Dark patterns in games are interface and monetization choices that steer players toward spending, hide the real cost or terms of a purchase, or make saying no harder than saying yes. They can include confusing purchase buttons, virtual currencies that disguise cash prices, random-reward products such as loot boxes, fake urgency, repeated prompts and misleading disclosures.
These techniques do not affect every player in the same way, and a pattern is not automatically proof of illegal conduct. The useful question is how a particular design changes visibility, pressure, uncertainty and consent at the moment money is committed.

Dark patterns are broader than loot boxes
A loot box is one example of a monetization system: the player pays (or sometimes earns) access to a package whose contents are selected randomly. Dark patterns describe the surrounding design choices that can influence a decision, whether the product is random or guaranteed.

A purchase button may be labeled or positioned inconsistently, a store may display only an amount of virtual currency rather than its cash equivalent, or a player may receive repeated prompts after declining an offer. Conversely, a random-reward product can be presented with clear pricing, visible odds and an easy refusal path. The product and the interface should therefore be assessed separately.

Four ways game design can increase spending pressure
1. Confusing controls and one-step charges
Purchase flows can reduce a decision to a single tap, use labels that do not clearly signal payment, or change the location and meaning of buttons from one screen to another. When confirmation is missing or confusing, a player can authorize a charge unintentionally.
In its March 2023 Fortnite enforcement announcement, the US Federal Trade Commission (FTC) said Epic’s “counterintuitive, inconsistent, and confusing button configuration led players to incur unwanted charges based on the press of a single button.” The finalized order required $245 million for consumer refunds. That is a finding about the practices addressed in that particular FTC action, not a conclusion that every game uses the same controls or that every accidental tap causes harm.
2. Virtual currency hides the cash price
Many games require players to buy tokens, gems or another in-game currency before they can purchase an item. The exchange can make the real-world price less visible: a player sees that an item costs 1,200 gems, not how many dollars were charged to obtain those gems. Bundles can leave a small balance that encourages another purchase, because the remaining currency has little use on its own.
The European Parliament’s 2023 resolution on consumer protection in online video games called for the real-world value of virtual currencies to be displayed clearly and prominently. The resolution is a policy position rather than a universal rule in every jurisdiction, but it identifies a practical test: a player should be able to understand the cash cost before committing.

3. Random rewards and repeated attempts
Loot boxes and similar products provide an uncertain result. The FTC staff’s 2020 account of its loot-box workshop described them as rewards that players may buy for a small fee or earn through play. The uncertainty can lead a player who wants a particular item to make multiple attempts.
Randomness alone does not establish that a product is gambling or that it inevitably causes overspending. Consumer-protection questions include whether the terms are understandable, whether the odds are disclosed where required, whether duplicate or low-value outcomes are explained, and whether a child can buy access without a parent’s knowledge. The European Union’s 2020 study on loot boxes and younger consumers recommended examining these issues through consumer protection as well as the gambling debate, particularly when minors are involved.
4. Urgency, nagging and apparent near misses
A store may claim an offer is expiring soon, show a countdown that resets, or repeatedly interrupt play with the same promotion. Social-proof messages and prompts after a refusal can make declining feel like an abnormal choice. These techniques are often described as fake urgency, nagging or pressure prompts.

A separate risk is a “near miss”: a presentation that appears to show a player almost receiving a rare reward. In an August 2024 consumer advisory, the US Consumer Financial Protection Bureau (CFPB) described stored-payment convenience and near-miss-style loot-box presentations as factors that may encourage another purchase. The advisory describes a risk, not a universal game mechanic or a proven response from every player.

How to tell a design pattern from proven harm
Use four different labels rather than treating them as interchangeable:
- Design pattern: what the interface or monetization system does, such as converting cash into tokens or placing a purchase behind one button.
- Intended or possible influence: the way the design may reduce reflection, increase uncertainty or create pressure.
- Observed consumer harm: documented unwanted charges, complaints, refunds or other outcomes in a defined population.
- Legal finding: what a regulator, court or settlement order concluded about identified conduct under a particular law and jurisdiction.
A regulator’s action can establish facts about one company’s conduct without proving that every similar feature is unlawful. Behavioral research can identify plausible mechanisms without showing that all players overspend. Keeping those distinctions explicit prevents both exaggeration and dismissal.
Case study: what the Fortnite FTC order shows
The FTC’s 2023 action against Epic is a concrete example of purchase confusion. The agency said inconsistent button configurations led to unwanted Fortnite charges from a single press and that children could make purchases without parental consent. The finalized order required $245 million in consumer refunds.

