In the United States, a “hands-off” approach to AI regulation means the federal government is emphasizing fewer perceived barriers to development, voluntary engagement for certain advanced models, and a more uniform national framework that could limit some state rules. It does not mean AI companies are exempt from existing law or that states have stopped regulating. Developers and businesses should treat this as a changing policy direction—not a blanket legal safe harbor.
What “hands-off” means in U.S. AI policy
“Hands-off” is a shorthand for a policy preference, not a legal category. The administration describes its approach as removing unnecessary red tape, updating rules written before recent AI advances, and clarifying requirements for particular sectors or uses. That is the administration’s stated rationale, not evidence that regulation has already been reduced or that a particular business has fewer legal duties. The White House set out that rationale in its December 11, 2025 fact sheet.

In practice, the policy direction combines three different moves: reviewing and potentially revising federal actions seen as barriers; relying on voluntary coordination with developers in a defined frontier-model context; and seeking greater federal influence over the patchwork of state AI laws. At the same time, the federal government retains existing agency authority and applicable law, and the policy explicitly includes targeted security and criminal-enforcement activity.
That combination matters to companies. A lighter-touch federal posture toward model development can coexist with obligations arising from a specific industry, use case, state law, or existing federal law. The practical question is therefore not simply whether the federal government is “regulating AI,” but which rules apply to a particular product, organization, activity, and location—and whether those rules are changing.

How the federal policy direction changed
January 2025: review of the previous administration’s actions
On January 23, 2025, President Donald Trump signed Executive Order 14179, “Removing Barriers to American Leadership in Artificial Intelligence.” It revoked Executive Order 14110 and directed a review of policies, directives, regulations, and other actions taken under the earlier order. Agencies were instructed, as appropriate and consistent with applicable law, to suspend, revise, or rescind actions identified as inconsistent with the new policy. The order also called for an AI Action Plan within 180 days. Its text says implementation must be consistent with applicable law and subject to available appropriations. Read the order in the U.S. Government Publishing Office.
The distinction between ordering a review and changing every underlying rule is important. Executive Order 14179 set a process and direction; it did not itself establish that every prior agency action had been withdrawn, nor does the order say that applicable law no longer governs. Organizations should look for the resulting agency action or legal change that affects them rather than infer a specific exemption from the policy announcement alone.
December 2025: a push for a national framework
Executive Order 14365, “Ensuring a National Policy Framework for Artificial Intelligence,” signed December 11, 2025, addressed the federal-state divide. It directs creation of an AI Litigation Task Force to challenge state laws considered inconsistent with the administration’s policy. It also directs evaluation of state AI laws, preparation of a legislative recommendation for a uniform framework that would preempt conflicting state laws, and consideration of conditions on certain discretionary federal grants. The Federal Register text describes the order and its mechanisms.

The order does not itself amount to a comprehensive federal AI statute or establish that all state requirements have been displaced. A direction to challenge laws is not the same as a court ruling invalidating them, and a request for legislative recommendations is not enacted legislation. Any actual change depends on implementation, litigation, and whether Congress takes further action.

The proposed legislative recommendation is instructed to preserve room for certain state laws, including laws concerning child safety, state-government procurement and use of AI, and AI compute or data-center infrastructure—with a qualification concerning generally applicable permitting reforms. These specified areas are part of the order’s requested approach to a future framework; they should not be read as a complete list of every state rule that will necessarily survive or as a current exemption from other legal requirements.
June 2026: security measures and voluntary frontier-model engagement
Executive Order 14409, “Promoting Advanced Artificial Intelligence Innovation and Security,” signed June 2, 2026, adds a more targeted approach for advanced AI. It calls for federal-industry collaboration on cyber defense and a classified benchmarking process to identify covered frontier models. It also describes a voluntary framework under which developers may engage with the government, including the possibility of up to 30 days of early access before a developer’s planned sharing with other trusted partners. The particulars are in the White House order.
That early-access arrangement is not described as a universal requirement for every AI developer or model. The order expressly says it does not authorize mandatory federal licensing, preclearance, or permitting for development, publication, release, or distribution of new AI models, including frontier models. The relevant distinction is between a voluntary engagement process for covered models and a compulsory approval system: the order disclaims the latter, while encouraging the former.

A policy that avoids broad model-development licensing can therefore still involve government security work and enforcement where existing law applies.

What this means for state AI laws
Federal efforts to create a national framework have not made state activity irrelevant. An Associated Press report published June 14, 2026, described state measures involving children’s interactions with chatbots, workplace AI, notice to employees and applicants, and provenance information embedded in AI-generated or altered digital content. That report is a dated snapshot, not a current survey of all 50 states or a definitive account of which provisions remain in force. See the Associated Press report.
For a company, the result is a period in which national policy and state requirements may point in different directions. The December order seeks litigation and a legislative route toward greater uniformity, but the status of a particular state law depends on its text, effective date, enforcement, and any later court decision or federal action. A business should not assume that a policy announcement automatically pauses a state obligation.
Uniformity could eventually make compliance easier for companies operating across state lines, but the orders themselves do not establish when or how much variation will disappear. A more prescriptive state or federal approach could impose more concrete duties; a lighter-touch approach can preserve room for experimentation but may leave organizations monitoring multiple jurisdictions. Those are policy trade-offs, not measured outcomes established by the cited orders.

