These rights are not a blanket veto over references to a person: the legal issue depends on how the identity is used, what interest is claimed, the evidence and the competing context, including freedom of expression.
What personality rights protect
Personality rights, sometimes discussed as publicity rights, concern the use of identity attributes that point to a particular person. Courts have considered attributes such as a person’s name, image, likeness, voice and other recognizable features of their persona. The concern can arise when another party uses those attributes without authorization, especially in a commercial context. Whether a particular use is legally actionable depends on the facts; merely mentioning or depicting someone does not automatically establish a violation.

The concept matters because identity can carry both personal and commercial significance. The Delhi High Court has described publicity rights as recognizing the commercial value of a person’s image or persona and protecting a proprietary interest in the profitability of that public reputation. That is the court’s summary in Krishna Kishore Singh v. Sarla A Saraogi, not a rule that every use of a well-known person’s identity is prohibited. Read the Delhi High Court decision.

In a separate order, the Delhi High Court observed that intellectual-property protections for individual attributes can have dimensions connected with rights protected by the Constitution of India. That observation appears in the interim order in Anil Kapoor v. Simply Life India, dated 20 September 2023. It illustrates why these disputes can involve more than a simple question of who owns a photograph or recording; it does not itself establish a universal rule for every identity-related claim. How the protection works in India
The cited decisions do not establish a single, comprehensive personality-rights statute. Instead, Indian courts have addressed persona and identity through cases involving privacy, publicity, intellectual-property interests and constitutional interests. A reader should therefore be wary of treating “personality rights” as one fixed statutory entitlement with an automatic outcome. The right asserted, the particular use and the procedural posture of the case all matter.
A court may be asked for an interim injunction—temporary relief sought while a case is pending—or may decide a matter at a later stage. An interim order records a court’s assessment at that stage and on the material before it; it should not be reported as a final decision resolving every possible dispute about the person’s identity. The 2023 Anil Kapoor order and the 2024 Arijit Singh order discussed below are interim orders.
When assessing a disputed use, the decisions point to several practical questions rather than one automatic trigger:

- Whose identity is involved? Is the person identifiable from the name, image, voice or combination of attributes used?
- What attribute and use are challenged? A photograph, a name in a story, a voice imitation and merchandise present different factual settings.
- Is the use authorized? Authorization is relevant, but the existence or absence of permission does not by itself settle every legal issue.
- What is the context? A commercial use, expressive work or use combining both may raise different considerations.
- What interest is asserted and what does the record show? The claimant’s legal basis, the evidence and the specific defendants or material are important.
- What competing interests apply? Freedom of expression and other relevant circumstances can affect whether relief is appropriate.
- What stage is the case at? An interim restraint and a final ruling have different procedural meanings.
This framework helps explain why a court order concerning one person and specified defendants cannot be converted into a nationwide ban on a whole category of speech or technology.
What the Anil Kapoor case decided at the interim stage
On 20 September 2023, the Delhi High Court considered Anil Kapoor’s request for protection of his name, image, likeness, voice and other attributes. The court found a prima facie case for ex parte interim relief and restrained specified defendants from specified uses of his persona. The order addressed, among other things, certain AI-generated and commercial content, face-morphing and merchandise uses. “Prima facie” describes an initial assessment for purposes of interim relief; it is not the same as a final ruling after a complete determination of all issues.
The decision is relevant to people asking whether synthetic or altered media can be challenged. It shows that, on the facts and at the stage before it, the court was prepared to grant interim protection against some specified uses involving Kapoor’s persona. It does not mean that every AI-generated depiction, parody, reference, altered image or use of a public figure’s name is automatically unlawful. The scope of the restraint was tied to the suit and the uses addressed in the order.

