Buying a digital game usually gives you a license—contractual permission to access software under an end-user license agreement (EULA). In both cases, the publisher normally keeps the game’s copyright.
The key distinction: a copy, a license and copyright are different things
“Ownership” is used loosely in game stores, but it can describe three separate legal relationships:
As an Amazon Associate I earn from qualifying purchases.
- Ownership of a copy: You possess a particular cartridge, disc or other tangible item and may have rights to transfer that item under the law that applies where you live.
- A software license: A publisher or platform gives you permission to install or access software under a EULA and store terms. The permission can be limited, conditional or non-transferable.
- Copyright ownership: The copyright holder controls reproduction, distribution, adaptations and other protected uses of the game. Buying a copy does not transfer those rights.
The U.S. Copyright Office describes copyright as control over reproduction, derivative works and distribution, subject to permissions and statutory limits such as first sale. A player can own a lawful copy while having no right to duplicate it, upload it, sell unauthorized copies or create an unlicensed sequel.

The practical question is therefore not simply “Did I pay?” It is “What exactly did I receive, what contract governs it, and what dependencies could stop me using it?”

What a physical game generally gives you
A tangible item you can possess
A cartridge or disc is a physical object that remains in your possession after purchase. You can normally lend it, give it away or sell that item, subject to local first-sale or exhaustion rules and any applicable contract. A second-hand market for physical games existed long before digital distribution; the World Intellectual Property Organization (WIPO) contrasts that market with today’s commonly non-transferable digital licenses.
Physical ownership does not mean every feature will work forever. The disc may contain only an installer, an incomplete build or a license key. A console may require an internet connection for activation, updates or account checks. Multiplayer, cloud saves, downloadable content and anti-cheat services can depend entirely on servers that the publisher later retires.
What the physical copy does not include
- The game’s copyright or permission to reproduce it.
- A permanent promise that online services, patches or downloadable content will remain available.
- A guarantee that new hardware will support the old format.
- Ownership of an account, virtual currency or separately sold in-game items.
A cartridge that runs its entire single-player game offline is usually more durable than a disc that launches only after account authentication. “Physical” reduces some platform dependence; it does not eliminate technical or legal conditions.

Access under a EULA
Digital storefronts commonly describe a purchase as a license to use software, not a sale of a transferable copy. The EULA may grant a personal, limited, revocable or non-exclusive right to install and play while your account remains eligible. Store terms can also change, and the game may be tied to one platform family or account.
The Federal Trade Commission said on April 18, 2024: “When you buy a physical item, you’ve got it. It’s yours. But when you click the ‘buy’ button on a digital product, it really depends.” The agency noted that access may last only while an account or platform remains available, that digital rights-management (DRM) can block use on another console brand, and that the buyer often receives merely a license explained in changeable terms of service.

Contractual controls can be broad
As one platform example, Epic’s EULA prohibits copying, selling, renting, leasing, licensing, distributing or transferring its software. It also says the company may remotely patch software and modify, suspend, discontinue, substitute, replace or limit access; game data may cease to be available without notice. Other publishers use different language, so the EULA for the specific title matters more than a general assumption about “buying” a game.
A license does not automatically mean the publisher can arbitrarily take every product from every customer in every country. Contract interpretation, consumer-protection statutes and mandatory local rights can limit what a term accomplishes. It does mean that your practical rights are defined by the contract and the platform’s technical systems rather than by possession of a standalone object.

Physical ownership versus digital licensing
| Issue | Physical copy | Digital license | Important qualification |
|---|---|---|---|
| What you hold | A particular cartridge or disc | Account-based permission to download or run software | Neither gives you the game’s copyright |
| Transfer or resale | Often possible for the item under applicable first-sale or exhaustion rules | Commonly prohibited by store terms; digital resale law remains unsettled across jurisdictions | Country, platform and contract can change the result |
| Account dependence | May run without an account if the game is self-contained | Usually tied to the purchasing account and platform | Some physical releases also require activation |
| DRM and updates | May avoid online checks, but updates and patches are optional or unavailable after support ends | DRM, authentication and remote updates can control access | Offline play depends on the title’s design |
| Server shutdown | Offline modes may survive; online modes may fail | Access, downloads, cloud saves and online modes may all stop | Read the game’s server and account requirements |
| Copyright | You own the physical object, not the underlying copyright | You receive permission to use software, not the copyright | Copying, redistribution and unlicensed derivatives remain restricted |
Can a platform revoke a game you paid for?
It can sometimes suspend or end access under the EULA, and a technical failure can have the same practical result even when no one expressly “revokes” the game. Common pathways include:
- Account suspension or termination: A ban can prevent downloads, license checks or access to a library.
- Store closure: If a platform stops operating, you may lose the service needed to authenticate or redownload a title.
- Delisting: A removed game may no longer be purchasable or downloadable to a new device, even if existing users retain limited access.
- Server retirement: A game that requires a publisher server can become unplayable when that server is shut down.
- Remote changes: Patches can alter mechanics, remove content or introduce new requirements. Some EULAs expressly reserve that power.
A paid license therefore is not identical to an irrevocable, perpetual entitlement. Whether a particular suspension or shutdown is lawful depends on the EULA, the reason for the action and the law of the relevant jurisdiction.
Can you resell a digital game?
Usually not through the ordinary storefront. Digital stores commonly make licenses personal and non-transferable, and they prohibit selling or transferring an account. Giving someone your login can violate the terms, expose your other purchases and trigger a security lock.

