AI liability insurance is not one universal policy. Coverage is usually assembled through professional-liability (E&O), employment-practices (EPL), directors-and-officers (D&O), cyber, media and general-liability policies, sometimes with a standalone AI policy or endorsement. A claim is paid only when the policy’s insuring agreement reaches the AI activity and the claim survives its exclusions, sublimits, retention, reporting and other conditions.
That means an AI chatbot error, discriminatory hiring result, shareholder suit or regulatory investigation can fall into different coverage parts—or into none. The actual wording, endorsements and facts control.

What “AI liability insurance” means
Insurers use the term for several products rather than a standardized contract. A technology company may buy E&O for incorrect outputs or failed services, cyber insurance for a data or security event, EPL for employment decisions, D&O for governance allegations, media liability for content claims and CGL for bodily injury or property damage. Some insurers add affirmative AI wording to those policies; others offer a standalone policy or a wrapper that combines selected protections.
Coverage generally pays some combination of defense costs, settlements and covered damages. Regulatory-proceeding costs, investigation expenses, fines and penalties are treated differently by policy and jurisdiction. A policy can have an AI definition, a dedicated AI limit, a retention that applies only to AI claims, or an exclusion that removes claims arising from AI altogether.

“Silent AI” describes wording that neither expressly covers nor excludes AI losses. Mayflower explains that silence can leave the parties arguing about intent and interpretation after a loss. An affirmative grant that describes the insured’s AI activities is clearer than relying on silence.
What kinds of AI claims may be covered?
Professional errors and E&O
A customer may allege that an AI product, model or chatbot supplied a wrong answer, misinformation, defective recommendation or substandard professional service. An E&O policy can respond when the allegation is a covered professional error and the policy does not exclude AI. Mayflower notes that many E&O forms are silent about AI or can exclude it unless affirmative wording is added.
Important details include whether the insured is a model developer, application provider, systems integrator, reseller or end user; whether the service promised human review; and whether the alleged loss is financial, bodily or property-related. A chatbot that gives a wrong tax instruction and an industrial AI system that causes physical damage may trigger different policy sections.
Employment-practices claims
Applicants or employees can allege that an AI screening, ranking, promotion or performance-evaluation tool discriminated against them. EPL may cover defense and covered damages if the claim fits the policy’s employment-practices insuring agreement and no AI exclusion applies. Underwriters may ask how the tool was tested, what human review occurred and how adverse decisions were documented.
Coverage does not make the use lawful. The employer remains responsible for complying with applicable employment, privacy and anti-discrimination rules, and intentional misconduct, prior-knowledge and uninsurable-penalty provisions may limit recovery.

Directors-and-officers and governance allegations
Shareholders may claim that directors or executives overstated the company’s AI capabilities, hid material risks or failed to supervise deployment. D&O can be relevant when the allegation is a wrongful management act and the policy has no applicable AI exclusion. Hunton’s 2025 review records AI exclusions appearing in D&O forms, including changes made at renewal, so a prior year’s wording is not a reliable guide to the current year.
Cyber, privacy, regulatory and media exposures
Some cyber products expressly list AI-related regulatory-proceeding and media-liability coverage. Those grants can cover specified damages, legal fees and expenses, subject to the policy’s definitions, limits and exclusions. A claim involving training data, a prompt-injection attack, an exposed model endpoint or an AI-generated publication may involve several coverage parts at once.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Check whether the policy treats a regulator’s investigation as a “claim,” whether defense costs erode the limit, and whether fines or penalties are legally insurable. Media coverage may require a covered publication offense, while cyber coverage may require a security or privacy event; an AI mistake by itself may not satisfy either trigger.
General liability, bodily injury, property damage and economic loss
CGL can address bodily injury, property damage, personal injury or advertising injury when the claim falls within its insuring agreement. It may also respond to certain economic-loss allegations if the wording allows them. However, Lloyd’s and ISO forms have introduced AI exclusions aimed at bodily injury, property damage, personal injury, advertising injury and economic loss arising from AI, according to Hunton. An AI endorsement can therefore remove an exposure that would otherwise look like a conventional CGL claim.
What AI liability policies commonly exclude
Broad “arising out of AI” exclusions
The broadest exclusions remove claims arising from the actual or alleged use, development or deployment of AI. Hunton describes carrier wordings that operate this way, including an “absolute” exclusion associated with Berkley. “Arising out of” language can reach more than a defective algorithm: it may encompass a contract dispute, an injury or a privacy allegation if the claimant says AI was part of the causal chain.

