It is a court order under section 84 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), directed at a person against whom a warrant has already been issued and whom the court has reason to believe is absconding or hiding so the warrant cannot be executed. The order requires that person to appear at a specified place and time, with at least 30 days between publication and the appearance date.
The CBI may investigate the case and ask the court to take procedural steps, but the court decides whether the statutory conditions exist. A proclamation is also not a finding of guilt. A separate court inquiry is needed before the person can be declared a “proclaimed offender,” and property attachment requires another order under section 85.

Which law applies: BNSS or the former CrPC?
The BNSS came into force on 1 July 2024. Its section 84 covers a “Proclamation for person absconding,” while section 85 covers attachment of property belonging to a person absconding. These provisions correspond broadly to sections 82 and 83 of the Code of Criminal Procedure, 1973 (CrPC).

For a current proceeding, read the order and the dates carefully. A matter initiated or governed under the former code may refer to CrPC sections 82 and 83, while a proceeding to which the new code applies will normally cite BNSS sections 84 and 85. Transitional provisions and the date of the relevant proceeding can affect which numbering and procedural rules apply. The official texts are available in the Bharatiya Nagarik Suraksha Sanhita, 2023 and the CrPC-to-BNSS section mapping.

What must happen before a court can issue the proclamation?
Section 84 is a sequence, not a single label that an investigating agency can apply. Three conditions are central.
1. A court must have issued a warrant
The person must already be the subject of a warrant issued by the concerned court. A police or CBI request, an arrest memo, or an allegation that the person is unavailable does not itself satisfy this precondition.
The Supreme Court of India stated in its judgment dated 14 March 2024, interpreting predecessor CrPC section 82: “There can be little doubt with respect to the position that the sine qua non for initiation of an action under Section 82, Cr. PC is prior issuance of warrant of arrest by the Court concerned.” The judgment is available at the Supreme Court of India. This is guidance on the former CrPC provision, not a CBI-specific ruling or a direct interpretation of BNSS section 84.
2. The court must form the required belief
The court must have reason to believe that the person has absconded or is concealing themselves so that the warrant cannot be executed. The statutory decision-maker is the court. The investigating agency can place facts before it, but an agency assertion alone is not the proclamation.

The Supreme Court described “reason to believe” in the predecessor provision as requiring the concerned Magistrate’s subjective satisfaction. That does not mean the court decides the person’s guilt at this stage; it means the court records the procedural basis for using the proclamation mechanism.
3. The order must specify appearance details
The written proclamation names a place and a date by which the person must appear. The date cannot be less than 30 days from publication of the proclamation. The period is measured from publication, not from the day the person says they first learned about the notice. It is therefore inaccurate to describe the rule as an automatic 30-day grace period after personal knowledge.

How the proclamation is published
Section 84 prescribes public methods intended to give the order visibility in the person’s ordinary place of residence and at the court. The court must direct the following steps:
- The proclamation is publicly read in a conspicuous place in the town or village where the person ordinarily resides.
- A copy is affixed at the person’s homestead or another conspicuous place in that town or village.
- A copy is affixed to a conspicuous part of the courthouse.
- The court may additionally direct publication in a daily newspaper circulating in the place where the person ordinarily resides.
The exact record of these acts matters. A person examining an order should check the publication date, the appearance date, the place of residence used, the affixture reports, and any newspaper direction or publication. The official IndiaCode text of BNSS section 84 sets out the statutory wording.
“Proclaimed person” and “proclaimed offender” are different
A proclamation requiring appearance does not automatically make someone a proclaimed offender. The first step concerns execution of a warrant and a direction to appear. The second is a further declaration that can follow only after the person fails to appear and the court conducts the required inquiry.

When the further declaration is available
Under BNSS section 84(4), the court may declare the person a proclaimed offender when the accusation concerns an offence punishable with imprisonment of ten years or more, imprisonment for life, or the death penalty under the Bharatiya Nyaya Sanhita, 2023, or another law in force. The court must make the declaration after the statutory inquiry; it is not an automatic consequence of every proclamation.

What the label does not decide
Neither the proclamation nor the proclaimed-offender declaration determines whether the accused committed the offence. Guilt remains to be decided in the applicable criminal proceedings. The procedural finding is about non-appearance and the court’s inability to execute the warrant, not the merits of the CBI charge.
What the CBI can and cannot do
The CBI connection identifies the investigating agency; it does not create a separate proclamation route. In a CBI case, the agency may investigate, report difficulties in executing a warrant, and seek appropriate orders from the court. The statutory proclamation itself is issued by the court under the applicable criminal-procedure provision.
The sources available for this explanation do not establish a distinct CBI-specific proclamation procedure or a reported decision that gives the CBI independent power to declare someone a proclaimed offender. Treating a CBI notice or press statement as the statutory proclamation can therefore confuse an agency action with the court order required by section 84.

