Data-center zoning rules determine where a facility may be built, which approvals it needs, and how its buildings, equipment and operations must protect nearby uses. Typical controls cover zoning districts, public hearings, setbacks, height and floor area, landscaping, appearance, noise, generator testing, water and wastewater, electric capacity, environmental review and post-construction monitoring. There is no single national data-center zoning code: the controlling requirements are the current rules for the specific parcel and jurisdiction.
What data-center zoning covers
Zoning is primarily a land-use system, but modern data-center reviews often reach beyond the building footprint. A local government may regulate the use itself, the site layout and building form, or operating effects that can affect neighbors and public infrastructure.

- Location: which zoning districts permit a data center and whether the use is treated as a separate category or grouped with industrial, warehouse or technology uses.
- Approval path: whether the project is allowed by right or needs a conditional-use permit, special exception, planned-development review, rezoning or another discretionary approval.
- Physical compatibility: setbacks, separation from homes and sensitive uses, height, building area, buffers, screening, lighting, equipment placement and facade design.
- Operating impacts: sound studies, property-line limits, low-frequency or tonal-noise controls, cooling equipment, generator testing and emergency operations.
- Infrastructure and environment: water and wastewater demand, electric-service capacity, backup generation, stormwater, air quality and environmental-review documents.
- Accountability: public notice, hearings, post-construction testing, annual reports, inspections and enforcement.
The exact numbers and procedures differ substantially. A rule in one city cannot be assumed to apply in another, even when both jurisdictions use the term “data center.”
First question: is the use allowed on this parcel?
How the code defines a data center
Some codes create a dedicated definition based on server rooms, electrical and cooling systems, and the facility’s primary purpose. Others place the use under an existing industrial or warehouse category. The definition matters because it controls which districts and approval procedures apply.

Calvert County illustrates why checking the latest code is important. The county reported that data centers had previously been permitted where warehouses were allowed, without a specific definition. A 2025 update formally defined the use and limited it to industrial zones. In Heavy Industrial I-2, the use is conditional. In Light Industrial and Mixed Use I-1, it requires conditional-use approval that includes a Board of Appeals Special Exception. The county also requires an applicant-hosted public meeting before Planning Commission consideration.
By-right, conditional and special approvals
A by-right use is reviewed mainly for compliance with objective standards. A conditional or special approval gives the local body discretion to impose conditions, deny the use or require mitigation after a public process. Hearing rights and decision-makers vary.
Kearney requires a conditional-use permit for data centers in its BP, M-1 and M-2 districts, with hearings before the Planning Commission and City Council. Tucson’s large-scale facilities use existing Planned Area Development and Planned Community Development procedures. Those procedures include neighborhood coordination, a public hearing, Zoning Examiner review and final consideration by the Mayor and Council. The required route therefore depends on both the district and the project’s local definition or size threshold.

Separation from homes and sensitive uses
Large equipment yards, substations, cooling plants and generator compounds can be placed far from property lines or occupied buildings even when the main structure meets a normal industrial setback. Codes may measure distance from a property line, a residence, a residential zoning district or another sensitive use such as a school, hospital or park.

Calvert County states a 200-foot setback from property lines and 400 feet from a parcel containing a residence or an active residential-building permit. The county describes a common-ownership exception in its rule; applicants must read the adopted text to determine when it applies. These figures are local requirements, not a general national standard.
Height, floor area and equipment placement
Data centers can be large, windowless buildings with rooftop cooling and extensive exterior electrical equipment. A code may cap building height, server-room or “white-space” area, floor area, lot coverage or the number of buildings. It may also specify where transformers, cooling towers, fuel tanks, loading areas and generators may sit.
Tucson’s adopted large-scale rules report enhanced separation distances and substantial landscaping or open-space requirements. An earlier proposed summary included a 50-foot height limit; that proposal should not be treated as the adopted standard unless the operative text confirms it.
Minneapolis describes preliminary recommendations rather than an effective ordinance. The material calls for conditional-use review for new or expanded facilities, limits in downtown districts, a 175,000-square-foot white-space cap, preference for using existing buildings and controls on where server rooms and equipment may be located. The page labels its hearing and City Council dates tentative, so an applicant must verify whether those recommendations have become law.