Line-specific exclusions
AI exclusions have appeared in professional liability, CGL, D&O, EPL and related forms. A company can therefore have coverage in one line and an exclusion in another. Read each endorsement rather than assuming that an AI exclusion on a cyber policy governs the entire insurance program.
Prohibited practices and use restrictions
Some cyber forms list prohibited AI practices. Raheja QBE’s cyber policy information, for example, identifies exclusions for prohibited-AI practices. The schedule or endorsement should state which uses are prohibited; a violation can defeat coverage even when the underlying incident would otherwise be insured.
Ordinary policy limitations that still matter
Affirmative AI wording does not override normal policy mechanics. Depending on the form, recovery can be reduced or barred by:
- Deductibles or self-insured retentions, including a separate AI retention.
- AI sublimits, aggregate limits, waiting periods or coinsurance.
- Claims-made reporting deadlines, a retroactive date or a prior-knowledge condition.
- Territorial limits and definitions of where an act, injury or claim occurs.
- Contractual-liability exclusions, unless an insured-contract exception applies.
- Intentional-conduct, fraud and knowing-violation exclusions.
- Exclusions for fines, penalties or other amounts that cannot legally be insured.
- Related-claims wording that treats multiple customer complaints as one claim.
There is no universal list. The policy, endorsements and applicable law determine which limitations apply.
How common scenarios are analyzed
| Scenario | Potential coverage | Questions that decide the result |
|---|---|---|
| Customer says a chatbot gave incorrect professional advice | E&O; possibly media or cyber | Was the chatbot part of a covered professional service? Is AI affirmatively covered or excluded? Are economic losses within the insuring agreement? |
| Applicant alleges an automated hiring score discriminated | EPL; possibly regulatory or cyber | Does EPL cover the alleged employment practice? Is there an AI exclusion? What human oversight and testing were required? |
| Shareholders allege executives misrepresented AI capabilities | D&O | Is the allegation a covered management wrongful act? Was an AI exclusion added at renewal? Are defense costs inside the limit? |
| Regulator investigates an AI deployment | Cyber or regulatory-proceeding coverage in an applicable policy | Does “claim” include the investigation? Are investigative fees covered? Are fines or penalties excluded? |
| AI-controlled equipment injures a person or damages property | CGL, product liability or specialty coverage | Does the bodily-injury or property-damage grant apply? Does an AI exclusion remove the claim? Where did the occurrence happen? |
| AI-generated advertisement allegedly defames a competitor | Media or advertising-injury coverage | Was the content a covered publication? Do intellectual-property, intentional-act or AI exclusions apply? |

1. Your role and AI activity
State whether you develop a model, provide an AI-enabled product, integrate a third-party model, resell a service or merely use AI internally. Identify training, fine-tuning, deployment, monitoring, updates and human-override duties. A policy written for an application user may not cover model development or services supplied to customers.
2. The claim types you need insured
Map professional errors, discrimination, privacy and security events, intellectual-property or media allegations, bodily injury, property damage, pure economic loss, shareholder suits and regulatory proceedings separately. “AI coverage” without a list of covered claim types can conceal important gaps.
3. Trigger and scope
Confirm whether the policy is claims-made or occurrence-based, its retroactive date and territory, when defense costs are paid, who controls the defense, and how consent to settle works. Review related-claims and interrelated-wrongful-act wording so repeated model outputs or multiple claimants do not create an unexpected single limit.
4. The AI wording itself
Look for an affirmative grant, the definition of AI, “arising out of” language, absolute versus partial exclusions, and exceptions for human oversight, approved vendors or specified uses. A narrow exclusion for autonomous decision-making is materially different from an exclusion for any use, development or deployment of AI.

