Utah has authorized Nolla Health to run a one-year pilot in which its AI system can issue first-time prescriptions and refills for certain topical acne treatments to eligible adults. The permission is limited to Utah, mild-to-moderate acne, and the terms of a regulatory agreement; it is not a general license for AI prescribing or a state endorsement of the service.
What Utah authorized
The Utah Office of Artificial Intelligence Policy and Division of Professional Licensing have a time-limited regulatory mitigation agreement with Nolla Health, operated by Magic Health, Inc. and Magic Health Services, LLC. The public pilot record lists a term from October 5, 2026, through October 5, 2027. It permits the system to issue initial prescriptions and refills for a defined set of topical acne creams and gels to Utah adults with mild-to-moderate acne. The pilot excludes oral acne medication, isotretinoin, and severe acne. Utah’s sandbox overview says participation is not state endorsement or product approval. The agreement adjusts only specified legal provisions for the described activity; other applicable requirements remain in force.

Nolla says the pilot is for Utah residents aged 18 and older. Its launch description says people complete identity verification, informed consent, an intake questionnaire, and a five-angle face scan; the company estimates the process takes 10–15 minutes and may lead to an initial prescription if appropriate. Utah’s public summary lists conditions that stop the process: severe acne, pregnancy or plans to become pregnant, breastfeeding, a weakened immune system, or a previous reaction to a medication on the pilot list. Nolla says people outside the pilot’s clinical parameters are directed to a physician or in-person care. The available public summary does not establish that every person who completes intake will receive a prescription.
How physician review changes during the pilot
Human review is built into the rollout, but its timing changes only through stages approved in writing by the state. Utah’s summary describes an initial stage with two Utah-licensed physicians reviewing every prescription before it is sent, followed by retrospective review and then sampling. The state pilot record

- Stage one: The first 100 patients; two physicians independently review each prescription before delivery.
- Stage two: Up to 500 patients; a physician reviews cases after the fact at least weekly.
- Stage three: Monthly review of at least 10% of cases, plus every escalation or side-effect case.

Pharmacy, reporting, privacy, and liability safeguards
Under Utah’s summary of the agreement, pharmacists are told that a prescription originated from AI and are given a physician contact for questions. Adverse events must be reported to the Office of Artificial Intelligence Policy within 24 hours, and the company must submit monthly reporting that includes agreement rates between the AI and reviewing physicians.
The agreement summary also says Nolla must carry professional liability insurance, may not sell or transfer patient data, and may not use its terms of service to limit its liability for harm. These are obligations under the summarized pilot agreement, not a claim that risk has been eliminated.

What the performance figures do—and do not—show
Nolla’s launch post reports 96% clinician agreement with its recommendations in real-world cases and characterizes differences as minor treatment adjustments. That is a company-published figure; the accessible sources do not establish its methodology or independently verify it. Agreement is not the same as an independently measured accuracy rate, evidence of better acne outcomes, or proof that the treatment is safe and effective for every eligible patient.

The available coverage, including STAT’s October 5, 2026 report, describes the pilot’s limited acne scope and phased clinician oversight. The sources available here do not provide a named third-party clinical trial or independent audit validating Nolla’s prescribing performance.

Why this is a limited Utah experiment, not a national change
Nolla’s CEO, Luis Wenus, described the launch as “the first AI-powered prescriptions in the country” in the company’s October 5 post. Utah’s own announcement places Nolla among its regulatory sandbox pilots, but the agreement applies to a particular company, service, patient group, treatment scope, place, and period. It does not authorize other services to prescribe, establish a nationwide rule, or remove the role of state regulators and clinicians. Utah Department of Commerce announcement
