A failed union vote does not end collective action or every legal option. Workers can promptly document possible election interference, file objections within the National Labor Relations Board’s stated deadline, report alleged unlawful conduct, continue acting together on workplace issues, and evaluate a future organizing campaign. The right path depends on whether the workers are covered by federal labor law, what happened during the campaign, and whether an election or contract bar applies.
First, determine which rules cover your workplace
The National Labor Relations Act (NLRA) generally covers employees of private-sector employers, including many people working at game studios, publishers, contractors’ workplaces and support operations. Coverage is not automatic for every person who writes code, designs levels, tests builds or produces art. The NLRB lists independent contractors and supervisors among excluded categories. Public-sector employees and some other groups may fall under different laws.

Job titles do not decide classification by themselves. A person called a “lead,” “producer” or “manager” may or may not meet the legal definition of supervisor, while a worker paid through an agency may have a different employment relationship from a direct employee. Before choosing a legal route, identify the employer, the state or territory, each person’s employment status, and the bargaining unit used in the election. The NLRB’s Employee Rights guidance says that covered employees may join together to improve wages and working conditions “with or without a union.”
This article describes general federal guidance, not a determination about any unnamed studio. A public employer, an excluded worker or a workplace governed by another jurisdiction requires separate advice.

Act quickly if the election may have been tainted
The NLRB says parties may file election objections and supporting proof with the appropriate Regional Director within seven days of the vote count. That is a short period, so do not wait for an informal internal investigation to finish. Contact the NLRB regional office or a qualified labor lawyer as soon as possible to confirm the filing method and the deadline that applies to your case.
Create an incident record
Make a contemporaneous record for every event that could have affected free choice. For each incident, note:
- the date and approximate time;
- the location or communication channel, such as a meeting room, chat server, email or video call;
- the exact words or conduct, distinguishing what you personally saw from what someone else reported;
- the people involved and anyone who witnessed it;
- which employees were eligible to vote or were waiting to vote; and
- the evidence available, including messages, notices, recordings, photographs, calendars or access logs.
Preserve original files and their metadata where possible. Do not edit screenshots, delete messages or ask witnesses to coordinate their accounts. Keep a separate copy in a lawful location, and protect confidential employee information.

The NLRB explains that conduct can justify setting aside an election when it creates confusion or fear of reprisals and interferes with employees’ free choice. Some objectionable conduct is not, by itself, an unfair labor practice. Examples identified by the agency include:

- altering an official Board document so it appears that the Board favors one result;
- excessive electioneering at or near the polls;
- prolonged conversations with voters who are waiting in line;
- maintaining a list of who voted;
- some promises of benefits or actual benefits offered during the campaign; and
- photographing or videotaping employees engaged in protected activity without a legitimate reason communicated to them.
These are examples, not an automatic finding that a particular studio or union violated the law. The Regional Director evaluates the facts, the evidence and the effect on the election. An objection can seek a new election, but no outcome is guaranteed.
Ask about review of an election decision
The NLRB states that requests for review of certain election-related decisions may be filed within 14 days. The applicable route and deadline depend on the decision issued in the case, so read the notice carefully and obtain case-specific advice. A review request is different from the initial objections filing; missing one deadline cannot be cured simply by filing the other.
Report alleged unlawful conduct separately
An election objection asks whether the vote should stand. An unfair-labor-practice (ULP) charge asks the NLRB to investigate alleged violations of rights under the NLRA. A worker who believes rights were violated may file a charge against an employer or a labor organization and may contact an information officer at an NLRB regional office.
The NLRB gives examples of potentially unlawful employer conduct such as threatening job or benefit losses for supporting a union, coercively questioning workers, promising benefits to discourage support, or punishing employees for protected activity or for participating in an NLRB investigation. Whether an incident violates the law depends on its wording, context, timing, the people involved and other facts. Treat an allegation as an allegation until the agency or a court makes a determination.

The same event can raise both issues. For example, a threat made shortly before voting might be relevant to an election objection and also support a ULP charge. The procedures, proof and possible remedies differ, so explain the complete sequence to the regional office or counsel rather than assuming one filing automatically covers the other.
The NLRB reports that more than 90% of meritorious unfair-labor-practice cases are settled by agreement at some point. That agency statistic is not a prediction about game developers, a particular charge or an election challenge; settlement terms and timing vary by case.
Keep working together after the vote
A lost vote does not remove the rights of covered, nonunion employees to engage in protected concerted activity about terms and conditions of employment. The NLRB’s examples include two or more workers approaching the employer about pay or workplace safety, and one employee speaking to management on behalf of coworkers about improving conditions.
Turn shared concerns into a documented request
- Identify a specific issue. Examples in a game workplace might include unpaid overtime concerns, inconsistent remote-work rules, unsafe crunch schedules, harassment reporting, severance terms or a health-and-safety risk. Describe the workplace impact rather than making a personal complaint only.
- Confirm that coworkers support the request. Use a voluntary sign-on list or a group message that records who wants the issue raised. Do not expose anyone’s identity unnecessarily.
- Choose a spokesperson and a written format. A short letter or meeting request should state the problem, the change sought and a reasonable date for a response.
- Keep a response log. Save the request, management’s reply, dates of meetings and any commitments. Follow up in writing when the company makes a promise or changes a policy.
- Watch for retaliation. Record schedule changes, discipline, exclusion from meetings or other adverse treatment that appears connected to protected group activity. Consult the NLRB promptly if the response seems coercive or punitive.
Protection is fact-specific. A personal dispute with no connection to coworkers may not be concerted activity, and excluded workers may not have NLRA protection. Do not assume that every group chat, social-media post or workplace protest is protected; obtain advice before taking a high-risk step.

