Short answer: In the United States, no single federal rule requires every campaign ad or video made with artificial intelligence to carry an AI label. A campaign must apply ordinary Federal Election Commission (FEC) disclaimer and fraud rules, the law and current court orders for the state involved, and the separate policies of the platform carrying the ad. The result depends on who paid for and authorized the communication, whether it is a paid placement or an organic post, what the AI changed, the sponsor’s intent, the election calendar, and where the message is distributed.

What rules apply to an AI political ad?

Think of compliance as three separate tests rather than one “AI rule.” First, determine whether federal campaign-finance law requires a sponsor disclaimer or prohibits a fraudulent representation. Second, check the state statute and any injunction or other controlling court order for the election. Third, satisfy the advertising platform’s authorization, disclosure, targeting and timing rules. Meeting one test does not satisfy the others.

  • Federal baseline: AI use does not replace the ordinary FEC analysis for a public communication, and the FEC did not adopt a universal AI-label mandate in 2024.
  • State overlay: States use different combinations of disclosure requirements, election-period bans and penalties. Some rules have been blocked by courts.
  • Platform overlay: A platform can demand an AI disclosure, identity verification or a blackout period even when the law does not.

This is a U.S. overview, not a determination for a particular campaign. The exact state, office, medium, sponsor, content, intent and dates are necessary to reach a legal conclusion.

Federal FEC rules: the ordinary disclaimer still comes first

When an internet communication is a “public communication”

FEC guidance treats traditional media and paid political communications placed or promoted for a fee on another person’s website, digital device, application or advertising platform as public communications. The campaign should identify who created the message, who paid, whether a candidate authorized it and which committee or person is responsible for the notice. A paid video placement and an individual’s unpaid organic post can therefore receive different treatment under the definition. Review the FEC’s current advertising and disclaimer guidance for the distribution facts.

Internet disclaimer presentation

For an internet communication containing text or graphics, the written sponsor disclaimer generally must be visible without the viewer taking an action and must have reasonable contrast. For a video-only internet communication, the disclaimer must appear without an action and remain visible for at least four seconds. An audio-only internet ad must carry the notice in the audio itself. These internet rules do not impose the same “stand by your ad” requirement used for television and radio.

The required notice is the ordinary sponsor disclaimer, not automatically an AI statement. A campaign should not remove or shrink that disclaimer because a video was generated or edited with software.

A current-law warning on FEC guidance

The FEC page currently notes that the Supreme Court held on June 30, 2026, that the Federal Election Campaign Act’s political-party coordinated-expenditure limits violate the First Amendment. The page also says it had not yet been revised for changes resulting from that decision. Do not treat the page as a complete, updated answer to questions affected by that ruling; confirm the current statute, regulations and FEC notices before relying on a coordinated-expenditure analysis.

What the FEC decided about AI in 2024

On September 19, 2024, the Commission voted not to open an AI-specific rulemaking. Instead, it adopted an interpretive rule applying the existing fraudulent-misrepresentation provisions regardless of the technology used. The Commission’s September 27, 2024 summary states: “The statute, and the Commission’s implementing regulation, is technology neutral.” Read the FEC interpretive-rule summary.

That decision is not a requirement that every synthetic image, parody, voiceover or campaign video carry an AI label. The provisions address specified conduct, including situations in which a candidate or agent purports to speak, write or act for another candidate or party in a damaging way, or a person falsely represents that they act for a candidate or party to solicit contributions. The FEC says it will apply the technology-neutral law to particular technologies and facts case by case.

Do state laws require an AI disclosure or ban a deepfake?

State rules are the most important source of variation. An August 7, 2026 national overview reported that 29 states had AI election-deepfake laws in effect, while California and Hawaii had laws permanently enjoined at that time. It described Minnesota and Texas as examples of time-limited prohibitions, Maryland as an example of a year-round prohibition, and other states as using disclosure rules. Those figures are a dated snapshot, not a substitute for the current statute, election-agency guidance or court orders. See the August 7, 2026 state-law overview and verify the law for the election at issue.

When comparing a state rule, check each of these elements:

  • Content threshold: Does it cover any AI assistance, or only a realistic synthetic depiction that could deceive?
  • Intent and subject: Must the sponsor intend to injure a candidate, deceive voters or impersonate someone? Does the rule cover candidates, ballot issues or both?
  • Timing: Is it effective year-round or only during a specified period before Election Day?
  • Required action: Is the remedy a disclosure, a prohibition, or both?
  • Coverage and exceptions: Does it apply to paid ads, organic communications, satire, parody, news or other exempt material?
  • Enforcement and status: What penalties and complaint processes exist, and has a court limited or enjoined the rule?

Florida’s 2026 conditional disclosure rule

Florida illustrates why the details matter. Section 106.145 of the 2026 Florida Statutes, Chapter 106, applies when a political advertisement, electioneering communication or other political advertisement contains AI-generated images, video, audio, graphics or other digital content that appears to depict a real person performing an action that did not occur. The provision also requires that the content have been created with intent to injure a candidate or deceive about a ballot issue.

  • [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by

When those conditions are met, the communication must prominently state: “Created in whole or in part with the use of generative artificial intelligence (AI).” Florida says this notice is in addition to other required disclaimers and provides penalties for failing to include a required notice. A campaign should apply the complete statutory text to its facts rather than assuming that every AI-assisted edit qualifies or that every synthetic depiction is exempt.

