What Australian Employees Need to Know About Annual Leave Rights and Refusals

In Australia’s national workplace relations system, an employer must not unreasonably refuse an employee’s request to take annual leave. That does not mean every requested date must be approved. The employer and employee still need to agree when leave will be taken, and the applicable award, enterprise agreement, workplace policy or contract may set the request process. A different set of rules applies when an employer directs leave during a shutdown or because an employee has built up a large balance.

Who gets annual leave, and how much?

Under the National Employment Standards (NES), employees other than casual employees accrue four weeks of paid annual leave for each year of service. Accrual is continuous and based on the employee’s ordinary hours. A part-time employee therefore receives a proportionate entitlement based on those ordinary hours, rather than an automatic four-week block at the full-time rate.

Leave becomes available as it accrues. It does not expire at the end of the year, and an employee does not have to use the entitlement within the year in which it was earned. Untaken annual leave generally remains owing until it is taken or paid out when employment ends. The exact entitlement can be affected by the employee’s classification, industrial instrument and hours, so confirm coverage before relying on a calculation.

Can an employer refuse a request for annual leave?

Yes, an employer can refuse a particular request, but the refusal must not be unreasonable. This is the Fair Work Ombudsman’s general rule: “The employer must not unreasonably refuse an employee’s request to take annual leave.” There is no universal statutory list of acceptable reasons and no single notice period that applies to every request across Australia.

The employee should make the request before the leave starts and follow the procedure that applies at the workplace. That procedure may be in an award, registered enterprise agreement, company policy or employment contract. One workplace may require a form or system request; another may specify a minimum notice period or an approval chain. A policy cannot remove the NES protection against an unreasonable refusal, but it can determine how a request is submitted and handled.

What “reasonable” means in practice

Reasonableness is assessed in the circumstances rather than by a fixed number of days’ notice. Relevant facts can include the timing and length of the absence, staffing needs, other approved leave, operational commitments and whether workable alternative dates exist. These are practical factors, not a national checklist that automatically decides every dispute.

If a request is declined, ask for the reason and whether alternative dates are available. Keep the original request, the response and any follow-up in writing. Those steps are sensible record-keeping, not mandatory legal requirements established by the general guidance. Do not begin leave simply because a request has been submitted; taking leave without approval can create a separate attendance or disciplinary issue.

Request refusal and employer direction are different legal questions

A refusal responds to an employee’s proposed dates. A direction tells the employee when the employer requires leave to be taken. The legal test and the source of the employer’s power differ, so an employee should identify which situation is occurring before arguing about whether the action is lawful.

Situation What must be checked Key qualification
Employee asks for annual leave Whether the employer’s refusal is unreasonable, and what request procedure applies No single national notice period or universal list of valid refusal reasons
Employer directs leave under an award or registered agreement Whether that instrument permits the direction and what notice, writing and balance rules it contains A direction is not valid merely because the business is closed or the balance is high
Employer directs leave with no award or agreement covering the employee Whether requiring leave is reasonable in the circumstances The general reasonableness test applies
Business temporarily shuts down The shutdown clause in the applicable award or agreement, or reasonableness if neither applies Shutdown is not the same as a stand down
Employee has a large accrued balance The instrument’s excessive-leave provisions and any employee or employer initiation rights The eight- or ten-week markers are general guidance, not an automatic direction power

When can an employer direct annual leave?

For an employee covered by an award, an employer can direct annual leave only if the award permits that direction. The same principle applies to a registered enterprise agreement. The employer must then comply with the clause’s conditions, which may cover written notice, timing, minimum periods and the treatment of an excessive balance.

If no award or registered agreement covers the employee, the employer may require annual leave when the requirement is reasonable. Reasonableness remains fact-specific; it is not a blanket permission to send everyone on leave whenever management chooses.

Temporary shutdowns

A temporary shutdown is a planned closure of the business, commonly around Christmas and New Year. It is not the same as a stand down, which has different legal conditions and consequences. Before accepting a shutdown direction, identify the instrument that covers the job and read its shutdown clause.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Most modern awards contain shutdown rules. In many cases, the direction must be reasonable, given in writing and issued within the notice period specified by the award. If the applicable instrument contains no rule allowing a shutdown direction, the employer cannot create that power by announcing a closure. The parties can still agree that the employee will use accrued annual leave, take annual leave in advance where permitted, or take unpaid leave. If the employee has insufficient accrued leave, the available arrangement depends on the instrument and the parties’ agreement; an employer cannot automatically force unpaid leave simply because the balance is exhausted.

A notice-period example, not a national default

The Legal Services Award 2020 (MA000116) illustrates why employees should not assume one shutdown deadline applies everywhere. Its temporary-shutdown provision uses 28 days’ written notice, with a shorter period possible if the majority of relevant employees agree. That is a rule in that award, not a universal Australian requirement. Your own award or agreement may use a different period, wording or procedure.

What happens when the annual-leave balance is excessive?

