attempt and abetment

Attempting or abetting the listed offences can attract prosecution. A person does not necessarily avoid liability because the fraudulent refund was stopped, the invoice was not ultimately used or the evasion plan failed. Participation, instructions, financing and assistance may all be examined.

Why an ordinary GST error is not automatically a crime

GST compliance is complex, and tax authorities distinguish between a criminal scheme and a technical or interpretive dispute. A classification disagreement, an arithmetic mistake, a delayed filing caused by a genuine systems problem or a bona fide interpretation of an unclear provision may lead to tax, interest or penalty proceedings without meeting the criminal standard.

CBIC’s prosecution instruction says prosecution should not normally be launched for a technical matter or where the additional tax claim is based on a difference of opinion about the interpretation of law. It also directs officers to assess whether the evidence can establish a guilty mind, knowledge, fraudulent intention or other required mens rea beyond reasonable doubt. That is a much higher evidentiary burden than proving a tax liability in adjudication.

How a GST matter can become a prosecution

There is no automatic conversion of every audit or demand notice into a criminal case. The usual decision points are:

  1. Detection and investigation: The department may identify discrepancies through returns, e-invoice data, e-way bills, refund claims, third-party information, searches or statements. Investigators gather records and examine the people involved.
  2. Identification of a section 132 offence: The conduct must fit one of the statutory categories, such as a supply without invoice with intent to evade, a false invoice, wrongful credit or fraudulent refund.
  3. Assessment of evidence and intent: Officers consider whether documents, electronic records, money trails and witness statements establish the required knowledge or intention. A numerical tax difference alone does not prove every criminal element.
  4. Prosecution sanction: Section 132(6) requires prior sanction before a prosecution complaint is launched. CBIC’s instruction assigns sanctioning responsibility to the competent Commissioner and, for specified Directorate General of GST Intelligence investigations, the relevant senior DGGI authority.
  5. Criminal complaint: After sanction, the department files a complaint before the criminal court with jurisdiction. The court process then determines whether the accused should be tried and whether the evidence proves guilt.
  6. Adjudication may run separately: Tax adjudication and prosecution are legally distinct. In grave matters, the instruction permits a complaint before adjudication where strong evidence exists, delay is anticipated or particular arrest-related circumstances apply.

A prosecution complaint is therefore a formal, sanctioned criminal step. It is not the same thing as an audit observation, a show-cause notice or a confirmed tax demand.

What does the ₹5 crore figure mean?

CBIC Instruction 04/2022-23, issued on 1 September 2022, says prosecution should normally be launched when evaded tax, misused input-tax credit or a fraudulently obtained refund connected with section 132(1) offences exceeds ₹5 crore (₹500 lakh). This is an administrative prosecution-launch guideline, not a statement of the statutory imprisonment bands.

The same instruction identifies exceptions. It refers to habitual evaders and cases in which an arrest was made under section 69. For this instruction, a habitual evader is described by reference to at least two confirmed demand cases at the first adjudication level or above during the preceding two years, with aggregate amounts exceeding ₹5 crore.

The instruction is from 2022, and its continuing status should be checked against the latest CBIC directions. It should not be used as a guarantee that an amount below ₹5 crore cannot be prosecuted, or as proof that every amount above ₹5 crore will result in a complaint. The statutory offence, evidence, sanction and case circumstances still matter.

Imprisonment, arrest, bail and conviction are different

Imprisonment is imposed only after conviction

Section 132 provides imprisonment and fines for covered offences, with punishment linked in the Act to the offence and the amount involved. The CBIC-hosted Act page available for older versions displays maximum-imprisonment tiers and a separate lower category for certain offences, but the exact rupee bands and procedural classifications are amendment-sensitive. Because a current consolidated section 132 and all applicable commencement notifications must be checked before publication, do not rely on an old table of thresholds to predict a present sentence.

The safe legal conclusion is that imprisonment is possible for qualifying GST offences, but it is not automatic. A court must find the accused guilty after the criminal process. A person may be acquitted, or the case may fail if the prosecution cannot prove the offence or the required mental element.

Arrest is an investigative measure, not a conviction

GST law contains a separate arrest power under section 69. Whether an arrest is lawful depends on the statutory conditions and the facts known to the authorised officer. Arrest can occur during an investigation, before a prosecution complaint is decided, and does not establish guilt.