State-law pattern What the 2026 overview reports What to verify before distribution
Time-limited prohibition Minnesota and Texas are examples The exact restricted period, covered content and available exceptions
Year-round prohibition Maryland is an example Whether the rule remains in force and how it defines a prohibited synthetic depiction
Disclosure requirement Other states use disclosure rules Required wording, placement, prominence, intent threshold and enforcement
Court-blocked law California and Hawaii were reported as permanently enjoined on August 7, 2026 The controlling court order and any later legislative or appellate action

Platform policies can be stricter than election law

Meta’s 2026 U.S. midterm rules

For the 2026 U.S. midterms, Meta said advertisers running ads about elections, politics or social issues must complete an authorization process and include a “paid for by” disclaimer. Meta’s Ad Library stores those ads for seven years. The company also said it requires AI disclosures in certain cases and blocks new political, electoral and social-issue ads during the final week of the campaign. Ads that had already received an impression could continue. These are Meta’s platform conditions, not a statement of universal election law. The published guidance is dated February 19, 2026, and was updated June 1, 2026: Meta’s 2026 election guidance.

Google election-ad verification

Google’s political-content policy permits U.S. Election Ads in the United States only after the advertiser completes its US Election Ads verification. The policy page also lists state and local restrictions and pre-purchase information requirements for some states. Because the cited page combines platform rules with jurisdiction-specific conditions, campaign staff should check the exact Google ad product, audience location and state requirements before buying: Google’s political-content policy.

AI changes the voice but not the event

A synthetic voice reading a script still needs the applicable sponsor disclaimer when the communication is a covered paid public communication. State law may add a disclosure if the voice or surrounding content creates a realistic false depiction, and a platform may require an AI label even when state law does not.

AI changes the face or makes the candidate appear to do something

This is the higher-risk pattern under state deepfake laws. Ask whether the depicted action actually occurred, whether the person is identifiable, whether the message concerns a candidate or ballot issue, and whether the jurisdiction requires an intent to injure or deceive. Florida’s 2026 rule, for example, reaches a covered communication that appears to show a real person performing an action that did not happen when the specified intent is present.

Satire, parody and commentary

Do not assume that calling a video satire removes every obligation. The applicable state statute may contain an exception, while federal disclaimer rules and platform policies can still apply to a paid placement. Check the text of the relevant law and the platform’s policy for the exact format and purpose.

A compliance workflow for an AI campaign ad

Use this sequence before publishing or purchasing distribution:

  1. Fix the jurisdiction and calendar. Identify the election, office, state or states where the ad will run, and every relevant date. Confirm the law and court orders as of the planned distribution date.
  2. Map responsibility and payment. Record who created the communication, who paid, who authorized it and whether it will be a paid placement or an organic post. Apply the FEC public-communication and sponsor-disclaimer analysis to those facts.
  3. Describe the AI alteration precisely. Note whether AI changed a voice, face, action, setting, script, image or other content. Ask whether a real person appears to perform an action that never occurred.
  4. Test intent and subject. Determine whether a state rule requires an intent to injure a candidate, deceive about a ballot issue or impersonate a candidate or party. Check whether the communication is about a candidate, a ballot issue or both.
  5. Build the federal disclaimer into the creative. For covered internet video, make the written notice visible without viewer action for at least four seconds; for audio-only ads, include an audible notice. Keep the notice readable with reasonable contrast.
  6. Add any state notice or restriction. If the state requires a particular AI statement, use its wording and prominence requirements in addition to the ordinary sponsor disclaimer. If the law prohibits the communication during the election window, do not publish it.
  7. Complete platform checks. Finish authorization or verification, add platform-required AI disclosures, review targeting and archive requirements, and confirm that the ad is not in a platform blackout period.
  8. Preserve the approval record. Keep the final creative, source media, edits, approval, disclaimers, distribution dates and platform review. This is prudent campaign process; the cited authorities do not establish a universal recordkeeping mandate for every AI ad.

What happens if the ad is already live?

Pause distribution while you identify the state, medium, sponsor and platform facts. Preserve the exact version that ran, including the AI-generated elements and timestamps. Check whether the missing item is a federal sponsor disclaimer, a state AI notice, a prohibited election-window communication or a platform authorization failure. Correcting the creative may not eliminate exposure for an earlier publication, so obtain advice on the applicable complaint, penalty and remedial process rather than silently replacing the file.

How common are undisclosed AI political ads?

The Associated Press reported on September 25, 2026, that the Wesleyan Media Project had identified at least 164 AI-generated or AI-enhanced political ads during the 2026 election cycle. Sixty-nine percent of those identified ads did not disclose AI use. The project cautioned that the total was likely incomplete because determining whether AI was used is difficult. The figures therefore describe a documented sample, not a census of all campaign advertising: Associated Press report.

What to verify before relying on an answer

Election rules can change quickly through legislation, agency guidance and court orders. Before an ad goes live, read the current FEC disclaimer materials, the statute and election-authority guidance for the relevant state, any controlling injunction or appellate decision, and the platform policy for the exact ad product. The FEC itself flags that its disclaimer page had not incorporated the June 30, 2026 Supreme Court decision on coordinated party expenditures. For a specific campaign, obtain advice from election counsel who can apply the current law to the sponsor, content, intent, timing and distribution facts.