Consider organizing again, without assuming a timetable
Workers may evaluate another representation campaign after a loss, but the NLRB does not provide a universal repeat-election date. Its process overview says agents examine whether a recent election or an existing contract bars another election. The history of the unit, the reason for the prior result and any pending objections can therefore affect the analysis.
To start an election process, an NLRB petition generally must show support from at least 30% of employees. If an election is held, the NLRB says the result is decided by a majority of votes cast, not a majority of everyone eligible to vote. The 30% showing starts a process; it does not guarantee that the petition will be accepted, that the proposed unit will be approved or that a new vote will occur on a particular date.
Rebuild before filing
- Analyze the loss without blaming individuals. Review turnout, unit boundaries, communication gaps, unresolved concerns and whether employees understood the proposed bargaining unit.
- Resolve factual uncertainty. Confirm who is an employee, who may be excluded as a supervisor or independent contractor, and which employer entities are involved.
- Set a small number of concrete priorities. A clear platform is easier to explain than a list of every workplace frustration.
- Train additional organizers. Reliance on a few visible supporters can make a campaign fragile when people leave or change teams.
- Plan for lawful employer communications. Keep records of statements, avoid speculation and route legal questions to experienced counsel or the NLRB.
- Check for procedural bars before collecting signatures for a petition. A regional office can explain how the prior election and any contract affect eligibility.
How the four practical paths differ
| Path | Primary goal | What you need | Main uncertainty |
|---|---|---|---|
| Election objection | Set aside a vote affected by objectionable conduct | Specific incidents, witnesses and supporting proof filed with the Regional Director | Whether the conduct legally interfered with free choice and warrants a new election |
| ULP charge | Seek an agency remedy for alleged unlawful conduct | A detailed account of the employer’s or labor organization’s actions and available evidence | Whether the facts establish a violation and what remedy is appropriate |
| Continued collective action | Improve pay, safety or other working conditions without a bargaining representative | Employees acting together around a workplace issue and a clear request | Whether the activity and participants are covered and protected in the circumstances |
| Later organizing campaign | Seek union representation in a future election | Support from at least 30% for a petition, an eligible unit and a campaign plan | Election or contract bars, unit questions, turnout and the employer’s response |
A practical response plan for a game team
During the first few days
- Save the official tally, notices, campaign communications and meeting invitations.
- Ask each witness for an independent account rather than a group retelling.
- Confirm the vote-count date so the objection deadline can be calculated correctly.
- Identify whether any conduct involved threats, promises, surveillance, coercive questioning or retaliation.
- Contact the NLRB regional office and, if possible, a labor lawyer who can separate objections from ULP issues.
During the following weeks
- Continue ordinary work while maintaining a secure chronology of management responses and workplace changes.
- Agree on one or two collective workplace requests and deliver them through a designated spokesperson.
- Do not destroy evidence, impersonate management, access systems without authorization or publish confidential personnel information.
- Review worker classifications and the bargaining-unit definition before discussing another petition.
- Tell coworkers what is known, what is disputed and what deadline or agency decision is pending.
Common mistakes and how to recover
Waiting until memories fade
Witness recollections become less precise, and digital messages can be deleted or automatically expire. A dated personal account made soon after an event is more useful than a reconstructed narrative months later. Preserve originals and give copies to counsel or the agency through the requested process.
Recommended Free Tools
Mixing personal grievances with a group claim
A complaint framed only as an individual dispute may obscure the fact that coworkers acted together. Explain who shared the concern, how it was raised and what collective improvement was requested. Conversely, do not label an unrelated personal dispute as protected concerted activity without legal advice.
Best Value
Assuming a loss proves misconduct
Election results do not establish that management or a union acted unlawfully. Turnout, persuasion, unit composition and many lawful campaign factors can determine the outcome. Use neutral language in records and identify evidence rather than conclusions.
Promising a guaranteed second vote
The NLRB’s review of election and contract bars means that a later petition may not be immediately available. Ask the regional office to evaluate the specific election history instead of announcing a date that the rules may not permit.
Questions to take to the NLRB or counsel
- Are the affected workers employees covered by the NLRA, or are any independent contractors, supervisors or public-sector employees?
- What exactly was the vote-count date, and which Regional Director handles the case?
- Does the evidence support an election objection, a ULP charge, both, or neither?
- Is a request for review available for the decision received, and what deadline applies?
- Does a recent election or contract bar another petition?
- Which collective actions can the current workforce take safely while the matter is pending?
The bottom line
For covered game-industry employees, losing a union election is a setback, not a legal dead end. Preserve evidence immediately, use the NLRB’s seven-day objection window if the vote may have been affected, report suspected unlawful conduct through the charge process, keep pursuing workplace improvements together, and assess a future campaign only after checking worker classifications and election bars. A regional NLRB office or qualified labor lawyer can match the facts to the correct procedure.
