What genomic data sharing means for farmers, researchers, and seed companies

Genomic data sharing is the exchange or reuse of genetic sequence information from crops and related agricultural resources for defined purposes such as research, conservation or crop improvement. It does not mean that every dataset is open, that one person automatically owns all sequence information, or that a recipient can use data for any purpose. The applicable permissions depend on what was collected, who contributed it, how consent was obtained, the intended use, security and transfer terms, and whether a treaty or national rule applies.

What counts as agricultural genomic data sharing?

Genomic data is information about the DNA sequence of an organism. In agriculture, it may come from a crop variety, a breeding line, a seed-bank accession, a field sample or another associated resource. CGIAR uses the term “digital sequence information” (DSI) broadly for detailed genetic data obtained by sequencing genomes. Researchers can use those sequences to locate genes associated with characteristics such as disease resistance, drought response, maturity, nutritional composition or other traits.

Sharing can happen when a laboratory sends sequence files to another research group, when a public database makes data downloadable, when a breeder receives results under a transfer agreement, or when a company combines sequence data with its own breeding records. Reuse is also sharing in the practical sense: a dataset collected for conservation may later be analyzed for a breeding project if the original permissions and any later conditions allow that use.

  • Physical genetic resources: seeds, plants, tissues or other material that can be grown, propagated or tested.
  • Digital sequence information: the electronic reads, assembled genomes, variants, annotations and related analyses derived from that material.

A rule that governs a physical seed transfer does not automatically govern every copy, derivative analysis or commercial application of its sequence data. The agreement, consent language and applicable framework must be checked for each case.

Why the three groups involved care about sharing

Farmers and farming communities

Farmers may conserve local varieties, supply samples, participate in on-farm trials or generate operational data linked to a crop. Their interests can include privacy, control over sensitive information, recognition of contributions, future access to improved varieties and economic effects if a trait becomes commercially valuable. Those interests are real, but they do not establish a universal rule that a farmer owns every genomic record connected with a field or variety. The legal and practical position varies with jurisdiction, the data type, community arrangements, consent and contract terms.

For a farmer deciding whether to participate, the important questions are concrete: What sample or data will be collected? Can it be reidentified or linked to a farm? Who may access it? Is it limited to a stated project? Will it be retained, transferred or published? What happens if the project changes? A clear answer to those questions is more useful than a broad promise that data will be “shared responsibly.”

Researchers

Researchers share sequence information to compare diversity, identify genes, validate findings, conserve threatened material and accelerate breeding. Access to a file does not by itself authorize every downstream experiment. A researcher may still be bound by informed-consent limits, an institutional ethics review, a material-transfer agreement, database terms, confidentiality requirements or restrictions on commercial use.

Researchers also need enough metadata to interpret a sequence correctly. Collection location, generation, phenotype measurements and handling history can improve scientific value, but those fields may increase privacy or reidentification risk. Good data planning balances reproducibility with the minimum information needed for the stated purpose.

Seed companies and other private users

Seed businesses can use genomic information to select parents, predict breeding values, validate traits or develop varieties. Commercial potential makes the permission trail especially important. A company needs to know whether the material and sequence may be used in commercial breeding, whether resulting varieties can be sold, whether attribution or reporting is required and whether benefits must be shared.

Where a treaty system covers the physical genetic resource, the relevant material, purpose, contract and benefit-sharing provisions determine the route. That does not turn treaty rules for covered plant resources into a general permission to use every sequence dataset in commerce.

The six questions that determine what a recipient may do

When comparing two sharing arrangements, evaluate the same six dimensions. A short data-sharing label such as “open” or “restricted” cannot answer all of them.

Dimension What to establish before access
Data or material Identify whether the transfer includes physical seeds or tissues, raw sequence reads, assembled genomes, variant calls, annotations, phenotype records or linked farm information.
Contributors and permissions Record who supplied the material or data, whether a community or institution is represented, what consent was obtained and whether any collection permit or ethics approval applies.
Purpose and downstream use State whether access is for research, conservation, training, breeding, commercial development or another defined activity; specify whether reuse, publication, sublicensing or redistribution is allowed.
Identifiability and security Assess whether records can be linked to a person, farm or community and set access controls, confidentiality rules, authentication and breach procedures accordingly.
Transfer and retention Define who may receive copies, where they may be stored, how long they may be retained, how deletion or return works and whether a new transfer requires approval.
Benefits and contributions Set out any required benefit-sharing, attribution, reporting, conservation support or voluntary contribution, including who receives it and when.

These questions mirror CGIAR’s responsible-data guidance, which recommends planning data use in advance, minimizing or avoiding personal information, obtaining informed consent and applying suitable confidentiality and access controls.

How the FAO Treaty’s Multilateral System fits

The International Treaty on Plant Genetic Resources for Food and Agriculture has a Multilateral System (MLS) for specified plant genetic resources used for food and agriculture. The current overview covers 64 crops, which FAO says collectively account for about 80 percent of human food consumption. In 2018, the accessible pool was described as about 2.5 million accessions. By September 2021, users had received more than 6.1 million materials for research, training and breeding.

Access under the MLS is facilitated for the Treaty’s defined purposes. Transfers use the Standard Material Transfer Agreement (SMTA), which sets conditions for access and use and includes benefit-sharing provisions. The system is therefore a structured pathway for covered plant genetic resources, not an open licence for every crop, every sequence file or every commercial activity.