The court wrote: “The present case shows how elements of intellectual property that protect the attributes of an individual, in fact have other dimensions including rights protected by the Constitution of India.” The observation reflects the court’s reasoning in that particular order. It is useful context for understanding why identity disputes may involve intersecting legal interests, but it should be read alongside the order’s specific procedural and factual setting. On 26 July 2024, the Bombay High Court issued an interim order in Arijit Singh v. Codible Ventures LLP. The dispute addressed alleged uses of the singer’s name, image, voice, vocal style, manner of singing and other attributes, including AI voice models and synthesized voice imitations. The order makes the case relevant to questions about whether reproducing or imitating a recognizable voice can raise a personality-rights issue.
Voice disputes are not limited to a literal copy of an existing recording. The allegations in Singh’s case concerned voice and vocal characteristics, including synthesized imitations. Still, the existence of an allegation and an interim order does not establish that every imitation or synthetic voice is prohibited. The context, identifiability, use, asserted legal interest and evidence remain significant, and the result in this case should not be generalized beyond its setting. Limits: expression, public information and context
Personality or publicity rights must be understood alongside freedom of expression. A person’s public profile does not automatically make every reference to them an unauthorized commercial exploitation, and an identity claim does not by itself resolve whether a film, article or other expressive work may be published. Courts consider the particular material and the claim before them.
In Krishna Kishore Singh v. Sarla A Saraogi, decided on 11 July 2023, the Delhi High Court declined an application seeking an interim restraint against a film about Sushant Singh Rajput. The court found the material was drawn from publicly available reporting and addressed freedom of expression. This was a decision about the record and request before the court; it does not establish that any publication using public information is immune from all possible claims.
The same decision rejected, on the facts before it, the plaintiff’s attempt to inherit the deceased person’s asserted privacy, publicity and personality rights. That holding should be described narrowly: it is not a complete statement of every possible posthumous claim or the law in every future case. Someone considering a claim involving a deceased person’s persona should not assume that a family member automatically inherits the same rights, or that the ruling answers every related legal question. Read the Delhi High Court decision.

How the three decisions differ
The cases are most useful when read as examples of different facts, claims and procedural settings, not as interchangeable precedents for every dispute.
| Case | Issue and setting | What the decision supports | Important limit |
|---|---|---|---|
| Anil Kapoor v. Simply Life India, Delhi High Court, 20 September 2023 | Request for protection of name, image, likeness, voice and other attributes; certain AI, face-morphing and commercial uses were addressed. | The court found a prima facie case and granted ex parte interim relief against specified defendants and specified uses. | Interim, case-specific relief—not a final national rule or a blanket ban on AI or references to public figures. Order. |
| Arijit Singh v. Codible Ventures LLP, Bombay High Court, 26 July 2024 | Interim proceedings concerning alleged uses of name, image, voice, vocal style and other attributes, including AI voice models and synthesized voices. | A recognizable voice imitation may raise a personality-rights issue depending on the claim and context. | The order does not settle that every imitation or synthetic voice is unlawful. Order. |
| Krishna Kishore Singh v. Sarla A Saraogi, Delhi High Court, 11 July 2023 | Application to restrain a film about Sushant Singh Rajput; the court considered public-domain reporting and expression, as well as asserted posthumous rights. | The court declined the interim restraint and rejected inheritance of the asserted rights on the facts before it. | Does not make every use of public information immune or comprehensively resolve all posthumous claims. Decision. |
What to do if you believe your identity has been misused
A useful first step is to preserve the material and the circumstances in which it appeared. The question is not only whether a name, image or voice is present, but how the content identifies the person, who made or distributed it, and what use is being made of it. A clear record can help a qualified lawyer assess the relevant facts without assuming that one of the reported cases decides the matter automatically.
- Save the specific content. Keep copies or captures of the image, recording, post, page or product listing, along with the address where it appeared and the date you encountered it, when available.
- Record the context. Note whether it appears to be advertising, merchandise, commentary, a film or other expressive material, an imitation, or a mix of uses. Preserve surrounding text rather than only an isolated image or audio clip.
- Identify the attribute at issue. Be precise about whether the concern is a name, image, likeness, voice, vocal style or multiple recognizable features, and why the person can be identified.
- Gather information about authorization and use. Record any relevant permission, terms or communication and, where apparent, how the material is being distributed or used commercially.
- Seek advice based on the facts. A lawyer can assess which legal interests may apply and whether a court remedy is appropriate. The cited cases discuss interim injunctions and damages as possible remedies, but neither is guaranteed by the existence of a disputed use.
This is general information, not individualized legal advice. The appropriate claim and response depend on the actual content, evidence, parties and context.

Quick Recap
What these rights do not mean
- They do not create an automatic right to prevent every mention, depiction or discussion of a person.
- They do not make every AI-generated image, deepfake, voice imitation or altered image unlawful solely because it resembles someone.
- An interim order in a particular person’s case is not, by itself, a final rule governing all people, platforms or content.
- A decision declining one request for an injunction does not establish that all comparable claims must fail.
- The Delhi High Court’s ruling about inheritance in the Sushant Singh Rajput film dispute should not be treated as a comprehensive answer to every posthumous-rights question.
