Useful accommodations during police questioning are individual, agreed adjustments to communication, sensory conditions, pacing and support. They can include a quieter or familiar room, reduced lighting or noise, permission to stim, clear non-figurative language, extra processing time, written or visual aids, planned breaks and an appropriate support person. The correct arrangement depends on whether the autistic person is a suspect, witness or victim, and on the jurisdiction. In England and Wales, custody safeguards under PACE and the appropriate-adult framework are different from witness-intermediary measures; neither should be presented as an automatic entitlement for every autistic person.
Start with the person’s role and jurisdiction
Police questioning is not one legal situation. A suspect being interviewed under caution, a witness giving an account and a victim reporting an offence may have different rights, procedures and support options. Ask the police what process is planned and which rules apply before promising that a particular adjustment or professional will be available.

| Situation | Support framework described in the guidance | What to clarify |
|---|---|---|
| Suspect in England and Wales | PACE Code H and the appropriate-adult rules may apply in custody, during a voluntary interview under caution and in other specified settings. | Whether the person is legally treated as vulnerable, whether an appropriate adult is required, access to a solicitor and fitness to be interviewed. |
| Witness in England and Wales | A registered intermediary may assess communication needs and advise on questions and answers. Witness special measures may also be relevant. | Whether an intermediary is needed, who will arrange one, and how a familiar supporter can participate. |
| Victim | Support depends on the investigation and local procedure; witness and suspect safeguards cannot simply be transferred to a victim interview. | The interview format, communication adjustments, supporter arrangements and any available special measures. |
| Autistic person in Ireland | The National Disability Authority has separate justice guidance for communicating with autistic people. | Irish law and local procedures rather than England-and-Wales PACE rules. |
Outside England, Wales and the specific Irish guidance, local law must be checked. The practical communication ideas below are broadly useful, but they do not create a legal right in another jurisdiction.

Planning works best when it starts with the autistic person, not with assumptions based on diagnosis, speech or appearance. - How does the person prefer questions to be phrased and answered?
- How much silence is needed to process a question?
- Which sounds, lights, smells, textures or room layouts are distracting or painful?
- Would a familiar person, written notes, drawings, a communication device or another visual aid help?
- How will the person signal that a break is needed?
- Is there a calming strategy or object that is safe and acceptable in the interview room?
Send these preferences to the investigating officer, solicitor or other contact in advance and ask what can be agreed. A witness may be able to discuss the room and location before attending. An adjustment is a practical arrangement to request and document; it is not necessarily guaranteed.
Make the room less overwhelming
Police stations can combine harsh lighting, background noise, unfamiliar smells, hard seating and waiting-room stress. Discuss each factor specifically rather than asking for a vague “autism-friendly” interview.
Location, sound and lighting
Where feasible, request a quieter or familiar location and a room with fewer interruptions. Reduce irritating sounds or lighting, and remove avoidable sources of noise. The National Autistic Society gives removing a ticking clock and conducting an interview in a familiar place as examples. Those examples are options to consider, not universal rights or solutions.

Allowing harmless stimming can help a person regulate attention and anxiety. If a fidget spinner or another small object is useful, agree it with police beforehand and check that it will not interfere with recording, safety or evidence handling. A calming object is optional and individual: it is not suitable for everyone and should never be treated as required.

Seating and sensory details
Ask about seating position, proximity to the interviewer, smells, temperature and the ability to move safely. A person who needs to stand, rock or use repetitive movement may be able to do so without being treated as evasive. The interviewer still has to manage safety and the integrity of the interview, so describe the proposed adjustment clearly.
Use direct language and allow processing time
Questions should be concise, concrete and addressed directly to the person. Avoid sarcasm, irony, metaphors, idioms, jargon and ambiguous wording. “Tell me what happened after you left the shop” is clearer than an expression whose meaning depends on implication. If a legal term is unavoidable, explain it in ordinary language.
Build in enough silence for the person to understand the question, organise an answer and speak. A delayed response is not automatically refusal, ignorance or deception. Do not repeat a question in a more forceful tone before the person has had time to process it. Ask whether the question was understood and offer a rephrasing that does not suggest an answer.

Written, visual and alternative communication
Some people communicate more reliably with written questions, timelines, sketches, photographs, symbols or a communication device. Agree which aids are acceptable and how they will be included in the record. Check understanding rather than inferring it from fluent speech, eye contact or confident vocabulary.

Checking the caution
For a suspect interview in England and Wales, the person needs to understand the separate elements of the caution. The National Autistic Society’s professional guidance suggests asking the interviewee to explain those elements back in their own words. This is a communication check, not a replacement for legal advice. A person attending an interview should be able to request legal advice where applicable; an appropriate adult can help a child or vulnerable person obtain it in the settings covered by the guidance.
Design questions without steering the answer
Question structure needs a careful balance. A completely open request can leave someone unsure whether the interviewer wants a short summary, a precise time line or every detail. But a closed or leading question can put words in the person’s mouth or imply the expected answer.
Use specific, neutral prompts that define the information sought without embedding a conclusion. For example, ask “Where were you standing when you heard the noise?” rather than “You were standing by the door, weren’t you?” Explain what level of detail is needed, then allow the person to answer in their own words. The legally appropriate approach may differ for a suspect, witness or victim, so the interviewer should adapt prompts without turning them into suggestions.

