What Communities Can Ask Before a Data Centre Is Built Nearby

Start with the decision map, not the publicity. Before a data centre is approved, ask which local land-use, building, environmental, utility and grid decisions control the project; obtain the applicant’s peak power and water figures; demand independent impact studies; and put any promised limits or benefits into documents that can be enforced after construction, expansion or a sale.

The exact hearing rights, permit names, deadlines, rate treatment and enforceable conditions depend on the jurisdiction and the project’s stage. The checklist below uses official examples from several US jurisdictions to show what to investigate, not rules that automatically apply elsewhere.

1. Map who decides, and when residents can still influence the design

Ask the planning department for the complete application file and a written list of every approval. A proposal may involve a zoning or rezoning decision, special exception or variance, site-plan and building approvals, air and water permits, stormwater authorisation, utility or transmission decisions, and a grid-interconnection process. Each can have a different decision-maker, notice period and appeal route.

Questions about the process

  • Is a data centre allowed at this site by right, or does it require a rezoning, special exception, variance or public hearing?
  • Which agency decides each zoning, site, building, air, water and stormwater issue?
  • What are the actual deadlines to submit written comments, speak at a hearing, request records, appeal, or ask for a continuance?
  • At what stage can conditions still change the building layout, cooling system, generator count, transmission route or operating hours?
  • Which decisions are local, and which belong to a state utility commission, environmental regulator or regional grid operator?

Fairfax County, Virginia, illustrates why this map matters: some facilities can be built by right in designated industrial areas, while other applications trigger hearings. The county also distinguishes local land-use decisions from state authority over energy rates, transmission and certain air or water matters. That arrangement is not a template for another locality. Confirm the path with the relevant planning authority, utility regulator or consumer advocate and environmental agency.

2. Get project-specific electricity and grid information

Do not accept a single annual electricity estimate. Request the facility’s maximum demand, timing and operating assumptions for each construction and operating phase. A campus that starts with one building can require substantially different substations, lines and tariffs after later phases.

Power questions to put in writing

  • What is the expected peak demand in megawatts (MW) for each phase, and when will each phase need service?
  • What interconnection, load-flow, reliability and transmission studies support the proposed connection date?
  • Will the site use grid electricity, on-site generation, batteries or another mix? How many generators will operate, for how long and under what conditions?
  • Are new substations, transmission lines, feeder upgrades or other network work required? Who pays the initial cost, and how is any remaining cost allocated over time?
  • Which utility tariff and regulator determine whether shared infrastructure costs are recovered from the applicant, other customers or a combination?
  • Could the load affect reliability, local capacity or household and small-business rates?

ERCOT’s 2026 information request covers developers of data centres of 25 MW or more seeking interconnection to the ERCOT system. That is the scope of that request, not a universal legal threshold. Fairfax County explains that a facility’s direct electricity bill is different from the recovery of shared grid infrastructure through utility rates. Ask for the project’s utility study and tariff analysis rather than assuming bills will rise or remain unchanged.

Separate direct use from system costs

Request a plain-language accounting that shows the facility’s own energy charge, demand charge, connection work and any network upgrades separately. Ask whether cost estimates change if the operator delays a phase, reduces load, provides flexible demand or adds on-site generation. Require the utility or regulator to identify which figures are estimates, which are approved, and which could be revised after interconnection studies.

3. Test the water and cooling plan

Cooling design can determine whether a project puts pressure on a municipal supply, relies on reclaimed water or largely avoids consumptive use. Ask for withdrawal and consumption by month, season and operating phase; “capacity” alone does not show what existing customers may experience.

Water and cooling checklist

  • What volume will be withdrawn, and what volume will be consumed rather than returned, under normal, peak and drought conditions?
  • Will the source be potable water, surface water, groundwater, reclaimed water or another non-potable supply?
  • Which cooling design is proposed: air-cooled, closed-loop, evaporative or a combination? What alternatives were evaluated?
  • How would demand change during a drought, heatwave, treatment-plant outage or other system stress?
  • Could withdrawals affect existing customers, stream flows, groundwater, water quality or sensitive resources?
  • Will actual withdrawal, consumption and water-efficiency data be published regularly, with the method and units explained?

