What GST Demands Mean for Businesses and How to Respond to a Tax Notice

A GST demand notice means the tax department alleges that a business has an unpaid tax liability, claimed an erroneous refund, or wrongly availed or used input tax credit. The notice asks why the stated tax, interest and any applicable penalty should not be recovered or determined. It is not, by itself, proof that the department’s calculation or legal position is correct.

Read the complete notice, identify the statutory section and tax periods, check the figures against your records, and file a specific response through the prescribed process by the stated deadline. A covered notice generally uses DRC-06 for the reply, while a later order may appear as DRC-07 and become recoverable. Because deadlines, payment consequences and applicable provisions depend on the notice, tax period and amendments in force, obtain case-specific advice from a GST practitioner, chartered accountant or tax lawyer when the amount or legal issue is significant.

What a GST demand notice is

A demand proceeding under India’s GST framework concerns an alleged tax shortfall, an erroneous refund, or input tax credit that the department says was wrongly availed or utilised. The notice sets out the alleged facts and asks the registered person to explain why the proposed tax, interest and penalty should not be recovered or formally determined.

The notice may relate to a return mismatch, classification or rate dispute, a credit condition, an unpaid liability, or another issue identified by the proper officer. The exact allegation matters more than the label “GST demand.” A notice can involve central GST, state GST or integrated GST, and the issuing authority and governing law depend on the transaction and tax period.

Do not treat an electronic summary as the whole case. Rule 142 distinguishes the detailed notice from its electronic summary. Save and review the full notice, attachments, calculations and material relied upon. The official Central Goods and Services Tax Act, 2017 and the CGST Rules, 2017 (Chapter XVIII: Demands and Recovery) provide the framework, but the rules PDF is an amended compilation dated 1 January 2022; later amendments must be checked before relying on a procedural detail.

What to check before deciding how to reply

Identify the legal route

Locate the section cited in the notice, the relevant financial years or tax periods, the alleged conduct, and the officer or authority that issued it. The section affects the available payment provisions, penalty exposure, evidence issues and later remedies. Never assume that every demand is a section 73 matter or that the section cited is automatically correct.

Separate the components of the amount

Make a line-by-line list of proposed tax, interest, penalty and any other amount. Check the calculation period, tax head, rate, credit reversal and arithmetic. A portal-generated figure or mismatch is a starting point for verification, not conclusive proof of liability.

Confirm service and the response instructions

Record when and how the notice was served, the deadline shown, the portal reference, and any instructions about filing, signatures, attachments or a hearing. If you can see only a DRC summary or message, obtain the underlying notice and relied-upon documents through the appropriate official channel.

Section 73, section 74 and section 74A: why the distinction matters

The Act separates demand routes by the alleged reason for the liability. Section 73 addresses tax not paid, short-paid, erroneously refunded, or input tax credit wrongly availed or utilised for reasons other than fraud, wilful misstatement or suppression to evade tax. Section 74 addresses the same broad kinds of liability where the department alleges fraud, wilful misstatement or suppression to evade tax. The CBIC Act text also contains section 74A language, so treatment for a current period cannot be reduced to an old 73-versus-74 formula.

Issue Section 73 route Section 74 route How to read it
Stated basis Alleged liability for reasons other than fraud, wilful misstatement or suppression to evade tax Alleged liability involving fraud, wilful misstatement or suppression to evade tax Describe what the notice alleges; an allegation is not the same as a proved finding.
Payment and penalty Statutory consequences depend on the stage, timing and version of the Act that governs the period. Different statutory payment and penalty provisions apply, also depending on timing and the applicable version. Do not use one penalty formula for every notice.
Later text May govern periods covered by that provision. May govern periods covered by that provision. Check commencement, amendments and the tax period, including whether section 74A applies.

This table is orientation only. The notice’s facts, the period-specific statute and amendments in force determine the route. If the notice alleges fraud or suppression, the evidentiary and financial consequences make prompt professional review particularly important.

