Repair common Windows errors and clear accumulated junk for a smoother, more stable PC - no reinstall needed.Free scan · no reinstallBefore sending business or personal data to an AI service, require a written map of the complete data path: what the service receives, which legal entities and subprocessors handle it, where data is stored or accessed, how long each copy survives, whether content is used for model training, and how deletion works. For each recipient outside the EEA, obtain the legal transfer mechanism, the supporting assessment and safeguards, and the vendor’s response process for incidents and government demands.
This checklist focuses on EEA personal data under the GDPR, with related EU AI Act questions. A vendor’s server-region label or general privacy statement is not enough evidence for procurement.

Start by defining the data and the geography
Decide which data your proposed use will send to the service and which jurisdictions’ rules apply. The detailed transfer analysis here concerns personal data protected by the GDPR when an EEA controller or processor makes that data available to another organisation outside the EEA. The European Data Protection Board (EDPB) notes that the GDPR does not provide a single definition of such transfers; in practice, a separate organisation’s ability to receive or access the data is central to the assessment. Read the EDPB’s guide at International data transfers.

Build a data-path record
| Point in the path | Questions to answer | Evidence to retain |
|---|---|---|
| Input | What prompts, files, identifiers, telemetry and feedback leave your systems? | Product data inventory, API documentation and configuration screenshots |
| Processing | Which service, region, legal entity and subprocessors process each category? | Current subprocessor list, data-flow diagram and processing terms |
| Access | Can support, engineering, safety or abuse teams view content from another country? | Remote-access description, role permissions and access-log policy |
| Storage | Where are live data, logs, caches and backups stored? | Region statement and retention schedule for each data store |
| Output | Are generated answers, embeddings or derived profiles retained or reused? | Output-handling terms and deletion procedure |
Use the record for the exact service tier, region and account configuration you will buy; a vendor-wide policy may describe products you are not using.
Ask exactly what goes in, comes out and is inferred
Request a category-by-category inventory rather than accepting “customer content” as a catch-all. Include:
- Prompts, uploaded documents, images, audio and code.
- Personal information contained in those materials, including customer, employee and patient records.
- Generated outputs, conversation history, embeddings and other derived information.
- User IDs, account and billing data, device details, IP addresses, diagnostics and usage telemetry.
- Ratings, corrections, feedback, support tickets, abuse reports and human-review records.
Ask whether the service infers or derives additional information, such as classifications, profiles or safety flags, and whether administrators can disable detailed logging. Apply data minimisation: send only the fields needed for the stated task, redact direct identifiers where possible, and set an approved maximum sensitivity for prompts and uploads. The EDPB treats minimisation, lawful processing and security as continuing GDPR obligations, not optional features of a transfer arrangement.
Evidence that makes the answer testable
- A product-specific data inventory or flow diagram.
- Processing terms for the purchased edition and region.
- Configuration instructions showing which logs, history and telemetry can be disabled.
- A retention schedule distinguishing content, metadata, safety logs and backups.
Identify every recipient and access route
Ask for the contracting entity, each processing entity, named affiliates, cloud and support providers, and the country in which each operates. For every subprocessor, record its function, the categories of data it can receive and whether it can access readable content or only encrypted material.
Ask specifically whether support or engineering access can occur from outside the selected hosting region, including during an outage or security investigation. A current subprocessor list should include countries, service roles, notice of proposed changes and your rights to object or terminate after a material change. “Hosted in the EEA” is incomplete if a separate organisation elsewhere can retrieve the data.

Clarify the legal role and contract
For each purpose, ask whether the vendor acts as your processor, an independent controller, or both. A single product can have different roles for core service delivery, account administration, fraud prevention, analytics, support and model improvement. Your records should assign a role to each purpose instead of relying on a label in marketing material.
Obtain the data-processing agreement (DPA) and check that it covers documented instructions, confidentiality, security, assistance with access and deletion requests, impact assessments, audits, subprocessors, breach cooperation and deletion or return at the end of service. Where the recipient is a processor, a processing contract is still required even when an international-transfer mechanism is in place. Transfer rules add to, rather than replace, the GDPR’s other requirements.
Match every cross-border recipient to a transfer mechanism
Make the vendor identify the mechanism for each recipient, not merely the country in which it is incorporated. The EDPB’s current guide describes these principal routes:
| Route | Questions for the vendor | Buyer checks |
|---|---|---|
| Adequacy decision | Which decision covers this destination, entity, data and processing? | Confirm the decision is in force and applicable to the named recipient; monitor for changes. The United States entry is limited to commercial organisations participating in the EU–US Data Privacy Framework, not every US company. |
| Standard Contractual Clauses (SCCs) | Which module, parties and annexes apply? Can you provide the signed version? | Verify that the module matches the controller/processor relationship and that technical, organisational and subprocessor details are complete. |
| Other Article 46 safeguards | Are binding corporate rules, an approved code of conduct or certification used? | Confirm the instrument covers the actual receiving entity and the relevant transfer. |
| Article 49 derogation | Which exception is relied on, and why is the transfer necessary? | Treat derogations as exceptional and non-routine; document the specific facts and frequency. |
The European Commission adopted the modernised SCCs on 4 June 2021, replacing the former Directive-era sets. Read the Commission’s current information at Standard Contractual Clauses (SCC). Ask for the selected module, completed annexes, named transfer parties and any supplemental contractual terms.
Demand a destination-specific transfer assessment
Ask the vendor for its transfer assessment, or an equivalent analysis, covering the law and practice of every destination. Under the EDPB’s explanation of the Court of Justice’s Schrems II ruling, an exporter must consider case by case whether foreign rules or practices could undermine the safeguards in the chosen mechanism, including laws that allow authorities to access data.

