For business operations, an AI incident is an AI-related event, error, or malfunction that causes—or could plausibly cause—material harm, compromise information or system security, violate policy, or disrupt safe and trustworthy operation. That is a practical working definition, not a universal legal definition.
Capture credible near misses as well as confirmed harm. Then keep three decisions separate: internal escalation, business-risk response, and external legal or contractual reporting. A statutory “serious incident” test depends on the jurisdiction, system category, organizational role, consequences, and sector rules.

Start with a working definition that people can use
NIST describes an AI system as an engineered or machine-based system that can generate predictions, recommendations, or decisions influencing real or virtual environments. Its AI RMF 1.0 executive summary presents risk management as a continuous activity across design, development, deployment, use, and evaluation. The framework is voluntary, and NIST says its AI RMF is being revised on the AI Risk Management Framework page.
For an internal business taxonomy, treat an event as an AI incident when one or more of these conditions is present:

- [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
- The system produced a materially wrong recommendation, classification, prediction, or decision.
- The system or an AI-enabled component contributed to harm to a person, organization, society, or the environment.
- Confidentiality, integrity, or availability of information or systems was actually or potentially jeopardized.
- A security, privacy, safety, acceptable-use, or other internal policy was violated or imminently threatened.
- AI-related behavior disrupted an important operation or exposed a control weakness that could plausibly cause harm.
This deliberately covers more than a data breach. NIST’s incident glossary defines an incident as an occurrence that actually or potentially jeopardizes information-system confidentiality, integrity, or availability, or violates or imminently threatens security or acceptable-use policies. The AI RMF adds a broader organizational lens: risks can affect individuals, organizations, society, and the environment, and they must be managed throughout the AI lifecycle.
Why a near miss belongs in the incident process
No harmful outcome is required before an organization records an event. A near miss can reveal a prompt-control failure, an unsafe integration, inadequate human review, a data-quality problem, or a missing override. If the same weakness could produce harm under slightly different circumstances, it belongs in the incident log and should be triaged.
NIST’s AI RMF calls for post-deployment monitoring that captures and evaluates input from users and other relevant AI actors, together with processes for tracking, responding to, and recovering from incidents and errors. That makes a credible failure mode operationally important even when a human catches it in time.
Examples: what may count in practice
The examples below are illustrations for internal classification, not an exhaustive or official taxonomy.
| Scenario | Why capture it | Questions to ask |
|---|---|---|
| An AI system gives a materially wrong recommendation or decision that harms a customer, employee, patient, applicant, or business operation. | The output may have caused direct harm or exposed a control failure in a consequential workflow. | Who relied on the output? Was there human review? Can the decision be reversed? |
| An AI-enabled component contributes to death, serious health damage, or serious property or environmental damage in a legally covered context. | The consequence may meet a statutory serious-incident threshold, depending on the jurisdiction and system category. | What was the causal contribution, and which legal role and reporting regime apply? |
| An AI-enabled service contributes to serious disruption of critical infrastructure. | Operational availability and public impact can make the event high severity even when no individual injury is immediately known. | How long did the disruption last? Which essential services and locations were affected? |
| A prompt injection, unauthorized data exposure, model-integrity attack, or other security event compromises information or systems. | Security and privacy compromise are AI-incident triggers as well as cybersecurity concerns. | What data, systems, accounts, or downstream services were exposed or altered? |
| A near miss shows that a guardrail, approval step, monitoring control, or override can be bypassed. | The absence of harm may reflect luck or timely intervention rather than a safe system. | Could the same weakness recur at greater scale or with a more vulnerable person? |
Do not confuse an internal AI incident with a reportable event
A model error, user complaint, policy breach, cyber event, or business loss can justify internal tracking without satisfying a statutory “serious incident” definition. Keep these decisions distinct:
- Internal capture and escalation: Should the event enter the incident register and reach the accountable owner?
- Business-risk response: What containment, investigation, remediation, communication, and monitoring are needed?
- External reporting: Does a law, regulation, contract, customer commitment, or sector rule require notification, and by when?
Reportability depends on the country or region, the AI system’s classification, the organization’s role (such as provider or deployer), the event’s consequences, and overlapping privacy, safety, critical-infrastructure, employment, consumer-protection, or sector obligations. The NIST AI RMF does not impose a universal reporting deadline.

