What Can Your Employer Legally Monitor at Work? U.S. Rules for Email, Location, Cameras and More

In the United States, an employer may often monitor activity on company systems, but it cannot lawfully monitor “anything” simply by publishing a policy. The answer depends on the device and account involved, the kind of data collected, where and when monitoring occurs, what notice you received, state consent rules, and whether the practice interferes with labor or discrimination protections.

This is a general U.S. overview, not individualized legal advice. State statutes, worker classification, and the identities of everyone being recorded can change the result.

What employers commonly monitor

Government and regulatory materials describe a broad set of workplace-surveillance tools. The Government Accountability Office’s 2024 report, Digital Surveillance of Workers: Tools, Uses, and Stakeholder Perspectives, discusses cameras, microphones, computer-monitoring software, geolocation, tracking applications and wearable devices. Those categories describe technology, not automatic legal permission.

Work email, messaging and internet activity

On an employer-provided account or network, organizations commonly collect message headers, login records, websites visited, downloads, file transfers and security alerts. They may also be able to access the content of work email or workplace chats, particularly when the account is administered by the organization and a written acceptable-use or monitoring policy explains that access.

A work account is not the same as a personal account. Signing a personal Gmail, messaging or cloud-storage account into a company computer does not automatically give the employer unlimited rights to every private message. It does, however, expose information to company security tools and backups. Keep personal communications on a personal device and account, and do not assume that using an employer network makes private content confidential.

Computer activity and productivity signals

Monitoring software can record application use, active and idle time, keystrokes, screenshots, browser history, USB connections, document activity and access to internal systems. Security monitoring that detects malware or unauthorized access is different from continuous productivity scoring, but both can involve extensive personal data. The stated business purpose, the sensitivity of the data and the monitoring schedule matter when assessing legality.

Calls, chats, microphones and recordings

Call recordings, meeting transcripts, voice assistants and an always-on microphone implicate federal and state communications laws. Title I of the Electronic Communications Privacy Act uses definitions in 18 U.S.C. §2510 for wire, oral and electronic communications. Whether a particular recording is lawful depends on who intercepted it, whether a party consented, the ordinary course of the business, the technology used and the law of every relevant state.

There is no single nationwide consent rule that resolves every workplace recording. The GAO’s 2025 report notes that some states require consent from both parties for certain communications. A call between people in different states can therefore create a conflict even when the employer is headquartered elsewhere. A notice hidden in a handbook may not satisfy a statute requiring specific disclosure or consent.

Cameras and video

An employer may use cameras for security, safety, access control or operational reasons in ordinary work areas. Video becomes substantially more sensitive when it captures private conversations, off-duty activity, a home workspace or areas where people ordinarily expect privacy. A camera pointed at a remote worker’s desk can also capture family members, medical information, private mail or other people’s conversations.

Camera access should be limited to a stated purpose, to necessary locations and to authorized viewers. A policy does not by itself make a camera lawful if another statute protects the space or activity being recorded.

GPS, geolocation and tracking applications

Location data may come from a company vehicle, a phone-management profile, a laptop application, a badge, a timekeeping system or a delivery app. Tracking during a delivery shift can serve a clear operational purpose; continuous location collection after the shift or at sensitive places raises a different privacy question. Ask whether tracking stops outside work hours, whether the employer can see precise history or only a work event, and how long location records remain available.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Wearables, biometrics and health-related signals

Wearable technology can measure location, heart rate, electrical brain activity, fatigue and other physical signals. In a December 19, 2024 bulletin, the Equal Employment Opportunity Commission warned that employers using wearables must comply with federal employment-discrimination law. The Federal Trade Commission has also identified worker collection of location, health, emotional and physical information as creating privacy, autonomy, discrimination and security risks.

A request to wear a safety sensor is not equivalent to a demand for unrestricted health surveillance. The employer should be able to explain the signal collected, the safety or operational purpose, who receives raw data, whether an algorithm makes employment decisions and how long records are retained.

The legal questions that determine whether monitoring is permissible

Instead of asking only whether a company has a monitoring policy, evaluate six facts together.

Question Why it changes the analysis
Whose system is it? An employer-owned device, account, vehicle or network generally gives the organization more administrative access than a personal device, but ownership does not erase wiretap, labor, discrimination or state-privacy limits.
What data is collected? Metadata such as login time is usually less intrusive than message content, audio, video, precise location, biometrics or health signals. Content and sensitive data trigger more legal and security concerns.
When and where? Monitoring during paid work in an ordinary work area is different from off-duty tracking, recording inside a home, or capturing a private conversation.
What notice or consent exists? A policy, pop-up, sign-in notice or signed acknowledgment may establish notice, but it cannot authorize conduct a statute forbids. Some states impose specific consent requirements.
What is the purpose and scope? Security, safety, payroll and access-control purposes may justify limited collection. Data gathered beyond what is needed, retained indefinitely or shared broadly creates greater risk.
What worker rights are involved? Monitoring can interfere with protected organizing or complaints, and data or algorithms can create discrimination risks. Worker classification also affects which protections apply.

Communications, email and internet: the rules to check

Federal interception law is only the starting point

Federal wiretap analysis covers more than traditional telephone calls. It can reach microphone audio, recorded meetings, chats and other electronic communications. The legality of an employer’s access may turn on consent, whether the system provider is involved, whether the access occurred in the ordinary course of business and whether the employer captured communications that were not part of work.

Do not infer that a company can read every personal message because it owns the laptop. Nor should you infer that a “private” label defeats a legitimate security investigation on a company account. The exact technology and facts matter.