6. Governance conditions
Some insurers require an AI inventory, written governance rules, testing, documentation, vendor controls, incident response and human review. A condition can become a coverage issue if the insured cannot demonstrate compliance. Obtain the exact wording rather than relying on a proposal summary.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Buyer checklist before binding or renewing
- Inventory systems and uses. List every model, application, vendor, customer-facing chatbot, employment tool and internal workflow. Include experimental and shadow-AI use discovered through procurement or security reviews.
- Describe your role. Tell the underwriter whether you develop, sell, integrate, resell or simply use each system, and identify who controls training data, updates and output review.
- Map the insurance program. Place each exposure against E&O, EPL, D&O, cyber, media and CGL. Note where two policies could respond and where neither clearly does.
- Collect every exclusion and endorsement. Obtain the full policy, AI exclusions, affirmative grants and renewal changes. A certificate of insurance or verbal assurance cannot establish the operative wording.
- Request affirmative protection. Ask specifically how chatbot errors, employment decisions, governance allegations, regulatory proceedings, media claims, economic loss and physical damage are treated. Ask whether defense costs and investigations are covered.
- Verify mechanics. Confirm limits, sublimits, retentions, territorial scope, retroactive dates and claims-made notice requirements. Calendar notice deadlines and identify who must receive notice.
- Provide governance evidence. Mayflower reports that an AI inventory, written governance policy and testing evidence can improve underwriting terms. Keep those materials current and preserve test results, approvals and incident records.
- Get a coverage opinion for material risks. Have a licensed broker or coverage counsel apply the actual wording to your facts before relying on it. The LMA states that an authoritative view on a specific loss requires review of the facts and the policy wording used.
What changed in the market for 2025–2026?
Hunton’s 2025 review records a rapid spread of AI exclusions across named carriers and multiple policy forms. Mayflower reports three ISO generative-AI CGL exclusions taking effect in January 2026. A renewal can therefore narrow coverage without changing the policy’s headline name or limit.
The NAIC’s 2025 Global Insurance Market Report describes a market containing standalone cover, wrappers and updates to existing products. It also reports that supervisors in 15 jurisdictions monitor and report AI-related underwriting risks. Product availability and regulatory treatment can differ by country, state and line of business.
Recommended Free Tools
The NAIC warns that AI-generated information can sound accurate while being incorrect. Insurers remain responsible for insurance-law, fairness, accuracy and anti-discrimination requirements when they use AI. Those obligations can create EPL, D&O, cyber, professional-liability or regulatory-proceeding exposure, but an insurer’s responsibility does not itself create coverage for the policyholder; the policy must grant it.
What to do after an AI-related incident
- Preserve evidence. Secure prompts, outputs, model and software versions, training or retrieval sources, logs, human approvals, customer communications and incident timelines.
- Notify potentially responsive insurers promptly. Follow each claims-made notice provision and any cyber-breach hotline or panel-counsel requirement. Late notice can become a coverage dispute.
- Do not characterize the event casually. A message saying the company “caused” a loss or “knew” a model was defective can affect defenses. Give factual notice and identify all potentially involved policy lines.
- Coordinate the response. Engage qualified incident, employment, regulatory, product and coverage counsel as appropriate. Preserve privilege and avoid destroying model or vendor records.
- Test every policy path. The same event may involve E&O, cyber, EPL, D&O, media and CGL. An exclusion in one policy does not automatically eliminate another policy’s coverage.
Bottom line: wording beats the label
Whether AI liability insurance pays depends on the insured’s role, the alleged harm, the policy trigger and the exact AI grant or exclusion. Affirmative wording that names the relevant use and claim type is more predictable than silent coverage. Broad exclusions can remove claims arising from AI use, development or deployment, while sublimits, retentions, claims-made conditions and uninsurable-penalty rules can still restrict recovery. Review every renewal, map the risks across policy lines and obtain advice on the actual facts and forms before assuming an AI claim is insured.
Frequently Asked Questions
Do I need a standalone AI liability policy?
Not necessarily. Many organizations address AI through affirmative endorsements or coordinated E&O, EPL, D&O, cyber, media and CGL coverage. A standalone policy may be useful when those lines leave a documented gap, but the decision depends on your role, use cases, limits and exclusions.
Does a certificate of insurance prove that AI use is covered?
No. A certificate summarizes insurance and does not replace the policy, endorsements or exclusions. Obtain and read the operative forms, including changes made at renewal.

Yes. AI exclusions and endorsements can be added or broadened at renewal. Hunton’s 2025 review and Mayflower’s report of ISO generative-AI CGL exclusions effective January 2026 illustrate why each renewal set must be compared with the prior year.
