Utah Amendment B would require 60% support for certain citizen initiatives involving specified tax changes—not every ballot measure. An opposition campaign says that standard could have stopped Utah’s 2018 Medicaid expansion and medical-marijuana initiatives, which received 53.3% and 52.7% of the vote. Both measures passed under the rules in effect in 2018; applying Amendment B to them is a conditional, retrospective argument, not a change to their actual results.
What would Amendment B do?
Amendment B is a proposed Utah constitutional amendment scheduled for the November 3, 2026 ballot. Under the proposal as described in current coverage, a citizen initiative would need at least 60% voter support if it would impose a new tax, expand or increase an existing tax, or change a property-tax rate so that it decreases less than it otherwise would under current law. What happened to the 2018 initiatives?
The 2018 measures passed under the rules that applied at the time. Their reported vote shares were below the proposed 60% mark:

The percentages are reported in 2026 coverage and can be checked against the Utah Lieutenant Governor’s Office 2018 General Election Statewide Canvass. The arithmetic shows how those results compare with 60%; it does not establish how Amendment B would legally apply to each past measure. The claim that Medicaid expansion and medical marijuana would have failed under the proposed standard is the opposition campaign’s interpretation, conditional on the measures being covered by its tax provisions. Supporters: a broader consensus for tax increases
Amendment B sponsor Sen. Lincoln Fillmore and supporter Billy Hesterman of the Utah Taxpayers Association argue that an initiative increasing taxes should receive broader public backing. Fillmore framed the question as whether a bare majority should be able to raise taxes, or whether such a measure should require broader consensus. Opponents: a higher barrier to citizen initiatives
Elizabeth Rasmussen, executive director of Better Boundaries, and Utahns Protecting Our Constitution argue that raising the passage bar weakens the initiative process, which citizens can use to check government. Rasmussen has also questioned how broadly the tax language might be applied; that is the opponents’ concern, not an established account of how legislators would interpret or use the amendment. What does the reported polling show?
Utah News Dispatch reported a Noble Predictive Insights poll in which 50% of respondents supported Amendment B, 21% opposed it, and 23% were unsure. The poll surveyed 602 registered Utah voters from September 8–12, 2026, and reported a margin of error of ±3.99 percentage points. These are figures reported by the news outlet; an original pollster release is not cited here. The results are a dated snapshot, not a forecast or election outcome.