Purposes covered by the treaty pathway

The FAO Treaty FAQ explains that access for research, breeding and training for food and agriculture is governed by the Treaty and the SMTA when the relevant plant genetic resources fall within the system. A proposed use outside those purposes may require different conditions or a separate permission. The fact that a sequence was derived from an MLS material does not eliminate the need to examine the transfer terms and the intended use.

Material under development

The FAQ also distinguishes plant genetic resources under development. A developer may exercise discretion over access to such material rather than treating it as immediately available through the same facilitated route. Anyone receiving a breeding line or associated sequence should verify whether it is covered material under development and which terms the developer has set.

Consent, privacy and security are part of the science

Sequence information may look anonymous once names are removed, but linked metadata can make a farm, household or community recognizable. CGIAR’s Responsible Data Guidelines reproduce a warning attributed to Paul Ohm in the UCLA Law Review (2010): “Data can be either useful or perfectly anonymous, but never both.” In CGIAR’s guidance, the sentence illustrates a trade-off rather than a universal technical law. Removing identifiers can reduce risk while also reducing the context needed for useful analysis.

A practical consent process should describe the collection, the specific purposes, likely recipients, publication plans, retention period, commercial possibilities and the process for handling a change in scope. Where personal information is not needed, do not collect it. Where it is needed, restrict access to the smallest group and dataset that can perform the work. Store keys that connect codes to identities separately, encrypt transfers and maintain an access log.

The OECD report Issues around data governance in the digital transformation of agriculture: The farmers’ perspective, published on 23 October 2020, frames the policy problem this way: “A key challenge for policy makers lies in finding a balance between protecting the privacy and confidentiality of agricultural data, and farmers’ economic interests in those data, while making it possible to leverage their potential for the sector’s growth and innovation.” Unclear governance can reduce farmers’ willingness to adopt digital tools, so privacy controls are also a participation and trust issue.

A practical workflow for setting up a sharing arrangement

  1. Classify the inputs. List the physical material, sequence files, phenotype data, location information and any identifiers. Mark which items are sensitive or potentially identifiable.
  2. Map contributors and authority. Identify farmers, communities, genebanks, universities, breeders and other contributors. Check collection permits, institutional approvals, community protocols and existing contracts.
  3. Write the purpose in operational terms. “Research” may mean conservation analysis, gene-function work or pre-commercial breeding. Specify the permitted experiments, publication, commercial development and redistribution.
  4. Choose the governing instrument. Use the SMTA when the covered plant genetic resource and purpose fall within the FAO Treaty MLS. Otherwise use the applicable material-transfer, data-use, consortium or database terms, along with national requirements.
  5. Set access and security controls. Decide who can download, analyze, publish or share the data. Use role-based permissions, authentication, encryption and a documented incident process.
  6. Define retention and changes. State how long records remain available, what happens at project completion, and whether a new consent or approval is required for a materially different use.
  7. Document benefits and accountability. Record attribution, reports, conservation support, monetary or non-monetary contributions and the party responsible for delivering each obligation.
  8. Review before release. Confirm that the planned transfer matches the consent, contract and treaty conditions. Reassess the arrangement if new metadata, partners or commercial objectives are added.

What is changing for digital sequence information?

Benefit-sharing rules for DSI are still developing. CGIAR’s account of the COP16 outcome says it established a multilateral mechanism and did not require tracking the use of DSI in individual commercial products. That leaves important implementation questions: how contributions will be calculated, which entities will participate, how funds or other benefits will be distributed, and what incentives companies will have to contribute.

Until implementation details are settled, organizations should not tell contributors that every commercial product will generate a traceable payment, nor should companies assume that a sequence file is free of all obligations. The safer approach is to follow the instrument that governs the material and data today, record the provenance and purpose, and monitor changes in applicable international and national rules.

Common situations and the right first check

A farmer supplies a local variety for sequencing

First check the consent and collection terms: who may access the sequence, whether the variety name or location may be published, and whether breeding or commercial use is included. If community interests are involved, use the relevant community or institutional process rather than treating an individual signature as the only consideration.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A university shares sequence files with a breeder

Confirm whether the files came from covered plant genetic resources, whether an SMTA or another transfer agreement applies, and whether the breeder may use the results commercially. The transfer should identify derivative data and publication rights, not just the original seed sample.

A company combines public sequences with proprietary breeding data

Separate the public and restricted inputs, preserve each source’s terms and document the resulting analysis. A public download does not automatically remove confidentiality, attribution or benefit-sharing conditions attached to linked material.

What is not established by the available evidence

There is no single universal legal owner for farmer-linked genomic data. Rights and duties differ by country, data type, consent, contract, community governance and the status of the physical plant genetic resource. CGIAR guidance, FAO Treaty materials and the OECD report are important institutional references, but they do not replace applicable national law, a negotiated agreement, ethics review or professional legal advice.

The most defensible interpretation is therefore conditional: genomic sharing can speed discovery, conservation and crop improvement, but access is permissioned by purpose and terms. Before a farmer, researcher or seed company sends or receives data, it should be possible to answer what is being shared, who contributed it, why it is needed, who may use it, how it is protected, how long it will be kept and what benefits or reports are due.
