A federal judge has temporarily stopped the U.S. Department of Agriculture from closing or consolidating covered Agricultural Research Service facilities, including the Beltsville Agricultural Research Center (BARC), and from relocating or reassigning affected employees. The order, issued October 13, 2026, has no reported expiration date. It remains in force while the lawsuit proceeds, but it is not a final ruling that the closures are unlawful or permanently canceled.
What the October 13 court order does
U.S. District Judge Vince Chhabria issued a stay blocking USDA from carrying out the covered facility closures, consolidations, employee relocations and reassignments described in the dispute. The order includes BARC in Beltsville, Maryland. Federal News Network reported that the stay is an interim measure while the court reviews the case.

There is no fixed end date in the reported order. USDA can ask an appeals court for relief, and the district court can later modify or dissolve the stay. In practical terms, scientists have an open-ended reprieve for now, not a permanent guarantee that their laboratories or jobs will remain unchanged.
Why USDA planned the changes
Proposed ARS closures and consolidations
USDA’s fiscal-year 2026 Agricultural Research Service explanatory notes list proposed closures and consolidations at several research locations. Examples include:

The agency’s detailed proposal is in the USDA FY2026 ARS explanatory notes. The listed destinations and program moves are proposals; the stay prevents covered implementation while the litigation is pending.
Beltsville and the Washington-area reorganization
In a July 2025 announcement, USDA said it would vacate BARC and other Washington-area facilities as part of a department-wide reorganization. The department said the process was intended to refocus USDA on farmers, ranchers and producers while preserving critical health and public-safety services. The announcement described the process as “transparent and common-sense” and said it would preserve “critical health and public safety services.” USDA’s announcement contains the agency’s rationale and quoted Secretary Brooke Rollins.

USDA later said on April 23, 2026, that it was restructuring its Research, Education, and Economics mission area while retaining the Office of the Chief Scientist’s scientific-leadership role. The agency’s description is available in its REE restructuring announcement.

Why the judge intervened
The lawsuit’s legal theory
The American Federation of Government Employees and allied plaintiffs challenged the reorganization under the Administrative Procedure Act and related restrictions in the fiscal-year 2026 appropriations law. They argued that USDA needed congressional approval to carry out the reorganization as planned.

According to Federal News Network’s account of the ruling, Judge Chhabria found that the plaintiffs were likely to succeed on that appropriations argument and concluded USDA had “almost certainly” reprogrammed congressionally appropriated funds for purposes outside Congress’s intent. That is a preliminary finding made for purposes of emergency relief, not the final judgment in the case.
Why the timing mattered
A case summary says USDA had already sent relocation letters with report deadlines as early as September 21, 2026. Plaintiffs sought emergency relief before those deadlines could trigger moves, separations or other irreversible personnel consequences. The FindLaw case summary describes that procedural background.

Are USDA labs still closing?
Not while the stay covers a facility or employee action. USDA is barred from carrying out the covered closures, consolidations, relocations and reassignments during the pause. The underlying reorganization has not been withdrawn, however, and the court has not yet issued a final decision on whether USDA’s actions violated the law. A later ruling, appeal or revised order could change what happens next.

Covered relocation and reassignment actions are paused under the order. That means employees affected by the challenged plan should not be forced to report to a new location under those actions while the stay remains in effect. The stay does not itself guarantee that every employee will stay permanently, nor does it resolve employment terms outside the challenged measures.

Why the pause matters for research
Specialized facilities and collections
BARC and other affected ARS sites support long-running work in agricultural production, animal health, food safety and pollinator science. KOSU reported that BARC scientists study bee health, diseases, parasites, pesticides and environmental pressures. Its coverage also describes challenges from unions, nonprofits and local governments over the proposed closure. KOSU’s report provides that local context.
Continuity risks if moves resume
Relocating a program can separate researchers from specialized equipment, biological collections, field sites and nearby collaborators. Employees who decline a forced move may leave federal service, and interrupted projects can lose years of continuity. These are practical risks of the proposed transfers and reported relocation orders; no published estimate quantifies the potential scientific losses.
What happens next
- USDA may seek appellate relief. An appeal could ask a higher court to narrow or end the stay.
- The district court will continue reviewing the merits. The preliminary appropriations and Administrative Procedure Act issues still require a final decision.
- The stay could change. Judge Chhabria may modify or dissolve it as the case develops.
- Congressional funding language remains central. Future decisions will turn partly on what fiscal-year 2026 appropriations restrictions authorized USDA to do.
- Program-by-program outcomes may differ. A final order could cover different facilities, employee actions or research programs than the initial stay.
For scientists and communities, the key facts to monitor are whether the stay is extended or overturned, which facilities remain covered, whether staff and funding stay attached to each program, and whether replacement sites have the physical infrastructure needed to continue the work.