How developers and businesses should respond
1. Map the activity, users, and jurisdictions
Start with what the organization actually does, rather than labeling itself simply an “AI company.” Record where a model is developed, where a product is offered, who uses it, and what the AI does in that setting. A developer providing a model to other businesses may face a different set of questions from an employer using AI in hiring or a service that interacts with children. Those examples correspond to issues reported in state activity; they do not imply that one particular rule applies in every state or to every product.

Then identify the jurisdictions and sectors relevant to those activities. The administration’s own policy materials refer to clarifying rules for certain sectors and use cases, while the executive orders preserve applicable law and existing agency authority. A broad federal policy slogan cannot answer the narrower question of which requirements apply to a specific deployment.
2. Separate binding duties from voluntary participation
Keep a written distinction between requirements that apply by law, agency action, contract, or court order and invitations or frameworks described as voluntary. For a developer whose model may fall within the covered-frontier-model process in Executive Order 14409, examine the order’s criteria and implementation details before deciding whether engagement is relevant. Do not treat the possibility of voluntary early access as a mandatory 30-day review for all models, and do not infer a general licensing process where the order expressly disclaims one.
For other work, continue to assess applicable federal and state obligations on their own terms. The absence of a new general model-approval requirement does not erase existing duties or make unlawful conduct permissible.

Maintain a change log for agency actions, grant notices, litigation, and legislation that could affect the organization. For each development, record the date, the affected activity or jurisdiction, and whether it is a policy direction, proposed legislation, a final agency action, or a court decision. That classification helps prevent a proposed framework or litigation instruction from being mistaken for a rule already in force.
Best Value
For any state requirement central to a product launch, confirm its current status using the state’s official legal materials and, where needed, qualified counsel. The June 2026 AP report identifies areas of state activity but is not a substitute for checking the operative law, amendments, enforcement dates, or later rulings in a particular jurisdiction.
4. Keep security and misuse controls in scope
Do not interpret a preference against mandatory model licensing as a signal to deprioritize cybersecurity. Executive Order 14409 specifically calls for cyber-defense collaboration and highlights enforcement of existing criminal laws against unlawful computer access or damage involving AI. Developers and deploying organizations should evaluate their own security risks and incident procedures based on their systems and applicable obligations; the order does not supply a universal technical checklist or establish that any one control satisfies the law.
5. Reassess decisions when the rules change
Use a review trigger tied to concrete events: a relevant agency implementation, a new state law or regulation, a lawsuit affecting a law your organization relies on, a change in grant conditions, or enacted federal legislation. Revisit product plans and compliance decisions when one of those events changes the governing requirements. This approach is more reliable than making a long-term decision on the assumption that “hands-off” means the policy landscape has settled.

The executive orders and White House fact sheet establish policy instructions and the administration’s stated objectives. They do not quantify how much compliance costs will fall, whether innovation or competitiveness will rise, or how many businesses will be affected. No named statistic in these materials measures the economic effects of this hands-off approach. Claims about those outcomes require evidence beyond statements of intent.
The best-supported conclusion for developers and businesses is narrower: federal policy has moved toward removing perceived barriers, a voluntary process for certain frontier models, and a challenge to some state-by-state variation, while preserving applicable law and emphasizing targeted security and criminal enforcement. The resulting obligations remain dependent on the company’s activity, jurisdiction, and the legal changes that actually take effect.
How this differs from a more prescriptive approach
The contrast is clearest across four dimensions. This is a comparison of policy mechanisms described in the orders—not a measurement of actual costs, safety outcomes, or business performance.
| Dimension | Hands-off direction in the cited U.S. policy | More prescriptive alternative |
|---|---|---|
| Developer obligations | Voluntary engagement is described for covered frontier models; the 2026 order disclaims mandatory federal model licensing, preclearance, or permitting. | Mandatory approval, reporting, or other model-development duties would be imposed by rule or statute. |
| Federal and state authority | The administration seeks a national framework and directs challenges to state laws it views as inconsistent; state requirements are not all displaced by that direction alone. | A federal law could set nationwide requirements and specify which state laws are preempted or preserved. |
| Scope of controls | The 2026 order emphasizes cybersecurity collaboration and existing criminal enforcement alongside innovation. | Broad controls could apply to model development or deployment across defined categories of AI. |
| Certainty and experimentation | Fewer broad federal controls may leave more room to experiment, while unsettled federal-state boundaries can make compliance less uniform. | More detailed nationwide rules could clarify common duties, while reducing discretion and increasing prescribed compliance steps. |
The specific effects of either approach depend on how laws and rules are written, implemented, and enforced. The available policy documents state objectives and mechanisms; they do not establish which model produces better outcomes.