- [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by
Request a description of supplementary technical, organisational and contractual measures and the circumstances in which they operate. Encryption and pseudonymisation are not automatic answers: ask who controls the keys, whether the vendor must process readable content, which metadata remains visible, and whether a subprocessor can obtain plaintext. The correct measures depend on the data, service architecture and destination.

Ask whether content trains models or improves the product
Get a direct answer about prompts, files, outputs, ratings and feedback. Ask whether each category is used to train a shared model, fine-tune a tenant-specific model, improve safety systems or conduct human review. Clarify:
- Whether use is on by default and whether an account-level or organisation-level opt-out exists.
- Whether the opt-out is contractual, applies to every subprocessor and covers support and abuse-monitoring data.
- What happens to data already placed in a training or evaluation pipeline when you opt out or terminate.
- Who can view samples for quality, safety or abuse investigations, and under what access controls.
Save the exact terms and configuration that establish the setting. There is no universal AI-vendor training default; it must be verified for the specific product and date.
Set retention, deletion and backup requirements
Require separate periods for prompts, outputs, conversation history, operational logs, safety and fraud records, support tickets, snapshots and backups. Ask:
- When deletion starts after an administrator request or contract termination.
- How deletion instructions reach each subprocessor and affiliate.
- When backup copies expire and whether they remain isolated from production use.
- Whether legal holds, abuse investigations or billing records create exceptions.
- Whether the vendor can provide a deletion record identifying systems and dates.
Do not accept “deleted from the service” without a description of residual logs, caches and backups.

Evaluate security evidence against your risk
Ask for concrete controls, not a certificate name alone. Cover encryption in transit and at rest; identity, least-privilege and privileged-access management; tenant isolation; key ownership and rotation; audit logging; vulnerability handling; secure development; disaster recovery; and incident response. Match the evidence to the sensitivity, volume and concentration of the data you intend to submit.
For a governance reference, the NIST AI Risk Management Framework can help organise AI risk-management discussions, but no framework or certification by itself proves that a particular transfer is lawful.

Security incidents
Put notification timing, points of contact, cooperation, evidence preservation and customer updates in the contract. Ask whether the vendor will provide affected-data scope, indicators of compromise and support for your regulator and individual-notification duties. Confirm how it will coordinate with subprocessors.
Government and law-enforcement demands
Ask whether the vendor will notify you where legally permitted, challenge or narrow an overbroad demand, and disclose only what it is legally required to provide. The EDPB’s final Article 48 guidance explains that a third-country judgment or administrative decision is not automatically recognised or enforceable in Europe; an international agreement may provide a basis, and other GDPR transfer grounds must still be considered. See the announcement at EDPB final Article 48 guidance.

Ask what the EU AI Act adds
Privacy and transfer compliance do not answer every AI Act question. Ask the vendor to state whether it considers itself a provider, what system documentation and instructions it supplies, and which duties it believes apply to your deployment. The European Commission says a provider established outside the EU can still fall under the AI Act when its system’s output is used in the EU.
Best Value
For Article 50 transparency duties, the Commission says the requirements apply from 2 August 2026. Certain marking obligations for qualifying systems already on the market before that date have a limited later compliance date of 2 December 2026. The exact duty depends on the system, role and use case. Review the Commission’s FAQ at Transparency obligations under Article 50 of the AI Act, and keep this analysis separate from the GDPR transfer assessment.
Check the vendor’s operational support
Ask how the service will help you answer data-subject access, correction, deletion and objection requests; perform audits and impact assessments; produce processing records; and update you when its data chain changes. Confirm which actions remain yours as controller or deployer, including user notices, lawful basis, minimisation, retention decisions and risk assessments.
Compare vendors on identical evidence
Use one scorecard for every candidate. Record the answer, document version, date and owner rather than awarding points for a marketing claim.

Use a documented procurement sequence
- Classify the proposed data. Separate personal, confidential, regulated and publicly available material, and define the minimum fields needed.
- Obtain the product-specific packet. Collect the DPA, terms, subprocessor list, data-flow description, retention schedule, security evidence and model-use settings for the intended tier and region.
- Map recipients. Add every legal entity, country, function and access path to the data-path record.
- Match mechanisms. Require the vendor to name the adequacy decision, SCC module or other safeguard for each cross-border recipient and provide the supporting documents.
- Review destination risks. Examine the vendor’s transfer assessment and supplementary measures, including who can access keys and plaintext.
- Test controls. In a non-production account, verify logging, retention, deletion, export and opt-out settings; retain screenshots and dates.
- Contract the response. Set incident deadlines, government-request handling, subprocessor notice, audit assistance and deletion evidence requirements.
- Approve with an owner and review date. Record unresolved risks, compensating controls and the person responsible for renewal review.
Red flags that require a written resolution
- The vendor names only a country or cloud region, not the legal entities and access routes.
- The subprocessor list omits countries, functions or a change-notice process.
- “No training” appears in marketing copy but not in binding terms or account controls.
- An SCC is offered without a selected module, annexes, named parties or destination assessment.
- Deletion promises exclude backups, safety logs or support systems without stating their expiry.
- A certificate is presented as proof of GDPR compliance without control details or scope.
- The vendor cannot explain notification, challenge or cooperation for government demands.
Escalate unresolved answers to privacy counsel and the security owner before production use. Keep signed contracts, subprocessor snapshots, configuration evidence and approval records so the same questions can be answered at renewal, after a material change or when the service expands to new data.