Maryland’s Executive Order 01.01.2026.16 identifies adequate supply without adverse effects, cooling alternatives, non-potable sources, disclosure of use and efficiency, drought and cumulative effects as review considerations. ERCOT’s 2026 request also asks developers about water source, consumption and cooling technology. Neither establishes a general water-use figure for data centres. Require the applicant to disclose its own engineering assumptions and to compare alternatives on seasonal use and drought resilience.

4. Require independent studies for noise, light, traffic and construction

Residents should see studies that model the whole site, not only an individual chiller or generator. The analysis should identify measurement locations, weather and operating assumptions, nearby homes and sensitive uses, and the combined effect of existing and proposed facilities.

Noise and lighting

  • Does the sound model include cooling equipment, transformers, fans, backup generators, generator testing and neighbouring facilities?
  • Were measurements or predictions made at property boundaries, nearby homes, schools, hospitals and other sensitive sites, including at night?
  • What enforceable limits apply during routine operation, testing, outages and emergency generation?
  • What setbacks, acoustic enclosures, barriers, landscaping or building changes will meet those limits?
  • Will exterior lighting be shielded, timed and monitored to prevent glare and night-time spill?

Fairfax County identifies noise studies, visual screening, design standards and setbacks as relevant subjects. Tucson’s adopted standards include sound studies, screening and operational limits. ERCOT’s 2026 request names noise and light impacts. Local limits differ, so obtain the ordinance, permit condition or hearing record that supplies the applicable number.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Traffic and construction

  • What are the construction hours, truck routes, worker-vehicle volumes and traffic-control measures?
  • Will emergency access, school routes, pedestrian safety or road maintenance change?
  • How will complaints about dust, vibration, lighting or blocked roads be logged and resolved?
  • Are construction impacts assessed cumulatively with other projects in the corridor?

5. Examine air emissions, stormwater and cumulative environmental effects

Backup generation is often described as emergency-only, yet permits may allow testing or other operation. Ask for the number, fuel, rated output, emissions controls and permitted hours of every generator, along with the conditions that would allow it to run.

  • [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by

Air and land questions

  • How many generators are proposed, what fuel do they use, and what emissions tier and controls apply?
  • What pollutants are expected during tests, outages or any grid-support operation? Are nearby facilities included in a cumulative analysis?
  • Will air monitoring, vegetation buffers or other mitigation be installed, and who receives the results?
  • How will stormwater, cooling-water discharge, waste heat and other pollutants be contained and monitored?
  • What effects on habitat, farmland, previously developed land, flood risk and overburdened or environmental-justice communities were evaluated?
  • Which alternatives were rejected, and what evidence supports that choice?

Maryland’s order lists generator numbers, emissions tiers and hours, cumulative effects, reduced diesel use, monitoring, buffers, stormwater, discharge, siting and impacts on overburdened communities. Fairfax County describes state environmental roles for air pollution and certain cooling-water discharges. Ask the applicable regulator which permits and monitoring duties attach to this site.

6. Compare genuine alternatives instead of accepting a single design

When an applicant presents options, request the assumptions and trade-offs in a side-by-side record. A lower water-use design may have different electricity, noise or capital requirements; an alternative site may reduce residential impacts but require longer transmission construction.

Decision Comparisons to request Evidence to seek
Cooling and water Potable versus reclaimed or other non-potable supply; air-cooled versus water-based or closed-loop systems Seasonal withdrawal and consumption, drought performance, discharge and efficiency data
Power supply Grid connection, on-site generation, storage and load flexibility Reliability, emissions, generator operating assumptions and allocation of infrastructure costs
Site and design Distance from homes and sensitive uses; previously developed or brownfield land; setbacks, screening and building orientation Noise and visual models, traffic analysis, habitat and stormwater assessments
Public commitments Informal promises versus measurable, time-bound obligations binding on successors Draft permit conditions, development agreements, reporting schedules and remedies

7. Calculate net public costs, jobs and community benefits

A large investment or headline tax number is not the same as a net public benefit. Request a fiscal analysis over a realistic time horizon that includes incentives, road and utility work, emergency services, inspections, water and wastewater capacity, tax abatements and other public costs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Questions about money and employment

  • What tax exemptions, grants, infrastructure support or other public assistance is requested?
  • What is the projected net fiscal effect after incentives and public-service costs?
  • How many construction and permanent jobs are expected, at what wages, benefits and skill levels?
  • What share of hiring, apprenticeships, procurement and training is committed locally, and how will it be measured?
  • What community benefits were negotiated, who represented residents and who will administer them?

