A dated screenshot can show a UDRP panel what appeared at a disputed domain, but a screenshot is only one part of a sound record. Capture the page promptly, record its URL and capture context, preserve the original file, and connect each exhibit to the specific fact it supports. When the page’s resources or technical context matter, preserve a web archive such as WARC as well; neither an image nor an archive guarantees completeness or a particular legal outcome.
What web evidence can show in a UDRP complaint
WIPO’s current Domain Name Disputes evidence guidance advises parties to provide evidence of bad-faith registration and use where applicable, including screenshots of the offending website, fraudulent emails, and prior correspondence with the registrant. The UDRP also requires evidence relevant to the other elements: trademark rights and confusing similarity, and the respondent’s lack of rights or legitimate interests. Organize captures around the factual proposition each one supports rather than treating an image as self-explanatory.

WIPO’s Overview 3.1, updated in 2026, is the current edition of its consensus guidance. The older 2017 Overview 3.0 expressly described dated screenshots of the resolving website as an example of available evidence for allegations under UDRP paragraph 4(b); that edition is now superseded. See the Overview 3.1 announcement and the 2017 Overview 3.0 for the relevant context.
How to capture a useful, dated website screenshot
- Capture promptly. Pages can change, disappear, redirect, or become inaccessible. Record the complete URL, including any relevant path or query string, rather than just the domain.
- Record capture circumstances. Keep a log with date and time, time zone, capture operator, browser or tool, and any context needed to understand what was displayed. These are prudent recordkeeping practices, not a WIPO-mandated protocol.
- Include identifying context. Make the URL and relevant page content legible where possible. Capture additional states or pages when a redirect, pop-up, consent prompt, or interaction affects what a single image can show.
- Keep the original intact. Preserve the original image file. If you crop, annotate, redact, or convert a copy for an exhibit, keep and identify the unaltered original separately.
- Save related evidence. Preserve relevant emails, correspondence, and other records alongside the image. WIPO names fraudulent emails and prior correspondence as potentially relevant evidence too.
- Explain the exhibit. Identify the page, capture time and method in the exhibit description, and state what proposition it supports. Do not claim the image establishes when the page was first published unless separate evidence supports that point.
There is no universal WIPO-prescribed screenshot tool or authentication method in the cited guidance. Check the current supplemental rules and case directions of the provider administering the complaint for file formats, size limits, and filing requirements.

Screenshot, WARC, or Wayback Machine: which record to keep?
| Record | What it can contribute | Limits and checks |
|---|---|---|
| Dated screenshot | A legible visual record of what appeared in a browser; WIPO’s guidance recognizes dated screenshots as an evidence example. | A static image does not retain hypertext functionality. Record the URL and capture context separately. |
| WARC web archive | A preservation container format for harvested web payloads, protocol control information, and linked metadata. The Library of Congress describes WARC records as documenting capture date, type, length, and related harvested resources. | The format does not establish that a particular capture is complete, authentic, or legally conclusive. Retain provenance and inspect what was captured. |
| Public historical archive, such as the Wayback Machine | May provide a view of an earlier public version of a page. WIPO identifies consultation of historical resources such as the Internet Archive as an example of limited panel research. | A page may be absent, partial, or difficult to interpret. Identify the archive source and timestamp, and corroborate where possible. |
ISO 28500:2017 defines the WARC format for web archival records; ISO says the edition was confirmed in 2023 and remains current. That is a format standard, not a certification of any particular capture’s completeness. See ISO 28500:2017, the Library of Congress WARC description, and the National Archives format guidance.
Use both formats when they answer different needs: the screenshot helps a reader quickly understand the visible page; a WARC capture may preserve more harvested resources and technical context. Keep the WARC file and associated capture information, and verify its contents rather than assuming the format alone proves what happened.

Can a Wayback Machine capture be used in a UDRP case?
A public historical capture can be useful corroborating material, but its availability and completeness vary. WIPO’s UDRP FAQ and UDRP Guide describe the panel’s limited ability to research public records where useful to deciding a case; historical resources such as the Internet Archive may indicate past domain use. One example is WIPO case D2020-1738.

That possibility does not make an archive capture conclusive, guarantee that a particular URL was archived at a particular earlier date, or remove the party’s responsibility to submit organized evidence and explain its significance. Preserve and identify your own captures, and distinguish an archive’s displayed timestamp from proof of the original publication date.

Keep an exhibit log and check provider rules
A compact log makes evidence easier to identify and review. Use one row per file, and keep the original filename or a stable exhibit identifier.
| Log field | What to record |
|---|---|
| Exhibit ID and filename | A unique identifier and the preserved original filename. |
| URL | The full captured URL, including relevant path and parameters. |
| Capture date and time | Timestamp and time zone. |
| Method and operator | Browser or capture tool, and the person who made the capture. |
| What it shows | A short factual description and the proposition for which it is offered. |
| Related files | Any corresponding original, WARC record, email, or other context. |
Before filing, consult the actual provider’s current supplemental rules and case directions. File-size limits, acceptable formats, and procedures for additional evidence depend on the provider and case; a general guide cannot settle those venue-specific requirements.

Where ScreenshotNeo fits—and what it does not prove
ScreenshotNeo is a website screenshot API and MCP server for developers. It can produce a PNG, JPEG, WebP, or PDF from a URL, and can help create a consistent visual capture. A generated screenshot is still a visual exhibit, not a guarantee of admissibility, completeness, or the date a page was first published. Record the capture circumstances and preserve the original output as part of your evidence process.
Or skip the browser setup
For a quick capture, make one GET request. See the ScreenshotNeo API documentation for the request options and response details.
curl -G "https://api.screenshotneo.com/v1/shot" -d access_key=YOUR_API_KEY --data-urlencode url=https://stripe.com -o shot.webp
ScreenshotNeo accepts cookie or consent banners like a visitor and removes 60+ known consent platforms, newsletter popups, and chat widgets before capture; each of those steps can be turned off. Bot checks or CAPTCHAs, blank pages, timeouts, failed loads, and cache hits cost nothing, with response headers indicating the page verdict and billing status. Its MCP server offers screenshot and PDF tools for AI agents. The free plan includes 1,000 shots per month with no card; paid plans start at $5 for 3,000 shots.

Frequently Asked Questions
Does a screenshot prove when a web page was first published?
No. A capture records what was displayed at the time of capture; it does not by itself establish the page’s original publication date.

The cited WIPO materials identify dated screenshots as an evidence example but do not prescribe one universal capture tool or authentication method. Follow the administering provider’s current rules and case directions.
