AI whistleblowers are people who report suspected harmful, unsafe, or unlawful AI-related conduct they learn about through work or a professional relationship. Whistleblowing does not automatically mean going public: it can mean reporting through an employer’s process or to a regulator with authority over the issue. The safest route depends on what happened, who is eligible to report it, the rules in the relevant jurisdiction, and the sensitivity of the evidence.

What makes someone an AI whistleblower?

The term describes a person raising a concern about AI-related conduct, not a special worldwide legal status. A concern might involve a suspected breach of an AI law, a workplace safety hazard involving an AI system, or possible securities-law violations connected to an AI business. Whether a particular report qualifies for legal protection depends on the law, the subject of the report, the person’s status, and the channel used.

Reporting is different from publishing. A regulator, designated internal recipient, or other authorized body may be able to assess a report without the person disclosing it publicly. Public disclosure can create additional risks for the reporter and for people whose information appears in the evidence.

How to choose a reporting route

Start with the suspected conduct, then identify a channel that has authority over that subject. Do not assume an employer’s internal process is the only route or that every regulator handles every AI concern. The European Commission’s AI Office tools, for example, have different purposes and anonymity conditions; U.S. SEC and OSHA routes apply to matters within their respective legal remits.

  1. Define the concern. Describe the conduct in concrete terms: what happened, when, which AI system or decision was involved, and why you believe it may be harmful, unsafe, or unlawful. Separate what you directly observed from what you infer.
  2. Find the competent channel. Check the subject matter and authority of the internal recipient or external body. If the issue concerns an immediate danger, use an emergency or relevant safety channel rather than waiting for a whistleblower process.
  3. Check eligibility and process. Read who may report, what kinds of conduct the channel accepts, whether reports can be anonymous, how follow-up works, and whether there are deadlines. A channel’s confidentiality language is not a guarantee of anonymity.
  4. Assess exposure and urgency. Consider whether the report could reveal personal data, customer information, security-sensitive details, intellectual property, or trade secrets, and whether delay could increase harm or cause a filing deadline to pass.
  5. Get independent advice when the stakes call for it. Consult a qualified lawyer in the relevant jurisdiction if retaliation, a confidentiality agreement, a regulatory deadline, or sensitive or classified information is involved. This is general information, not individual legal advice.

What are the EU AI Office reporting options?

AI Act Whistleblower Tool

The European Commission’s AI Office says its AI Act Whistleblower Tool is for individuals professionally connected to providers of general-purpose AI models or AI systems within the AI Office’s enforcement remit. It accepts reports about harmful practices or other AI Act violations. The tool page was last updated on 6 October 2026.

The AI Office says a person can submit a report anonymously in any EU language with supporting documents. A secure inbox allows progress updates and follow-up questions while the reporter remains anonymous. The Office describes a confidentiality commitment and internal procedures intended to maximize identity protection. These features apply to this defined tool and its scope; they do not make it a universal channel for every AI complaint or guarantee that identity can never be inferred from the facts reported.

AI Act Complaints Tool

The Commission’s separate AI Act Complaints Tool handles certain complaints under the AI Office’s enforcement powers. It is not anonymous: the Commission asks complainants for identification and contact details. A person choosing between these tools should distinguish a whistleblower report from a complaint and check which process fits their circumstances.

EU-wide minimum standards and national rules

Directive (EU) 2019/1937 establishes minimum EU standards for reporting breaches of Union law, including effective confidential internal and external channels, follow-up, and protection against retaliation. It does not make every workplace grievance or AI concern eligible. Legal scope and national implementation matter, so check the applicable national rules and competent authority.

What do U.S. SEC and OSHA routes cover?

Possible securities-law violations: SEC

For potential securities-law violations, the U.S. Securities and Exchange Commission says Rule 21F-17(a) prohibits actions that impede direct communications with the SEC about a possible violation. The SEC says agreements or internal materials that restrict such reporting may violate the rule and advises consulting an attorney about a specific agreement.

The SEC also describes a specific condition for the Dodd-Frank retaliation protection at issue: the individual must report possible securities-law violations to the Commission in writing before experiencing retaliation. These points concern securities law; they are not a general legal protection for every person reporting an AI concern. The SEC guidance cited here is dated 24 June 2024.

Workplace safety and retaliation: OSHA

The U.S. Occupational Safety and Health Administration (OSHA) distinguishes workplace safety and health complaints from whistleblower retaliation complaints. OSHA says safety complaints can be anonymous and may be filed online, by phone, or by letter. For retaliation complaints under statutes OSHA administers, filing deadlines range from 30 to 180 days depending on the law. Because the deadline varies, act promptly and confirm the rule for the specific statute and circumstances.

These procedures apply to issues within OSHA’s remit, not to every AI-related concern. A safety complaint and a complaint that an employer retaliated against a reporter are also different processes.

How to preserve evidence without creating new risks

A clear, factual record can help a recipient understand what happened. OSHA’s account of its investigation process advises both sides to preserve relevant potential evidence. Examples it lists include emails, letters, notes, texts, voicemails, phone logs, personnel files, contracts, work products, and meeting minutes.

  • Write a timeline with dates, events, the system or decision involved, people present, and the basis for each factual statement.
  • Preserve records already lawfully available to you. Keep originals and note where each item came from; do not alter or selectively edit material.
  • Do not bypass access controls, take data you are not authorized to access, or unnecessarily copy personal or customer information.
  • Before transmitting documents, consider whether they contain confidential, security-sensitive, personal, or trade-secret material. Seek qualified advice if disclosure rules are unclear.

A 2025 California frontier-AI policy report discusses possible reporting recipients such as a company board or a government entity and identifies privacy, security, intellectual-property, and trade-secret concerns. Those concerns are reasons to choose and prepare a channel carefully, not reasons to expose sensitive material publicly.

What to check in an internal reporting policy

Before relying on an employer’s process, read the policy for its actual scope and limits. A company process may be useful, but the existence of a policy does not establish that it is independent or that confidentiality guarantees anonymity.

  • Which conduct and workers or contractors are covered?
  • Who receives and investigates a report, and can it be escalated outside the immediate management chain?
  • What does the policy say about confidentiality, identity, follow-up, and anti-retaliation?
  • Does it identify a deadline or preserve the option of contacting an external authority?

Do not assume you must report internally first. The rules depend on the jurisdiction and issue; the SEC, for example, describes direct reporting protections for possible securities violations.

Why protections cannot be assumed across countries

The EU examples concern EU AI Act channels and EU reporting standards; the SEC and OSHA examples concern specific U.S. legal subjects and procedures. They do not establish a worldwide rule. National or state law, sector-specific regulators, government-employee rules, contractor status, and classified-information procedures may change the available route and protection.

The Future of Life Institute’s 2025 AI Safety Index treats a sound company whistleblowing framework as addressing policy scope, covered persons, reporting methods and recipients, handling, and available protections. Its survey records differing public disclosure practices among surveyed companies; it should not be treated as a census of all employers or evidence about a company beyond what the report specifically records.

When to get help promptly

Seek qualified local legal help promptly if you face retaliation, have been asked to sign an agreement that may restrict reporting, are approaching a regulatory deadline, or need to disclose sensitive or classified information. If someone is in immediate danger, contact emergency services or the relevant safety authority rather than waiting for legal or internal reporting procedures.
