After a data breach, a company must contain the exposure, preserve evidence, determine what happened and who is at risk, assess every applicable notification rule, communicate accurately, and fix the cause. There is no single deadline or checklist for every organization: duties depend on the company’s location, the people affected, the data involved, its role as controller or processor, and sector-specific law. European Union and United Kingdom rules can require regulator notice within 72 hours when the relevant risk threshold is met; United States deadlines differ by state and industry, with some Federal Trade Commission rules setting separate limits.
What to do in the first hours
Activate an incident-response team
Put one person in charge and bring together the specialists needed to make decisions. Depending on the incident, that group may include security, IT, operations, legal counsel, communications, privacy staff, senior leadership, and outside forensic investigators. Define who can authorize containment, engage vendors, communicate with regulators, and approve public statements. Keep a written incident log from the first decision onward.

Contain the ongoing exposure
Stop additional loss without destroying evidence. Isolate affected servers, accounts, endpoints, applications, or physical areas; disable compromised credentials; block malicious access; and remove personal information that was accidentally posted online. The Federal Trade Commission advises taking affected equipment offline, while cautioning organizations not to turn machines off before forensic experts can assess them. Follow the containment plan with the forensic team so that a well-intentioned shutdown does not erase volatile evidence. The FTC’s Data Breach Response: A Guide for Business (August 2023) describes these initial actions.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesPreserve evidence
Do not wipe, reimage, or casually alter systems that may explain the intrusion. Preserve logs, email, access records, malware samples, images of storage, relevant physical evidence, and the chain of custody for each item. Interview the people who discovered the incident and those who operated the affected systems. The UK government’s Model Action Plan for Responding to Significant Data Breaches includes isolating systems, disabling compromised accounts, preserving evidence, identifying the source, and recording decisions.

Establish what happened and who is affected
Use qualified investigators
An independent forensic investigator can identify the entry point, determine how long an attacker had access, capture and analyze evidence, and recommend remediation. Counsel should help preserve legal privilege where appropriate and determine which laws, contracts, insurance conditions, and law-enforcement obligations apply. Technical findings should be updated as new evidence appears; an early estimate is not a substitute for a documented investigation.
Inventory the data
Determine whether the event involved disclosure, theft, loss, destruction, alteration, or unauthorized access. Identify each data category, such as names and contact details, account credentials, financial information, government identifiers, health records, employee records, or confidential business information. Record whether data was encrypted or otherwise protected, whether the protective measure remained effective, and whether an attacker actually accessed or exfiltrated it.
Count people and locate them
Establish the number of affected individuals, the countries or U.S. states where they live, and whether you have reliable contact details. Separate confirmed victims from people whose data may have been exposed. Note vulnerable groups, such as children, patients, or employees, because the likely harm and required safeguards can differ. Preserve the method used to reach each estimate so it can be explained to a regulator or corrected later.

Identify the company’s legal role
Under data-protection frameworks, a company may be a controller deciding why and how personal data is used, or a processor handling it for another organization. Contracts can add notice duties. For example, under the EU GDPR, a processor must notify its controller of every personal-data breach, while the controller evaluates regulator and individual notification duties. A company should map each affected dataset to its owner, processor agreement, and applicable sector rule rather than assuming one rule covers the whole incident.
Assess notification duties before choosing recipients
Make a jurisdiction-by-jurisdiction assessment with counsel. The relevant questions are whether the incident meets a legal definition of breach, what risk it creates for individuals, when the organization became aware, which regulator has authority, whether a sector rule applies, and whether an exception or effective safeguard changes the result. A generic checklist cannot replace this case-specific analysis.
| Framework or situation | Regulator notice | Notice to affected people or media | Key qualification |
|---|---|---|---|
| EU GDPR | When the breach is likely to pose a risk to individuals’ rights and freedoms, the controller notifies the supervisory authority without undue delay and, where feasible, within 72 hours after becoming aware. | Generally required without undue delay when the breach is likely to result in a high risk to individuals’ rights and freedoms. | Communication to individuals can be excepted when effective protective measures make the high risk unlikely to materialize, among other exceptions. A processor notifies its controller of every personal-data breach. See the European Commission’s GDPR obligations overview. |
| UK GDPR guidance | Notify the Information Commissioner’s Office within 72 hours of awareness when notification is required. The ICO says to submit within the period even if all details are not yet available. | Tell affected people without undue delay when the breach is likely to create a high risk to their rights and freedoms. | Record the breach and the organization’s assessment, including a decision not to notify. See the ICO personal data breaches guide. |
| United States, general business | There is no single federal deadline for every business incident. Determine which state, federal, territorial, and contractual rules apply. | State and federal requirements govern content, timing, and recipients. Every state, the District of Columbia, Puerto Rico, and the U.S. Virgin Islands has notification legislation involving personal information. | Definitions, triggers, deadlines, and exceptions differ substantially. The FTC’s business guide directs companies to review the law in every affected jurisdiction. |
| FTC Health Breach Notification Rule | Covered vendors of personal health records and related entities must notify the FTC when the rule’s conditions are met. | Notify affected people; media notice is required in some cases, including when at least 500 residents in a jurisdiction are affected. | The FTC describes a general outside limit of 60 calendar days after discovery, alongside acting without unreasonable delay. Confirm that the organization and incident are covered. See Complying with the FTC’s Health Breach Notification Rule. |
| FTC Safeguards Rule | A covered financial institution must report a defined notification event to the FTC as soon as possible and no later than 30 days after discovery. | Individual notice may also be required under other laws or rules. | Coverage and the definition of a notification event must be tested against the entity and facts. See the FTC’s Safeguards Rule guidance. |
The 72-hour, 60-day, and 30-day periods are not interchangeable. They start from different events, apply to different entities, and may run alongside state, contractual, or sector deadlines. A company should calendar the earliest plausible deadline while its investigation continues, then update the assessment as facts become clearer.

