Virginia Code § 18.2-325 defines illegal gambling to include making, placing, or receiving a bet or wager of money, other consideration, or a thing of value in exchange for a chance to win a prize or other value that depends on an uncertain event. - Whether users pay money, buy or stake paid currency, or contribute something else of value to enter or participate.
- What users can win, including whether rewards have monetary or other value.

Virginia-permitted sports betting is a separate category
Virginia regulates sports betting through a permit program administered under the Virginia Lottery framework, with oversight by the Virginia Lottery Board. The statutory program defines sports betting and provides for permits; it is not blanket permission for unlicensed apps. See Virginia Lottery Law and the sports-betting article.
For regulated betting, the Director approves the sports events, leagues, and wager categories that may be offered under 11VAC5-70-170. The Lottery says its directive can change and marked its sports-betting guidance updated August 17, 2026. Check the Virginia Lottery’s current sports-betting guidance and the administrative regulation rather than relying on an old list or article.

Fantasy or “social” labels do not decide the legal category
Virginia’s sports-betting statute excludes certain separately authorized categories, including fantasy contests, charitable gaming, lottery games, and horse-race wagering. Those category-specific exclusions do not automatically make a product lawful just because it uses words such as “fantasy” or “social.” The activity still has to be assessed under the laws and rules that apply to its actual structure. The statute also restricts certain sports wagers, including bets on youth sports, proposition bets on college sports, and bets on Virginia college sports. The Lottery’s current authorized-events and wager guidance provides additional limits for permit holders. An app’s status and the permissibility of a particular event or wager are distinct questions.

2026 credit-card rule for regulated sports-betting accounts
Virginia HB 515, approved April 13, 2026, prohibits the Director from approving credit cards as a funding method for sports-betting accounts and requires permit holders to take reasonable measures to prevent credit-card acceptance on their platforms. This is a funding rule for regulated sports-betting accounts; it does not determine whether a social-style app is legal. Read HB 515, Chapter 926.

- Identify the activity. Read the app’s rules to see whether you are making picks for entertainment, entering a contest, or placing a wager.
- Trace the value. Check what you must pay or contribute, what you may win, and whether currency or rewards can be redeemed or transferred.
- Check authorization. If the app offers regulated sports betting, verify that the operator and activity fit Virginia’s permit framework and current Lottery guidance.
- Check the event and wager. Confirm that the event and wager type are permitted and that no statutory restriction applies.
- Get advice for an app-specific answer. The statutes and official guidance do not provide a blanket ruling for every product marketed as a social sportsbook. A lawyer can assess the app’s current terms and mechanics.