Property attachment is a separate step
A proclamation does not automatically seize, forfeit, or transfer the person’s property. Under BNSS section 85, the court that issued the proclamation may order attachment of property belonging to the proclaimed person, whether movable or immovable, and must record reasons in writing.
Ordinary timing
Ordinarily, attachment follows the proclamation. The court considers the property question through a separate order rather than treating attachment as an automatic effect of the appearance notice.
When attachment can be simultaneous
The court may order attachment at the same time as the proclamation when it is satisfied, by affidavit or otherwise, that the person is about to dispose of the whole or part of the property or remove it from the court’s local jurisdiction. The order should therefore be checked for the recorded reasons and the evidence relied upon for any simultaneous attachment.
Claims by other people
Former CrPC section 83 contained a mechanism for people other than the proclaimed person to assert an interest in attached property that was not liable to attachment. The complete current claim-and-objection deadlines and remedies should be verified in the applicable BNSS provisions, including sections 86 to 89, before relying on a deadline or filing strategy. The former-code text can be consulted in the Code of Criminal Procedure, 1973.

- Applicable code and date: identify whether the order cites BNSS section 84 or CrPC section 82 and check the event dates and transitional rules.
- Earlier warrant: locate the warrant issued by the concerned court and confirm that it predates the proclamation.
- Recorded basis: look for the court’s reasons for believing that the person absconded or concealed themselves so the warrant could not be executed.
- Publication: compare the order with the reading, affixture, courthouse, and any newspaper steps required by the statute.
- Calendar calculation: count at least 30 days from the publication date to the appearance date.
- Status used: distinguish an order merely directing appearance from a later order declaring proclaimed-offender status after inquiry.
- Property order: check whether there is a separate section 85 attachment order, the reasons recorded, and the property described.
This checklist cannot resolve a live case without the actual orders and procedural history. It is designed to prevent common category errors, such as assuming that a CBI request is itself a proclamation or that a proclamation automatically proves guilt.
Common misunderstandings and the accurate position
| Misunderstanding | Accurate position |
|---|---|
| “CBI declares a person a proclaimed offender.” | The court issues the proclamation and, where section 84(4) applies, makes the further declaration after inquiry. |
| “Any person who cannot be found can immediately be proclaimed.” | A court-issued warrant must precede the proclamation, and the court must have the statutory reason to believe the person is absconding or concealing themselves. |
| “Thirty days starts when the person hears about the notice.” | The appearance date must be at least 30 days after publication. |
| “Every proclamation makes someone a proclaimed offender.” | The further status is limited by the offence threshold in BNSS section 84(4), failure to appear, and the required inquiry. |
| “Property is automatically confiscated.” | Attachment requires a separate court order under section 85 with reasons recorded in writing; attachment is not the same as forfeiture. |
| “A proclamation proves the charge.” | It is a procedural measure concerning execution of a warrant and appearance. The criminal accusation still requires adjudication. |
What the 30-day rule means in practice
The statutory minimum is a date-calculation rule. For example, if the court publishes the proclamation on 1 September, the appearance date cannot be earlier than 1 October under the 30-day minimum. The relevant publication date must be established from the court’s record, not assumed from the date the order was drafted or signed.
If multiple publication methods occurred on different dates, the file should be examined to determine which publication event the court treated as operative. A person or lawyer reviewing the matter should preserve copies of the proclamation, affixture reports, newspaper material if ordered, and the order sheet showing the next appearance date.
What this means for a person named in the order
A proclamation is a court process with a specified appearance requirement, not an invitation to wait for a CBI office notice. The order should be read immediately for the court, case number, warrant history, publication date, appearance date, alleged offences, and any separate attachment direction. The person should obtain advice from a qualified criminal lawyer on the appropriate response in the court that issued the process; the correct remedy depends on the record, the applicable code, and the stage of the case.
Because the Supreme Court authority cited above interprets CrPC section 82, it should be used as predecessor-law guidance alongside the current BNSS text rather than treated as a CBI-specific ruling under section 84. No general frequency or success-rate statistic for proclamations in CBI cases is established by the cited authorities, so claims about how often the CBI uses this process should not be inferred from the existence of one order.