Coordinate regulators, law enforcement, and other parties
Regulators
Prepare the required regulator report with the facts known at the time, the categories and approximate number of people and records involved, likely consequences, containment steps, and a contact person. If details are incomplete, submit the initial report within the applicable period and provide updates rather than waiting for a perfect forensic narrative where the rule permits staged information.

Discuss criminal conduct, extortion, threats, safety concerns, or evidence-preservation issues with the appropriate law-enforcement agency. Coordinate timing with counsel because an investigation may affect what can safely be disclosed. Do not promise secrecy that the law does not allow, and do not delay a mandatory regulator or individual notice without a documented legal basis.
Customers, business partners, and insurers
Review contracts for notice clauses, processor-to-controller escalation terms, security obligations, and approved communication channels. Notify partners whose systems or data are implicated. Follow cyber-insurance requirements for approved investigators, counsel, and evidence handling; failure to follow them can complicate coverage even when the breach response is otherwise sound.

Write an effective notice to affected people
The exact legal elements vary, but a useful notice is plain, specific, and actionable. Explain:
- What happened and when the organization detected it, using a confirmed timeline and clearly labeling facts that remain under investigation.
- What information was involved and whether the organization has evidence of misuse or only unauthorized access.
- The likely consequences for recipients, such as phishing, account takeover, identity theft, financial fraud, or exposure of sensitive personal details.
- What the company has done and is doing, including containment, credential resets, vulnerability fixes, cooperation with investigators, and monitoring.
- What recipients can do now, matched to the exposed data: change reused passwords, enable multifactor authentication, scrutinize messages and calls, contact financial institutions, place an appropriate fraud alert or credit freeze, or seek specialized medical advice when health information is involved.
- A reachable contact point, such as a dedicated phone number, web page, or data protection officer, plus the hours and languages supported.
- How and when further updates will be delivered.
ICO guidance specifically calls for a plain-language description, a data protection officer or other contact, likely consequences, and response or mitigation measures. FTC guidance likewise recommends explaining what happened, what information was taken, remediation, protective support, and relevant contacts. Avoid speculative claims, legal conclusions presented as facts, and technical details that would help an attacker. Never tell people that their risk is zero unless the evidence and applicable rule genuinely support that statement.
Offer proportionate help without overpromising
Support should reflect the information exposed. If financial information or Social Security numbers were involved, the FTC suggests considering at least one year of credit monitoring or other identity support. That is guidance, not a universal legal requirement, and it does not replace fixing the underlying vulnerability. Explain enrollment limits, eligibility, duration, and what the service does not cover. Provide a staffed channel for people who cannot use an online process.
Best Value
Use one source of truth for notices, call-center scripts, and status updates. Train staff to recognize follow-up scams that impersonate the company. Publish only the details needed to help recipients protect themselves; a notice that reveals attack paths, employee names, or unrepaired weaknesses can create additional risk.
Remediate the cause and document the decision trail
Fix the weakness
Apply forensic recommendations, patch exploited software, rotate exposed secrets and credentials, review privileged access, close unnecessary services, and restore systems from trusted backups. Test the fix and monitor for repeat access. If a supplier or processor was the entry point, require corrective action and verify it rather than treating the vendor’s assurance as proof.
Review the response plan
After urgent work is complete, conduct a structured post-incident review. Compare detection, escalation, containment, investigation, notification, and recovery against the written plan. Assign owners and deadlines for improvements, and update contact lists, decision authorities, logging, retention, tabletop exercises, and employee training.

Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Keep an auditable record
Record the incident chronology, systems and data examined, risk analysis, affected jurisdictions, regulator and individual notices, communications, remediation evidence, and the reasoning behind every notification decision. If the company concludes that a regulator or affected people need not be notified, preserve that conclusion and its supporting facts. UK ICO guidance and the UK action plan both emphasize recording breaches and decisions; documentation also helps answer later regulator, customer, insurer, or litigation questions.
Common failure modes and safer alternatives
- Shutting down everything immediately: isolate systems in coordination with forensic responders so volatile evidence is not lost.
- Waiting for a complete investigation before acting: meet the applicable clock with the information available, then supplement the report as facts develop.
- Using one national checklist: map every affected person, state or country, data category, sector rule, contract, and controller or processor relationship.
- Sending a vague apology: state the affected data, likely consequences, protective steps, contact method, and update plan in plain language.
- Assuming encryption ends the analysis: verify whether the key or credentials were also exposed and whether the protection made the risk unlikely to materialize.
- Forgetting people whose addresses are missing: document the population estimate and use legally appropriate alternative communication methods where required.
- Declaring the incident closed after notifications: monitor for misuse, complete remediation, and retain the decision record.
A practical standard for “done”
A response is not complete merely because systems are online or a notice has been mailed. The company should be able to show that exposure was contained, evidence was preserved, the affected data and people were identified as accurately as possible, every applicable notification path was evaluated, communications were truthful and useful, and the exploited weakness was corrected. The final record should explain both what the organization did and why it chose not to take any step that the law did not require.