How to respond to a GST demand notice

1. Preserve and verify the complete communication

  1. Download the notice, every attachment, the portal copy and each electronic summary.
  2. Check the GSTIN, legal name, issuing authority, reference number, service date and response deadline.
  3. List each tax period and transaction or return mismatch mentioned.
  4. Confirm the cited section and whether the notice relies on an audit, return comparison, investigation, refund review or another source.
  5. Save evidence of service and create a secure folder for the reply and acknowledgement.

Do not respond to an incomplete message by guessing what the officer intended. Request or obtain the underlying notice and relied-upon material through the official process.

2. Calendar the actual deadline

Use the date and time stated in the notice, together with the governing provision and current rules. There is no safe universal deadline for all GST demands: the notice type, tax period, service details and amendments can change the calculation. If the deadline is close, unclear or has already passed, seek advice immediately and preserve proof of any filing or communication.

3. Reconcile every allegation to business records

Build a working schedule with one row for each allegation and amount. Match it to the relevant return, invoice, ledger entry, payment, credit record or earlier portal filing. Mark each item as agreed, partly agreed, disputed or unsupported. Verify dates, tax heads, place-of-supply treatment, credit eligibility, reversals and arithmetic. Investigate the underlying transaction instead of treating a portal mismatch as conclusive.

Record missing documents and explain why they are unavailable. A concise, honest explanation is safer than an unsupported assertion that records do not exist.

4. Prepare a specific written reply

For covered notices, rule 142 specifies DRC-06 as the representation or reply. Follow the current portal workflow and the instructions in the notice, including any digital signature or verification requirement. Organise the reply in the same order as the allegations:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. State the notice reference, tax periods and the precise relief requested.
  2. Respond to each factual allegation separately.
  3. Explain the legal basis for the position, including why a cited provision does or does not apply.
  4. Attach or clearly identify the supporting records and reconcile them to the amount in dispute.
  5. Distinguish any amount accepted from the amount contested.
  6. Request correction of arithmetic, withdrawal, reduction or another appropriate outcome, as supported by the facts and law.
  7. Request a hearing in writing when oral clarification or examination of disputed evidence would assist.

File before the stated deadline, download the submitted reply and attachments, and preserve the acknowledgement or reference number. Filing DRC-06 does not itself settle the demand.

5. Consider payment only after checking the consequences

Rule 142 describes DRC-03 payment intimation and related acknowledgements or closure forms for specified payment situations. The route and consequences differ by statutory provision, timing and kind of demand. Before paying, admitting liability or seeking any statutory reduction, confirm the applicable subsection and period-specific law with a qualified adviser. A payment that is appropriate in one route may not produce the same result in another.

6. Request and attend a hearing when it can change the result

Section 75 provides an opportunity of hearing when the person chargeable with tax or penalty requests one in writing, or when the officer contemplates an adverse decision. Make the request in the reply or a separate filing, keep proof of submission, and prepare a short agenda of disputed facts, documents and legal points. Attend with authority to explain the records and answer questions. The eventual order should set out relevant facts and the basis for the decision.

7. Review any order immediately

An order is a separate stage from the notice. Rule 142 provides for DRC-07 as the electronic summary of specified demand orders and treats the order as a notice for recovery. Compare the order with your reply: identify which arguments were accepted or rejected, whether the calculation changed, and when the order was communicated.

GST demand forms and what each one does

The forms below have different functions. Filing one does not automatically replace another or conclude a proceeding.

Form Purpose Important limitation
DRC-01 Electronic summary accompanying specified demand notices. Read the full notice and supporting material; the summary is not a substitute.
DRC-02 Electronic summary of a statement under specified provisions. Its purpose depends on the statutory route and the underlying statement.
DRC-03 Intimation of payment in specified cases. Payment does not universally close every demand or produce the same penalty result.
DRC-04 Acknowledgement of payment in specified cases. It is an acknowledgement, not a general adjudication order.
DRC-05 Order concluding proceedings in specified timely-payment cases. Availability depends on the statutory route and timing.
DRC-06 Representation or reply to covered notices. It must address the allegations; filing it alone does not settle the demand.
DRC-07 Electronic summary of specified orders, including amounts payable. The underlying order is treated as a notice for recovery, so appeal and payment deadlines matter.

