What Game Developers Need to Know About Age Ratings and Age Assurance

Age ratings and age assurance solve different problems. A rating tells players, parents, stores and platforms what content a game contains and which age group it is considered suitable for. Age assurance estimates or verifies whether a particular user meets an age threshold so an online service can apply access controls or child-safety protections. A PEGI or ESRB rating does not, by itself, prove a user’s age or make an online service compliant with safety law.

Developers should therefore make two connected but separate decisions: classify the game for each target market, then assess whether the online service needs to establish users’ ages. The answer depends on features such as chat, matchmaking, livestreaming and user-created content, the countries served, the relevant age threshold and the privacy impact of the chosen technology.

Age ratings and age assurance answer different questions

A content classification is attached to the game or release. It uses age categories and content descriptors to communicate themes, violence, language, gambling-like content, sexual material and other factors that may affect suitability. It can also disclose interactive features. The Entertainment Software Rating Board (ESRB), for example, describes three parts of its system:

  • Rating Categories: the age-based category assigned to the game.
  • Content Descriptors: details about content that contributed to the rating.
  • Interactive Elements: notices about features such as user interaction, location sharing, in-game purchases and unrestricted internet access.

Age assurance is an identity or age-estimation process applied to a person using a service. Depending on the design, it may estimate an age band, confirm that someone is above a threshold such as 13 or 18, or rely on a trusted third party to issue an age signal. It is used to decide whether a user can enter a service, view particular material, use a feature or receive protections designed for children.

These functions should not be substituted for one another. A rating is generally produced once per title, edition or market submission; age assurance operates at the point of access and may need to account for changing users, accounts, devices and jurisdictions. Conversely, a reliable age check does not tell a parent whether a game contains intense violence or paid random items. Your compliance and product plans need both tracks.

When does my game need an age check, and is a PEGI or ESRB rating enough?

There is no universal rule that every online game must verify age. Start with the service you operate, not only the game executable. In the UK, Ofcom’s gaming guidance says the Online Safety Act can apply to UK-linked user-to-user services where people interact or create, share or upload material. Its examples include chat, player-created content, matchmaking and livestreaming. Ofcom states: “The Online Safety Act applies to certain types of online services, including those where users can interact with each other, or create, share or upload content.”

Provider-published material is treated differently. Ofcom says the Act’s user-to-user provisions do not cover provider-published game content such as offline gameplay and original or additional game content, except for the pornography exception described in its guidance. The guidance also identifies enforcement of PEGI ratings as a provider activity. That distinction does not remove other duties, but it prevents a developer from treating every part of a game as user-generated content.

Document moderation, reporting, blocking, parental controls and the boundaries between your own content and player contributions. A single-player title with no user interaction presents a different regulatory question from a game service that combines voice chat, user uploads and livestreaming, even when both carry the same content rating.

Follow the UK assessment sequence

For an in-scope Part 3 service, Ofcom’s process is sequential. The regulator’s age-assurance duties page, published 23 February 2024 and updated 2 September 2026, describes these stages:

  1. Complete a Children’s Access Assessment. Decide whether the service is likely to be accessed by children.
  2. If it is likely, complete a Children’s Risk Assessment. Examine the risks to children arising from the service’s content and functions.
  3. Select and implement proportionate protections. The risk assessment informs which measures apply, including age assurance where the service allows content harmful to children.

Ofcom says most Part 3 services without highly effective age assurance are likely to meet the “likely to be accessed by children” test. That does not mean every game must verify age, nor that an age gate is automatically sufficient. The obligation depends on the service’s scope, features and the harmful content or activity it enables. Keep a written rationale for the assessment, the age threshold used, the evidence considered and the controls that follow.

How to evaluate age-assurance methods

Ofcom describes its approach as principles-based and technology-neutral. It lists methods that can be capable of being highly effective at an 18 threshold, but capability is not blanket approval. Accuracy in a laboratory or vendor demonstration can differ from performance in your product, and implementation quality, accessibility, fraud controls and privacy obligations all matter.

