What Counts as Future Employment Prospects When Calculating Compensation?

“Future employment prospects” is not a universal compensation formula. It is evidence about the work a person was reasonably likely to obtain or keep, and the earnings or earning capacity that would probably have followed, compared with the person’s likely position after an injury, dismissal or other legally relevant wrong. The governing jurisdiction and type of claim determine which evidence is relevant, what must be proved and how uncertainty is valued.

Before applying any calculation, identify the legal route: a UK personal-injury claim, a UK unfair-dismissal claim, a discrimination or data-protection remedy, or a claim under a US state’s law may all use different tests. The examples below explain the main reasoning tools without turning one jurisdiction’s rule into a general answer.

What the phrase means in a compensation claim

A future-employment-prospects issue asks a counterfactual question. What employment, progression and income were reasonably likely if the relevant event had not happened, and what is reasonably likely now? The difference may be expressed as future lost earnings, reduced earning capacity, difficulty obtaining comparable work, or another legally defined loss.

The comparison is not a promise that a claimant would have followed a particular career path. Courts and tribunals estimate what was more likely than not, or what can be established under the applicable standard of proof, using evidence available at the time of assessment. A person’s current job title alone does not settle the question. Qualifications, age, training, transferable skills, health or functional restrictions, labour-market conditions, likely promotion, periods out of work and attempts to find suitable employment can all matter where the governing law permits them.

Past wages, future wage receipts and loss of earning capacity are related but distinct concepts. A claimant may have a period of provable salary loss, a longer-term reduction in the ability to earn even after finding work, or both. Some regimes compensate only loss attributable to the defendant’s act; others assess the effect of an injury on capacity over a work life. The legal label controls which measure is recoverable.

Start with jurisdiction and claim type

No single table or percentage safely answers this question across legal systems. The first decision is to identify the forum and the cause of action. The following comparison shows why the same employment evidence can be treated differently.

Axis Personal-injury future earnings UK unfair-dismissal compensatory award
Legal question How the injury affects likely future earning capacity or earnings What loss was sustained because of dismissal and is attributable to the employer’s action
Main comparison Likely earnings absent injury versus likely earnings after injury Loss caused by dismissal, including qualifying benefits and expenses
Evidence emphasis Work and disability status, earnings history, future employment prospects and work-life assumptions Causation, actual and expected loss, mitigation and reasonably expected benefits
Calculation support Ogden Tables can provide factors for certain UK injury claims Statutory tribunal assessment under section 123 of the Employment Rights Act 1996
Key caveat Tables and legal rules are jurisdiction-specific; individual facts remain important This is not a personal-injury earning-capacity formula

That distinction prevents a common error: importing an actuarial factor from a personal-injury case into an unfair-dismissal claim, or using a US lost-earning-capacity instruction as though it were a UK rule.

How UK personal-injury claims use employment prospects

What the Ogden Tables do

The UK Government’s Ogden Tables, 7th Edition: Explanatory Notes describe employment status and disability status as inputs to future-loss-of-earnings factors. The tables are an aid to quantification, not a universal statement of substantive law. Relevant dates and status

The notes distinguish the claimant’s circumstances at the accident or onset date from circumstances at settlement or trial. Employment status and disability status at those relevant points affect which factors apply. Evidence should therefore record what the person was doing, and what restrictions existed, at each legally relevant date rather than describing only the present position.

Interruptions and age

The tables include factors for interruptions associated with bringing up children and caring for dependants. Those assumptions do not automatically apply to every claimant; the facts and the applicable category must support their use. For older claimants beyond the table’s stated age range, the explanatory material places particular weight on individual circumstances rather than mechanically extending a factor.

What the tables do not establish

An Ogden factor does not prove that a particular promotion, occupation or salary would have occurred. It converts an accepted future-loss assumption into a present-value calculation after the legal and factual questions have been resolved. Questions about causation, disability, likely employment and mitigation still require evidence and legal submissions.

