What a Health Data Breach Means for Patients: Records, Identity Theft, and Privacy

A health-data breach notice means an organization found an incident involving health information that may have been improperly used or disclosed. It does not prove that your record was readable, that every listed detail was taken, or that anyone has used your identity. Read the notice to learn what information was involved, who sent it, and what actions the sender recommends; then check the records and bills that relate to the exposed information.

What does a health data breach mean for me?

It means an organization identified a possible improper use or disclosure of health information and is notifying you under the rules that apply to it. The notice is important, but it is not a finding that you personally suffered fraud.

For organizations covered by HIPAA, an impermissible use or disclosure of protected health information is generally presumed to be a breach unless the organization demonstrates, through a risk assessment, that there is a low probability the information was compromised. The assessment considers what information and identifiers were involved, who received or could access it, whether it was actually acquired or viewed, and what steps were taken to reduce harm. Certain good-faith or inadvertent uses and disclosures are exceptions. HHS explains the HIPAA Breach Notification Rule.

HIPAA breach-notification requirements concern unsecured protected health information: information not made unusable, unreadable, or indecipherable to unauthorized people by specified methods. HHS identifies encryption and destruction as the methods described in its guidance. As a result, a notice about an incident does not necessarily mean an outsider could read the affected data.

Can someone steal my identity from my medical records?

Medical identity theft is possible, but exposure is not the same as theft. HHS Office of Inspector General describes medical identity theft as the appropriation or misuse of a patient’s or provider’s medical identifying information to fraudulently obtain or bill for care. That could show up as care you did not receive, unfamiliar claims, or charges associated with your records. The available evidence does not establish a reliable probability that a particular breach will lead to identity theft, so a notice alone cannot tell you that fraud has occurred.

Medical information can also be misused in ways that are not immediately visible as an unfamiliar bill. Focus your review on the information named in the notice and the health accounts, claims, or records connected to it rather than assuming either that everything is compromised or that no follow-up is needed.

Does HIPAA cover health apps?

Not every organization that handles health information is covered by HIPAA. A provider or health plan may be subject to HIPAA, while some consumer health apps, connected devices, websites, and personal health record services may fall outside it. Certain personal health record vendors, related entities, and service providers can instead be covered by the FTC’s Health Breach Notification Rule. The FTC’s 2024 update clarified how the rule applies to health apps and similar technologies and expanded notice requirements; it did not make every health app subject to the rule. See HHS’s overview of consumer health information and the FTC Health Breach Notification Rule.

Substance-use-disorder treatment records can have additional protections under federal Part 2 rules. Part 2 programs must report breaches of unsecured Part 2 records and notify affected people, HHS, and sometimes the media. These rules have their own scope and exceptions; consult HHS’s current Part 2 guidance for a notice involving those records.

What should I do if my medical information was exposed?

  1. Read the notice closely. Identify the organization, incident and discovery dates, types of information involved, and any specific instructions or assistance offered. Notices under the FTC rule may include details about third parties that acquired information in specified circumstances.
  2. Follow the sender’s instructions. The organization may explain what it knows about the incident and what actions it recommends. Do not treat the notice as proof of misuse, but use it to decide which accounts, bills, or records to check.
  3. Review relevant medical bills, claims, and records. Look for unfamiliar services, providers, claims, or charges connected to the information named in the notice.
  4. Contact the provider or health plan if you find something unfamiliar. Ask them to investigate and explain how to dispute an incorrect claim or billing entry. FTC guidance says patients have a right to copies of records maintained by covered health plans and medical providers; request copies if you need to compare activity.
  5. Use official identity-theft guidance if you suspect fraud. The FTC directs consumers to IdentityTheft.gov for response steps, including dealing with medical billing errors. Paid monitoring is not required to understand a notice or report suspected misuse, and monitoring alone cannot correct fraudulent medical records.

How do I check whether someone used my medical identity?

Compare the notice’s list of exposed information with your own records, then check the places where misuse could appear:

  • Review explanations of benefits and insurance claims for care or providers you do not recognize.
  • Compare provider bills and your medical records with appointments and services you actually received.
  • Contact the health plan or provider about any unfamiliar entry and ask how to dispute it and correct the record.
  • Request copies of records from covered providers or health plans when needed to investigate a discrepancy.

An unfamiliar entry is a reason to contact the organization and ask for an investigation; it is not, by itself, proof of who caused it. If you believe an organization failed to comply with HIPAA or Part 2 requirements, HHS accepts complaints. Its process calls for a written submission identifying the organization and describing the suspected violation. The usual deadline is 180 days from when you knew of the issue, with possible extension for good cause. A complaint is separate from an organization’s duty to report a breach. Details are on HHS’s health information privacy and security complaint page.

Who has to report a breach, and when?

HIPAA-covered entities must notify affected individuals after discovering a breach of unsecured protected health information. Separate deadlines apply to reports to the HHS Secretary, not to an individual patient’s notice:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
People affected Deadline for reporting to HHS Secretary
500 or more Without unreasonable delay and no later than 60 days after discovery
Fewer than 500 Within 60 days after the end of the calendar year in which the breach was discovered

These thresholds describe the organization’s reporting to HHS, not a deadline for you to take action or a guarantee about when you receive a notice. The HHS breach-reporting page provides the Secretary-report rules. HHS also maintains a live list of reported breaches affecting 500 or more people; the list changes over time and is not a count of all breaches or a measure of your individual risk.