Method What it can do Important qualification
Digital identity service Use an established identity provider to return an age or age-band signal. Check coverage, assurance level, account recovery and whether the provider reveals more identity data than you need.
Facial age estimation Estimate an age from a live or captured facial image. Test accuracy across relevant demographics, spoof resistance, accessibility and retention. An estimate is not the same as verified identity.
Mobile-network operator check Use a network account’s age information or eligibility signal. Coverage and reliability vary by country, operator and prepaid or family-account arrangements.
Photo-ID matching Compare an identity document with a selfie or other live check. Consider document coverage, liveness, biometric processing, data deletion and users who lack accepted documents.
Credit-card check Use a card-based process as an age signal. Ofcom lists credit-card checks among methods capable of being highly effective at 18, but you must assess fraud, access, cost and data minimisation.
Open banking Use a regulated banking flow to obtain an age or identity confirmation. Availability, consent, bank coverage and the data returned differ by market.
Email-based age estimation Infer an age signal from an email account or associated information. Assess account sharing, children’s access to family addresses, confidence levels and circumvention.
Self-declared age Ask the user to enter a date of birth or select an age. Ofcom says self-declaration is not capable of meeting its highly effective standard at 18.
Debit-card check without an over-18 requirement Use possession of a debit card as a proxy. Ofcom says this is not capable of meeting the highly effective standard because minors may hold debit cards.
General contractual restriction Put an age limit in terms of service. Ofcom says contractual restrictions alone are not capable of the highly effective standard.

Compare candidate methods on eight axes: accuracy under test conditions; robustness in real deployments; resistance to circumvention; privacy and data minimisation; friction and accessibility; deployment and operating cost; ability to establish the exact threshold required; and geographic and legal acceptability. Ofcom expressly notes that real-world effectiveness and process implementation matter. A method that is technically strong but unusable for a substantial part of your audience may create a different safety and fairness problem.

Use the least intrusive signal that meets the purpose

Define the decision before collecting data. If the service only needs to know whether a user is over 13, receiving a yes/no or age-band token is usually more proportionate than storing a scan of an identity document. Separate the age-assurance provider from your game account where practical, set deletion periods, restrict staff access and log only the decision and evidence needed for audits. Provide an alternative route for users who cannot complete a biometric, banking or document check, while preventing that route from becoming an easy bypass.

What a rating submission should cover

Rating systems are market- and storefront-specific. The UK government identifies PEGI as the video-game rating system and recommends considering ratings industry best practice in its child online safety guidance. In the United States, the ESRB description explains the categories, descriptors and interactive-element notices outlined above. Neither source establishes every legal requirement or storefront rule worldwide.

When planning submissions, compare the target geography and storefront, the scope of the rating, the age-category structure, content descriptors, disclosures about online interaction and monetisation, the submission workflow and whether classification is legally required or mainly a distribution norm. A game may need different submissions, labels or disclosures for different editions, platforms or markets. Re-check current rules with each rating body and storefront before launch or a material content update.

Rating-planning question Why it matters
Which country and storefront? Categories, symbols, legal status and submission routes can differ.
What content is in the shipped build? Descriptors must reflect the actual edition, including downloadable or seasonal content where the system requires it.
What online and commercial features exist? User interaction, purchases and other interactive elements may need separate disclosure from the content category.
Is the label mandatory? Some markets or storefronts impose rules; elsewhere a rating may be a voluntary distribution expectation.
Will the service change after launch? New chat, user uploads, livestreaming or monetisation can change both disclosures and safety assessments.

Privacy, children’s design and safety controls

Age assurance should be reviewed alongside data protection and product safety, not bolted on after a compliance decision. The UK Information Commissioner’s Office includes online games among services likely to be accessed by children and directs designers to its Children’s Code resources on risk assessments, age assurance, transparency and privacy. Use the ICO’s guidance and resources as a parallel privacy-by-design workstream; it is not the same assessment as Ofcom’s Online Safety Act duties.

