What a Data Center Moratorium Does—and What It Doesn’t Do

A data center moratorium is a temporary pause on particular government approvals or permit actions. It may give officials time to study electricity demand, water use, air quality, land use, noise, or community effects; gather public comments; and write new rules. The word moratorium alone does not tell you which projects or permits are affected.

The controlling ordinance, executive order, agency directive, or statute determines the answer for a specific project. A pause on new applications is not automatically a cancellation of existing permits, a stop-work order for construction already under way, a block on utility interconnection, or a permanent ban on data centers.

What a data center moratorium is

In land-use and environmental policy, a moratorium is a time-limited legal pause. A government body temporarily withholds, stops accepting, or stops processing a defined category of approvals while it considers policy changes or completes a review.

The paused action might be a zoning decision, a building permit, a certificate of occupancy, an environmental permit, or the acceptance of a new application. A county may halt intake and processing, while a state agency may continue ordinary permits but hold only discretionary environmental approvals. These are different legal effects even though officials use the same word.

Madison, Wisconsin, describes its measure as a planning tool that “presses pause” on potential proposals so the city can set rules for a new land-use category. Montgomery County Executive Marc Elrich similarly said his county’s order creates time to establish clear rules before applications move through permitting. Those explanations describe policy purposes, not a universal legal definition.

Why the label is not enough

Identify the issuing authority and instrument

Start with who acted and what document they adopted. A city-council ordinance, county executive order, governor’s announcement, state-agency directive, and legislative bill do not have the same status. A bill introduced in a legislature is a proposal, not an enacted moratorium. An announcement may describe an intended agency action, but the agency’s written order and existing statutes control the result.

Read the covered project definition

Measures can use a size, capacity, location, ownership, or primary-use threshold. Madison’s 2026 FAQ, for example, covers a new principal-use data center or telecommunications center larger than 10,000 square feet. The city counts only floor area used by the data-center or telecommunications function and excludes a center serving another primary use on the property. That threshold is local; it is not a national rule.

Read the covered government action

“No data centers” can mean no new zoning approvals, no acceptance of permit applications, no processing of pending files, or no issuance of a particular environmental permit. The text may also connect one approval to another. Madison says that blocking zoning approval for a covered new principal use consequently prevents the related building permit and certificate of occupancy. A different jurisdiction may leave building permits untouched while pausing only discretionary environmental permits.

Check application status and exceptions

Moratoria often distinguish between an application that has not been filed, one accepted for review, one deemed complete, and one already approved. They may include statutory exemptions or grandfathering language. New York’s 2026 state announcement excludes discretionary permits that had already been deemed complete. Charlotte’s local FAQ says previously approved projects may continue and notes that state law can exempt some projects.

Find the end date or end condition

A pause may expire on a calendar date, after a fixed period, when permanent amendments are adopted, or when an agency completes a specified review. Some measures allow an earlier end. Others require a new vote to continue. Do not infer a nationwide duration: the examples below range from six months to an expected year and use different triggers.

How current examples differ

Jurisdiction and action What is paused Who or what is covered Duration or endpoint Stated purpose
Madison, Wisconsin; Common Council approval January 13, 2026 Zoning approvals, with related building-permit and occupancy consequences New principal-use data centers and telecommunications centers over 10,000 square feet; facilities serving another primary use are excluded The city describes a 12-month planning period; the precise legal end date must be read in the current ordinance Research best practices, develop standards, and provide public participation
New York State; Governor’s July 2026 announcement Issuance of discretionary Department of Environmental Conservation permits Permits not already deemed complete while a generic environmental impact statement is prepared Review expected to take up to one year; projects may proceed after standards are finalized, subject to state and local approvals Study energy demand, water use and quality, and air quality; develop community-investment guidance
Montgomery County, Maryland; County Executive order announced June 12, 2026 Acceptance, processing, and consideration of new data-center permit applications New applications handled by the county permitting department Six months, with possible earlier termination if permanent zoning amendments are adopted Allow the County Council to finalize a legislative framework
Texas; Governor’s September 21, 2026 direction Texas Commission on Environmental Quality permits sought by data centers Data-center permit requests pending completion of electricity- and water-related information and audits Held until the ERCOT audit; the announcement requested an agency update by October 19, 2026 Obtain grid and water information through audits by ERCOT, the Public Utility Commission, and the Texas Water Development Board
Charlotte, North Carolina; city FAQ Specified development approvals such as zoning or building permits Projects within the scope of the local measure, subject to state-law exemptions The FAQ describes a temporary pause; the current local end date requires confirmation from the operative measure Manage development approvals while the city applies the local rules

Madison: a use-specific zoning pause

Madison’s example shows how a moratorium can operate through land-use law rather than a blanket construction prohibition. The city’s FAQ ties the pause to a new principal use and the 10,000-square-foot threshold. Because zoning approval is the gateway for that use, the city says the related building permit and certificate of occupancy cannot follow for a covered proposal.

The city reported that staff presented possible zoning-framework recommendations to the Plan Commission on September 29, 2026, but no final action was taken at that meeting. A proposed framework should not be described as adopted without a later ordinance or official action.

New York: a state environmental-permit hold

New York’s announcement concerns discretionary environmental permits, not every local approval. During preparation of a generic environmental impact statement, the Department of Environmental Conservation is directed not to issue discretionary permits that were not already deemed complete. Once standards are finalized, a project still needs to satisfy state requirements, zoning codes, and other local approvals. The announcement also calls for guidance on community investment.

