Follow your organization’s approved policy, identify every data recipient, determine whether the information is protected health information (PHI), and confirm the legal basis, contract terms, retention, reuse, security controls and human oversight. A tool’s privacy notice or “HIPAA compliant” marketing claim is not enough.
This guide is U.S.-focused. HIPAA, state privacy laws, institutional rules, contracts and the tool’s actual technical behavior can produce different answers for different products. Use it to structure a review with your privacy officer, security team or counsel—not as a substitute for that review.

Why the same AI feature can have different privacy rules
“AI medical tool” describes a wide range of products rather than one legal category. An administrative drafting assistant, a general-purpose chatbot, an ambient documentation service, an EHR-integrated assistant and a diagnostic-support product may receive different data, send it to different parties and make different claims about how it is used.
The relevant questions are practical: what information leaves your system, who receives it, why it is disclosed, whether the recipient is acting for a regulated health-care organization, how long the information remains available, and whether it is reused for analytics, product improvement or model training. The answers can change when a vendor adds a new integration, changes its terms or introduces a new model.

The American Medical Association’s House of Delegates says, “Generative AI should: (a) only be used where appropriate policies are in place within the practice or other health care organization to govern its use and help mitigate associated risks; and (b) follow applicable state and federal laws and regulations (e.g., HIPAA-compliant Business Associate Agreement).” That is a governance requirement, not a blanket approval for any particular tool.
What HIPAA covers—and what it does not
HIPAA attaches to regulated entities and workflows
HIPAA’s Privacy Rule regulates covered entities such as health plans, health-care clearinghouses and most health-care providers that conduct certain electronic transactions, along with their business associates. Whether an AI vendor is a business associate depends on the relationship and the services it performs for the covered entity. It is not decided solely by the vendor’s product label or by whether the software uses machine learning.
If a vendor creates, receives, maintains or transmits PHI on behalf of a covered entity for a covered function, the organization must evaluate the business-associate requirements and the permitted disclosure for that workflow. A written Business Associate Agreement (BAA) generally addresses permitted uses and disclosures, safeguards, subcontractors and incident reporting. The business-associate definition can apply based on the parties’ relationship even if a required BAA has not yet been signed; the missing agreement is not a safe harbor.

HIPAA does not follow data into every consumer app
The Department of Health and Human Services (HHS) explains that HIPAA does not protect information a person voluntarily enters into an app that was not developed or offered by or on behalf of a regulated entity. That can be true even when the information originally came from a medical record. Other federal or state laws may still apply, but a clinician should not assume that copying a chart excerpt into a public consumer service keeps it under HIPAA’s protections.
Identifiability is broader than a name and medical-record number. HHS notes that an IP address, email address or device identifier can be individually identifiable health information when combined with health-related context. Prompts, uploaded images, audio recordings, transcripts, appointment details, free-text notes and metadata can therefore create PHI risk even when obvious identifiers have been removed.

A BAA is necessary in some workflows, but never sufficient by itself
A BAA establishes contractual obligations when the vendor is a business associate; it does not automatically authorize every disclosure. The covered entity also needs a HIPAA Privacy Rule permission for the purpose or, where required, a valid patient authorization. The organization should document that analysis before enabling the integration.
| Question | What to determine |
|---|---|
| Is the tool HIPAA-covered? | Whether the organization is a covered entity, the vendor is acting as a business associate, and the specific workflow involves PHI. A consumer app may remain outside HIPAA even when a user enters information copied from a record. |
| Do we need a BAA? | Determine whether the vendor performs a business-associate function. If so, obtain and review the BAA before the PHI workflow begins. |
| Does a BAA permit the disclosure? | No. Confirm a separate Privacy Rule permission or authorization for the intended use. |
| Does a privacy notice create permission? | No. HHS says notice alone does not authorize a PHI disclosure to a tracking technology vendor. FTC also requires privacy representations to be clear and truthful. |
A six-step privacy review before using an AI tool
1. Define the exact use case
Write down what the tool will do and what decision, if any, it may influence. Distinguish administrative drafting, clinical summarization, ambient recording, patient messaging, coding, triage, diagnosis support and treatment recommendations. State whether the output enters the designated record, is shown to a patient, or is used only as an internal draft.
This definition controls the rest of the review. A tool that drafts a de-identified letter has a different exposure from one that continuously records an encounter and sends a transcript to a vendor. A diagnostic or treatment-support claim may also raise medical-device questions that an administrative tool does not.
2. Inventory the information and every recipient
List each input: typed prompts, pasted notes, transcripts, recordings, photographs, scans, laboratory values, identifiers, timestamps, location data, browser information and device identifiers. Mark which elements are PHI or could reasonably identify a patient when combined.
Then map the recipient chain. Identify the primary vendor, cloud host, analytics provider, model provider, support personnel and other subprocessors. Ask whether data remains within the United States, whether any personnel can access it, and whether the vendor can route it to a different provider after a product update.

