Improving brightness or straightening an image may simply make it clearer; adding a window, removing a utility pole, or changing a finish can make the property appear different from what it is. The precise rules depend on the applicable law and multiple-listing service (MLS), so there is no universal edit checklist.
How to tell a clarity correction from a misleading change
Ask whether the edit only improves how clearly the existing scene is shown, or changes what a viewer would think is there. CRMLS says common adjustments such as lighting, exposure, white balance, sharpening, cropping, straightening, and angle correction are not digitally altered images under its rule when they do not change the representation of the real property. ARMLS similarly permits standard clarity adjustments if they do not misrepresent the property. Those are examples under particular MLS guidance, not a blanket authorization everywhere.

The concern is a change to the viewer’s understanding—not simply whether editing software or AI was used. The same adjustment can be harmless in one image and misleading in another if it alters the apparent features or condition.
Edits that can change a buyer’s understanding
Changing, adding, or removing a feature can make the listing photo represent a different property. CRMLS identifies examples including walls, windows, structural elements, cabinets, flooring, paint color, fixtures, landscaping, and a façade. Its guidance also covers floor plans, utility poles, views through windows, and neighboring properties. NSW Government advertising guidance likewise warns that digitally adding or removing features can change a property’s appearance and mislead consumers.

- Condition and finish changes: recoloring paint or changing finishes in a way that suggests the property is in a different condition.
- Exterior and surroundings: changing landscaping, the façade, a visible utility pole, a neighboring property, or the view through a window.
- Floor plans: editing the plan so it no longer accurately represents the property.
The practical test is whether a reasonable viewer might rely on the edited image and form a materially different impression of what is being offered.
Virtual staging and AI edits
Virtual staging can show how a room might look furnished, but it should not imply that furnishings, appliances, finishes, views, or improvements are part of the property when they are not. Whether a staging image is permitted, and what disclosure it needs, depends on the governing MLS and advertising rules. Follow any local requirement to label the image or show an original alongside it.

CRMLS Rule 11.5.2 treats digitally altered images through a rule that distinguishes common clarity adjustments from edits that change the representation of the real property. For covered altered images, CRMLS requires the original image and a label; using AI or calling an image “staged” does not by itself make an inaccurate depiction acceptable.

| CRMLS, United States | Its 2026 FAQ distinguishes common adjustments that do not change the property’s representation from digitally altered images; it also restricts changes to real-property features and elements outside or visible from the property under truth-in-advertising rules. | For a covered digitally altered image, submit the original unaltered image, display it immediately before or after the altered image, and label the altered image “Photo Modified,” “Virtually Staged,” “Digitally Altered,” “AI Altered,” or an accurate substantially similar term. | CRMLS Rule 11.5.2 FAQ: CRMLS. Applies to CRMLS participants; check the current rule. |
| SmartMLS, United States | Its compliance guidance addresses digitally altered photos. | Show an accurate as-is photo alongside each digitally altered photo, with the as-is version first, followed by the altered version; mark both to identify their status. | SmartMLS guidance updated September 2, 2026. Requirements and placement differ between MLSs: SmartMLS. |

| NorthstarMLS guidance | Proposed guidelines address digitally altered images and staging. | Specific requirements are not stated in the cited material. | Proposed guidance, not established here as binding policy: NorthstarMLS. |

What to do before publishing an edited photo
- Compare it with the original. Identify every change and ask whether it affects a property feature, condition, or visible surrounding.
- Check the applicable requirements. Confirm the current MLS rule and the advertising requirements for the place where the property is marketed.
- Preserve and present the original if required. Follow the local rule for whether the as-is image must accompany the edited image and where each must appear.
- Label the image accurately. Use the wording and placement required by the applicable rule; do not assume one MLS’s label or procedure works everywhere.
- Remove or correct an image that changes the representation. A label does not make a materially inaccurate depiction accurate.
Why the applicable location and MLS matter
The cited sources cover different rule systems: CRMLS and SmartMLS guidance in the United States, ARMLS guidance, NSW government advertising guidance, and proposed NorthstarMLS guidelines. Their principles overlap, but their legal reach and procedures differ. No complete survey of all U.S. states, MLS systems, or other countries is established here. For a specific listing, check the current MLS rules and local advertising law; the NSW guidance applies in NSW, while MLS policies apply within their own systems.