Evidence that can support a future-prospects assessment

The admissible material depends on the claim and jurisdiction, but a well-supported assessment commonly addresses several categories:

  • Qualifications and training: completed credentials, professional licences, apprenticeships, unfinished courses and realistic retraining options.
  • Health and functional limits: medical evidence linking restrictions to the incident, the tasks that can no longer be performed, expected duration and capacity for adjusted or alternative work.
  • Career trajectory: promotions, comparable colleagues, performance records, employer plans and evidence of a genuine progression route, rather than an unsupported assumption of rapid advancement.
  • Labour-market evidence: the availability of suitable work, geographic and occupational constraints, hiring conditions and whether the claimant’s skills transfer to other roles.
  • Job-search and mitigation records: applications, interviews, rejected offers, agency contacts, retraining, medical restrictions given to employers and reasons for declining or being unable to take work.
  • Expected absences: periods outside work for treatment, rehabilitation, childcare or dependant care where the relevant legal framework recognises them.

Evidence must be tied to the legal test. A vocational opinion may explain realistic occupations; it cannot replace proof of an injury, dismissal, causation or the statutory requirements of the claim.

A practical method for comparing the two scenarios

Although the arithmetic differs, the reasoning can be organised into a disciplined sequence.

  1. Define the event and the legal measure. State whether the issue is injury-related future earnings, dismissal loss, diminished capacity, stigma or another remedy. Identify the governing jurisdiction and the relevant valuation date.
  2. Build the no-event scenario. Use records to identify the employment, hours, pay, benefits, likely progression and work interruptions that were reasonably probable without the event. Mark assumptions that are disputed.
  3. Build the post-event scenario. Set out actual work after the event, restrictions, periods without work, retraining, alternative occupations and realistic future earning ability. Separate established facts from forecasts.
  4. Test causation. Ask which part of the difference was caused by the injury, dismissal or other wrong, and which part reflects unrelated redundancy, voluntary choices, market change or ordinary career risk.
  5. Address mitigation and available work. Document reasonable steps to reduce loss and explain barriers to accepting work. A claimant is not required to take unsuitable or medically unsafe work, but unsupported inaction can affect the assessment where the governing law imposes mitigation duties.
  6. Apply the permitted calculation tool. In an eligible UK injury claim, an appropriate Ogden factor may convert an accepted annual loss into a present value. A tribunal or court applying another regime may use a different method, discount convention or statutory limit.
  7. Stress-test uncertainty. Identify assumptions about retirement, promotion, unemployment, recovery and labour-market conditions. The result should communicate uncertainty rather than present a speculative career as guaranteed.

UK unfair dismissal: a different statutory question

Section 123(1) of the Employment Rights Act 1996 provides that “the amount of the compensatory award shall be such amount as the tribunal considers just and equitable in all the circumstances having regard to the loss sustained by the complainant in consequence of the dismissal in so far as that loss is attributable to action taken by the employer.” The current consolidated text is available at section 123 of the Employment Rights Act 1996.

In this setting, future employment prospects matter insofar as they help establish loss caused by the dismissal. The assessment can include expected earnings, qualifying benefits and specified expenses, subject to the statute and tribunal principles. Mitigation is central: the tribunal considers what work or income the claimant could reasonably have obtained and when. This is not the same as valuing a permanent reduction in physical earning capacity after an injury.

A claimant should therefore separate the period of actual unemployment, expected time to secure comparable work, benefits lost, expenses incurred and any longer-term disadvantage that can be proved. A tribunal does not award an automatic career projection simply because dismissal occurred.

Future stigma and difficult-to-prove prospects

Hilco Capital Ltd v Denise Harrington [2022] EAT 156 illustrates the evidential problem when a claimant says employment litigation will damage future prospects. The Employment Appeal Tribunal indicated that a tribunal should not infer widespread future stigma merely from assertion or suspicion. However, extensive and unsuccessful attempts to mitigate may support a finding that future work in the relevant industry is unlikely on the facts of that case. Read the official judgment at Hilco Capital Ltd v Harrington.