Buffers, screening and appearance
Landscape strips, walls, berms and opaque fencing can hide generators, substations, loading areas and cooling equipment. Requirements may include evergreen plantings, minimum planting widths, maintenance obligations, photometric limits for lighting and viewshed plans. Facade rules can require articulated walls, changes in materials, entrances facing public streets or treatments that reduce the appearance of a blank industrial box. Calvert County expressly requires facade treatments in addition to its separation standards.
Noise, cooling systems and generators
Why acoustic review is common
Cooling fans, pumps, chillers and generators can operate continuously or at high output. Zoning conditions may require a baseline ambient survey, predictive modeling, a mitigation plan and testing after construction. Measurement points are often at a property line or a nearby residence, and some rules distinguish ordinary sound from tonal or low-frequency noise.
Fairfax County’s staff report describes worst-case modeling with cooling equipment at full load and requires a post-construction study before a Nonresidential Use Permit is issued. Its noise framework includes exceptions for routine backup-generator testing and emergency use, subject to the applicable conditions.

Kearney lists sound-level limits at the property line, sound studies, and specific treatment of tonal and low-frequency noise. Its requirements also address emergency generators and air-quality measures, with annual reporting. Those details show why a single daytime decibel number may not answer a local reviewer’s questions.

Generator testing and proposed standards
Backup generators are usually tested periodically, even when they are not running during a utility outage. A rule may restrict testing to weekday hours, require acoustic barriers, limit duration, require emissions information or distinguish routine tests from emergencies.
Fort Worth’s web materials separate existing standards from proposed data-center standards. The proposed material describes a baseline ambient-noise study near residential areas, a limit relative to that baseline, mitigation and weekday generator-testing hours. Because the city labels these provisions as proposed, they should not be presented as enforceable requirements without checking the current code and approval documents.
Water, wastewater, electricity and environmental review
Utility capacity and demand studies
Even when zoning does not set a detailed engineering standard, the development review may require evidence that public systems can serve the project. Kearney lists water and wastewater feasibility studies and confirmation of electric needs and utility infrastructure. Fort Worth’s development-review materials describe water-loading and wastewater studies. Tucson states that large-scale projects must demonstrate adequate water and power and undergo environmental review.

Submissions commonly identify peak and average water demand, cooling technology, discharge volumes, sanitary capacity, electrical load, substation or transmission needs, fuel storage and emergency-generation capacity. A utility “will serve” letter may be required, but it does not replace building, air-quality, stormwater or state permits.

State programs that interact with zoning
Pennsylvania’s Department of Community and Economic Development describes a GRID consent-order framework for certain data-center growth. The framework includes incremental capacity and energy procurement, annual water-use reporting and maximum-day tracking, evaluation of feasible water recycling or closed-loop cooling, generator limits and operating logs, and enhanced safeguards in designated Environmental Justice Areas. It also requires proof of local land-use approvals before specified environmental permits can be issued or reach final review.
This is state-level permitting and program guidance, not a nationwide zoning rule. A project may therefore need both local land-use approval and separate state or federal approvals for air emissions, water discharges, stormwater, wetlands or other environmental effects.
Regional figures require their geography
Fairfax County reports, citing the Interstate Commission on the Potomac River Basin, that approximately 40 percent of regional data centers use air cooling. The same county material attributes daily regional data-center water use of less than 100,000 gallons and less than 0.1 percent of total upstream consumptive use to Northern Virginia and the Potomac River basin. These are regional figures and should not be generalized to every market or cooling design.

