What Brazil’s President Can Change About Taxes, Spending, and the Central Bank

Brazil’s president can set the government’s agenda, propose federal tax and budget changes, and nominate Central Bank leaders. But the president cannot change the tax system by decree, spend beyond legal appropriations, or personally set monetary policy. Congress has a central role in legislation and budgets, while the Central Bank operates under statutory autonomy and its leaders require Senate approval.

Taxes: the president can propose changes, not rewrite the system alone

Brazil’s Constitution assigns taxing powers among the Union, states, the Federal District, and municipalities. The president can make federal tax policy a priority and submit proposals through the legislative process, but a proposal must pass through Congress to become law. An executive decision cannot transfer or override tax powers assigned to other levels of government; changing the constitutional allocation requires a constitutional amendment.

Tax reform involves more than the federal government

Constitutional Amendment 132 of 2023 changed the Constitution’s tax provisions and established a new goods-and-services tax framework, including the IBS Management Committee. The Constitution describes that committee as a public entity with technical, administrative, budgetary, and financial independence and provides for state and municipal representation. Its governance is therefore not simply a matter of presidential direction.

Spending: the president proposes and administers within legal limits

The Constitution sets out a federal planning and budget framework built around a multi-year plan, a budget-guidelines law, and an annual budget law. The president’s government submits budget proposals; Congress considers them. Once the annual budget is in force, the Executive is responsible for implementation, but appropriations, mandatory spending, fiscal rules, and legally tied resources limit what can be changed or spent.

How budget execution is constrained

Under Brazil’s Fiscal Responsibility Law, the Executive Branch establishes financial programming and a monthly disbursement schedule within 30 days after the budget is published. If revenue forecasts threaten compliance with fiscal targets, restrictions on commitments and financial execution may be required under the applicable Budget Guidelines Law. The law exempts legally or constitutionally mandatory spending, debt service, and specified other categories from those restrictions.

Those rules do not mean every discretionary item is automatically protected or that every outlay can be cut. The effect on a particular program depends on the applicable budget laws and appropriations for that year. The government’s role is to execute the enacted budget subject to those rules, not to treat the full budget as freely adjustable.

Central Bank: nomination is not day-to-day control

Complementary Law No. 179 of 24 February 2021 gives Brazil’s Central Bank statutory technical, operational, administrative, and financial autonomy and says it has no ministerial subordination. The president nominates the Bank’s president and directors, but the Senate must approve the nominees. Their terms are four years and staggered across the presidential term.

Who sets and conducts monetary policy

The Monetary Policy Council sets monetary-policy targets. The Central Bank is responsible for conducting the monetary policy needed to meet them. The Bank’s fundamental objective is price stability; the statute also identifies financial stability and efficiency, smoothing fluctuations in economic activity, and promoting full employment among its objectives. The president therefore cannot personally set the Bank’s policy decisions simply by issuing an instruction.

Removal is limited by statute

The law lists grounds for ending a Central Bank leader’s term, including resignation, incapacity, specified final or collegial convictions, and proven recurring insufficient performance. For the insufficient-performance ground, the Monetary Policy Council must submit the proposal and the Senate must approve it by an absolute majority. Presidential nomination does not create an at-will dismissal power.

Currency and Treasury financing

The Constitution assigns currency-issuing authority exclusively to the Central Bank and prohibits it from lending directly or indirectly to the National Treasury. It separately permits the Bank to buy and sell Treasury securities to regulate the money supply or interest rates. That permitted securities activity is distinct from a direct loan to the Treasury.

How the powers compare

Area What the president can do Who else must act Main constraint
Taxes Set federal priorities and propose legislation Congress must legislate; constitutional changes require an amendment The Constitution allocates tax powers among levels of government
Spending Submit budget proposals and administer the enacted federal budget Congress considers the budget Appropriations, mandatory spending, and fiscal rules govern execution
Central Bank leadership Nominate the Bank’s president and directors The Senate must approve nominees Four-year staggered terms and statutory limits on removal
Monetary policy No direct authority to set the Bank’s policy decisions The Monetary Policy Council sets targets; the Central Bank conducts policy The Bank’s statutory autonomy

The framework described here is grounded in the Constitution, Complementary Law No. 179, and the Fiscal Responsibility Law. The English-language Fiscal Responsibility Law translation hosted by the government is marked revised 2025; the Portuguese text is controlling for close legal interpretation. This is the legal framework as of 4 October 2026, not a prediction about political negotiations or a particular year’s budget decisions.
