A “ghost gun” is a common name for a privately made firearm (PMF). The key difference from a typical commercially manufactured firearm is its production and marking history—not a special firing mechanism or a separate physical kind of weapon. A PMF is made or assembled outside the licensed-manufacturer process, so it may lack the manufacturer-applied serial number that helps identify and trace commercial firearms.
What does “ghost gun” mean?
“Ghost gun” is a colloquial term; the federal regulatory term is “privately made firearm.” Under 27 CFR § 478.11, a PMF is a firearm, including a frame or receiver, completed, assembled, or otherwise produced by someone other than a licensed manufacturer without a serial number placed by a licensed manufacturer at the time it was produced. The regulation excludes certain registered firearms and firearms made before October 22, 1968, unless they were remanufactured or remade afterward.

The name refers to the difficulty of tracing a firearm that lacks a manufacturer-applied serial number. It does not mean the firearm is inherently invisible, mechanically different, or impossible to identify. ATF explains the common name and the tracing concern on its Privately Made Firearms page.

“Traditional firearm” is used here to mean an ordinarily commercially manufactured firearm, not a separate legal category. The comparison turns on who produced the firearm, how it was marked, and the regulatory path through which it was made or sold.

| Issue | Commercially manufactured firearm | Privately made firearm |
|---|---|---|
| Who makes it | Produced by a licensed manufacturer. | Produced or assembled by someone other than a licensed manufacturer, as described in the federal definition. |
| Serial number at production | A licensed manufacturer applies the required identifying markings, including a serial number. | The regulatory definition focuses on whether a licensed manufacturer placed a serial number when the firearm was produced. A PMF is not necessarily unmarked forever; marking requirements may apply when it enters a licensed dealer’s inventory, and state law may impose additional duties. |
| Traceability | The manufacturer-applied serial number and associated records can help law enforcement trace it through the commercial system. | Without that manufacturer-applied serial marking, tracing may be more difficult. That does not establish that every PMF is untraceable. |
| Regulatory path | Commercial manufacture and sales are subject to federal licensing, marking, recordkeeping, and transaction requirements. | Its production falls outside the licensed-manufacturer process, but federal rules can still apply to qualifying kits and components, and other requirements may apply depending on later transfers and jurisdiction. |
These distinctions describe general federal context, not every firearm’s history or every legal requirement. The firearm’s actual markings, date and method of production, later handling, and applicable state or local law can matter.
What changed under the 2022 federal rule?
ATF’s 2022 Frame or Receiver rule, published as 2021R-05F, revised regulatory definitions including “firearm,” “frame or receiver,” and “privately made firearm,” and amended marking and recordkeeping rules. It also addressed qualifying kits and components. ATF’s summary of the final rule is a high-level overview; ATF expressly says it is not intended to be relied on for compliance.

In Bondi v. VanDerStok, decided March 26, 2025, the Supreme Court considered a facial challenge to the ATF rule under the Gun Control Act. The opinion discussed how the statute may cover some weapon-parts kits and unfinished frames or receivers. It did not rule that every unfinished component automatically qualifies as a firearm. The distinction matters: the rule’s scope and the Court’s decision on a facial challenge are not the same as a universal conclusion about every part or kit. Read the Supreme Court opinion for the Court’s reasoning.

The Department of Justice reported that law enforcement recovered approximately 45,240 suspected privately made firearms from potential crime scenes between January 2016 and December 2021. Of those, 692 were associated with homicide or attempted-homicide investigations, according to the DOJ announcement. These are historical reported recoveries, not an estimate of how many PMFs exist or how often all PMFs are involved in crime. ATF repeated the figures on its PMF page, last updated September 11, 2025.

What should readers know about legality?
Federal rules are only part of the picture. State and local laws may set additional requirements for making, possessing, marking, registering, or transferring a privately made firearm. The cited federal sources do not provide a complete current state-by-state survey, so no general federal description can determine what is allowed in a particular place. Check current official rules for the relevant state and locality, and consult a qualified lawyer for advice about a specific situation.
The most recent dated sources cited here are ATF’s September 11, 2025 PMF page and the Supreme Court’s March 26, 2025 opinion. They do not establish the status of any later agency action, injunction, or litigation. For a present-day legal decision, verify the latest official federal and local sources.