The practical lesson is to prove the mechanism, not just the fear: identify the employers approached, responses received, the role and market involved, and why the evidence connects the difficulty to the legally relevant event.

US illustrations: similar words, different rules

California and loss of earning ability

Fair v BNSF Railway (California Court of Appeal, 2015) discussed an instruction for loss of the ability to earn money. The court explained that the jury was not simply being asked to award past or future wage receipts, and the instruction did not require a work history. That is an example of California law in that case, not a rule for every jurisdiction. The case text is available at Fair v BNSF Railway.

For a California claim, counsel must therefore identify the pleaded loss, the instructions approved for that claim and the evidence needed to show reasonable certainty. A claimant with little conventional work history may still need credible evidence of capacity, skills and the effect of the injury, but the precise evidential route is jurisdiction-specific.

Pennsylvania and future-earnings calculations

Kaczkowski v Bolubasz (Pennsylvania Supreme Court, 1980) recognised recoverable lost future earnings when properly proved and addressed productivity, inflation and discounting under Pennsylvania’s approach. Its treatment cannot be exported to another state or to the UK. Consult the case text at Kaczkowski v Bolubasz and apply current Pennsylvania authority to a live claim.

Do not confuse general and special damages

A UK Government explanatory framework for ICO and redress lists loss of future employment prospects among possible general damages, while financially valued lost earnings are discussed as special damages in that explanatory context. That document is specific to its redress framework and does not create a universal classification for personal injury, dismissal or every data-protection claim. See Explanatory Framework for ICO and Redress.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The classification matters because a claim may require different proof for a measurable salary loss, a non-financial disadvantage or a reduced capacity to earn. Use the definitions and remedies in the legislation governing the actual claim.

Common mistakes and how to avoid them

  • Using one jurisdiction’s formula everywhere: confirm the court, tribunal, cause of action and current legislation first.
  • Treating current unemployment as proof of permanent loss: show the expected duration, job-search evidence and labour-market explanation.
  • Assuming a promotion is certain: support progression with records, comparable employees or employer evidence and distinguish probability from possibility.
  • Conflating wages with capacity: state whether the loss is receipts, earning ability, benefits, expenses or another recognised head of damage.
  • Ignoring mitigation: keep a contemporaneous record of applications, treatment, retraining and reasons suitable work was unavailable.
  • Applying an Ogden factor mechanically: confirm the edition, claimant category, employment and disability status, relevant dates and assumptions.
  • Presenting a table factor or discount as a universal statistic: factors depend on edition, category, age and assumptions; no general percentage quantifies the effect of future prospects across jurisdictions.
  • Relying on stigma assertions alone: connect the alleged disadvantage to concrete employer responses and documented unsuccessful efforts to find work.

What a claimant should prepare before valuation

Create a dated chronology from the event to the valuation date. Gather employment contracts, payroll and tax records, benefit statements, appraisals, training documents, medical or functional reports, applications and interview outcomes. Ask an adviser to identify which assumptions require an employer, vocational or economic expert and which can be proved by ordinary records.

Keep separate schedules for past loss and projected loss. For each projected period, state the assumed occupation, hours, pay basis, benefits, probability of obtaining work, expected interruptions and the evidence supporting that assumption. Flag disputed items instead of embedding them in a single optimistic forecast.

Bottom line for the question

Future employment prospects count when they are relevant to the legal measure of loss and supported by evidence. The usual inquiry compares a supported no-event employment scenario with a supported post-event scenario, then applies the jurisdiction’s causation, mitigation and valuation rules. UK personal-injury claims may use the Ogden Tables after those factual decisions; UK unfair-dismissal claims follow section 123’s loss-and-attribution test; California and Pennsylvania illustrate still different approaches. There is no responsible universal multiplier, guaranteed career path or cross-border formula.