Build predictable breaks and respond to distress
Agree how often breaks may be needed and what happens during one. Explain when a break starts, how long it is expected to last and what will happen when questioning resumes. Predictability reduces the uncertainty of an abrupt pause or an unexplained change of plan.

Repetitive speech, repetitive movement, shouting, self-injury or physical behaviour can indicate distress or a need for a break, according to the National Autistic Society’s professional guide. These signs require individual interpretation: the same movement may be ordinary self-regulation for one person and a crisis signal for another. Ask what the behaviour means for this individual and follow the agreed safety plan.
In custody in England and Wales, PACE Code H includes fitness-to-be-interviewed guidance. It addresses whether conducting an interview could significantly harm the detainee’s physical or mental state. A serious concern should be raised with the solicitor, appropriate adult and custody staff rather than handled by pressing on until the person answers.

Appropriate adult in England and Wales
GOV.UK says an appropriate adult is needed when a child or vulnerable person is arrested and held in police detention, attends a voluntary interview under caution or is detained for a specified intimate strip search. The role is safeguarding, not acting as the person’s lawyer or answering questions for them. The official wording is: “The appropriate adult’s role is to safeguard the child or vulnerable person’s interests.” See Being an appropriate adult.
An appropriate adult supports rights and welfare, helps communication, helps the person understand rights and can speak privately with them. They can help ensure that legal advice is available. Autism alone does not mean every adult is legally classified as vulnerable, and an appropriate adult is not automatically required for every police conversation. The custody setting, the person’s circumstances and the applicable vulnerability rules matter.

Intermediary for a witness
A registered intermediary is an impartial communication professional. They can assess a witness’s communication needs, advise police on how to phrase questions and help the interviewer understand answers. Crown Prosecution Service guidance says intermediaries should be considered for adult witnesses with autism. An intermediary is not an appropriate adult and is not an interpreter.
The relevant England-and-Wales guidance notes important limits for suspects in England and Wales, including no statutory framework for intermediary use for suspects in that context. Do not present a witness intermediary as an automatic suspect entitlement.
Familiar supporter
A parent, carer, social worker or advocate may be a helpful familiar presence for a witness or victim, subject to police arrangements. Their participation, position in the room and ability to speak should be agreed in advance. A familiar supporter is not necessarily an appropriate adult or an intermediary, and each role has different responsibilities.

1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minute| Support role | Main function | Key limit |
|---|---|---|
| Appropriate adult | Safeguards the rights and welfare of a child or vulnerable person in specified England-and-Wales custody and interview settings. | Not automatic for every autistic adult or every police conversation; not a substitute for a solicitor. |
| Registered intermediary | Impartial assessment and communication facilitation, particularly for witnesses. | Witness guidance should not be presented as an automatic suspect entitlement. |
| Familiar supporter | Provides trusted practical and emotional support when police agree participation. | Does not automatically have the legal functions of either role above. |
A practical plan for an interview
- Identify the process. Ask whether the person is being interviewed as a suspect, witness or victim, whether the interview is voluntary or under caution, and where it will take place.
- Record the person’s needs. Write down sensory triggers, preferred wording, processing time, communication aids, break signals and signs of distress in the person’s own words.
- Ask for named adjustments. Request room, lighting, noise, seating, stimming, calming-object, question-format and break arrangements rather than relying on a general diagnosis.
- Confirm legal support. In England and Wales, ask whether the appropriate-adult rules apply and arrange a solicitor where relevant. For a witness, ask whether a registered intermediary should assess communication needs.
- Agree how understanding will be checked. For a suspect, this includes checking the caution’s meaning without treating the check as legal advice.
- Set a pause procedure. Decide who can request a break, what will happen during it and how questioning resumes.
- Review the plan on arrival. A room, staff member or sensory condition may differ from what was promised. Raise the difference before questioning starts.
- Escalate concerns. If distress, confusion or possible harm develops, tell the solicitor, appropriate adult, intermediary or custody staff and ask whether the interview remains appropriate.
What the evidence can and cannot establish
The practical guidance supports individualised communication and sensory adjustments, but it does not provide a numerical success rate for any particular accommodation. The National Autistic Society article stated that no published research on how autistic people fare under the interview demands it discussed was available at the time of publication; that statement is limited to that article’s scope and date, not a claim that no research exists today.
Because legal entitlements vary, use England-and-Wales terms only for England and Wales. Ireland’s National Disability Authority guidance addresses communication with autistic people in Irish justice settings, but it is not PACE law. Other jurisdictions require their own legal check.