Montgomery County: an intake and processing freeze

Montgomery County’s order is broader at the application-processing stage: the permitting department is directed to pause acceptance, processing, and consideration of new data-center permit applications. The stated six-month period can end sooner if permanent zoning amendments are enacted. The county identified energy, cooling water, noise, grid strain, and environmental effects as issues for policymakers to consider; those statements identify questions under review, not measured impacts at every site.

Texas: permits tied to utility audits

Texas illustrates a state permit hold linked to information gathering. The governor directed the environmental agency to halt data-center permits until an ERCOT audit is complete and tied agency approvals to obtaining electricity and water information. The announcement referenced audits by ERCOT, the Public Utility Commission, and the Texas Water Development Board. An October 19, 2026 update was requested; because that date is after the information available here, it should not be treated as proof that the audits or update are complete.

Charlotte: an FAQ that highlights exceptions

Charlotte’s FAQ defines a moratorium as a temporary local pause on specified development approvals. It says projects already approved may continue and that state law can exempt certain projects. The FAQ is a useful starting point, but a project owner still needs the current ordinance, any amendments, and the applicable state statute.

Does a moratorium stop construction already under way?

Not automatically. The answer depends on the measure and the project’s approvals.

  • Construction with final approvals: A moratorium that targets new applications or future approvals may leave an already approved project able to proceed. Charlotte’s FAQ gives that kind of example.
  • Construction awaiting a later approval: Work can be blocked if the project still needs the approval named in the pause, such as a certificate of occupancy or a discretionary environmental permit.
  • Applications in review: The text may allow accepted or complete applications to continue, or it may stop processing them. New York’s announcement draws a line at permits already deemed complete.
  • Work without required approvals: A moratorium does not legalize construction that was never authorized. Ordinary building, safety, environmental, and inspection requirements still apply.
  • Utility connection: A permit pause does not by itself cancel an interconnection agreement or prohibit a utility from serving a project unless the operative measure says so.

Only the project’s permit record and the exact language of the controlling measure can answer whether work may continue.

How to determine whether a specific project is affected

  1. Collect the controlling documents. Obtain the enacted ordinance, executive order, agency directive, emergency rule, and every amendment or extension. Treat press releases and FAQs as explanations, not substitutes for operative text.
  2. Map the project’s location and authority. Identify the city, county, state agency, and special district that issue its approvals. A county pause may not reach a city permit, and a state environmental hold may not pause local zoning.
  3. Match the facility definition. Check size, capacity, primary use, building area, location, ownership, and any telecommunications or co-location language. Record whether the project crosses a stated threshold.
  4. List every approval and its stage. Separate zoning, site-plan, building, environmental, water, air, electrical, occupancy, and utility approvals. Mark each as not filed, filed, accepted, complete, approved, appealed, or under construction.
  5. Apply grandfathering and exemptions. Look for language covering complete applications, vested rights, previously approved projects, public facilities, state-law exemptions, or projects serving another primary use.
  6. Calculate the operative dates. Note the effective date, expiration date, renewal vote, early-termination trigger, and any deadline for agency studies or reports.
  7. Check later actions. Search the issuing body’s meeting records and agency notices for amendments, replacements, court orders, or a new permanent zoning rule. A later measure may narrow or extend the pause.
  8. Get a project-specific determination. For a consequential filing or construction decision, ask the permitting authority or qualified land-use counsel to apply the text to the project record in writing.

What officials are studying during a pause

Government materials commonly identify electricity demand, grid reliability, cooling-water consumption, water quality, air emissions, land use, noise, and community effects. A moratorium creates time to gather data, compare practices, solicit public input, and decide whether permanent standards are needed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That process does not prove that every data center causes a particular level of harm. It also does not prove that a proposed standard is legally adopted or technically sufficient. Keep an agency’s stated concern separate from evidence about an individual facility.

Moratoria, proposed laws, and enacted rules are different

The North Dakota Legislative Council reported that lawmakers in 15 states introduced legislation to establish data-center moratoriums during the 2025–26 legislative session. That figure counts introduced bills, not enacted moratoria. A bill’s findings, fiscal estimates, or policy claims are not automatically established facts, and a bill can be amended, rejected, or left pending.

The same caution applies to New York legislative proposals that appear alongside the governor’s 2026 executive action. Do not call a bill law or merge its provisions with the governor’s permit plan unless its enactment and effective date are confirmed.

Common mistakes when describing a moratorium

  • Calling it a ban: Use “ban” only when the operative text permanently prohibits the activity or imposes an equivalent prohibition.
  • Assuming all permits are frozen: Name the exact approval type and agency.
  • Ignoring project status: Distinguish complete, approved, and merely proposed applications.
  • Assuming construction stops: Check whether work already authorized is addressed.
  • Promising a universal duration: Quote the local endpoint and any early-termination condition.
  • Treating proposals as law: Verify enactment, effective date, and later amendments.
  • Presenting concerns as findings: Attribute policy rationales and describe unresolved impacts as matters under study.

Bottom line for readers and project teams

A data center moratorium is best understood as a jurisdiction-specific pause on identified government actions. Its practical effect turns on five facts: the authority and legal instrument, the facility definition, the approval being paused, the project’s application status and exemptions, and the duration or end condition. Until those facts are matched to the project record, statements such as “the project is banned,” “construction must stop,” or “all permits are canceled” go beyond what the word moratorium establishes.