- [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by
3. Establish the legal and organizational basis
Have the privacy and security personnel determine whether the disclosure is permitted for the stated purpose, whether the vendor is a business associate, and whether authorization is required. Apply the minimum-necessary standard where it governs the use, and check stricter state privacy rules, professional obligations, employment policies and institutional requirements.
If the organization cannot identify a permission or an appropriate business-associate relationship, do not send identifiable information until counsel or the privacy officer resolves the issue. A clinician’s individual consent banner click does not replace the organization’s legal analysis.
4. Obtain written answers about data handling
Request answers that correspond to the exact product edition, configuration and integration you will deploy. Ask:
- What inputs are stored, in which systems and for how long?
- Are prompts, recordings, images or outputs used to train, fine-tune or evaluate a model?
- Can human reviewers or vendor support staff see the content?
- Which subprocessors receive it, and for what purposes?
- How are data access, encryption, authentication and audit logs managed?
- Can the organization delete data, and how is deletion verified across backups and subprocessors?
- What notice and assistance are provided after a security incident?
- Can the vendor change retention, model use or subprocessors without approval?
Compare the answers with the BAA, master services agreement, product settings and technical documentation. A general privacy policy may describe a consumer service rather than the enterprise configuration you intend to use.
5. Minimize data and supervise outputs
Use the least information needed for the approved task. Prefer de-identified or synthetic material for testing and demonstrations when appropriate. Do not paste identifiable patient information into an unapproved public tool, even for a seemingly harmless formatting or summarization request.

6. Reassess after meaningful changes
Repeat the review when the vendor adds a model, changes retention, introduces a new integration, modifies subprocessors, expands the intended use or changes access controls. Keep a current inventory of approved versions and configurations so staff do not unknowingly use an unreviewed feature.
How common AI tool types differ
| Tool type | Typical data exposure | Questions that change the review |
|---|---|---|
| Administrative drafting or summarization | Text copied from messages, notes or records; may include identifiers. | Can the task be completed with de-identified text? Is content retained or used for model improvement? |
| General-purpose chatbot | Prompts, pasted records, uploaded files and account metadata may leave the organization’s environment. | Is the service approved for PHI? Which account and retention settings apply? Is there a BAA? |
| Ambient documentation | Audio, speaker labels, transcripts, timestamps and encounter context. | When is recording activated? Where are audio and transcripts stored? Who can replay them, and when are they deleted? |
| EHR-integrated assistant | Structured record data, user identity, patient context and generated output. | What permissions and audit logs govern access? Does the integration send data to subprocessors? |
| Diagnostic or treatment-support product | Images, waveforms, laboratory values or other clinical inputs, sometimes linked to patient identity. | What is the intended use, validation evidence, human oversight and regulatory status? |
“HIPAA compliant” is not a complete answer
Vendors may use phrases such as “HIPAA compliant,” “HIPAA secure” or “HIPAA certified.” The Federal Trade Commission warns against unsupported or misleading claims. Compliance is not a permanent product attribute that eliminates the customer’s obligations; it depends on the vendor’s practices, contract, configuration and the covered entity’s own safeguards.
The FTC’s consumer-protection guidance states: “Also, be upfront about your practices, tell consumers the whole truth, and don’t bury key facts in a privacy policy, a Terms of Use section, or other places where consumers aren’t likely to read and understand them.” For a clinical deployment, ask for specific, written explanations rather than relying on a badge, banner or short sales statement.
HHS likewise states: “The Privacy Rule does not permit disclosures of PHI to a tracking technology vendor based solely on a regulated entity informing individuals in its privacy policy, notice, or terms and conditions of use that it plans to make such disclosures.” That warning applies to the legal effect of notice; it does not mean every AI product is a tracking vendor. It does mean that disclosure analysis cannot be replaced by a notice alone.
When an AI product may be a medical device
Using AI in a clinical setting does not automatically make a product a medical device. The Food and Drug Administration says, “The FDA does not regulate AI as such; it regulates medical devices, including AI-enabled medical devices.” Device status depends on the product’s intended use, claims and applicable statutory and regulatory criteria.
Review the exact labeling and claims. A tool that organizes information may be treated differently from one that claims to diagnose disease, recommend treatment or control another device. For a product within the device framework, the organization should examine authorization, intended use, validation, deployment, monitoring, maintenance and modification controls. FDA reported that more than 1,600 AI-enabled medical devices had been authorized for marketing in the United States as of September 2026. That point-in-time figure is not a count of every clinical AI product and does not establish that a particular tool is authorized.

Privacy controls that make daily use safer
- Approved access: provide the tool only through managed accounts and approved devices; prohibit personal accounts for PHI workflows.
- Role-based permissions: limit who can create, view, export or delete prompts, recordings and outputs.
- Logging: retain access and export logs long enough to investigate misuse and satisfy organizational requirements.
- Patient communication: explain recording or AI assistance when required by law, policy or professional standards, and provide any required choice or authorization.
- Human review: require review before generated content becomes part of the record or guides care.
- Incident response: define whom staff contact if information is sent to the wrong tool, retained unexpectedly or exposed in a security event.
- Training: teach clinicians what data may be entered, which tools are approved, how to verify outputs and how to report an error.
The AMA’s privacy policy states that “Individuals should know how their data will be used or reused, and the potential risks and benefits.” In practice, that principle supports plain-language explanations, documented governance and meaningful clinician oversight.
Why clinicians are paying closer attention
AMA’s July 2026 overview reported that more than 80% of physicians said they use AI in professional work, more than three-quarters said it improves their ability to care for patients, and about 40% said they feel both excited and concerned about AI’s role in health care. AMA identified privacy and the patient-physician relationship among physicians’ leading concerns.
Those figures describe the AMA’s survey context; they are not universal adoption measurements for every specialty, employer or country. They do show why privacy decisions are now routine operational decisions rather than hypothetical technology questions.
A practical decision rule
If you cannot clearly answer what data the tool receives, who receives it, the permitted purpose, whether a BAA is required, how long the data remains, whether it is reused for training, how it is deleted and who reviews the output, pause the workflow. Use an approved alternative or obtain privacy, security and legal review. Revisit the decision whenever the product, contract, model or integration changes.