The older Act rendering also distinguishes cognizable and non-cognizable offences and bailable and non-bailable treatment. Those classifications, like monetary cut-offs, can change through amendments. Anyone arrested should obtain immediate advice from an Indian lawyer experienced in GST and criminal-tax procedure and seek the appropriate bail remedy.

Prosecution can continue even when tax proceedings are separate

Paying a disputed tax amount, receiving a demand order or challenging an assessment does not by itself answer the criminal allegations. Conversely, the existence of a prosecution complaint does not finally determine the civil tax liability. The two tracks can involve overlapping records but have different legal tests and outcomes.

When can a company director or officer be prosecuted?

Section 137 addresses offences by companies. A company and people responsible for the conduct of its business may be proceeded against, and directors or other officers may face liability where the offence is attributable to their consent, connivance or neglect.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That provision does not make every director automatically guilty. CBIC’s instruction tells officers to focus on people who were involved in the company’s day-to-day operations and actively participated in, or connived at, the conduct. Job title alone is not a substitute for evidence. Investigators may examine signing authority, control over finance and invoicing, instructions to staff, knowledge of the transactions and the steps taken after irregularities were discovered.

Tax demand versus criminal prosecution

Issue Tax adjudication Criminal prosecution
Purpose Determine tax, interest, penalty or refund consequences under GST law. Determine whether a statutory offence was committed and whether the accused is criminally liable.
Trigger Audit finding, return discrepancy, assessment or show-cause notice. Alleged conduct falling within section 132, supported by evidence and preceded by required sanction.
Decision-maker GST adjudicating authority, subject to statutory appeals. Criminal court after a complaint and trial process.
Standard of proof Tax authorities determine liability under the applicable adjudication rules. Prosecution must prove the offence beyond reasonable doubt.
Personal exposure Usually concerns the registered person’s tax and related amounts. Can extend to individuals whose conduct, consent, connivance or neglect is legally established.
Relationship May proceed alongside a criminal case. May, in grave cases, be filed before adjudication is completed.

Examples of situations that create criminal risk

Fake invoices with no movement of goods

An entity issues invoices to another business, receives a fee and records no genuine supply. The recipient claims input credit. The issuer may face allegations relating to invoices without supply, while the recipient may face allegations relating to wrongful credit. Bank transfers, e-way bills, stock records, transport documents and communications would be relevant to proving what each participant knew.

GST collected from customers but retained

A supplier charges GST on invoices, receives payment and repeatedly fails to remit the collected amount. If the statutory period and other elements are met, the conduct can fall within the offence concerning tax collected but not paid to the Government. A temporary cash-flow problem is not automatically equivalent to a criminal offence; the facts, duration, records and explanation matter.

False refund documentation

A claimant fabricates export or supply documents to obtain a refund to which it is not entitled. That may be investigated as a fraudulent refund, with additional allegations if documents were falsified or destroyed after the inquiry began.

What to do after a summons, search or arrest

  • Preserve records: Keep invoices, contracts, ledgers, bank statements, e-way bills, return workings, emails and accounting-system logs. Do not delete, alter or backdate material.
  • Identify the exact allegation: Read the summons, search record or arrest document carefully. The relevant section, tax period, entities and transactions should be clear enough for counsel to assess.
  • Obtain specialist advice promptly: A lawyer handling Indian GST and criminal-tax matters can advise on attendance, statements, privilege, bail and parallel adjudication.
  • Answer accurately: Do not guess when records are unavailable. Explain what is known, identify documents that support the answer and correct an error through the proper process.
  • Separate the company’s position from individual responsibility: Directors and employees should document their actual roles, authority and involvement rather than assume that a designation decides liability.
  • Check current law: Before relying on any imprisonment threshold, arrest classification or bail statement, verify the latest consolidated CGST Act and effective-date notifications.

The practical bottom line

GST offences most likely to create prosecution risk are deliberate invoice and supply fraud, wrongful input-tax credit, tax evasion, fraudulent refunds, retaining GST collected from customers, specified TDS or TCS violations, unlawful credit distribution, knowing involvement with contravening services, destruction or falsification of evidence, false information, and attempts or abetment. Imprisonment is legally possible, but only a criminal court can impose it after conviction. A demand notice or arrest is not a conviction, and the ₹5 crore figure in CBIC’s 2022 instruction is a normal prosecution-launch guideline—not the statutory punishment threshold.