Why children and families need extra safeguards
Children may have less experience translating virtual prices into cash, recognizing promotional pressure or understanding that a random reward can require repeated payments. Stored payment details also remove a pause that would otherwise occur when entering card information.
Practical safeguards include a separate child account, a requirement for parental approval for purchases, spending limits, purchase notifications and removal of stored payment credentials from devices a child uses. These settings vary by platform and region, so check the current controls for the console, computer, phone or tablet in question. A control is useful only if the child cannot bypass it through another account or payment method.
UK government guidance, updated in 2025, reports industry commitments to use technological controls to prevent under-18s from acquiring paid loot boxes without parental knowledge or consent, present offers understandably and disclose probabilities clearly. Those are UK guidance and industry commitments, not a universal law that applies identically everywhere.

What regulators and policy bodies have said
United States
The FTC’s Fortnite order is a finalized enforcement action with a specified refund amount. The FTC’s 2020 loot-box workshop account is staff material describing products and concerns; it is not a binding rule or a finding that all loot boxes violate consumer law. The CFPB’s 2024 advisory explains potential risks involving stored payments and near-miss presentations; it is consumer guidance, not a case-specific judgment against every game.
Best Value
European Union
The European Parliament’s 2023 resolution said consumers “should have all the necessary information about an online video game, including on the presence of in-game purchases such as loot boxes and other apparently randomised in-game purchases”. It also called for clearer information about virtual-currency value and effective enforcement of consumer-protection rules. A parliamentary resolution expresses policy priorities; the legal duties that apply to a developer or platform depend on the country, facts and applicable legislation.
A European Commission staff working document published in October 2024 reported examples including fake urgency and nagging in its review of mobile games. Its observations are limited to the reviewed mobile-game sample. They should not be presented as a prevalence rate for all games or as evidence about PC games that were outside that scope.
A practical test for any in-game offer
Before buying, work through these questions. If an answer is unclear, pause and look for the store’s full terms or leave the offer unopened.
- Is the cash cost visible? Can you see the amount in your local currency before pressing the final purchase button, including taxes or recurring charges where relevant?
- Is the reward guaranteed? If it is random, are the possible outcomes and probabilities displayed in language a reasonable player can understand?
- Is the deadline genuine? Does the timer identify a real event end, or does the same offer return when the countdown reaches zero?
- Can you decline without repeated interruption? Look for a clear close or “no thanks” control that does not lead immediately to another prompt.
- How many confirmations are required? A review screen showing the item, cash amount and account is a useful barrier against accidental taps.
- Who is spending? For a minor, verify that parental consent and spending controls apply to the exact account being used.
- What happens if something goes wrong? Find the platform’s refund route, transaction history and support contact before authorizing a large or repeated purchase.
Comparing common monetization patterns
| Pattern | What the player sees | Main decision risk | Questions to ask |
|---|---|---|---|
| Confusing purchase control | A button with unclear wording, changing placement or no clear confirmation | Unwanted or accidental charge | Does the final screen state that money will be charged, and can the player cancel? |
| Virtual-currency conversion | An item priced in tokens bought in a separate transaction | Cash value becomes hard to track | Is the real-money equivalent prominent, and does a bundle leave unusable currency? |
| Random reward | A paid or earned box with an uncertain item | Repeated attempts in search of a desired outcome | Are odds, possible rewards and duplicate rules disclosed? |
| Urgency or nagging | Countdowns, limited-time claims or repeated prompts | Decision made before reflection | Is the deadline real, and can the offer be dismissed once? |
| Near-miss presentation | An animation or message suggesting a rare reward was almost obtained | Another attempt feels justified | Does the presentation accurately describe the result rather than imply a win? |
How to respond to an unwanted purchase
- Stop further attempts and capture the transaction date, amount, item description and account name.
- Check the platform’s transaction history to determine whether the charge was a direct purchase, a virtual-currency conversion or a recurring subscription.
- Use the platform’s official refund or dispute process promptly, explaining that the purchase was unauthorized or accidental when that is accurate.
- Change the account password, enable purchase approval and remove stored payment details if another person may have access.
- If a child’s account was involved, document whether parental controls were enabled and whether the game displayed a consent step.
Do not assume a refund is automatic. Eligibility, deadlines and evidence requirements differ by platform and country.
Bottom line
Dark patterns in games work by changing the decision environment: they can obscure a price, remove a confirmation step, add uncertainty, create artificial pressure or keep asking after a refusal. Loot boxes are only one example. The strongest way to evaluate an offer is to check the cash cost, randomness and odds, urgency, confirmation friction, age and consent controls, and the available refund path—then separate a documented regulatory finding from a possible behavioral risk.