EU AI Act: a specific legal test, not a universal definition
The EU AI Act is a useful example of why internal and legal classifications must remain separate. Under Article 3’s definitions, a serious incident is an incident or malfunctioning of an AI system that directly or indirectly leads to specified outcomes, including:
- Death or serious damage to health.
- Serious and irreversible disruption of critical infrastructure.
- A breach of obligations under Union law intended to protect fundamental rights.
- Serious damage to property or the environment.
That is the Act’s scope-specific definition. It should not replace a broader internal rule that also captures security events, policy violations, unsafe outputs, operational disruption, and near misses.
Who reports under Article 73
Article 73 places the reporting duty on providers of high-risk AI systems placed on the Union market when a covered serious incident occurs. The provider reports to the relevant market-surveillance authority after establishing a causal link, or a reasonable likelihood of one, and must investigate, assess risk, take corrective action, and cooperate with authorities.
| Event or circumstance | Article 73 timing described by the cited text |
|---|---|
| General covered serious incident | Immediately after a causal link or reasonable likelihood is established, and no later than 15 days after awareness. |
| Widespread infringement or the specified serious-incident category | Immediately, and no later than two days. |
| Death | Immediately once a causal relationship is established or suspected, and no later than 10 days. |
| Initial information incomplete | An initial report may be followed by a complete report. |
Article 75 provides a specific route for cases within the AI Office’s competence, so identify the correct authority rather than assuming every event goes to the same regulator. The European Commission’s consultation page on draft guidance and a reporting template was published in September 2025 and said the reporting obligation would apply from August 2026. Dates, implementing material, and amendments can change; verify the current consolidated Act, guidance, authority, and any sector-specific rules before relying on a deadline.
How to triage two or more AI events
Use a written matrix so that the most alarming headline does not automatically receive the highest rating and a quiet near miss does not disappear. Record evidence and uncertainty separately.
| Dimension | What to assess | Evidence to preserve |
|---|---|---|
| Impact | Actual or potential effects on people, rights, property, the environment, information, or essential operations. | Decision records, affected accounts, safety outcomes, service metrics, and complaints. |
| Severity and likelihood | How serious the consequence is and how plausible recurrence is. NIST frames risk as probability combined with consequence magnitude. | Failure rates, test results, comparable cases, threat intelligence, and uncertainty ranges. |
| Scope | Number of people, customers, decisions, systems, locations, or jurisdictions involved. | Population counts, transaction logs, geographic reach, and time windows. |
| Duration and reversibility | Whether the effect is continuing and whether decisions, records, or harm can be reversed. | Start and end times, rollback capability, correction status, and residual effects. |
| System and control context | Model and version, data, prompts or configuration, connected services, human review, and override path. | Model identifiers, deployment settings, input and output samples where lawful, access logs, and approval records. |
| Duties and roles | Who is provider, deployer, importer, or another responsible party, and which legal, contractual, privacy, safety, or sector rules apply. | Contracts, role assignments, data-processing terms, product classification, and regulator contacts. |
Document what is known, what is inferred, and what remains unknown. A plausible high-impact failure with limited evidence can warrant immediate containment while the investigation continues.

A practical response sequence for businesses
The following sequence translates the NIST AI RMF outcomes for monitoring, incident response, recovery, change management, documentation, communication, and feedback into an operational workflow. Adapt it to your existing incident-response plan; it is not a universal legal procedure.
1. Capture and preserve
- Record who reported the event and when.
- Identify the AI system, model or release, use case, affected workflow, and connected services.
- Preserve relevant prompts, inputs, outputs, retrieval context, configuration, access logs, human approvals, and override actions where collection is lawful and proportionate.
- Describe observed impact, potential impact, affected people or systems, and whether the issue is still active.
- Preserve evidence before changing prompts, models, permissions, routing, or data pipelines; otherwise the change may obscure the cause.
2. Triage harm and urgency
Assess actual and potential harm, severity, scope, recurrence likelihood, affected people’s vulnerability, duration, reversibility, and policy or legal triggers. If there is a plausible risk to life, health, fundamental rights, critical services, or sensitive information, escalate immediately under the organization’s emergency path.
3. Contain safely
Choose the least risky control that stops further exposure while preserving evidence. Depending on the system, that can mean pausing automated decisions, restricting a feature or user group, routing cases to qualified human review, disabling a tool or integration, revoking credentials, blocking a data flow, or activating an approved override. Do not restore automation merely because the visible symptom has stopped.