The Fair Work Ombudsman generally describes an excessive annual-leave balance as more than eight weeks, or more than ten weeks for a shiftworker. Those figures help identify when the issue may need attention, but they do not automatically authorize an employer to choose dates or ignore the applicable industrial instrument.

Some awards and agreements allow an employer to direct leave once specified conditions are met. Some also give an employee a right to initiate leave when the balance is excessive. The operative rules can include written notices, minimum leave periods, a protected minimum balance and a process for negotiating dates. Read the actual clause rather than applying the eight- or ten-week figure as if it were a stand-alone law.

If an employer says your balance is excessive, ask which award or agreement clause is being relied on, how the balance was calculated and what notice the clause requires. Compare the proposed dates with the instrument’s limits and retain the written direction.

How annual leave is paid

For NES-covered employees, annual leave is paid at the base rate for the employee’s ordinary hours. An applicable award or registered agreement can prescribe a different calculation or an annual-leave loading, so the amount in a payslip may be higher than the base-rate minimum.

A public holiday that falls during approved annual leave is not counted as a day of annual leave. The public holiday therefore does not reduce the employee’s leave balance. At the end of employment, untaken annual leave must be paid out; any annual-leave loading that would have applied while the employee was taking leave must also be included where the relevant award or agreement provides for it.

A practical process for handling a refused request

  1. Check coverage. Identify whether the role is covered by a modern award or registered enterprise agreement. If it is, locate the clauses dealing with annual-leave requests, notice and dispute handling. If not, check the contract and workplace policy for the request process.
  2. Submit the request before leave starts. Use the required form, payroll system or written channel, and state the proposed start date, end date and total working days. Keep a copy showing when it was submitted.
  3. Ask for the response in writing. If the request is declined, ask for the reason and whether alternative dates would work. Do not characterize the refusal as unlawful merely because it is inconvenient; the legal question is whether it is unreasonable in context.
  4. Compare the response with the instrument. Check any notice period, blackout or peak-period clause, staffing rule and escalation process. A workplace policy may explain administration, while the award or agreement supplies enforceable conditions.
  5. Propose workable alternatives. Offering different dates or a shorter period can clarify whether the problem is the particular timing rather than annual leave generally. Record any revised proposal and the employer’s answer.
  6. Escalate with documents. If the dispute remains unresolved, gather the request, refusal, relevant clause, leave balance and payslips. Contact the Fair Work Ombudsman, a union, an industry association or a workplace-relations professional for guidance on the individual facts.

How to assess a shutdown direction

  1. Confirm that it is a shutdown. Establish the closure dates and whether the employer is directing annual leave, proposing an agreement, or discussing unpaid leave. Do not treat a shutdown announcement as proof that the direction is valid.
  2. Identify the governing instrument. Check the modern award or registered enterprise agreement that covers the work. An award-free and agreement-free employee is assessed under the general reasonableness test instead.
  3. Read the exact clause. Look for authority to direct leave, required written form, notice period, minimum or maximum periods, and rules for employees without enough accrued leave.
  4. Check timing and balance. Compare the written notice date and proposed leave period with the clause. Verify the accrued balance and whether the direction would leave any protected minimum.
  5. Respond in writing if there is a problem. Identify the clause or missing notice, explain the practical issue and ask what alternative arrangement is proposed. Avoid assuming that unpaid leave can be imposed without agreement.

Common mistakes that create avoidable disputes

  • Assuming every request has a fixed notice period. The sources do not establish one national deadline. The applicable instrument or workplace process may set one.
  • Treating “excessive” as an automatic command. Eight weeks, or ten for shiftworkers, is general Fair Work Ombudsman guidance. The award or agreement controls the actual direction mechanism.
  • Assuming a Christmas closure overrides an award. A shutdown direction needs permission in the applicable award or agreement, or must be reasonable for an employee outside both systems.
  • Confusing a shutdown with a stand down. They are different arrangements with different legal rules.
  • Forcing unpaid leave when annual leave runs out. The lawful options depend on the instrument and agreement; there is no automatic right to impose unpaid leave.
  • Ignoring public holidays in the calculation. A public holiday during annual leave does not consume a day from the annual-leave balance.
  • Relying on a verbal conversation alone. Written requests, responses and directions make the dates, reasons and applicable rule easier to verify.

What to check before taking action

  • Are you in Australia’s national workplace relations system, and are you a non-casual employee for annual-leave purposes?
  • Which modern award or registered enterprise agreement, if any, covers your role?
  • What does the current instrument say about requests, shutdowns, excessive balances, notice and written directions?
  • How much leave has actually accrued, and are any public holidays inside the proposed period?
  • Is the employer refusing your requested dates, or directing a different period under a specific power?
  • Have you preserved the request, response, direction and relevant payslip or leave record?

Where to get help with a live dispute

Fair Work Ombudsman guidance is general information, not individual legal advice. For a personal dispute, contact the Fair Work Ombudsman Infoline on 13 13 94, your union, an industry association or a workplace-relations professional. Give them the current award or agreement, the exact wording of the request or direction, dates, leave balance and any written explanation. Because awards and agreements can change, verify the live instrument before relying on a procedural detail such as a notice period.