State consent and notice requirements

State law can be stricter than federal law. If an employer records a call or meeting, identify the states where the participants were located at the time, not just the employer’s headquarters. When a state requires consent from all parties for a covered recording, a one-sided announcement may be insufficient.

Delaware illustrates how a state may impose an electronic-monitoring notice rule. Its statute requires an employer either to provide electronic notice at least once each day an employee accesses employer-provided email or internet services, or to give a one-time written or electronic notice acknowledged by the employee. That is a Delaware requirement, not a national standard.

Remote work and monitoring inside the home

Remote work does not automatically remove an employer’s ability to monitor a work device, but it changes the privacy stakes. A company may have a legitimate reason to secure its laptop or verify a work event; that does not necessarily justify continuous webcam video, an always-on microphone or location tracking throughout a worker’s personal time.

Check whether the remote-work policy specifies camera activation, audio capture, screen screenshots, location collection, recording of meetings and the hours when each tool operates. Determine whether household members, visitors or medical information could be captured. Prefer technical controls that separate work from personal use, such as a company-managed account, a physical camera shutter and a clear off-hours boundary.

Electronic monitoring and labor rights

The National Labor Relations Board protects many private-sector employees who act together about wages, benefits, safety or other working conditions. Its employee-rights guidance states: “Your employer cannot discharge, discipline, or threaten you for, or coercively question you about, this ‘protected concerted’ activity.”

Electronic monitoring and algorithmic management can be unlawful when they tend to interfere with or prevent a reasonable employee from engaging in activity protected by the National Labor Relations Act. For example, a system designed to identify employees discussing pay, a policy that treats group safety complaints as misconduct, or surveillance selectively aimed at organizers can create a labor-law issue even if the same technology is used for ordinary security elsewhere.

NLRA coverage is broad for private-sector employees but does not cover everyone. Government employees, independent contractors, supervisors and some transportation workers fall outside ordinary NLRB coverage. Another law or a state statute may still protect them.

Discrimination, health data and automated decisions

Monitoring can create an employment-discrimination problem when collected information reveals a disability, pregnancy, religion, age-related condition or other protected characteristic, or when an algorithm produces unequal results. Wearable fatigue or health scores are especially sensitive because an apparently neutral threshold may disadvantage workers with disabilities or different medical conditions.

Before accepting a sensor or app, ask whether the employer receives raw readings or only a narrowly defined safety result, whether a human reviews an automated flag, how employees can correct an error and whether the data is used for discipline or accommodation decisions. A monitoring system that was introduced for safety should not silently become a general-purpose performance database.

How to assess a monitoring practice step by step

  1. Collect the governing documents. Obtain the current monitoring, acceptable-use, recording, bring-your-own-device and remote-work policies, plus any pop-up notices or acknowledgments.
  2. Identify the technical setup. Record the device, account, application, sensor, camera or vehicle involved; note who owns it and whether a vendor processes the information.
  3. Describe the data precisely. Determine whether the tool captures metadata, screen activity, message content, audio, video, location, biometric readings or health information.
  4. Map time and place. Note whether collection occurs only during working time and in work areas, or continues during breaks, off-duty hours, travel or time at home.
  5. Check disclosure and consent. Find the exact notice, when it was delivered, whether acknowledgment was required and which states govern the people being recorded.
  6. Ask about access and retention. Find out which managers or vendors can view the data, how long records are kept, whether they are sold or shared, and how a worker can request correction.
  7. Consider protected activity and discrimination. Ask whether the system targets group complaints or organizing, or whether a score could disadvantage a protected group or expose medical information.
  8. Preserve evidence before objecting. Save policies, screenshots, device settings, notices, disciplinary messages and dates. Keep copies in a personal location that does not violate confidentiality rules.

Examples: how the same tool can produce different outcomes

Company laptop versus personal laptop

A security agent that scans a company laptop for malware is easier to justify than a keylogger installed on a personal laptop under a bring-your-own-device program. The BYOD policy should identify exactly what the employer can see and provide a way to keep personal files and accounts outside the managed area.

Delivery vehicle versus off-duty phone

GPS on a company vehicle during scheduled deliveries can document routes and safety events. An app that continues precise tracking on an employee’s own phone after the shift presents a broader privacy question and should have a clear off-duty boundary.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Scheduled video meeting versus room surveillance

Recording a scheduled meeting after announcing the recording and identifying its purpose is different from leaving a microphone active in a home office all day. The latter can capture people and conversations unrelated to work.

Group safety complaint versus individual productivity review

A dashboard that measures response time for individual assignments may be ordinary performance management. Using the same dashboard to identify and discipline employees who jointly raise a safety concern can implicate protected concerted activity.

What to do if you think monitoring is unlawful

Start with a focused written question: what data is collected, during which hours, from which device, for what purpose, who can access it and when it will be deleted. Avoid placing confidential personal information in a work ticket while seeking that explanation.

If the issue involves group complaints, organizing, retaliation or coercive questioning, contact the National Labor Relations Board. If it involves discriminatory treatment or disability-related data, consider the Equal Employment Opportunity Commission or an employment lawyer. State regulators and lawyers can address state recording, electronic-monitoring and privacy rules. Bring the preserved policy and timeline to any consultation.

Official publications provide context but not a single percentage of U.S. employers that monitor workers. The GAO issued its 2024 tools-and-perspectives report and a 2025 report on potential effects and federal-agency roles, reissued with revisions on December 10, 2025. Those reports describe technologies and concerns; they do not create a universal permission for employers to monitor every activity.