Notify the business owner and AI or system owner, then involve security, privacy, legal or compliance, safety, and vendor contacts according to the response plan. Assign one incident lead and one decision log. Clarify who can authorize a pause, who communicates externally, and who decides that recovery controls are adequate.
5. Investigate causal contribution
Establish how the AI system contributed without assuming it was the sole cause. Examine upstream data, prompts, retrieval, model behavior, downstream automation, human decisions, and environmental conditions. Test whether the event can be reproduced, whether a similar configuration exists elsewhere, and whether the same people or systems remain exposed.
6. Communicate proportionately
Communicate material incidents and errors to relevant AI actors and, where appropriate, affected communities. Explain what is known, what action has been taken, what people should do, and how to seek correction, appeal, or support. Avoid publishing sensitive attack details or personal data that would increase harm. Preserve a dated record of internal, customer, partner, regulator, and public communications.

Controls that make incidents easier to detect and handle
Incident response is stronger when evidence and authority exist before the first failure. A practical AI operations baseline includes:
- System inventory: owner, purpose, model and version, data sources, connected tools, deployment locations, and affected populations.
- Release and change records: approvals, evaluation results, prompt or retrieval changes, model swaps, and rollback instructions.
- Monitoring: quality, drift, refusal and escalation rates, anomalous use, security events, access, latency, and downstream outcome signals.
- Human controls: defined review points, decision authority, appeal channels, override procedures, and rules for pausing automation.
- Evidence handling: time synchronization, immutable or access-controlled logs, retention periods, and lawful handling of personal or sensitive inputs.
- Communication paths: named contacts for business operations, security, privacy, legal, safety, affected users, vendors, and regulators.
- Learning loop: post-incident review, corrective-action tracking, tests for recurrence, and checks on comparable systems.
NIST’s AI RMF Core states in Manage 4.1: “Post-deployment AI system monitoring plans are implemented, including mechanisms for capturing and evaluating input from users and other relevant AI actors, appeal and override, decommissioning, incident response, recovery, and change management.” Manage 4.3 adds: “Processes for tracking, responding to, and recovering from incidents and errors are followed and documented.” Read the surrounding outcomes in the AI RMF Core.
Common classification mistakes
Calling every inaccurate answer a serious incident
An inaccurate generated response can be a quality defect, a user complaint, an internal AI incident, or a legally reportable event depending on its consequences and context. Classify the effect, not just the presence of an error.
Waiting for confirmed harm
Requiring proof of injury before escalation discards the value of near-miss detection. Record credible control weaknesses and investigate their potential scale.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteUsing “cyber incident” as the whole taxonomy
A breach or attack is only one route to harm. Unsafe recommendations, discriminatory outcomes, operational failures, environmental effects, and policy violations can occur without a conventional cybersecurity compromise.
Best Value
Assuming the AI caused everything
Complex systems distribute responsibility across data pipelines, model providers, deployers, users, integrations, and human decisions. Causal investigation should identify the AI contribution and the surrounding controls.
Treating the EU deadline as a global rule
Article 73 applies within its statutory scope and to the roles and systems covered by the EU AI Act. Other jurisdictions, contracts, and sectors can impose different duties—or none for the same event.
A concise incident-record template
Use a record that supports both operational action and later legal analysis:
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →- Incident identifier, reporter, discovery time, and current status.
- System name, model or version, provider/deployer role, use case, and affected workflow.
- Event description, relevant inputs and outputs, configuration, connected services, and human decisions.
- Actual and potential impact, affected people or assets, scope, duration, reversibility, and uncertainty.
- Containment, escalation, evidence-preservation, investigation, and communication actions with timestamps and owners.
- Applicable policy, contract, privacy, safety, sector, and regulatory checks, including the reason a report was or was not made.
- Corrective action, monitoring changes, decision reversals or user support, residual risk, and closure approval.
This record should support a defensible decision without pretending that an internal label itself determines legal liability or reportability.
Bottom line for business leaders
Use a broad internal net: capture harmful outcomes, credible near misses, security and privacy compromise, unsafe or materially erroneous behavior, policy violations, and operational disruption. Triage each event by consequence, likelihood, scope, duration, reversibility, system context, and responsible roles. Contain first when harm could continue, preserve evidence, investigate the AI’s contribution, communicate appropriately, and improve monitoring and controls.
Only after that internal work should the organization decide whether an external notice is required. For EU high-risk systems, apply the specific Article 73 test and deadlines, confirm the competent authority, and verify the current consolidated law and guidance before filing.