Maryland’s order expressly considers job quality, local hiring, net fiscal impact after incentives and costs, measurable and time-bound commitments, community-benefits agreements, successor obligations, remedies, decommissioning and review. ERCOT’s 2026 request asks developers about public financial assistance and tax benefits. Treat projections as proposals until targets, dates, reporting and consequences are written into an enforceable instrument.

Make promises enforceable

Ask whether each commitment appears in a permit, zoning condition, development agreement, utility agreement or other document that a public body can enforce. Require annual public reporting, an audit method, correction deadlines and a remedy such as a fine, withheld approval, performance bond or other lawful consequence. Confirm that obligations survive a sale, lease, merger, expansion and decommissioning.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Support on Ko-Fi

8. Identify the owner, users and long-term contact

A project company may not be the entity that controls the site or occupies the capacity. Ask for the applicant’s parent and controlling owner, expected tenants or anchor users, financing or ownership changes that are already known, and the person responsible for community communications during construction and operation.

Transparency questions

  • Who owns and controls the applicant, and who is expected to use or lease the facility?
  • Which project details are public, and do confidentiality terms restrict information needed to assess public impacts?
  • Who is the named contact for complaints, records and emergencies after opening?
  • Will actual power, water, emissions, jobs, taxes and compliance be reported annually against promises?
  • Are commitments recorded in documents that bind successors and later expansions?

Maryland’s order identifies ownership and anchor-tenant disclosure, public statements of commitments, annual reporting, accurate information about load, timing, end users and jobs, and binding successor obligations as review considerations. Pennsylvania GRID standards call for early outreach and input on siting, noise mitigation, viewshed and facade design.

9. Use the local record and build a durable community process

Organise questions by agency and deadline. Request the application, site plans, traffic and sound studies, utility correspondence, environmental permits, fiscal-impact analysis, draft conditions and complaint procedures. Keep a versioned log showing when each document was received and which assumptions changed.

  1. Start with planning. Obtain the zoning map, application number, hearing calendar, notice rules and appeal instructions.
  2. Contact environmental agencies. Ask which air, water, stormwater, discharge and generator permits apply and where monitoring results will be posted.
  3. Contact the utility regulator or consumer advocate. Request the tariff, interconnection study, upgrade-cost allocation and any rate proceeding open to public comment.
  4. Submit focused records requests. Ask for raw study data, modelling assumptions, operating schedules and draft enforceable conditions, subject to lawful exemptions.
  5. Attend hearings with specific requests. Tie each request to a measurable limit, reporting duty, deadline or design change rather than a general statement of support or opposition.
  6. Track operation after approval. Compare annual actuals with permitted limits and promised benefits; use the documented complaint and enforcement route when results diverge.

10. Keep jurisdiction-specific thresholds in context

Published figures can help residents understand scale, but they are not universal benchmarks. Fairfax County reported 20 standalone data centres operating and 11 under construction as of August 2026. It reported about $110.6 million in data-centre revenue for tax year 2026, approximately 1.9% of its FY 2027 General Fund revenue. Those are Fairfax-specific results, not a typical revenue forecast.

ERCOT’s 2026 request covers developers at 25 MW or more pursuing interconnection to the ERCOT system. Massachusetts Executive Order 658 addresses projects with peak demand exceeding 25 MW. Fairfax County describes additional disclosure requirements for high-energy-use facilities of 100 MW or more in specified local applications. Each threshold belongs to its named policy or jurisdiction; do not use it to infer that another locality must hold a hearing or apply the same disclosure rule.

What the community should leave on the record

Maryland’s Executive Order 01.01.2026.16 states: “Communities must have a decisive voice and remain central to decisions about whether and how data center projects proceed within their jurisdictions.” A practical way to exercise that voice is to insist on a documented decision path, project-specific power and water numbers, independent impact studies, alternatives analysis, net-cost accounting, measurable benefits and successor-proof enforcement.

No general checklist can supply a hearing date, local noise limit, appeal right, rate outcome or permit requirement for an unnamed site. Those facts must be verified with the planning authority, utility regulator or consumer advocate, and environmental permitting agency handling the actual proposal.