Explain the check in plain language before it starts: why it is needed, what data is processed, who receives it, how long it is retained, what happens after a failed check and how a user can appeal. Test the complete journey with assistive technologies and low-bandwidth connections. Avoid dark patterns that pressure a child or parent into sharing unnecessary identity information. Review vendors and processors for security, international transfers, deletion guarantees and incident response.

Safety controls should still work after a user passes an age check. Maintain reporting, blocking, moderation, parental controls and escalation paths for abuse. Ofcom’s 2025 gaming guidance reports that 47% of 13-to-17-year-olds expressed high concern about trolling while playing online games, 45% about one-off abusive behaviour or threats, and 37% about intentional harassment, also called “griefing.” These are reported concerns, not incidence rates or proof that those percentages of all players experience harm; they are nevertheless useful signals when prioritising service design.

European Union developments

The European Commission says its proof-of-age solution became feature ready on 15 April 2026, following publication of a blueprint on 14 July 2025. The Commission says the approach can let a user prove they are over 18 without sharing other personal information: “The age verification solution allows users to prove they are over 18 without sharing any other personal information.” It can be adapted to thresholds such as 13+ and is designed for interoperability with future EU Digital Identity Wallets.

This is a development to track, not evidence that every game developer must deploy the solution. Assess whether an EU-wide signal fits your legal basis, target countries, platform architecture and users’ ability to obtain the required credential. Keep market-specific obligations and storefront requirements in your launch checklist.

United States and other markets

The ESRB material explains what its rating communication contains, but it does not establish all United States legal or storefront requirements. State privacy laws, platform policies, payment rules and service-specific obligations can impose additional duties. The same caution applies elsewhere: there is no global matrix in which one rating or one verification method automatically satisfies every jurisdiction.

For each launch market, obtain current advice on classification, child-safety, privacy, biometric processing, consumer protection and age-restricted content. Record the age threshold that each requirement uses; “under 13,” “under 16” and “under 18” are not interchangeable, and a method suitable for one threshold may not establish another.

Consequences of getting the boundary wrong

Ofcom’s gaming guidance, published 14 October 2025, says the Online Safety Act makes online businesses legally responsible for keeping UK users safe, including businesses based abroad. Its age-assurance page says the maximum fine in the most serious cases of non-compliance can be up to 10% of qualifying worldwide revenue or £18 million, whichever is greater. That is a stated maximum, not a prediction of the penalty for a particular game.

More common failures are operational: a rating omits a major online feature; a chat system is launched without a child-risk assessment; a vendor retains identity documents indefinitely; or an age gate is easily bypassed and gives the team false confidence. Assign an owner for each control, test it before launch, monitor bypass and false-positive rates, and trigger a review whenever you add a social, broadcast, creation or monetisation feature.

Developer implementation checklist

  1. Describe the service. Draw the boundary between provider-published content, offline play and user-to-user functions.
  2. List markets and thresholds. Include countries, storefronts, editions and the age threshold relevant to each requirement.
  3. Plan ratings. Gather content, interaction and purchase disclosures and confirm each submission route and deadline.
  4. Run the UK assessments when applicable. Complete the Children’s Access Assessment and, where required, the Children’s Risk Assessment.
  5. Choose an assurance signal. Compare effectiveness, circumvention, privacy, accessibility, cost, coverage and legal acceptability rather than selecting from a technology list mechanically.
  6. Minimise data. Prefer a verified age or age-band response over retaining raw identity or biometric material, and document deletion and access controls.
  7. Build safety around the check. Keep moderation, reporting, blocking, parental controls and appeals available to users who pass or fail assurance.
  8. Reassess on change. Repeat the analysis when chat, uploads, matchmaking, livestreaming, trading, purchases or new regions are added.