Physical resale is legally more familiar because the transaction transfers the same tangible object. U.S. first-sale doctrine and comparable exhaustion rules elsewhere can limit a copyright owner’s control over a lawfully made copy after its first sale. Those rules do not automatically create a digital resale market: transferring a digital file generally involves making a new copy, while a license contract may prohibit assignment altogether.
Law differs by country, product design and contract wording. A court or regulator may distinguish a true sale from a license, but a store’s “buy” label alone does not settle that question.
What happens when servers or accounts disappear?
Offline-capable games
If the installed game contains a complete offline mode and does not require recurring authentication, a physical copy may continue working after an online service closes. A digital version might also work if the platform leaves the license installed and does not require a new check. Keep in mind that deleting the installation or replacing the device can make recovery impossible if redownload servers are gone.
Online-only games
When the game logic, matchmaking, inventory or saves live on a publisher’s servers, the client software alone is insufficient. Shutdown can end play regardless of whether you bought a disc or a digital license. Virtual currency and in-app purchases can also become inaccessible. The Australian Competition and Consumer Commission warns that cancellation, suspension or discontinued support may prevent recovery of a game or its in-app purchases.
Hybrid games
Many titles combine offline and online components. A campaign may remain playable while multiplayer, events, cloud saves or account-linked unlocks vanish. Check the product description and EULA for separate requirements rather than treating the title as wholly online or wholly offline.

How to check what you are actually buying
- Identify the format. Confirm whether the product is a cartridge, a disc, a download code or an account-bound download.
- Read the store description. Look for “online connection required,” activation, platform restrictions, subscription requirements and statements about downloadable content.
- Open the EULA and store terms. Search for ownership language, license duration, transfer restrictions, suspension rights, remote updates and termination provisions.
- Check account requirements. Determine whether first launch, every launch, multiplayer or redownload requires a publisher or platform account.
- Check server dependence. Find out which modes, saves and purchases stop working if servers are retired.
- Plan for device replacement. A physical copy may need compatible hardware; a digital license may require the original account and a functioning storefront.
- Save evidence. Keep receipts, the product page and the version of the terms in effect at purchase. They can help if the description was misleading or access changes unexpectedly.
Ownership does not authorize copying the game
Whether you own a disc or hold a license, copyright law still governs what you can do with the software. The copyright owner generally controls reproduction, distribution, public performance, adaptations and other protected acts. Personal use of a lawful copy is not the same as uploading a disc image, sharing a download, selling duplicate copies or making an unlicensed derivative.
Exceptions vary. Statutory limits, interoperability rules, preservation provisions and consumer laws differ by country and may be narrow. Do not assume that owning the media makes every technical workaround lawful.
Consumer protection and jurisdiction
The result for a disputed game depends on where you live, how the product was advertised, the platform’s contract and whether the title is usable without remote services. The FTC’s 2024 guidance emphasizes that digital products are often sold with access conditions that consumers may not notice. The ACCC likewise warns that access and in-app purchases can be lost after cancellation, suspension or discontinued support.
Those statements are not a universal rule that every digital purchase is temporary, nor are they a promise that every physical copy is permanent. They illustrate why “buy” can be misleading without qualification. If a seller represented lifetime ownership but supplied only revocable access, local consumer-protection authorities or courts may provide remedies. This is general information, not jurisdiction-specific legal advice.
Practical answers to the questions players ask
Do I actually own a digital game I bought?
You generally own a license or access entitlement, not the copyright and not a transferable digital object. The exact duration and conditions are in the EULA and store terms.

Can a platform take it away?
Suspension, termination, delisting, server shutdowns and remote technical changes can prevent access. The contract and local law determine whether a particular action is permitted.
Is a cartridge mine if the publisher owns the copyright?
Yes, you can own that physical cartridge while the publisher retains copyright. Your ownership is subject to copyright limits on copying, distribution and adaptations.
Can I resell a download?
Store licenses commonly prohibit transfer, and account sales can violate security and contract rules. Digital-resale rights remain legally unsettled and vary by jurisdiction.
What should I buy if long-term access matters?
Prefer a physical release with a complete offline mode, verify that it does not require activation, and check whether essential content is on the disc or cartridge. No format guarantees perpetual access to online services.
The practical bottom line
A physical copy gives you a tangible object that may be transferable and usable without a storefront, while a digital purchase usually gives you conditional, account-based permission. Neither transaction transfers the game’s copyright, and either format can lose features when servers, accounts or compatible hardware disappear. Treat the EULA, technical requirements and local consumer law as part of what you are buying—not as fine print that can be ignored.