Hearings and neighborhood participation
Conditional-use, special-exception and planned-development applications commonly require mailed notice, posted notice, a staff report and one or more public hearings. Tucson’s process includes neighborhood coordination, a public hearing, Zoning Examiner review and final Mayor and Council consideration. Calvert County requires an applicant public meeting before Planning Commission consideration. Fairfax County said it held more than 20 stakeholder meetings while developing its 2024 zoning amendment; the county states that its Board established rules in September 2024.
Adopted rules versus proposals
Status is as important as substance. Tucson’s page says its large-scale rules became effective September 4, 2026. Fort Worth labels its data-center standards as proposed. Minneapolis calls its material preliminary recommendations and marks hearing dates tentative. Staff reports and web summaries can combine existing law, draft language and policy suggestions, so applicants should read the adopted ordinance, zoning map, definitions and effective-date provisions together.
Fairfax County’s 2026 information also describes a 100-megawatt threshold for certain high-energy-use facilities subject to additional information requirements under new laws. That threshold is a Fairfax requirement, not a general trigger for all data centers.
How to evaluate a local project
| Review axis | Questions to answer |
|---|---|
| Zoning district and definition | Is “data center” a defined principal use? Which districts allow it, and are there size or power thresholds? |
| Approval and public process | Is the use by right, conditional, a special exception, planned development or rezoning? Which body decides, and who may comment or appeal? |
| Site and building form | What setbacks, separation distances, height, floor-area, white-space, lot-coverage, buffer, screening and facade standards apply? |
| Acoustics and generators | Is a baseline or worst-case study required? Where are measurements taken? Are tonal and low-frequency sound covered? When may generators be tested? |
| Utilities and environmental review | What water, wastewater, electric, fuel, stormwater, air-quality and environmental documents are required? |
| Operations and enforcement | Are post-construction tests, annual reports, operating logs, inspections, permit renewals or penalties specified? |
A practical approval sequence
- Confirm the parcel and current code. Check the zoning map, district regulations, definitions, overlays and effective dates. Do not rely on a news article or an undated staff presentation.
- Classify the facility. Document server-room area, total building area, electrical load, cooling method, generator capacity and any phased expansion. These facts may determine whether a local size or power threshold applies.
- Identify the approval route. Ask the planning department whether the proposal is by right or needs conditional, special, planned-development or rezoning approval, and list every hearing and notice step.
- Map compatibility constraints. Measure property lines, homes, residential permits, schools and other sensitive uses. Lay out buildings, generators, substations, fuel storage, cooling equipment, loading and emergency access against required setbacks and buffers.
- Commission technical studies early. Obtain acoustic modeling at worst-case cooling load, baseline measurements where required, generator-testing assumptions, traffic information, stormwater calculations and utility feasibility letters.
- Prepare environmental and operating commitments. State water and wastewater demand, recycling or closed-loop options, electric supply, emissions controls, fuel plans, lighting, landscaping, inspection access and proposed reporting.
- Track conditions through construction and occupancy. Assign responsibility for noise verification, landscaping, generator logs, annual reports and corrective work. A project can satisfy site-plan approval yet still fail a post-construction condition.
Common mistakes and how to avoid them
- Treating an industrial designation as automatic permission: a data center may be prohibited, conditional or subject to a special exception even in an industrial district.
- Using a draft as if it were law: separate adopted text, staff recommendations, proposed amendments and tentative hearing schedules.
- Modeling only normal operations: reviewers may require full-load cooling, simultaneous equipment operation or generator testing scenarios.
- Ignoring low-frequency sound: a project can meet a basic decibel limit while creating tonal or low-frequency impacts addressed by a separate standard.
- Leaving utility evidence until the end: inadequate water, wastewater or electric capacity can delay land-use approval or trigger separate environmental review.
- Assuming one jurisdiction’s numbers travel: Calvert County’s 200- and 400-foot setbacks, Minneapolis’s preliminary 175,000-square-foot white-space cap and Fairfax’s 100-megawatt information threshold are local examples, not a national template.
- Forgetting the occupancy stage: conditions may require post-construction acoustic testing or other verification before a use permit is issued.
What a complete local checklist should contain
For a parcel-specific answer, assemble the adopted zoning text and map, definitions, application checklist, hearing calendar, building and fire requirements, noise ordinance, utility requirements, stormwater rules, air-quality permits and applicable state environmental programs. Compare each document for conflicts and effective dates. The result should identify not only whether the use is allowed, but also every study, public meeting, approval condition and operating report needed to open and continue operating the facility.