These descriptions come from rule 142 and should be checked against later amendments and the portal’s current labels.

What evidence to assemble

Tailor the file to the allegation rather than attaching everything indiscriminately. A useful index can include:

  • Relevant GST returns, reconciliations and amendment history.
  • Tax invoices, debit or credit notes, e-way or delivery records where relevant, and contracts or purchase orders.
  • General-ledger extracts, sales and purchase registers, bank or payment records and proof of tax payment.
  • Input tax credit eligibility records, supplier communications, reversal calculations and payment evidence.
  • Refund applications, sanction or rejection communications and the calculation supporting the refund.
  • Earlier portal filings, audit replies, correspondence, statements and acknowledgements connected with the same issue.
  • A calculation workbook that ties every disputed figure to a document and identifies the tax head and period.

Use a numbered annexure index and cross-reference each document in the reply. Redact unrelated personal or commercially sensitive data where lawful, but do not remove information needed to establish the transaction.

How to deal with a disputed mismatch

When the department’s figure is higher than the books

Trace the difference to timing, amendments, duplicate invoices, credit notes, tax-head mapping, place of supply, supplier reporting or a simple arithmetic error. Explain the reconciliation rather than merely asserting that the portal is wrong. If part of the amount is accepted, identify that part and show how it was calculated.

When input tax credit is questioned

Map each credit entry to the invoice, supplier and period, then check the statutory conditions applicable to that period. Preserve payment and receipt records, reversal or re-availment workings, and correspondence that explains any reporting difference. Do not claim that a single document proves entitlement if the notice raises several conditions.

When an erroneous refund is alleged

Reconstruct the refund application, supporting calculation, relevant returns, payment trail and the communication under which the refund was issued. Identify whether the dispute concerns eligibility, amount, documentation or the timing of the claim.

What happens after the reply

The officer may accept the explanation, reduce the proposed amount, request clarification, or issue an adverse order. Continue monitoring the portal and preserve every communication. If a further document request arrives, answer the specific request by the new deadline and link it to the earlier reply.

For an adverse order, section 107 generally provides an appeal to the Appellate Authority within three months from communication, with a limited extension possible for sufficient cause. Statutory pre-deposit and filing requirements apply and must be checked against the current law and the order. Do not wait until the end of the possible appeal period to obtain advice, calculate the amount or assemble the record.

Common mistakes and how to avoid them

  • Replying only to DRC-01: Obtain and address the detailed notice and relied-upon documents.
  • Using a generic paragraph: Answer each allegation, figure and tax period in the notice’s order.
  • Missing the deadline: Calendar the stated date immediately and escalate unclear or near-term deadlines.
  • Paying before checking the route: Verify the section, timing and legal effect of DRC-03 payment before making an admission.
  • Ignoring a hearing: Request one in writing when disputed evidence or legal issues warrant oral explanation.
  • Failing to preserve proof: Download the filed reply, annexures, acknowledgement and service records.
  • Assuming an order is just another notice: Review DRC-07 and the underlying order for recovery and appeal consequences.
  • Applying current rules to an old period: Check the law, commencement dates and amendments that govern the specific tax period.

When professional help is justified

Consider prompt assistance from a GST practitioner, chartered accountant or tax lawyer experienced in demand proceedings when the notice alleges fraud or suppression, spans multiple years, involves substantial input tax credit or refund, contains a complex place-of-supply issue, or arrives close to the response or appeal deadline. Professional review is also useful where records are incomplete, several GST registrations are involved, or payment could affect statutory concessions or later proceedings.

Provide the adviser with the complete notice, every DRC summary, service proof, return data, reconciliations, invoices, ledgers, payment records, prior correspondence and your deadline calendar. A clear evidence index reduces delay and helps distinguish factual disagreement from a legal challenge.

Official sources and limits of this guidance

The primary legal references are CBIC’s CGST Act text and its CGST Rules, Chapter XVIII. The rules document is dated 1 January 2022, and both the Act page and procedural rules require checking for later amendments, commencement notifications and the relevant tax period. CBIC also maintains an official GST FAQ page, but a general FAQ cannot determine the correct response to an individual notice.
